The Honorable Carteret County Board of Commissioners sat in regular session on January 12, 2015 at 6:00p. m. Present were: Chairman Robin Comer, Commissioners Elaine Crittenton, Jimmy Farrington, Terry,

r Frank, Mark Mansfield, Jonathan Robinson and Bill Smith.

I. MEETING CALLED TO ORDER

Chairman Comer called the meeting to order. All present recited the Pledge of Allegiance. Carl Tilghman

delivered the invocation.

II. CONFLICT OF INTEREST/CELL PHONE STATEMENT

Chairman Corner called for any conflicts of interest by the Board and asked that all cell phones be turned off.There were no conflicts of interest.

III. ADOPTION OF AGENDA

Commissioner Frank asked to add Approval to Appropriate Reserve Funds for Morehead City: Mitchell

Village Fire District to Purchase a New Tanker to the Consent Items. He had provided a copy of the requestto each Commissioner that detailed the request from Morehead City to utilize $208, 000 from reserves of the

Mitchell Village-Crab Point Rural Fire District to acquire and equip a new tanker. This tanker, Commissioner

Frank informed, would replace a 33 year-old tanker with substantial repair needs and would assist the

Morehead City Fire Department as they worked toward lowering the insurance rating in their rural districts.He also stated the Fire and EMS Commission had approved this during the budget process. A budget

amendment had been prepared and was attached as a part of the additional agenda item for consideration.

Motion — On a motion by Commissioner Smith, seconded by Commissioner Crittenton, the agenda was

adopted with the addition of Consent Item 7 Approval to Appropriated Reserve Funds for Morehead City:Mitchell Village Fire District to Purchase a New Tanker and Approval of a $ 208, 000 Budget Amendment.

Motion carried unanimously.

3. Approval to Accept an Emergency Management's Hurricane Exercise Grant and $ 8, 000 Budget °

Amendment

In a memo from John Ford, Emergency Services Director it was explained that the North Carolina Division ofEmergency Management had approved the proposed Hurricane Exercise Memorandum of UnderstandingGrant for Carteret County.

The grant award for this exercise was $ 8, 000. This was a 100% grant with no required matching fundsrequested. The funding for this exercise was currently projected to be executed in our 2014- 2015 fiscalyear.

Emergency Services would exercise on various objectives to include our Emergency Support Functions insupport of the Emergency Operations Plan, use of our crisis management tool (WebEOC), situational

assessment and resource management.

4. Approval of Prescription Drug Detective Grant Application Renewal

In a memo from Sheriff Asa Buck, he requested approval to submit a grant application to the Governor' sCrime Commission ( GCC) regarding a grant that would assist and continue efforts in combating thediversion, distribution and abuse of prescription medication in Carteret County. The grant would continue tofund the salary of an investigator who was assigned to investigate all aspects of prescription drug diversionin Carteret County and provide education and prevention training. The memo expressed their goal to worktowards a reduction in the diversion, misuse and abuse of prescription medication and overdose and death.

Additionally, the memo provided the following: in the ten year period of 2002-2011 Carteret County saw thedeaths of 115 people due to unintentional poisoning related to prescription medication. In the year 2011, 18

people died; which was up from 6 deaths in the year 2002. The unintentional poisoning death rate ( deathsper 100, 000 in population) for Carteret County ( 18. 2) is almost twice the state average ( 9. 8) for unintentionalpoisoning deaths.

Roughly half of NC cases of unintentional death involve people who did not have a prescription for themedication which caused their deaths. This statistic alone proves that prescription drug diversion is rampant.

The Carteret County Sheriff's Office was successfully awarded funding for this full- time position by the GCCfor the fiscal years of 2012- 13, 2013- 14, and 2014- 15. The Carteret County Sheriff's Office requested toapply for a fourth and fifth year of this grant in order to continue funding this position. The grant required a25% local match of $ 15, 061. 81 for year 1 and $ 15, 066. 81 for year 2. The federal funding for year 1 of thisproject was $45, 185.43 and $ 45, 200.43 for year 2. In total, the local match for both years would be

30, 128.62 and the federal funding source would equal $ 90, 385. 86. The information provided for year 2 was

subject to change due to the cost of benefits associated with the position rising with no guarantee forapproval.

