public areas. Storage of refuse containers in areas visible from neighboring lots, streets, parks, and public areas will result in issuance of a notice of deed restriction violation. Concealment can be efficiently achieved numerous ways – by storing the containers in the garage or in the back yard or by screening the containers with a special section of fence or plantings. There are many options and the majority of Bay Forest residents employ one of these or another method. Placement of any trash at the curb prior to the evening immediately preceding pick-up (i.e., on Sunday evenings and Wednesday evenings only) will result in issuance of a notice of deed restriction violation. Continued TCV and TOE violations will ultimately lead to enforcement.

Roaming Pets Pose a Problem in our CommunityThere are provisions regarding roaming animals in both our Bay Forest Community Association CCRs and the City of Houston ordinances.

PET MYTH: Only dogs need be on leashes in Bay Forest.As a matter of fact, there are provisions regarding roaming animals of all sizes, makes and models in both our Bay Forest Community Association CCRs and the City of Houston ordinances.

Section 14 of the Bay Forest CCRs states “Animals are not permitted to roam the property [Bay Forest] and must be controlled on a leash if they are not on an Estate Lot, Custom Lot, Executive Lot or Patio Lot [any lot in Bay Forest].”

The City of Houston Leash Law states “It is against the law for pets to roam loose. Pets with access to public sidewalks, streets or neighbor's property may be impounded. This includes animals tied or staked.”

So what do these mean to us? They simply say that, if you own a dog or cat, you may not let it freely roam our neighborhood. And, importantly, you are responsible for any damage or harm caused by a pet you own and do not control.

First, when your pets (dogs, cats, other) are not on your personal private property – in your home or your yard, they must be on leashes. While most folks are aware that they must have their dogs on a leash when they take them out for a walk, it is important to understand that both our CCRs and the City's leash law apply to all pets…dogs, cats, ferrets, gerbils, etc. ALL PETS must be on a leash when you take them for a walk.

And, second, even when your pets are on your personal private property, they must be controlled. This is accomplished by keeping them indoors or keeping them inside a fence, for examples.

Myths About Bay Forest Community AssociationReading through the hundreds of comments received in the Bay Forest annual survey over the past several years, we’ve compiled a list of the most popular myths about life in our community. Below are the myths and the real story that debunks each one…the mythbusters.

STREET PARKING MYTH: BFCA has absolute authority over street parking in Bay Forest through its DCCRs.Unfortunately, this is not the case. Our neighborhood streets, like all dedicated streets across Houston and including other Clear Lake communities located within Houston city limits, are public rights of way. BFCA has absolutely no jurisdiction over use of our streets with regard to parking. Street parking is regulated by City of Houston ordinance and state law. Here…anyone can legally park a vehicle on our streets anywhere, any day, and any night.

The operative word here is "legally." According to Texas state law and City of Houston, a vehicle is legally parked if, and only if, the front and rear passenger side wheels are located within 18 inches of the curb. That means that "head in" parking in our cul-de-sacs is illegal and can be ticketed. That means parking a vehicle facing into oncoming traffic is illegal and can be ticketed. Further, if a vehicle is parked in the street for more than 24 consecutive hours, it is in violation of City ordinance and may be ticketed and towed. If you are aware of vehicles illegally parked on the streets in Bay Forest, you are encouraged to contact the City of Houston Parking Enforcement Unit supervisor Roland De La Cerda (832-393-8655 office, 713 458-0703 cell phone, [email protected] email) who will send an officer out to issue a ticket to the owner of an illegally parked vehicle.

POOL HOURS MYTH: If you open the pool longer, they will come.Been there, done that…and learned that they don't. In the quarter century since our pool opened, we've tried a myriad of different swim season and daily schedules based on feedback from residents. For example, there was a time when our pool was open every day in September. Some years, we kept the pool open until 10 pm on certain nights. We tried opening the pool from 3 to 8 pm during the week once school started in the Fall. For many years, we reopened the pool on weekends through the entire month of September.

At the same time, we've kept hourly counts of pool users. We reviewed those records to see what days of each week the pool was used the most and the least. We know which hours of which days are most popular and least popular. And what we found is that despite stated intentions of our residents, use of the pool was essentially non-existent during the week once school was back in session. Even though we have warm weather in September, we also have school and YMCA sports practice and games. We have band practice, scout meetings, Sunday afternoon pro football on TV, homework and school projects. Over the years, we have found the hours of pool operation that we think best fits our residents usage patterns. And that's the schedule we currently implement.

COMMUNITY AMENITIES MYTH: The only BFCA residents who benefit from the community pool, tennis courts and parks are those that actually visit them and use them.That's not what real estate professionals tell us. Your home is part of a larger community and the amenities of the community contribute to your home’s value and ability to sell it for the price you want when the time comes.

Please join us for this event, which will be held at the Bay Forest Pool Park near the pavilion on Saturday, October 26th from 3:00 to 5:30 pm. This event is sponsored by the Bay Forest Community Association, the Bay Forest Mommies’ Club and Ladybug Realtors/Edrina Fitting.

All are welcome.

