TRENTO SUMMER SCHOOL ON ADVANCED EU COMPETITION LAW AND ECONOMICSThe third edition of the Summer School will take place in Moena (Italian Dolomites) from 18th to 24th June 2017. The Summer School is organized by the Osservatorio Permanente sull’Applicazione delle Regole di Concorrenza based at the Faculty of Law of Trento University (“Osservatorio Antitrust”). It is co-directed by Gian Antonio Benacchio and Michele Carpagnano. The Summer School offers a unique opportunity to analyze and study EU Competition Law and Economics at an advanced level. The advanced course combines academic studies with a pragmatic approach to the application of competition rules. The academic program is designed to cover both substantive and procedural aspects of EU Competition Law with practical session (complaints, compliance programs, leniency applications and estimation of antitrust damages) and how to do sessions (mock dawn-raids and mock trial before the EU General Court). There will also be two workshops on hot topics in EU Competition Law and Economics and a keynote speech on New Nationalism and Competition. Moreover, three cocktail-talks will focus on: i) the relationship between Public and Private Antitrust enforcement; ii) how Competition Law is seen from the Digital market; and iii) on the Competition viewed from the business and finance community. A new feature of the third edition will be the Antitrust Compliance Night where participants will be engaged in a play role game with leading expert on antitrust compliance from Academia, Business community and Practice.

Born 1960; Graduate of Trinity College, Dublin (Legal Science) (1984) and of the Honourable Society of King’s Inns, Dublin (Barrister-at-Law) (1986); Bencher of the Honourable Society of King’s Inns (since 2013); Barrister-at-Law (1986-90 and 1997-2003) and Senior Counsel (2003-13) at the Bar of Ireland; Legal Secretary at the Court of Justice of the European Communities (1990-97); Director of the Irish Centre for European Law (1997-2000) and continues to be a Member of its Board of Directors; Vice-President of the Council of European National Youth Committees (1979-81); General Secretary, Organising Bureau of European School Student Unions (1977-84); General Secretary, Irish Union of School Students (1977-79); International Vice-President, Union of Students in Ireland (1982-83); Member of the Permanent Delegation of the Council of Bars and Law Societies of Europe (CCBE) to the EU and EFTA Courts (2006-13); Judge at the General Court since 16 September 2013.Richard Whish is Emeritus Professor of Law at King’s College London; in 2014 he was appointed QC Honoris Causa. He was a non-executive director of the Office of Fair Trading in the UK from 2003 to 2009, and a non-executive director of the Singaporean Energy Markets Authority from 2005 to 2011. He is the co-author, with David Bailey, of Competition Law, 8th edition 2015 (OUP), and the author of many other books, articles, case-notes and book reviews on various aspects of international competition law and policy.Eleanor M. Fox is the Walter J. Derenberg Professor of Trade Regulation at New York University School of Law, where she has taught since 1976. She specializes in antitrust and competition policy, and teaches, writes and advises on competition policy in nations around the world and in international organizations. She has a special interest in trade and competition and in developing countries and explores how opening markets and attacking privilege, corruption and cronyism can alleviate marginalization and open paths to economic opportunity and inclusive growth. Her books include a US antitrust casebook (West 2012), a co-authored European Union law casebook (West 2015), and a book on the design of competition law institutions with Michael Trebilcock (Oxford 2013).