This was a competitive grant process with no guarantee of award. For law enforcement agencies to be

considered for continued funding, they must re- apply annually and show distinct progress in the

investigation, confiscation and seizure of illegal prescription narcotics, as well as successful prosecutions.

Sheriff Buck emphasized in the memo a strict zero tolerance drug policy; including the diversion ofprescription drugs. Approximately % of all Sheriff's Office drug cases involved the illegal sell and delivery ofprescription medication.

120Due to the size of the grant application, it was incorporated in the minutes by reference. A copy would be

maintained in the Sheriff's Department and in the County Manager's Office.

5. Approval of Contract with CureMD for Electrical Medical Records Software at the HealthDepartment

Details of the request and subsequent approval of the Contract with CureMD for Electrical Medical RecordsSoftware at the Health Department were provided by David Atkinson, Human Services Director through amemo dated December 19, 2014. Those details included:

A key provision of the American Recovery and Reinvestment Act of 2009 ( ARRA) require that all public andprivate healthcare providers ( including local public health agencies) must have adopted and demonstrated ameaningful use" of electronic health records ( EHR) in order to maintain their existing Medicaid and

Medicare reimbursement levels. This requirement was to become effective in 2015. Failure to comply may

result in a decrease in federal reimbursements. The goal of this legislation revolved around the

implementation and use of technology to improve client care and increase patient safety. Health care

providers must have had a minimum of 90- days active use of their EHR system prior to the end of 2015 inorder to avoid the initial 1% reimbursement penalty.

Essentially, two vendors, Patagonia and CureMD had provided EHR applications in approximately 70counties across the state, with the remaining counties either using the state' s Health Information SystemHIS) or some other self-developed system. Those counties utilizing the state system were in much the

same situation as Carteret County, looking for some solution in order to avoid the reduction in revenue dueto a penalty. County health care staff had traveled to surrounding counties to view the two products beingdemonstrated, and both vendors had visited our health department to conduct demos for other staff as wellas County IT. Staff determined CureMD was more user friendly and allowed them to move betweenapplications and patient records more fluidly.

The CureMD application, like Patagonia, is web- based and would require only our internet to access thesystem. Patagonia has special requirements around the web browser which potentially could createproblems for County IT, which was another factor in selecting CureMD. Data storage, security and softwareenhancements were included in the monthly fee.

The existing state system being used by Carteret County ( HIS) did not currently meet the federalrequirements and it was uncertain if the state would be able to meet those requirements by the end of 2015.

The ARRA requirements also came with incentive funds that would cover most, if not all of the cost forinstallation and annual fees for at least two years. These " Meaningful Use" funds would only be available tothe county if we are able to implement the system and had 90 days of active use by the end of the year. For

Carteret County, the costs for set-up, data migration, conversion and validation (of existing data) and

training was $15, 399. Once the county was set up and fully operational, there was a $ 1, 070 monthly

subscription fee which would cover data storage and software modifications and updates.

There was funding for EHR procurement in the current budget.

MENTS-TO SR 1300 ( MERRI

BY THE N. C. DEPARTMENT OF TRANSPORTATION

WHEREAS, SR 1300 ( Merrimon Road) from SR 1163 ( Laurel Road) to US 70 is approximately 2.44miles in length; and

WHEREAS, the North Carolina Department of Transportation proposes to widen and strengthen thisarea of roadway in an effort to improve safety and create a more drivable surface.

NOW, THEREFORE BE IT RESOLVED, that the Carteret County Board of Commissioners doeshereby support the proposed improvements to SR 1300 ( Merrimon Road) as planned by the North CarolinaDepartment of Transportation.

