UNI Area XV amendment

Motion 1 – BREAKING THROUGH STRATEGIC PLAN, 2018-2022

Paragraph 1

c) Bigger is better! Building on the experience of COZZ (Central European Organising Centre), and in order to maximise the impact of UNI’s resources, UNI will establish organising centres in areas of high strategic importance and low density, such as Colombia and Southern Africa. These centres are aimed at building organising capacity and leading and winning multiple campaigns, creating a greater opportunity for change and efficiencies of scale.

c) Bigger is better!

Justification: There are many countries and regions in the world with high strategic importance and low density. It is better to avoid mentioning specific countries in the motion.

Paragraph 2

a) UNI and its affiliates will set priorities that identify the multinational companies in which, by means of united organising efforts, decisive trade union power will be established.

Comment: The text needs to be clarified. What kind of priorities are foreseen?

c) UNI Sectors will create and maintain the company (or broader) Alliances in order to enable affiliates to strategize about common issues, share best practices in organising and bargaining and demonstrate strategic solidarity. These company Union Alliances will lead the effort to achieve and then implement the global agreements with UNI, and will support organising efforts within the company.

c) UNI Sectors will create and maintain the company (or broader) Alliances in order to enable affiliates to strategize about common issues, share best practices in organising and bargaining and demonstrate strategic solidarity. These company Union Alliances will lead the effort to achieve and then implement the global agreements with UNI, and will support organising efforts within the company.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

Justification: TBD

Paragraph 3

c) Follow the jobs! UNI will encourage unions to organise and bargain collectively for the “atypical” workers, especially in those multinational companies identified in accordance with 2a).

Comment: 2a needs to be clarified – what kind of priorities are foreseen to identify these multinationals?

Paragraph 4

a) The freedom of association is in crisis. UNI will continue to play a visible and leading role to strengthen global tools - such as the OECD Guidelines for Multinationals, the ILO Tri-partite Declaration on Multinationals and all other ILO mechanisms and the UN Guiding Principles for Business and Human Rights - and to use these instruments when companies refuse to respect this critical right for workers.

a) The freedom of association is in crisis. UNI will continue to play a visible and leading role to strengthen global tools - such as the Global Deal, the OECD Guidelines for Multinationals, the ILO Tri-partite Declaration on Multinationals and all other ILO mechanisms and the UN Guiding Principles for Business and Human Rights - and to use these instruments when companies refuse to respect this critical right for workers.

Justification: The Global Deal, a UN-backed global multi-stakeholder partnership to jointly address the challenges in the global labour market and enabling all people to benefit from globalisation, is important to mention in this context.

c) UNI will actively engage with investors to ensure that they too are held to account for global norms and to promote investment policies which recognise workers’ right to organise and bargain collectively.

c) UNI will actively engage with investors to ensure that they too are held to account for global norms and to promote investment policies which recognise workers’ right to organise, strike and bargain collectively.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

Justification: Self-explanatory

d) UNI will fight for workers’ rights, justice and safety in multinationals’ value and supply chains through private agreements, like the Bangladesh Accord, as well as national and international instruments, such as ILO Conventions or Protocols or a UN Treaty. The ultimate goal is to establish effective and legally binding instruments to hold companies accountable.

Comment: What is meant by “effective and legally binding instruments”?

Paragraph 5

a) UNI calls on all governments to establish strong national action plans that transpose the UN Guiding Principles on Business and Human Rights into practice. UNI invites all countries to adopt laws imposing due diligence on multinationals.

a) UNI calls on all governments to establish strong national action plans that transpose the UN Guiding Principles on Business and Human Rights into practice. The Global Deal is an important tool in this context. UNI invites all countries to adopt laws imposing due diligence on multinationals.

Justification: See paragraph 4a.

Motion 3 – UNIONS FOR A SUSTAINABLE GLOBAL ECONOMY

Paragraph 1

a) The world needs a pay rise! UNI will join and support the global and regional campaigns for increases in pay and purchasing power and a global living wage for all people. Wages must compensate for inflation and rise in line with productivity gains. The gender pay gap must be eradicated.

a) The world needs a pay rise! UNI will join and support the global and regional campaigns for increases in pay and purchasing power and a global living wage for all people. Wages must compensate for inflation and rise in line with productivity gains. The gender pay gap must be eradicated.