Maria Pilar Canedo Arrillaga is the Chairperson of the Basque Antitrust Authority since its creation in 2012. She is Professor of Private International Law and Jean Monnet Chair Holder on Transnational Trade Law. She has directed an “Erasmus Mundus Master in Transnational Trade Law & Finance” and lectures in several Graduate post graduate and PhD Programs at Deusto University. She has also taught, among other institutions, as Invited Professor such us Universidad Carlos 111, Madrid; Universidad Pontificia de Comillas, Madrid; ESADE, Barcelona; Université Robert Schumann Strasbourg 111; University of Strathclyde, Glasgow; Universidad de Guadalajara, Mexico; Hamline University, Saint Paul, Minnesota and USF, San Francisco, USA.Gabriella Muscolo is a Commissioner of the Italian Competition Authority.Appointed as a Judge in 1985, she sat at the Specialist Section for Intellectual Property and Competition Law in the District Court of Rome and at the Court for Undertakings in Rome.In 2009, she was appointed as a member of the Enlarged Board of Appeal-EBA of the European Patent Office-EPO and she resigned in May 2014, when she was elected as Commissioner.Since 2008, Gabriella Muscolo has been lecturer of Company Law at the School of Specialization for the Legal Professions at the University of Rome - La Sapienza. She also lectures at Italian and Foreign Universities. Mattia Melloni is one of the four members of the “Conseil de la concurrence” of Luxembourg and in this capacity is responsible of the ECN for this Authority. He is also an associate professor at the University of Nancy, Law School. He started his professional career in London and moved to Brussels later on while working for two leading international law firms in competition and trade matters. He also spent several years at the General Court of the European Union while working as référendaire (law clerk) before joining the “Conseil de la concurrence” of Luxembourg (2012). Mattia Melloni qualified as “avocat” in Brussels (2004). He holds a Ph.D. from the Free University of Brussels, an LL.M. from the University of Minnesota Law School, a D.E.S. from the Institute of European Studies of Brussels and a law degree from the University of Bologna.

Roberto Chieppa is the Secretary General of the Autorità Garante della Concorrenza e del Mercato since December 2011. Councillor of State since February 2000. Lecturer for university and post -graduate courses on administrative law and antitrust law; co-edited and contributed to legal trade journals, authored over 50 publications in the administrative law sector. Roberto Chieppa collaborated with the Ministry of Regional Affairs and Local Autonomies as a member of the joint Committee on the laws for implementing the special Statute of the Region of Aosta Valley and as an expert on issues concerning the liberalization of public services and the reform of the consolidated law on local entities and issues related to mountainous areas. Member of the regulatory quality and simplification Unit established at the Presidency of the Council of Ministers.Andrea Pezzoli is Director General for Competition of the Italian Competition Authority, where he has worked since 1993 as head of the Investigative Directorate “Food, Pharmaceutical and Transport” and as Chief Economist. Previously he was a senior economist of the Research Department of Istituto Mobiliare Italiano (1981-86) and Head of the Industrial Policy Unit of the Centro Europeo Ricerche (1986-93).He teaches Competition Issues at the University of Tor Vergata and at Luiss University in Rome. Author of several articles in the field of Competition Policy and Industrial Economics. He is the co-author with Lapo Berti of Le stagioni dell’antitrust: dalla tutela della concorrenza alla tutela del consumatore, UBE, 2010. In 2016 he published Originators vs Originators: Competition Before the Market and Market Power Beyond Dominance in G. Muscolo and G. Pitruzzella (eds), Competition and Patent Law in the Pharmaceutical Sector, Wolters Kluwer.Ralph Taschke Ralph Taschke has worked for the Austrian Competition Authority since beginning 2014. Previously he worked as legal clerk at the Vienna Court of Appeal and in the legal service of the Ministry of Defence.Internships in the State Aid department of the Ministry of Economy and in the Cartel Directorate of DG Competition rounded up his experience in competition law. Taschke studied law in Vienna and Nottingham.

