AwAknMaulidf Mpshahama (herdnafter called çithe grievant''), was

employed by the raspondents as a P.S.V. driver, on 21st October,1971. He worked as such until 19th August, 1986, when he wassummarily disrnissed from tls services of the respondents fornegligently and carelessly ddvlng a bus, Ceet No. 46, downhillat an excessive speed along Wundanyi/ Dembwa Road, on 7thJune, 1986, and as a rçsult he caused an accident in which oneqassenger died anil the bus was extensively damaged. At thetlme of his dismissal, he had served the respondents for a periodof 13 years and his salary stood at KSh. 1 491 plus a house

# .! .allowance of KSh. 550 per month.The claimants took up the matter on behalf of the grievant

with the respondents but no nmicable settlement was reached.Consequently, the claimants reported a trade dispute to theMinister for Labour in accordance with section 4 of the TradeDisputes AG (Cap. 234), and on 11th February, 1987, E. A.Onmp of M ombasa Labour olco, was appointed to act as an

The daimants urged the court to uphold the ministry'sIindinqs and recommendation ; and, in addition, award thatthe grlevant .be paid his salary for the period he has been keptout' of employinent without a justisable cause. ln reply, therespondents heavily relied on their cllief engineer's accidentreport in this matter dated 1st July, 1986.The rcspondents pointed out that grior to this fnddent,

the grievant had been served with warnlng letters on 3rd July,1972, for speedin! on 29th June, 1972, on 25th October, 1977,fbr causing an accldent through careless driving on 18th October.1977, and on 17th July, 1979, for hitting a' stationary bus on8th July, 1979, and failure to report the accidcnt. In supportof their case, they told the court that in Traëc Case No. 585of 1987, before the resident magistrate's at Voi, which wasdetermined before the release of their chief engineer's rcport,the grievant was found guilty on the charge of causinq deathby dangerous driving.The respondents snally pleaded with the court to ;nd that

the grievant's summary dismissal was justised, and prayed it toreject the claimants' demand for his reinstatement and com.pensation.The facts relating to this case are undisputed. 'Fhe grievant

The griewant wasas summarlly dismissed on account of the accident and sub-sequcntly charged as aforestated with the oflknce of causingdeath by dangerous driving for which he was found guilty,convicted and placed on one year probation period. But theclaimants did not admit that the grievant was zn any way res-ponsible for causing the accident. They contended that theaccident happened unexpectedly because 'the brakes of the busfailed while moving downhill, and consequently it crashed.In our view and frsm the facts and the evidence on record