Justification: The gender pay gap should be addressed in more detail in an own point – see below.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

b) The gender pay gap must be eradicated. Women’s wages are still trailing those of men’s, and in some cases the gap is widening. The principle of equal pay for equal work is still far from a reality, in all sectors. UNI Global Union should continue efforts to increase women’s labour market participation and bargaining power, and seek cooperation with global stakeholders to eliminate the gender pay gap. Justification: Self-explanatory

b) The expansion of collective bargaining is critical for a sustainable economic future, pairing economic success with distributive justice. Negotiations must include women and youth. Alongside its work to expand bargaining through organizing, UNI will step up its activity to resist attacks on bargaining and sectoral bargaining in particular.

The expansion of collective bargaining is critical for a sustainable economic future, pairing economic success with distributive justice. Negotiations must include women and youth all age groups and genders on an equal basis. Alongside its work to expand bargaining through organizing, UNI will step up its activity to resist attacks on bargaining and sectoral bargaining in particular. Justification: Rather than pointing out women and young, the paragraph should use an all-encompassing formulation based on the principle of equality.

c) UNI and its affiliates demand an increase in public spending to support the growth of employment and our economies, along with the promotion of more equal societies. Investment in social spending, education and the care economy is particularly important because it creates jobs and facilitates the participation of women in the labour market. Public spending should be linked to responsible procurement policies which favour good employers.

Investment in social spending universal social protection, education and the care economy is particularly important because it creates jobs and facilitates the participation of women in the labour market. Public spending should be linked to responsible procurement policies which favour good employers. Justification: The term “universal social protection” is more accurate and better describes the desired outcome.

Paragraph 3

a) An end to the current era of unprecedented inequality in income, wealth and opportunity, which threatens both democracy and a sustainable economic future. We will magnify the message that “Without the participation and contribution of the unions there can be no solution.”

a) An end to the current era of unprecedented inequality in income, wealth and opportunity, which threatens both democracy and a sustainable economic future. We will magnify the message that “Without the participation and contribution of the unions there can be no solution.” “Unions are a necessary part of the solution as crucial contributors to democracy and sustainable economic development for all”. Justification: Area XV prefers a positive wording.

d) A well-run and regulated and sustainable banking system which can support the real economy, social welfare and job creation and an investment model which rejects short-termism.

d) A well-run and regulated and sustainable banking system which can support the real economy, social welfare and job creation and an investment model which rejects short-termism favours long-termism. Justification: Area XV prefers a positive wording.

e) Empowering women all over the world, in particular by improving economic and political opportunities as well as defending the rights of women and girls.

e) Gender equality and empowering women all over the world, in particular by improving economic and political opportunities as well as defending the rights of women and girls. Justification: Self-explanatory

Paragraph 4

c) Urge governments, and companies and unions to adopt sustainability measures, to deliver on the Paris Agreement’s commitments. Trade unions must also commit themselves to this goal.

c) Urge governments, and companies and unions to adopt sustainability measures, to deliver on the Paris Agreement’s commitments. Trade unions must also commit themselves to this goal. Tripartite cooperation can play a vital role in this regard.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

Justification: Unions are already mentioned in the first sentence. Tripartite cooperation is an important tool for pursuing the Paris agreement goals as it builds mutual commitment from both state, employers and unions.

Paragraph 5

e) Exclude corporations and investors from privileged legal treatment. Any legally tenable solution to settle trade disputes must satisfy the criteria of transparency, fairness and equal treatment and at least be in accordance with the provisions of the WTO agreements (in particular GATS and TRIMs).

e) Exclude corporations and investors from privileged legal treatment. Any legally tenable solution to settle trade disputes must satisfy the criteria of transparency, fairness and equal treatment and at least be in accordance with the provisions of the WTO agreements (in particular GATS and TRIMs). Comment: Why does specific agreements need to be mentioned in a parenthesis? The principles should be universally applicable.

f) Consider the duties of investors towards employees, consumers, the environment and society as a whole.

