“Banking Company Officer” a senior officer stationed at the head office and nominated by a banking company to coordinate with the board for provision of any information and documents required by the board.

Question: We have received refund request of WHT Tax deducted U/S 231A, 236P & 151(1)(b). Customer claims that It is Government entity and has quoted section 80/D ITO,1979 (Attached). Please suggest, Is it a valid document for exemption OR Cantonment Board should be treated as Government entity & no exemption certificate will be required. In addition to that please tell us If non-resident person Invest in Govt. securities, Will WHT & Zakat be deducted or not?

Answer: 1.No specific exemption is available, ask them to provide exemption certificate. 2. Non-resident’s Pakistan source income is taxable, so tax shall be deducted.

Question: ABC account holder dies and account marked deceased. now his legal heirs produce the succession certificate from court. court order the bank to remit the fund in form of pay order. when we transferred the funds from deceased account to Pay order account, shall we laible to deduct the WHT u/s 236? if we deduct the tax then court order cant be obey as tax deducted reduces the amount from total ordered amount.

Answer: Section 236P shall apply if the deceased is non-filer as per FBR records otherwise not.
