    I Robert Benson, o Hereby Declare under penalty of perjurythat the following averments of fact are t rue and correct , to wit:

    1. I am over the age of 21, and can at tes t to the statementscontained herei.n, a l l of which are made upon personal knowledgeand in support of Howard Lee White, et a l . v. David Hanke, et a l .to which I am a party.

    2. Declarant, being African-American was subjected to invidiousdiscrimination by Richard Gammick, John Malone, Michael Speechio,John P. Calvert , Steven R. Kosach, Judge and other officials ofWashoe County in the following respects:

    a. On January 4, 2004, I was charged with robbery with theuse of a deadly weapon and kidnapping in the f i r s t degree. On orabout December 21, 2004, I was found guilty of said charges andsentenced by Judge Kosach to serve two consecutive prison termsof thir ty f ive 35) to one hundred f i f ty six 156) months for therobbery and two consecutive prison terms of f ive 5) to f if teen15) years for the kidnapping, in case number CR04-163A-B. Order

    of Affirmance f i led October 4, 2005, in Supreme Court of Nevadadocket number 44739.

    b. Declarant will be el ig ible for parole af ter servingapproximately si.xteen 16) years.

    c. On c,r about January 21, 2004, John Malone, Deputy PublicDefender and Karl Hall, Assistant Distr ict Attorney, in concertdenied my r ight to tes t i fy before the grand jury. Mr. Hall had

    d. Declarant suffered invidious discrimination on a numberof levels . for example, Judge Kosach showed a complete disregardfor my r ights . He emphasized this by saying the following: Freeattorneys, this is the way things are. Go down and hire JohnieCochran r ight now and t e l l him to come here and try the case onApril 5th. nd I ' l l bet y u he says, I can ' t do i t " These commentscould be interpreted to mean Kosach had an impermissible bias andprejudice against me and African-American people. Arguably theseremarks amounted to a racial s lur . In fact , Judge Kosach wasdisrespecting and mocking me because I was unable to hire a AfricanAmerican defense attorney. Kosach challenged me by bet t ing meabout what Mr. Cochran would do in this si tuat ion.

    e. On or about July 30, 2004 in the parking lot of thenorthwest Reno Wal-Mart Richard Martin forced his wife into hiscar and attempted to ki l l her throws her in the car. Thewhole time he's saying to her ' I 'm going to ki l l you.' and 'Do youwant to die? ' " The Washoe County Distr ict Attorney charged himwith second-degree kidnapping and attempted murder. Judge Kosachsentenced him t() a maximum of ten (10) years on the second-degreekidnapping and f if teen (15) years on the attempted murder.