Comment: What is meant by this paragraph? A clarification is needed.

g) Be negotiated in full transparency for trade unions, consumers and all other interest groups. Transparency of the committees entrusted with the application of investment treaties, particularly those with responsibility for regulatory cooperation, the liberalisation of services and investments is essential.

g) Be negotiated in full transparency for trade unions, consumers and all other interest groups. Transparency must be established in relation the work of the committees entrusted with the application of investment treaties, particularly those with responsibility for regulatory cooperation and the liberalisation of services. Justification: The second sentence of the paragraph is rewritten for clarity.

Motion 4 – Unions and the Future World of Work

General comments to Motion 4:

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

The motion contains several messages that are of a general character and more belong in motions 1 and 3. In addition, some paragraphs are descriptive and should be moved to the background paper. The motion also needs to be streamlined in its disposition, layout and content to fit with the previous ones – it should be structured in the same manner. Lastly, it is important to also emphasise that technological change and digitalisation/digitization has the possibility to make a great contribution to workers and societies provided that it is harnessed through political means and thus balanced with social and human needs. General change: strike out “Key demand” at the top of all sections. Justification: The motion should be structured in a similar way as motions 1 and 3.

Paragraph 1

1.1 All workers should have decent work under fair conditions with a voice on the job. The future world of work must be characterised by Transparency, Opportunity and Responsibility. This calls for reinvesting the profits of digitalization in new jobs and giving workers a share of the gains made from rationalization, for example, in the form of shorter working hours.

1.1 All workers should have decent work under fair conditions with a voice on the job. The future world of work must be characterised by Transparency, Opportunity and Responsibility. This calls for a) Reinvest the profits of digitalization in new jobs and give workers a share of the gains made from rationalization, for example, in the form of shorter working hours maintaining wages and working conditions. Justification: Move descriptions to the background paper and explain what is meant by the three keywords. Shorter working hours is a matter for national unions to decide on but should nevertheless not lead to a worsening of wages and working conditions. Many groups of members within UNI also actually ask for more working hours because of their disadvantaged position in relation to the employer, so the wording is highly problematic.

The future world of work is expected to be dynamic, fluid and ever-changing. The underlying digital technologies make markets and labour markets, products and services, people and places simultaneously more inter-connected, yet also potentially separated. The boundaries between work and private life will be blurred. In this respect, it is essential to realise articles 23 and 24 of the Universal Declaration of Human Rights regarding the right to work and the right to rest. Structural changes to the labour

Public actors must anticipate the possibility of persistent structural unemployment and rising inequality finding a new way of thinking about the relationship between work and the distribution of wealth. A collective reduction in working time could be one of the pillars of this new approach. Justification: This paragraph should be moved to the background section.

New point: b) UNI should work for the realisation of articles 23 and 24 of the Universal Declaration of Human Rights regarding the right to work and the right to rest Justification: One of two actions points from the second paragraph in 1.1

New point: c) Technological and digital development should be geared towards support of rather than replacement of human labour and contribute to sustainable economies and societies Justification: See above; the scope is also broadened.

UNI demands in this new world of work, Transparency, Opportunity and Responsibility: - Transparency: in AI-facilitated decisions, in data trails, in data ownership and use, in corporate structures and supply chains. - Opportunity: Citizens and workers across the world, regardless of where they live, age, gender, skill level, ethnicity, or socio-economic status must be free from discrimination and have the opportunity

All people must be free from

to thrive, to feel empowered and valued. All workers, in all forms of work must have the rights to organise and to collective bargaining. They must also benefit from occupational health and safety and have access to social protection and lifelong learning. - Responsibility: Technological innovations, politicians and corporations, must put the interests of people and planet above the interests of the few.

discrimination and have the opportunity to thrive, to feel empowered and valued. All workers, in all forms of work must have the rights to organise and to collective bargaining. They must also benefit from occupational health and safety and have access to social protection and lifelong learning. - Responsibility: Technological innovations, politicians and corporations, must put the interests of people and planet above the interests of the few. Justification: Move erased section above to motion 1 on organising, and motion 3 respectively. The motion should focus on the new world of work and the specificities that it entails, hence the clarification under Opportunity.

1.3 It is essential that change must benefit employment by promoting job-creating innovation and diverting productivity gains to areas of social need, which in turn will foster the development of necessary social services.

1.3 e) It is essential that change must benefit employment by promoting job-creating innovation and diverting productivity gains to areas of social need, which in turn will foster the development of necessary social services. Justification: changed in accordance with how the other motions are structured.

