The permittee and its C<lntrador(s) shall not remove, relocate, obstruct. willfully damage, make fast to, or Interfere with any aids to navigation defined.t 33 C.F.R. chapter I, subchapter C, part 66. 10. ShOllld the permittee determine the work requIres the placement and useof private aids to navigation in navigable waters of the U.s .. the permittee >hall submit a reqU<!8t in writing to the Corps as well as the U.S. Coast Guard, Aido to Navigation office. The permittee is prohibited from establishing private aids to navigation in novigable waters of the U.s. until au:hori:ted to

do SO by the Corps and the USCG.

11. Upon notification to the USCG as specified in Special Condition 10, the permittee shall forward a C<lpy of the notification to theCoast Guard Captain of the Port (Corp)' The Corp may modify the deployment 01 marine ronstructionequipm .... t or mooringsystems to safeguard navigation during project construction. The permittee shall direct questions ronceming lighting, equipm .... t plaC'ement, and mooring to the appropriate Can>.

12 Within 30 calendar days of completion of the project .uthorized by this permit. the pennittee >han conduct a post-project survey indicating changes to structures and other features in navigable waters. The permittt!<! shall forward a copy of the survey to the Corps

13. The permitie<.' understands and agrees th.t, if futu~ operations by the United Sbtes , rC<juire the structu~ Or work he~in authorized, or if, in the opinion of the Secretary of the Army or his authorized "'Presentative, said structure or work shall cause unreasonable obstruction to the free navigation of the IUIvigable waters, the permittee will be ""lulled. upon due notice from the Co'1'" of Engmecrs, to remove, Moc.te, or alter the stru<:tu.ral work Or obstruCtiOIlS caused thereby, without exp<'TIse to the United States. 15. Dredging authorized fn this permit shall be limiled to the areoS defined in I'ort of Los Angeles Drawings 1-2778 D-OO to 1-2778 D-17. No more than 102,OOOcubk yards ofdr«lged mat<:rial is authorized for dredging withm appro~imately 8 acres 01 Watchorn Basm byihe permittee (this number includes allowance for a maximum 012 feet of over-dredge depth). Dredging docs not include the excavation of upland material or land cuts 10 create approximately 4.5 acres of additional waters of the US in the project area. No dredging is authorized m any other location under this permit.

16. For dredging under this permit, the ma~imum dredging design depth <also known as the project d~pth or grade) shall be - 15 fe<>1 MLLW, with a m",imum allowable over-<lredg~depth of - 2 feel below the design grade. The only exception to this limit i.th~ dredging to -35 MLLW in the vicinity 01 the Confined Dil;JXlSal F<>eility rock dike perimeter needed to address geotechnical.lability at thi. particular location. No dredging shall OCl"Ur deeper than _2 leet below the design grade or ()IJtsid~ the project boundaries.

17. The permitie<.' Is prohibited from disposing 01 any of the dredged rna"'rial in waters of the U.S., except within the Confined Disposal hcility to becreated in the approximately 2.1-.ae northeast triangu1ar portion of the Watchorn Basin. Disposal of dredged material in this ca.., would include side<:asting or otherwise redistributing dredgedJeJ<Cavated material in waters of the US.

18. At lust 15 c.ale!1dar days before initiation of any dredging operations authorized by this pennit, the permitte<: shall send a dredging and disposal operations plan to the Corps and LARWQCB, with the following inlormotion:

A) A list 01 the names, addresses. and telephone numbers of the permittee's project mano.ger, the contractor's project manager, the dredging operations inspector, the disposal operations inspedOl". and the captain of each tug boat, hopper/clam-shell dredge, Or other form of vehicle used to transport dredged material 10 the designated dlsposalsile . 21. The permittee shall ensure that the captain of any dredge, til&- Or other v-.:I used in the dredging.. tr1InSier, o. dJspos.aI operlilions, is a II~ operator under USCG regul.o.tions and lollows the Inland and Ocean Rules of Navigation or the USCG Vessel Traffic Control Servi<e. All such v_Is, dredS .... or disposal barges or scows, shall have the proper day shapes, operating marine band radio, and other appropriate navig.tional.ids.

23. Upon noques~ the permittee and itsmntractor(s) shall allow inspectors from the Corps, US. Environmental Prot...:tion Agency (USEPA), LARWQCB, and/or the USCG to inspect 0.11 phases of the dredging.. transfer, and disposal operations.

24. Upon reques~ the permittee and its contractor(s) retained taperform work authorized by the permit or to manitor <:ompliance with this permit shall make available to inspectors from tile Corps, USEPA, LARWQCB, and/or the USCG tile following: dredging and disposal operations inspectors' logs, the vessel track plots and all disposal v_I logs or records. any analyses af the characteristics of drroged material, or my other documents related to dredging and disposal operations.

25. If a violation of any pcrmitcondition occurs, the violation shall ~ rf'ported by th .. permittee to the Corps within twenty_four (24) hours. If the permittee retains any conlractors to perform any activity autllorized by this permit. Ihe permittee shall instruct all such contractors that notice of any violations muSI be reported to the permiltee immediately.

26. When u&ing a transferor disposal barge at scow, no water shall be allowed to flow over Ihe sides. The lIN .. 1 that a disposal barge or scow can be filled shall not exoeed tile load line to prevenl any dredged material or water from spilling Over the sides 31 the dredging site. 27. The permittee shall use an dectronic positioning system to navigate al the dredging sile. The electroniC positioning system shIll have a minimum m:uracy and preci5ion oj +1- 10 feet (3 melers). If the electronic positioning .ystem fail. or navigation problems are detected, all dredging operations shall cease until the failure or navigation problem. are corrected. Any n avigation proble"," and corrective measures shail be describ<!d in the posl-dredging completion rf'potl per Special Condition 30.

28. The permiltee shall impl<'lllentadequate measures 10 ensure water does not runoff and return to the Watchorn Basin/Los Angeles Harbor from the approximately 3.7 acre temporary stnckpile/stQrag<;: area for dredged material that will be established in the Cabrillo Way Marina project area.
