Lewis S. - Dortmund was all the rage(and still is) following his head-turning Churchillallowance romp, but a little of the mystique was lostwhen he was only able to beat Firing Line by a head at3-5 in the GI Los Alamitos Futurity. He did have one ofthe easiest trips in racing, sitting behind the runner-upand Mr. Z as they dueled through fractions of :21.98,:45.29 and 1:09.64. But it was still a fairly tall task forDortmund, having debuted only some six weeks earlierand being asked to go two turns for the first time--especially at Los Al, where the turns might have beentoo tight for the hulking chestnut. Firing Line has plentyof upside and promise too, but Dortmund is supposedto be the best horse in this race, and I expect him toshow it if he=s close to ready. Selection: #6 Dortmund(4-5).

MRC PUTS NUMP=S MULTIPLE MEDICATIONVIOLATION PENALTY SYSTEM INTO ACTION By Mike Kane Trainers Scott Lake and Hector Garcia unwittinglybecame part of racing regulatory history in late Januarywhen they were the first horsemen to receive additionalsuspensions from the Maryland Racing Commission,which was using the guidelines of the MultipleMedication Violation Penalty System that is part of theNational Uniform Medication Program (NUMP). Maryland became fully compliant with all foursections of NUMP Jan. 1. Ed Martin, president of the Association of RacingCommissioners International (RCI), which developed themodel rules in the NUMP, confirmed that Lake andGarcia were the first horsemen to cross pointthresholds for multiple violations and trigger thesupplemental penalties. While Martin said it was anoteworthy moment, it wasn=t a happy occasionbecause it meant that medication rules were beingbroken. Mike Hopkins, executive director of the MarylandRacing Commission, acknowledged the significance ofthe added penalties and said it showed that the NUMPsystem worked. AWhen this whole process started about 15 years agowith the RMTC (Racing & Medication TestingConsortium), the goal was for some uniformity in anumber of areas,@ Hopkins said. Lake received an extra 60 days to go with the 60days and $1,000 fine he was assessed by Maryland=sstewards for post-race positives for the anabolic steroidstanozolol in December. The four penalty points Lake

was handed for the Marylandinfraction were added to fourpoints he had on his recordfrom a post-race stanozololpositive at Penn National onJune 11, 2014. The total ofeight points triggered thesecond 60-day suspension.Lake has appealed the120-day suspension that wasdue to begin Feb. 5. Hopkins said he hopes theMaryland Racing Commissionwill be able to hear Lake=sappeal at its March meeting. Garcia had a total of fourpost-race positives inDecember and January and

the multiple medication violation penalty points thatcame with those cases increased his suspension by 240days. Maryland=s stewards handed out a total of 150days of suspensions and $2,000 in fines for the fourpositives--three for stanozolol and one for the sedativexylazine. The suspensions, which must be servedconsecutively, will keep Garcia away from trainingthrough Feb. 29, 2016.

After the suspensions were announced, the MarylandJockey Club notified Garcia and suspended trainer JuanVazquez, for whom Garcia worked, that they had toremove their horses from MJC property within twoweeks. NUMP was formalized in 2012 to replace the oftendisparate rules in place in the nation=s racing states. The Jockey Club has long advocated for uniformnational standards for medications, testing andpenalties. At its annual Round Table Conference in 2013 and2014 in Saratoga Springs, N.Y., Jockey Club officials,led by chairman Ogden Mills Phipps, said they wouldseek federal legislation if states did not adopt theNUMP standards. The Jockey Club has promoted the concept of anindependent third-party body, such as the United StatesAnti-Doping Agency, which handles Olympic testing,overseeing racing=s program. In his closing remarks at the 2014 Round Table,Phipps said that the organization=s Board of Stewardshad authorized staff to develop and implement anational legislative strategy. ATo be clear, this broadened strategy will includefederal legislation,@ Phipps said. AWe have alsoinstructed The Jockey Club management team tofurther investigate a relationship with the independentand well-respected body like USADA. Matt Iuliano, executive vice-president and executivedirector of The Jockey Club, said that the organizationis following the Stewards> mandate. AThat work is in process,@ he said. According to The Jockey Club, which closely followsthese matters, with Maryland on board, eight of the 33

racing jurisdictions haveadopted all four phases ofNUMP. The NUMP package ismade up of a schedule ofthresholds for 26 approvedtherapeutic medications;third-party administration ofLasix; use of anRMTC-approved lab; themultiple medication violationpenalty system. Of the eightstates that account for approximately half of theraces and 83% of the gradedstakes in the U.S., onlyMaryland and New Jersey

have implemented all of the NUMP. Lake=s second 60-day suspension is an ideal exampleof the penalty program working because the infractionsoccurred in different states. The RCI maintains the national database for the pointslists. Iuliano said that some progress has been made sincePhipps made his comments at the Round Table andpointed to states that had adopted pieces of the NUMP.