Daniele Calisti joined the European Commission’s Directorate-General for Competition in 2008, where he first worked in the European Competition Network Unit. As a member of the Private Enforcement Unit, Dr Calisti worked on all the EU policy initiatives on damages actions for breaches of the EU antitrust rules, from the 2008 White Paper to the 2013 proposal for a Directive. A graduate of the School of Law at LUISS University in Rome, Dr Calisti holds an LLM in European Law from King’s College London and a PhD in Public Law and Economics from La Sapienza University in Rome. Prior to joining the European Commission, he also served as an advisor on the implementation of EU law to the Chair of the Committee for Legislation of the Italian Parliament.Sergio Dompé is President of the Dompé Group, a leading Italian biopharmaceutical company dedicated to the development of innovative therapeutic solutions for rare and orphan diseases. As an entrepreneur in the pharmaceutical and biotechnology sectors, he has been awarded honorary degrees in Pharmaceutical Biotechnologies (University of Bologna, 1996), Medical Biotechnologies (University of L’Aquila, 2005),and Pharmacy (University of Urbino, 2010). In 2016 Sergio Dompé was awarded the Aid to Research in Rare Diseases Foundation Award (A.R.M.R.), an award given to people who have distinguished themselves for their commitment in research, meant as a life witness.Michele Carpagnano is a partner in Dentons’ Rome office and the head of the Italian Competition & Antitrust practice, PhD, he holds a teaching position in EU Competition Law at University of Trento and he is the Founder and Co-Director of the Osservatorio Permanente sull’Applicazione delle Regole di Concorrenza. As Attorney he represents national and multinational companies before the Italian Competition Authority as well as the European Commission and he has been involved as a legal expert in several cases and class actions before domestic courts concerning antitrust infringements. Michele Carpagnano advised the European Parliament on the introduction of EU legislation on collective redress. He is author of three books on private antitrust enforcement and several articles on competition law issues.Marco D’Ostuni is a partner based in the Italian offices of Cleary Gottlieb. He focuses mainly on competition law and on regulation in the energy, telecommunications and media sectors. He has represented clients in some of the leading EU and Italian competition law cases, often in liberalized and heavily regulated sectors. He is distinguished as a leading lawyer in Italy in Competition/EU Law by Chambers Europe and Who’s Who Legal, and in

TMT: Telecommunications by Chambers Europe and The Legal 500 EMEA. In 2014, he was named “Best Italian Telecommunications Lawyer of the Year” by online magazine Legal Community. He is a member of the Rome and New York Bars. He has widely published on antitrust matters and regularly lectures at numerous conferences and universities. Jesús Alfaro has been a Professor of Commercial Law since 1995 and is currently teaching at the Universidad Autonoma of Madrid. He specialises in (i) EC and Spanish competition law (mainly, cartels and abuse of dominant position investigations); (ii) Unfair competition; (iii) Contracts (mainly distribution agreements, termination of manufacturer/distributor relationships); (iv) Consumer law. Additionally, he is also well known as a Corporate law specialist (mainly, internal corporate conflicts, corporate governance and corporate litigation). Consultant at Linklaters since February 2012. As well as his strong practice in commercial and competition law, Jesús has also written books and dozens of articles on problems related to constitutional and private law, general theory of contracts, antitrust law and economic analysis of law, corporate and consumer law.Francisco Marcos is expert in economic analysis of law, commercial and competition law, he teaches law at IE Business School, having studied as a Fulbright scholar (1994-1995) at UC Berkeley and having enjoyed a scholarship for the Real Colegio di Spagna (1997-1998) in Bologna (Italy).He works as an independent consultant and as short-term consultant for the World Bank-IFC, advising governments, companies and firms on different matters in the area of market regulation and antitrust law. In October 2006 he was appointed General Director of Competition Policy at the Regional Antitrust Authority in Madrid, stepping down from that position on September 2009. He is member of the Editorial Board of the European Business Organization Law Review and of European Company Law. Author of numerous academic works, including two books.

Anthony Mark Williams is a Professor of Law at The University of Melbourne, School of Law. He read law at the University of Bristol and subsequently read for an LLM with Merit and a PhD from King’s College, University of London. He was admitted as a Solicitor in England and practiced law for 5 years before switching to an academic career in 1990. He worked at Hong Kong Polytechnic University until 2014. Professor Williams is also admitted as a Solicitor in England and Wales and Hong Kong. He has published in various leading law journals. Professor Williams has been actively involved in the promotion of competition policy and law in Hong Kong, China and the wider Asian region. He is the founder of the Asian Competition Forum, a non-profit organization with a membership of over 300 that seeks to bring together academics, government officials, lawyers, business and consumer leaders to discuss competition-related issues and to promote research into competition law and policy issues.Luigi Prosperetti is professor of Economic Policy at Faculty of Law, Università di Milano. He studied economics at Bocconi, Milan (cum laude, 1976) and at the London School of Economics (M.Sc., 1978; Ph.D., 1982). He has written extensively on regulatory and antitrust issues, and in 2009, he published Il danno antitrust: una prospettiva economica.Ginevra Bruzzone is Deputy Director General of Assonime, in Rome. Assonime is a private think tank active in corporate law, tax law, competition and regulatory policies.At Assonime, which she joined in December 2000, she is in charge of EU and Italian competition law, consumer protection, IP law and regulation. She was formerly Senior Economist at the Research Department of the Italian Competition Authority, from 1991 to 2000.Ginevra Bruzzone has published extensively in the field of law and economics in national and international publications, and has a significant experience as teacher and lecturer on antitrust issues. She teaches a course on Competition and Consumer Protection in the EU in the Master on European Economic Governance at Luiss University, in Rome. She is a member of the Advisory Board of the Italian Authority for Transportation and of the Steering Council of the Italian Section of the International Chamber of Commerce.