7. Approval to Appropriated Reserve Funds for Morehead City: Mitchell Village Fire District to

Purchase a New Tanker

In a memo from Jamie Fulk, Fire/ EMS Chief and David Whitlow, Morehead City Manager facts regarding theconditions of the current tanker were provided as:

1982 Ford/ Pierce ( 33 years old)

Carries 2500 gallons of water

Pump will not pass pump test and was estimated to cost $ 15, 000- 20, 000 to repair.

In 2010 staff removed top of tanker and hired a welder to come in and repair the steel tank.Truck was currently leaking more than 300 gallons of water per day; and must be filled with water daily Iorder to be in a constant state of readiness.

MCFD was requesting $ 208, 000 from reserves by the County to purchase a new tanker to replace the 33year old vehicle. The general specs being considered were:

Commercial Chassis with seating for two1500- 1800 gallon water tank

Ability to quick dump water on three sides of the truck500 GPM, Power Take Off (PTO) PumpCompartments for storage

Drop Tank and an area for storageTruck would assist the department in improving its ISO rating — MCFD had requested an ISO re- grade,

which could lower the insurance rating in the rural district.Carteret County

V. PUBLIC COMMENT

Chairman Corner called for public comment. No one had signed up to speak.

VI. PRESENTATION BY McGLADREY & PULLEN ON THE FY 2013-14 COUNTY GOVERNMENTI" AUDIT

Mr. Gary Ridgeway of McGladrey and Pullen gave highlights from the Fiscal Year 2013-2014 Audit andstated that the Audit Report provided that the County had received an unmodified clean opinion. He made

reference to the management discussion letter which gave a detailed summary of the fiscal year. The

discussion letter had been prepared by the County Manager and Finance Officer. $ 51 million was the

balance — with $ 30 million unassigned in the General Fund, which represented a little over 42% of General

Fund Expenditures. Mr. Ridgeway indicated that the County was fiscally sound, with a $ 7. 1 million increase

in Fund Balance for the year. He made reference to page 37 of the audit, which gave a budget comparisonof last year (2013) compared to 2014. Compliance with state awards was also unmodified. There were no

findings to report and no internal control findings. The tax collection rate was between 96-99%.

On questions from the Board, Mr. Ridgeway further explained that the ratio to reserves was at 42% for

Carteret County. The Local Government Commission ( LGC) required 8% unassigned funds. This

percentage amount helped to support bond ratings for communities. Most coastal towns fell between 25-

36%.

Board members expressed gratitude to the Finance department and County staff for their dedication inmanaging County funds well. The unmodified clean opinion reflects that dedication.

Lastly, Mr. Ridgeway reviewed the formal communications ( report card) with the Board — in essence it

reported that the auditor had communicated with the Board and staff. It reflected that both entities worked

well together.

Due to the size of the Audit document, it was incorporated in the minutes by reference. A copy would bemaintained in the Finance Department and in the County Manager's Office.

VII. APPROVAL OF THE REDEMPTION FROM FORECLOSURE OF A PARCEL LOCATED AT 2800ARENDELL STREET IN MOREHEAD CITY

Carl Tilghman, Tax Assessor/Collector provided through his memo to the Board that 2800 Arendell Street inMorehead City ( Parcel 6376. 20. 82. 5029000) was sold at a county tax foreclosure sale pursuant to a civilaction filed in Carteret County Superior Court. The County was the only bidder and the sale was confirmedon November 14, 2014. The civil action was commenced against three parcels. During the course of thelitigation two of the parcels were redeemed by the tax payer and all taxes and cost were paid prior to finalsale and confirmation. The subject parcel was not redeemed and went on to sale and final confirmation.

However, prior to the final sale and unknown to county staffs, a Deed of Trust was recorded from DawcuttHospitality to the Law firm of Stubbs and Perdue securing an indebtedness of $ 150,000 on September 13,

2014. The sale was concluded without receiving notice of this intervening interest in the property. Staff had

since received a request from Stubbs and Perdue to redeem this parcel from foreclosure by payment of alltaxes and costs.