However, Iuliano said small victories and partial implementation of NUMP standards are not enough. AOur main objective,@ he said, Ais to ensure that we=vegot a single uniform medication rule book and penaltystructure that is fairly and independently applied to allthe connections--owners, trainers, breeders, etc.--andthat it is enforced without variation. Naturally, we=revery keen on areas where there appears to benon-uniformity, which creeps into the process.@ Iuliano said The Jockey Club applauds states, such asArkansas, North Dakota and Maryland, that recentlybegan following the NUMP, but that a number of statesare missing one or more of the elements. AWhen you look at that scorecard there is variation,@he said. AA lot of it is timing. That is, one aspect of theuniformity initiative may come on line followed afterseveral months with a second component of it,followed perhaps by a third and a fourth. AWe certainly don=t want to discourage anyjurisdiction from adopting it, but we continue toencourage jurisdictions that when they look at theserules they have to be adopted in their totality. And theyhave to be put into place so there is very clearinstructions that can be presented to everyone who hasa connection to a Thoroughbred.@ New York, has implemented two of the NUMPstandards--the controlled therapeutic medicationschedule and the third party administration of Lasix--and is moving toward adding more of the program.Cont. p13

CHAPA CASE SET FOR MARCH By Mike Kane The State of Texas=s criminal case against jockeyRoman Chapa for unlawful influence on racing has beenreset to Mar. 18. Chapa, 43, appeared in Harris County District Courtin Houston Friday to face charges that he illegally usedan electrical device on a horse in a race Jan. 17 at Sam

Houston Race Park.Judge Stacey W. Bondset the March date togive prosecutors andChapa and his attorneytime to prepare for thecase. Chapa is free on$10,000 bail. On Feb. 9, thestewards at SamHouston will hearChapa=s appeal of theimmediate suspensionthey imposed Jan. 19.

The stewards acted after accusations surfaced that aphotograph appeared to show that Chapa had a buzzerin his left hand near the end of Quiet Acceleration=svictory in the $50,000 Richard King Handicap. Thesuspension was handed down while the Texas RacingCommission investigates the allegations. Robert Elrod, aspokesman for the racing commission, said Friday thata hearing on the matter will likely take place within thenext month. Chapa has twice been punished for similar incidentsinvolving devices to shock a horse, often called buzzersor machines. He was suspended for 19 months in 1993 and served four years of a five-year suspensionfor a 2007 violation before being granted aprobationary license in New Mexico. In the probable cause statement, Jeffrey Green ofthe Texas Department of Public Safety said that trackphotographer Jack Coady told him he was contacted byChapa the day after the race and asked to take thephotograph off the track=s website. Green said in hisstatement that Chapa told him he had never seen thephotograph or had reached out to Coady. However,Green said that when Chapa allowed him to look at hisphone he could see that a call had been made and atext sent to Coady. Green said that a copy of thephotograph was in a recently deleted file on Chapa=sphone.

On the New York road to the Kentucky Derby (G1), in his first start on dirt,

I Want Revenge rose to the top of the three-year-old class in the

Gotham Stakes (G3), drawing off by 8 1/2 widening lengths setting

a new Stakes Record. He defeated the likes of Grade 1 Winners

and Millionaires Haynesfield, Giant Ryan, and Russell Road.

The impressive effort earned him a 113 Beyer Speed Figure,

which was the third-highest three-year-old Beyer of the year

and one of the highest pre-Derby Beyer Figures ever.

I Want Revenge followed up his Gotham win with a spectacular victory

in the Wood Memorial (G1), following in the footsteps of successful sires

Tapit, Empire Maker, Unbridled’s Song, Broad Brush, Pleasant Colony,

and Seattle Slew. After being completely left at the gate,

spotting the field several lengths, and getting pinched in the stretch

several times, I Want Revenge stamped his ticket to Louisville

in one of the year’s most memorable performances.

After devastating back-to-back wins in the Grade 1 Wood and

Grade 3 Gotham Stakes, I Want Revenge was installed as the

morning-line favorite for the 2009 Kentucky Derby.

On the morning of the race, he was scratched like his Grandsire

A.P. Indy, who was also the morning-line favorite.