Gwenael Muguet-Poullennec is a référendaire (law-clerk) at the General Court of the EU. He first worked with Judge Rafael Garcia-Valdecasas before joining Judge Sten Frimodt Nielsen’s cabinet. As a référendaire for the reporting judge, he actively contributed to cases such as Airtours v. Commission (T 342/99), My Travel v. Commission (T 212/03), Ryanair v. Commission (T 342/07) or Kingdom of the Netherlands and ING v. Commission (T 29/1O and T 33/10). Prior to joining the Court, Gwenael practiced in the Paris office of an American law firm. In this capacity, he advised clients in competition law matters. He also worked as a legal expert in relation to several WTO disputes between the EU and the USA He qualified as an attorney-at-law in New-York State after obtaining law degrees from Panthéon-Assas (Paris Il) and Panthéon-Sorbonne (Paris l) Universities as well as the Columbia University School of Law (NYC). Gwenael has been lecturing on a regular basis in France and Switzerland. He is also co-editor of the pages on State Aid and Procedural Law for the Revue Lamy de la Concurrence, one of the French-speaking leading reviews dedicated to Competition Law.Jakob Rüggeberg studied economics at the Universities of Maastricht, Hamburg and Toulouse and graduated with a master thesis on the economics of private enforcement in 2005, published by the NMa (Dutch Competition Authority) as the best economics thesis of the year in the Netherlands. Jakob earned practical experience working at a leading economics consulting firm and is currently finishing his doctoral thesis in economics at the University of Amsterdam. His PhD research is published in peer-reviewed journals and focuses on the economics of private enforcement and effective mechanisms of compensation.Paolo Buccirossi is the Director and the founder of Lear. Paolo has been working in the field of competition policy since 1994. After five years as economic advisor at the Italian Competition Authority, in 1999 Paolo set up Lear. Paolo has also cooperated with several governments in the implementation of a national competition policy regime and has advised the Dutch and the Czech Competition Authorities on their system of sanctions for breaches of competition law. In addition, he has led several research projects for the European Commission, the OFT, the UK Competition Commission and the Brazilian CADE. Paolo has been Visiting Scholar at George Mason University, New York University and Cambridge University He also teaches Economics of Competition Law at the University of Rome Tor Vergata. Paolo has published on several academic journals.

Paolo Palmigiano is the General Counsel and Chief Compliance Officer (EMEA) for Sumitomo Electric Industries. Previously he was the Head of Competition Law at Lloyds Banking Group in London, the General Counsel of the Commission for Communications Regulation (ComReg), the regulatory and competition authority in Ireland for telecoms and post. From 2000 to 2009 Paolo headed the Competition and Regulatory team of BT Group plc in London. He is the chairman of the Association of in-House Competition Lawyers, vice-chair of BIAC (the voice of business at the OECD in Paris) and a non-governmental advisor to the Competition and Markets Authority (‘CMA’) in the UK He is also a member of the Competition Appeal Tribunal’s users’ group.Miguel Perez Guerra is a senior antitrust counsel at Google in London, where he advises and oversees competition matters throughout the EMEA region. He previously worked at Amazon in its European headquarters in Luxembourg, where he was lead counsel to the pan-EU retail and marketplace e-commerce businesses. Prior to moving in-house, he was a senior associate at Linklaters’ Competition & Antitrust team, and was an associate at Clifford Chance’s European Competition and Regulation group before that. He qualified into the Energy & Telecoms department at Spanish law firm Garrigues. He is a graduate in law and in economics by Comillas-ICADE University in Madrid, and has studied international and EU law at Georgetown University and at King’s College London.Irene de Angelis Head of Antitrust & Competition Policy for Intesa Sanpaolo, she advises on the full spectrum of EU and Italian competition law and procedures. Qualified lawyer in Italy, she previously spent several years in the private practice and then was legal counsel for the Belgian-Italian Chamber of Commerce in Brussels. She is Vice-President of ICLA Italia - In-house Competition Lawyers’ Association, and member of Antitrustitalia - an association of professionals working in antitrust based in Brussels. She has been nominated amongst the ’30 in their 30s’ Notable Women in Competition 2017.Dahlia Kownator is a member of the Qualcomm’s Government affairs team. She focuses on antitrust policy as well as on high technological regulatory issues at European level. She started her antitrust policy career working with international law firms in Brussels, before working for the French Competition Authority, where she led high-profile antitrust cases related to the Internet industry. Dahlia then moved into high-level government affairs roles within the telecom/internet industry. Dahlia holds law degrees in public and private law

