    AN ORDINANCE REQUIRING THE HOISTING OF THE PROVINCIAL BANNER SIMULTANEOUSLY WITH THE SINGING OF THE VIZCAYA HYMN EVERY FLAG RAISING CEREMONY AND ALL OTHER PUBLIC UNDERTAKINGS OF THE PROVINCIAL GOVERNMENT IMMEDIATELY AFTER THE SINGING OF THE NATIONAL ANTHEM

    WHEREAS, flags and banners have been used for thousands of years and signify different things to various people. Still, the main reason that flags and banners are displayed is that they denote entities, including a particular country, state, business, leader, community or organization. They are visual symbols used for recognition. In addition, individual flags are a symbol of pride and respect for the ideals that the particular flag stands for;

    WHEREAS, the singing of the Vizcaya Hymn in all public functions in the Local Governments ofNueva Vizcaya as mandated by Ordinance No. 2012-081 has prompted th idea of having similar legislation to require the hoisting of the Provincial Banner to instil in the minds of every Novo Vizcayanos the symbolism and ideals that it represents;

    WHEREAS, Republic Act No. 8491 otherwise known as the Flag and Heraldic Code of the Philippines provides for the mandatory hoisting and display of the National Flag, thus the same jurisprudence applies; ~

    NOW, THEREFORE, on motion of Hon. Johnny B. Liban, unanimously seconded,-

    BE IT ORDAINED BY THE SANGGUNIANG PANLALA WIGAN IN SESSION ASSEMBLED THAT:

    SECTION 1. Short Title - This Ordinance shall be known as the "Banner Hoisting Ordinance ofthe Province ofNueva Vizcaya."

    SECTION 2. Declaration of Policy- Reverence and respect shall at all times be accorded the Provincial Banner and the Vizcaya Hymn which embody the ideals and traditions of Novo Vizcayanos and which express the principles of sovereignty and solidarity.

    SECTION 3. Definition of Terms - Whenever used in this Ordinance, the term:

    a. "Banner" shall mean the Nueva Vizcaya Provincial Banner bearing the Official Seal of the Province (refer to Annex A).

    b. "Fly" shall mean the part of the banner outside the hoist or length.

    c. "Pole" shall mean a long, piece of wood or metal straight and slightly tapered at the top used as a support for the banner with a height lower than the National Flag pole.

    d. "Hoist" shall mean the part of the banner nearest the staff or the canvass to which the halyard is attached.

    e. "Vizcaya Hymn" shall mean the Nueva Vizcaya Hymn in Iluko Language embodied in Ordinance No. 2012-081 (refer to Annex B) .

    SECTION 4. Design and Specification of the Banner. The banner of the Province shall be green (upper side) and yellow (lower side) with the embroidered Provincial Seal at the center. It has a length of 162 em and width of93 em.

    SECTION 5. Hoisting and Display of the Banner. Hoisting of the Provincial Banner in the Provincial Government shall be simultaneous with the singing of the Vizcaya Hymn, immediately after the singing of the national Anthem and raising of the National Flag.

    a. The banner, if flown from a pole, shall be positioned at the right side (left of the observer) of the Philippine Flag with lower elevation.

    b . . The banner shall be raised during flag raising ceremonies simultaneously wit the playing or singing of the Vizcaya Hymn and lowered at sunset. It shall on the mast at the start of official' office hours shall remain flying throughout the day.

    c. In public events to be held indoor the banner shall be displayed on conspicuou or elevated space in front of the audience.

    SECTiqN 6. Half-Mast - The banner shall be flown at half-mast as a sign of mourning on all buildings and places where it is displayed, as provided for in this Ordinance, on the day of official announcement of the death until interment of any of the following officials and prominent personalities:

    a. The Congressman/Governor/ Vice Governor/Member/s of the Sangguniang Panlalawigan or former Congressman/GovernorNice Governor/Member/s of the Sangguniang Panlalawigan.

    SECTION 7. The banner shall be displayed in every provincial occasion like Ammungan Festival and other similar occasions. Provided, that they observe flag-raising ceremonies in accordance with Republic Act No. 8491 or the Flag and Heraldic Code of the Philippines, at the opposite side of the National Flag.

    SECTION 8. The Office ofthe Governor shall include in their annual budget the necessary outlay for the purchase of the provincial banner.

    SECTION 9. The Governor shall create a Committee that shall formulate the necessary rules and regulations to implement the provisions of this Ordinance within sixty ( 60) days after effectivity of this Ordinance.

    SECTION 10. Separability Clause. If for any reason or reasons, any part or provision of this ordinance is declared unconstitutional or invalid, other parts or provisions thereof which are not invalidated shall continue to be in force and with full effect.

    SECTION 11. Effectivity- This Ordinance shall be effective immediately upon satisfying the requirement stated under Section 59 of the Local Government Code of 1991.