This is a great introduction to our wonderful neighborhood, as there will be adults to visit with and meet - especially if you are new to Bay Forest. And there will be pumpkin decorating for the children as well as good food and fun. Children should wear a costume. Don’t miss it!

There will be hotdogs, bratwurst, giant pretzels (plus a few other goodies…). Bring your lawn chair if you like, and come meet some of your neighbors. Even if you have been a resident for years, there are always new people to meet, and old friends to catch up with!

TRASH CAN MYTH: It’s okay to store my trash cans near my garage…nobody ever looks up there to see them.

Not so. Your neighbors notice and they complain. Be advised that the Bay Forest CCRs do not allow for the storage of Trash or Trash Cans in public view.

Article IX, Section 17: Visual Screening states that “All clotheslines, equipment, garbage cans, service yards, woodpiles, refuse containers, or storage piles and household projects such as equipment repair and construction projects shall be screened by adequate planting or fencing so as to conceal them from view of neighborhood lots, streets, parks and public areas. All rubbish, trash, and garbage shall be kept in sanitary refuse containers with tightly fitting lids and shall be regularly removed from the lots and not allowed to accumulate thereon.”

That’s a lot to absorb, so here’s another way to say it. Trash or trash cans may only be visible in Bay Forest on trash pick-up days (Monday or Thursday), including the previous evenings. But you must store them in some out-of-sight location – like in your garage or in your backyard. Some homeowners have even planted large shrubs or constructed special fences (high and low) to screen trash cans from view when stored between trash days.

Tennis Court LocksRecently the locking system on the tennis courts was upgraded. The new keyless system is –

1. Safer – avoids people being locked inside the tennis courts.

2. More Efficient – physical keys do not need to be managed and delivered. Access codes can be changed as needed and distributed to Bay Forest homeowners via the community web site.

3. More Cost Effective – the current locks and keys are specialized and costs are high to repair locks and purchase keys.

Now that new locks are installed, they will use a PIN code that we can change as needed. The first code will be 2255. It – and all future codes - will also be posted to the web site. As you would not share your key with a non Bay Forest homeowner – please do not share this code. Keep your metal key – we will announce a turn in date so you can get your deposit back.

Oh boy, do we have two beautiful yards for you this month! Of course I say that every month, but it's true. Some of the prettiest yards in the area are found right here in Bay Forest, and we have selected two shining examples for you. Congratulations to the Yard of the Month winners for September, 2013, Jo Lynn Anderson at 2107 Purple Plum on the North side, and Marcia and Richard Toalson at 15603 Lake Lodge on the South side.

Jo Lynn Anderson at 2107 Purple PlumThe Anderson house on Purple Plum house has a beautifully symmetrical landscape. Two tall trees, one Pine and one Oak, keep the house nice and shady. The trees are surrounded by variegated grasses. The house is flanked at each corner by Ligustrum plants that have been trained into trees. Sago palms provide some visual weight and mass in the center of the beds.

Bay Forest Yard of the Month

Decorative grasses fill in the spaces and provide texture in the front beds, while whimsical concrete figures peer out from behind the grasses and smile at visitors and passers by. A stone border sets this all off and provides visual interest and contrast to the landscaping.

Bay Forest Yard of the Month

Marcia and Richard Toalson at 15603 Lake LodgeWhile most of us give up on flowers in the hottest days of Summer, the Toalson's on Lake Lodge have managed to keep some colorful blooms in their garden. Their cheerful yard is packed full of pink and white Elephant Ears, red Begonias, white Dusty Miller and purple Salvia. These colorful plants are set off against a lush green backdrop of Palms, Ligustrum, Pittosporum and many others. The deep beds have multiple rows of shrubs with graduated heights, so this yard has lots of vertical and texture and interest in addition to ground level flowers. And, if you look closely, you will discover frogs and flags and sunny flowers popping up throughout their front beds.

We have had a few committee members retire this month, so we need volunteers to keep the Yard of the Month committee going strong. FYI... winners are not eligible to win again for 3 years. Bay Forest Board of Directors and Yard of the Month committee members are not eligible to win.

Bay Forest Gourmet ClubThis year the Gourmet Club will be visiting some of the best wine regions in the world to taste their cuisine and sample their wines. Our first stop will be the South American wine regions of Argentina and Chile. Argentina is probably best known for its Malbec wines, which were originally grown in southeastern France. The climate and terrain in the area of Maipú, Mendoza produce an excellent Malbec which goes fabulously with grilled steaks for which Argentina is also famous. Chile is also renowned for its reds, especially Merlot and Cabernet Sauvignon, and its white Sauvignon Blanc. While the dishes have not been finalized for the first party, which will be held on October 19, you can be sure red meat and wine will be on the menu. If we whetted your appetite for some beef, here is a recipe that was used at a previous gourmet club party. Filet aux Eschalottes1½ pounds large shallots (about 24), halved lengthwise, peeled3 Tbsp. Olive oil6 cups canned beef broth 1½ cups tawny Port1 Tbsp. tomato paste2 3 to 3¼ pound beef tenderloins (large ends), trimmed2 tsp. dried thyme6 Tbsp. (¾ stick) butter1½ Tbsp. all-purpose flour1 large bunch watercress

Position rack in center of oven and preheat to 375ºF. In 9-inch diameter pie pan, toss shallots with oil to coat. Season with salt pepper. Roast until shallots are deep brown and very tender, stirring occasionally, about 30 minutes.