Paragraph 2

2.1 Citizens and workers across the world, from the Global North and South, from rural to urban areas, from the old to the young, from women to men, from skill level to skill level, ethnicity and socio-economic status must be free from discrimination, and have the opportunity to thrive, to feel empowered and valued.

Justification: Move to background text

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

UNI calls on a future world of work that provides equal opportunities to all citizens and workers: economically, technically, socially and environmentally. Much needs doing to bridge the digital divide between the Global North and the Global South. Trade policies that aim to widen the digital divide must be stopped. Citizens and workers should have the right to their data, and the right to influence how it is mined, stored and used – where and by whom.

a) UNI calls on will fight for a future world of work that provides equal opportunities to all citizens and workers: economically, technically, socially and environmentally, including: efforts to bridge the digital divide between the Global North and the Global South; stopping trade policies that widen the digital divide; and giving citizens and workers the right to their data, and the right to influence how it is mined, stored and used – where and by whom. Justification: The changes above are an effort to make the point more concrete and action-oriented and bring it in line with the logic of the other motions to the World Congress.

Paragraph 3

3.1 All workers in all forms of work must have the same strong and enforceable social and fundamental rights, including freedom of association. This includes, in particular, the right to join a union and the right of unions to have access to workers, to negotiate collective agreements and the right to strike to attain said agreements. Co-determination rights as well as the right to be heard and informed must also apply in the new networked world of work. The definition of the workplace must be broadened to reflect this.

This includes, in particular, the right to join a union and the right of unions to have access to workers, to negotiate collective agreements and the right to strike to attain said agreements. Co-determination rights as well as the right to be heard and informed must also apply in the new networked world of work. The definition of the workplace must be broadened to reflect this. a) UNI will work to ensure that fundamental trade union, labour and social rights apply for all workers in the new world of work, including new workplace definitions that might be needed. Justification: The paragraph describes fundamental trade union political principles. They belong under motion 1 on organising. A suggestion is made to shorten and make it into an action point.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

3.2 In this new platform capitalism, we must reject fee-charging platforms and challenge all existing laws that are used to block workers from exercising their fundamental rights. Competition law must be changed so the single-unit self-employed have a right to collective bargaining. Forcing workers into self-employment and removing their collective rights is unacceptable. This must be addressed by appropriate legislation.

b) In the new platform capitalism, UNI must work to reject fee-charging platforms and challenge all existing laws that are used to block workers from exercising their fundamental rights. This includes changing competition law must be changed so the single-unit self-employed have a right to collective bargaining. Forcing workers into self-employment and removing their collective rights is unacceptable. This must be addressed by appropriate legislation. Justification: The point is rewritten and shortened for clarity. The removed sentence can be integrated into the background text.

Paragraph 4

4.1 Social security systems must be established/modernised so all workers, in all forms of employment, earn the right to social security.

a) Social security systems must be established/modernised and adapted to function in the future world of work ensuring all workers, in all forms of employment, the right to social security. Justification: The point is rewritten for clarity.

4.2 This requires that: a) All companies contribute financially through taxes and social contributions to the societies in which they are embedded, and on which they belong. b) That the right to social security is measured by the aggregated hours worked, regardless of the form of work, duration and extent. This notion of a portable benefit system is currently gaining traction in several countries.

b) This requires that Therefore, UNI will work to make: - All companies contribute financially through taxes and social contributions to the societies in which they are embedded, and on which they belong. - The right to social security be based on the aggregated hours worked, regardless of the form of work, duration and extent. This notion of a portable benefit system is currently gaining traction in several countries. Justification: The point is rewritten for clarity.

Paragraph 5

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

5.1 All workers, in all forms of employment, must have the rights and access to training on a regular basis.

5.1 a) As the future world of work demands that all workers, in all forms of employment, must have the rights and access to training on a regular basis, UNI should work to: Justification: The point is rewritten for clarity.