She was admitted to the Brussels Bar as ‘Avocat stagiaire’Francesca Valente is the Head of Italian Regulatory and Antitrust Affairs Department of Enel since it was created in July 2014.Born in Roma in 1964, after a four year-experience at ANCE (Associazione Nazionale Costruttori Edili) she joined Enel Group in 1994 as Manager Legal and Regulatory Affairs of Commercial Department within the Generation Division of Enel SpA.In this position she developed an extensive knowledge of the energy sector including antitrust law, leading the Regulatory and Antitrust Department of different Divisions of Enel Group, including both generation and trading activities, retail market, infrastructure and network sector, research and innovation activities.As Head of Italian Regulatory and Antitrust Affairs Department of Enel, she currently manages all regulatory and antitrust issues relating to the Enel Group business in Italy, from generation to infrastructure and network sector including wholesale and retail market and innovative business (e.g. electric vehicle).Luca Leonardo, admitted in Italy (Avvocato), is the Legal Compliance and Antitrust Manager of Italcementi Group, which he joined in 2000. Graduated in law from the University of Messina, he later earned a Master in EU competition Law and international contracts from Bicocca University and an Executive Master MBM (Management of Building Materials) from the MIP School of Management at Politecnico University in Milan.He deals with antitrust, antibribery, corporate criminal liability laws and other compliance matters. He is also responsible for designing and managing corporate compliance programmes, coordinating and supporting subsidiaries to ensure global implementation.

Julia Suderow is Rechtsanwältin and Abogada, based in Bilbao. As a lawyer she advises companies and law firms on competition law issues. She is also specialized on energy issues and international litigation. She previously worked as an associate with the Spanish Law firm Gomez Acebo y Pombo and with the law firm, Dr. Frühbeck Abogados y Economistas in Madrid. She studied Law and History in the University of Hannover Germany. She has an LLM of the University of Hannover and holds a doctorate in Private International Law and EC Competition Law of the Universidad Carlos III of Madrid. She has several publications on Private International Law and Private Enforcement of Competition Law. Julia is the coordinator of the Spanish Team of the Osservatorio Antitrust.

ACADEMIC STAFF AND TEAMGiulia Ancona works as a lawyer in Trento and has been collaborating with the Osservatorio Antitrust since 2015. She obtained her Master degree in Law at Trento University in 2012, and in 2013 she obtained a LL.M. in European Law at the University Panthéon-Assas in Paris.

Riccardo Haupt is a Ph.D. Candidate in Business and Social Law at Bocconi University in Milan. Prior to starting his doctoral studies, he was a junior associate at a leading Italian law firm and an intern at the Italian Competition Authority. He is currently a holder of the G. Mucciarelli Fellowship for young researchers active in the area of Italian Business law. He is a member of the Osservatorio Antitrust team since 2017.