NCGS 105- 376 ( c) allowed the Board to approve the redemption of this property by payment of all taxes,costs and expenses associated with the foreclosure sale by the taxpayer or others with interest in theproperty even though the sale was complete.

Motion — On a motion by Commissioner Smith, seconded by Commissioner Farrington approval wasgranted that Stubbs and Perdue or their successors in interest be allowed to redeem tax parcel

6376.20. 82. 5029000 by payment in an amount equal to the total of all taxes due, plus expenses and costs ofthe foreclosures sale in the amount of$ 11, 268. 61. Motion carried unanimously.

VIII. APPOINTMENT OF THE NEW CLERK TO THE BOARD

Motion — On a motion by Commissioner Robinson, seconded by Commissioner Smith, Paula Webb wasappointed as the new Clerk to the Board. Mrs. Webb would begin employment with Carteret County onJanuary 26, 2015. Motion carried unanimously.

Motion - At the suggestion of Attorney Wheatly, Commissioner Farrington made a motion to appoint Mr.Overman as interim Clerk to the Board until the new Clerk was on board so that the signing of documentswas not delayed. The motion was seconded by Chairman Comer. Motion carried unanimously.

II Barbara Pagels was nominated by Commissioner Frank. Carl Spangler was nominated by CommissionerSmith. Both were unanimously appointed.

BEAUFORT—MOREHEAD AIRPORT AUTHORITYAppointment to the Beaufort-Morehead Airport Authority was tabled.

JUVENILE CRIME PREVENTION COUNCIL (JCPC)Commissioner Farrington nominated Vanessa Chazal to fill the " person Under 18" seat. He also nominated

Bernette Morris to fulfill the unexpired term of Chief Wrenn Johnson, who would be retiring her position. The

term would expire on 6/ 30/ 15. Both were unanimously appointed.

MARINE FISHERIES ADVISORY BOARDAppointment to the Marine Fisheries Advisory Board was tabled.

TOURISM DEVELOPMENT AUTHORITY (TDA)

Chairman Corner nominated Bobby Stanley to fill the Hospitality Association seat on the TourismDevelopment Authority. This unexpired term would expire on 12/ 31/ 16. The appointment was unanimous.

ZONING BOARD OF ADJUSTMENTCommissioner Farrington nominated Blake Beadle for re- appointment. The appointment was unanimous.

X. MANAGER' S REPORT

Mr. Overman reported that the Community Services Block Grant Program Application packet had beenreceived and provided to the Board for comment prior to submittal. The deadline to offer comment was

January 29th, 2015.

Chris Turner, Assistant County Manager/ Human Resources Director had recently conducted a supervisioninstitute workshop. Multiple department heads had attended and spoke highly of the presentations.

Mr. Overman announced he would be attending the Legislative Goals Meeting and the NC CountyCommissioners Meeting on Thursday and Friday.

County Offices would be closed on January 19th in observance of Martin Luther King Day.

The Board' s annual Strategic Planning Retreat was scheduled for January 29- 30, 2015 at the Trinity Centerin Pine Knoll Shores.

XI. COMMISSIONERS' COMMENTS

Commissioner Crittenton reminded everyone that flu season was upon us — be responsible. The season

would last another 6- 8 weeks. Upon a question about the flu, Commissioner Crittenton gave a brief

description of how the flu developed differently each year.

Commissioner Smith thanked Kristen Haworth for assisting with the meeting tonight in the absence of aClerk.

Commissioner Mansfield praised those who worked and promoted the Christmas parade and New Year'sevent.

Multiple Commissioners welcomed Paula Webb, the new Clerk to the Board scheduled to begin on January26th,

2015.

Multiple Commissioners thanked Dee Meshaw, Assistant County Manager/Finance Officer for her work onthe Audit and Chris Turner, Assistant County Manager/Human Resources Director for his work andpresentation with the supervision institute workshop.

Chairman Comer spoke about the insurance ratings for Carteret County and urged the Board to continue thefight to get the language changed at the state level. He thanked the staff for their hard work.