5.2 As a means to support labour market mobility, and as a consequence of rapidly developing technologies, all workers, also those in self-employment, must have access to continuous up-skilling and reskilling. This calls for a general right to further training with an appropriate level of remuneration. This requires that: a) All companies must contribute to an education fund, governed by the social partners and the state, from which workers can seek funds to conduct training. This fund should also cover income losses during training, and address the need for elder care and childcare during training. b) Unions must have a role in the training process, including identifying the employers’ future skills needs. c) Active labour market policies must be revamped and broadened to include all workers in all forms of employment. d) All companies take responsibility in training, re-training and upskilling current and future staff through extended apprenticeship schemes that are tailored to all types of workers.

5.2 As a means to support labour market mobility, and as a consequence of rapidly developing technologies, all workers, also those in self-employment, must b) Enable access to continuous up-skilling and reskilling for all workers including those in self-employment. This calls for a general right to further training with an appropriate level of remuneration. This requires that: ba) All companies must contribute to an education fund, governed by the social partners and the state, from which workers can seek funds to conduct training. This fund should also cover income losses during training, and address the need for elder care and childcare during training. Systems for training and professional development are established with a clear role for social partners, bb) Unions must have a role in the training process, including identifying the employers’ future skills needs, bc) Active labour market policies must be revamped and broadened to include all workers in all forms of employment, bd) All companies take responsibility in training, re-training and upskilling current and future staff through extended apprenticeship schemes that are tailored to all types of workers. Justification: The paragraph is rewritten for clarity. National systems for financing training and professional development look very different so a more general wording is to be preferred. Unions should not commit to identifying the employers’ future needs, but can be part of a general assessment. The last point needs to be broader, hence the deletion.

Paragraph 6

6.3 Furthermore, data, big data and the artificial intelligence and machine learning that comes out of that must be made a ‘commons’, i.e. available for every citizen, organisation, business and government to tap in to, use and learn from. Currently, it's the Big Six (Google, Microsoft, Apple, Amazon, Facebook and IBM) that predominantly own the data produced putting them into an untouchable class with undue political, scientific and economic monopoly and power.

Justification: No need to mention specific companies, and the sentence (a description) should be moved to the background text.

Paragraph 7

7.1 Workers and their union representatives must have the right to access, influence, edit and delete data that is collected on them and via their work processes. This calls for appropriate legislation and other mechanisms.

7.1 a) Workers and their union representatives must have the right to access, influence, edit and delete data that is collected on them and via their work processes. This calls for appropriate legislation and other mechanisms, as outlined in the UNI Global Union 10 Principles for Workers’ Data Rights. Justification: Self-explanatory

Paragraph 8

8.1 Human rights, including the rights of workers, must be respected throughout corporate supply chains. Companies must be held responsible for their actions and non-actions. Crowdwork and other online work platforms must be regulated.

8.1 Human rights, including the rights of workers, must be respected throughout corporate supply chains. Companies must be held responsible for their actions and non-actions. Crowdwork and other online work platforms must be regulated. Comment: Area XV suggests moving this paragraph to motion 3.

ARBETSDOKUMENT UNI-NORDEN – EJ FÖR SPRIDNING (ENGLISH)

Paragraph 9

9.1 To move beyond GDP as a measure of society’s economic and social health, and adopt a multi-dimensional matrix that includes the values of human dignity, freedom, democracy, equality, rule of law, and respect of human rights. The OECD’s Better Life Index offers an interesting starting point. 9.2 Yet more and more people and organisations realise that whilst GDP measures growth and income, it far from encompasses factors like the environment, social well-being, equality, health and happiness.

The OECD’s Better Life Index offers an interesting starting point. 9.2 Yet more and more people and organisations realise that whilst GDP measures growth and income, it far from encompasses factors like the environment, social well-being, equality, health and happiness. Comment: Area XV suggests moving point 9.1 to motion 3, as it is a more general vision and not as such connected to the core issues of the future world of work. Point 9.2 is purely descriptive and belongs in a background text.

Paragraph 10

a) UNI Global Union will make the points in this motion happen through cutting edge campaigns and advocacy, expanded and deepened global networks, and by making use of research and modern technologies, to protect and enforce the rights of all workers in the future world of work.

Justification: The paragraph is a mix of policy points that are already there in other motions (collective bargaining, organising, work-life balance etc) and concrete action points (campaigning, research, networking, conferences and seminars) that belong in a Work Plan or similar document, not in a Congress motion. Area XV suggest replacing the paragraph with a summarising policy point as regards the future world of work.