Maurizio Dellantonio is Police Inspector, he coordinates the Mountaineering Activities of the Italian State Policy. In 1991 he became Alpine Guide and participated in extra-European expeditions. In 1980 Maurizio took part in the Corpo Nazionale del Soccorso Alpino e Speleologico (Alpine Rescue Team) and obtains the title of ‘Instructor’ and ‘Rescue Helicopter Technician’. In 1995 he became Station Master, in 2001 Managing Director of the zone Fiemme Fassa, from 2004 to 2009 he was the President of the Provincial Service of Trentino. From 2007 to 2012 he was National Councillor, and since 2013 he is the National Vice President. During his 35 years of militancy in the Alpine Rescue Team takes part and coordinates innumerable rescue operations. In 2001 he was nominated Cavaliere of the ltalian Republic.

He is co-Director of the Osservatorio Permanente sull’Applicazione delle Regole di Concorrenza, an independent Research Centre, member of International Academy of Comparative Law, Paris, of Société de législation comparée and of Board of Sird. Co-director of Trattato di diritto privato comunitario, published by Giappichelli. His research interests are Comparative law, Private European law, Public Procurement Law and East European Law. He is author of several publications, among which Diritto Privato dell’Unione Europea, VI ed., Padova, 2013.Michele Carpagnano is a partner in Dentons’ Rome office and the head of the Italian Competition & Antitrust practice, PhD, he holds a teaching position in EU Competition Law at University of Trento and he is the Founder and Co-Director of the Osservatorio Permanente sull’Applicazione delle Regole di Concorrenza. As Attorney he represents national and multinational companies before the Italian Competition Authority as well as the European Commission and he has been involved as a legal expert in several cases and class actions before domestic courts concerning antitrust infringements. Michele Carpagnano advised the European Parliament on the introduction of EU legislation on collective redress. He is author of three books on private antitrust enforcement and several articles on competition law issues.

ACADEMIC PROGRAMHistorical foundations and their relevance todayThe historical foundations of competition law are essential to understand the current legal framework. The workshop will present the main aspects of the evolution of competition law in the EU since its origins. The workshop will also consider the goals of competition law and the methods applied by public authorities to pursue these goals, as applied in the last century and today. Moreover, the main theories that support Competition Law & Economics will be discussed from a historical perspective.

Substantive law: Articles 101 and 102 TFEUThese two advanced courses aim at analysing the application of Articles 101 and 102 TFEU in light of the latest case law and decisions from European and National Competition Authorities. Departing from the general description of the functioning of competition rules, this course focuses on complex legal, economic and practical issues encountered in the application of these rules. Summer school participants will discuss the relevant case law and decisions during the course also confronting their knowledge and perception of specific problems.

Competition economicsThe aim of this advanced course is to provide the participants with a practical understanding of how economics is used in antitrust law assessments. The course will look into the modern usage of economic tools for the enforcement of competition rules and will encourage active participation in order to foster the creation of an interactive environment.

Public Antitrust enforcementThe aim of this advanced course is to analyse the dynamic of public enforcement in the European Union. Moreover, it will focus on specific procedural problems that arise in practice, adopting a practical approach.The Commission is charged with the enforcement of EU competition law and, since the entry into force of Regulation 1/2003, also National Competition Authorities are empowered to enforce the same competition rules. The course will also take into consideration the policy background that characterises the EU of competition law enforcement system.

Private Antitrust enforcement & collective redressThe aim of this advanced course is to provide knowledge and practical guidance in relation to damage claims resulting from infringement of EU competition law in pan-European cases. The workshop will also discuss the EU Directive for damage claims and relevant case law as part of the legal framework applicable to private enforcement of Competition Law in Europe. The course will also give guidance on Collective Redress legislations and their practice in Europe.

How to sessions

The practical sessions of the Summer School will give participants insights and guidance on: i) how to check your antitrust damages; ii) manage down raids.

Hot topics in Competition Law & economicsThese two sessions will provide a summary and an authoritative outlook of the main developments in European Competition Law and Economics. Case law on European and national levels as well as relevant legislative developments and the new trends in competition law will be discussed with the participants.

Practical simulationsThe practical simulations will be based on the interaction with participants. The basics of each case will be presented (Dawn-raids, Court Hearings) and then the participants will have to simulate with the speaker and the team.

Cocktail-talksTop experts from private practice, academia, business community and Institutions will discuss informally on: i) the relationship between Public and Private Antitrust enforcement; ii) how Competition is seen from the Digital market; and iii) how Competition is seen from the business and finance community.