Boil broth and Port in a large saucepan until reduced to 3¾ cups, about 30 minutes. Whisk in tomato paste. (Shallots and broth mixture can be made one day ahead. Cover separately and chill.)

Pat beef dry; sprinkle with thyme, salt and pepper. In a large roasting pan set over medium-high heat, brown beef on all sides, about 7 minutes. Transfer pan to oven; roast beef until meat thermometer inserted into center registers 125ºF for medium- rare, about 45 minutes. Transfer beef to platter. Tent loosely with foil.

Spoon fat off top of pan drippings in roasting pan. Place roasting pan over high heat. Add broth mixture and bring to boil, scraping up any browned bits. Transfer to medium saucepan; bring to simmer. Mix 3 Tbsp. butter and flour in small bowl to form a smooth paste; whisk into broth mixture and simmer until sauce thickens, about 2 minutes. Whisk in 3 Tbsp. butter. Stir in roasted shallots. Season with salt and pepper. Cut beef into ½-inch slices. Spoon some sauce over each serving and garnish with watercress. Pass remaining sauce.

Gardeners by the Bay

Gardeners of all levels are invited to attend the Gardeners by the Bay meetings held the first Wednesdays of each month, from September to May, at University Baptist Church (Great Room on 2nd floor) located at 16106 Middlebrook Drive.

Members and guests enjoy a light brunch from 9:00 to 9:30 am. A brief business meeting is then held prior to the main program. Guest speakers present timely programs of interest to all gardeners. Welcome back Falcon Pass students and families! My name is Carrie Quigley and I am excited to start my second term as the Falcon Pass Elementary PTA President for the 2013-2014 school year. I have three kids myself and truly appreciate the many wonderful opportunities this district has provided them. This is my seventh and final year at Falcon Pass, truly a bittersweet time for me.

Science Fair UpdateIt is time to start the paperwork for your EXTRA CREDIT SCIENCE FAIR PROJECT! To get started: Submit your CCISD Experimental Design Project/Topic Approval Form to the CLHS Science Fair Coach, Brenda Pinchbeck, for initial approval prior to completing the SRC paperwork. Science Fair Information and forms can be found on the school district website. Once your topic has been approved, we will get you started on your paperwork for final approval! Don't delay...the school science fair will be the week of December 9. From the Office...The office will only accept academic related items for students, i.e. homework, books, lunches. Anything else will not be accepted. To reduce classroom interruptions, messages regarding deliveries will not be sent to students. The delivered item will be kept in the office until the student comes to claim it. ALSO, please note, the office will not accept fountain drinks. These drink cups sweat and spill easily, for that reason, they will not be accepted. Our goal is for every student to come to school prepared and ready to learn.

For the safety of our students and of those within the school, visitors must report to the main office and officially register through the visitor check in system and receive a badge prior to admittance to the school. Students may not go to the parking lot or outside the building to meet a visitor or parent. Visitors or parents who wish to deliver a lunch to a student must check in at the front office. Persons with official business are permitted on the school campus. Nonstudents, such as friends from other schools, or siblings or relatives may not be on campus to visit during the school day without permission from the principal. Pets or animals, other than certified assistance animals are not to be brought to school without prior approval. Visitors to individual classrooms during instructional time shall be permitted only with the principal's approval, and such visits should be limited to a duration of fifteen to twenty minutes. Visits are not permitted if their duration or frequency interferes with the delivery of instruction or disrupts the normal school environment. All visitors are expected to demonstrate the highest standards of courtesy and conduct; disruptive behavior will not be permitted. Unauthorized visitors may have charges of trespassing filed against them.

TRASH SERVICE MYTH: Bay Forest, we pay for back door trash pick-up because we're lazy.Actually, that’s far from the truth. The biggest benefit of back-door pick-up is the positive impact it has on our property values. Many new Bay Forest homeowners comment on how much more attractive they found Bay Forest to be – versus surrounding neighborhoods with curbside trash pick-up – when they were home shopping. Our streets aren’t cluttered with trash cans at the ends of every driveway twice a week. Over the years the question has come up many times about why Bay Forest does not just opt for City service and save money. The question is brought up and addressed in our annual meetings in October. Based on the feedback of the residents present, the overwhelming feedback received is that Bay Forest residents want to maintain the type of service that historically has been provided – twice-a-week pick-up at the back door – and help maintain our property values.

Hispanic Heritage Month – 4-6 pm in Community RoomThursday, 9/19 All ages celebration-- We will have piñatas, crafts & music so bring the whole family! ESL PROGRAM HCPL’s literacy and English as a second language programs help adults with the basic reading and writing and/or spoken English skills they need to reach work, family and personal goals. Freeman Library provide a place where tutors and students from a variety of cultural and educational backgrounds can meet to share what they have learned.
