THE Governor has, under sections 18 and 31 of “ The Excise Ordinance, No. 8 of 1912,” directed that in addition to the general conditions published by Excise Notification No. 186 of April 12,1929, the following shall be the special conditions for the grant of the privilege of selling arrack by retail within any local area :—1. The privilege w ill be exclusive, subject to the right of an y holder of a foreign liquor licence in the same area , to whom the E xcise Commissioner m ay have g iven special perm ission in th at behalf, to sell on h is licensed prem ises arrack bought exclusively from the grantee of the privilege.

7 - D elive ry o f T en ders .—E very tender shall be p laced in a sealed envelope clearly marked in the top le ft hand corner w ith the nam e of

the tavern in respect of w hich the tender is m ade and its num ber on the lis t of sanctioned taverns. The envelope shall be (a) deposited in the K achcheri Tender B ox , or (b) handed to the Government A gent or to the A ssistant Govern­m ent A gent or to h is Office A ssistant, or (c) sen t b y registered p ost so as to reach the Kachcheri before the tim e fixed for closing the tenders.

8. (1) P o w er o f R ejection o f T en der .—The Governm ent A gent m a y in h is discretion reject an y or all of the tenders received ; and in the ev en t of

his so rejecting all tenders, he m a y p u t up the privilege for sale by auction.(2) R estr ic tio n o f B id d in g a t A u c tio n .—

A t such auction no person shall be allow ed to b id u n less he shall have either—(а) subm itted a tender accom panied b y the Treasury or Kachcheri receipt prescribed in the foregoing condition

6, w hether such tender be for the particular privilege to be auctioned or for any other privilege ; or(б) produced the receipt jsrescribcd in the foregoing condition 6 notw ithstanding h is failure to subm it a tender

for the particular privilege to be auctioned or for any other privilege.Provided th at no person who is d u ly declared the purchaser of any privilege, w hether b y way- of tender or of auction shall use or be perm itted to vise the sam e receipt for the purpose of a tender or a b id for an y other privilege, u n til he has com pleted in respect of the privilege already granted to h im the step s prescribed hereinafter in condition 9 (1) (a)

(3) P o w er o f R ejec tion o f B id .—Subject to th e proviso th a t the Governm ent A gen t shall have discretion to reject any or all of the bids, the

privilege shall be granted to the h ighest bidder a t such auction.(4) P o w er to gran t P riv ileg e to A p p ro v e d P erso n .—

In the even t of the rejection o f a ll b ids as aforesaid, the privilege m a y b e granted to an y person who is approved by the Governm ent A gent and w ho agrees to p ay b y w ay of rent such am ounts as th e Government A gent m ay fix.

9. (1) (a) S ecu rity D e p o s it.—The grantee shall, im m ediately on being granted the privilege, sign these conditions and pay to the Government

A gent as a security deposit a sum eq u ivalen t to tw o m on th s’ rent of the privilege.(b) S ig n in g o f B o n d .-—

The grantee shall also w ith in fourteen days of the sale of the privilege enter in to a bond w ith the Government A gent for the fu ll am ount for w hich he has purchased i t and he shall specially hypothecate b y such bond the said security deposit.

(c) Consequences of Breach of C on dition s o f B ond.—, The said security deposit shall b e liable to b e confiscated by th e Governm ent A gent for breach of any of these

conditions or for non-payment of an y instalm ent and such confiscation shall be in addition to an y other penalty prescribed by these conditions for such breach.

(2) B a n k in g of S ecu rity D eposit.—Security m oney so paid w ill be deposited in a bank only on the grantee’s application and only at liis risk, and

when such deposit is m ade no w ithdraw al w ill b e allowed till th e date of m aturity.(3) W arran t o f A tto rn ey to Confess J u d g m en t.—

If the highest b id or tender under condition 3 exceeds th e sum of R s. 2,000, th e grantee shall a t th e tim e of the execution of th e bond as aforesaid execute, if so required b y th e Governm ent A gent, a power of attorney in the form sanctioned by law , to confess judgm ent in an y action w hich m ay h e in stitu ted against h im for th e recovery of any m onoys due in respect o f th e privilege, and shall also furnish to th e Governm ent A gent w ithin fifteen days of the date of th e execution of such pow er of a ttorney a duly certified copy' thereof for filing in th e D istrict Court under section 32 of the C ivil Procedure Code.

(4) R egistered P o sta l A d d ress .—The grantee shall, on signing these conditions, elect and sign ify under his hand a P ost Office or postal address to

which all notices and processes w hatever in connection w ith th e privilege m ay be addressed under registered cover • and all such notices or processes, so addressed to .such p ost office or to such postal address, and posted in due course, shall be deem ed to h a v e been du ly served and be as effectual for all purposes as if th ey had been served upon th e grantee in person upon th e day on w hich an y such notice or process w as so posted.

10. F a ilu re to com plete P u rch ase o f P riv ileg e .—I f any tenderer or bidder, on being declared to b e th e purchaser of th e privilege, declines or fails to sign these

conditions of sale or faffs to furnish th e security prescribed in th e foregoing condition 9 (1) (a) when called upon to do so. th e deposit m ade under th e foregoing condition 6 w ill be declared fo ife ited and th e defaulter will render him self liable to have h is n aaA en tered in th e list of defaulters in respect of all arrack or tod d y rents. Subject to th is excep­tion th e deposits ofilplXcndercrs or bidders w ill be returned after th e conditions of sale have been signed and th e aforesaid security g ivtft b y th e successful tenderer or bidder.

11. (1) P a y m e n t o f Rent*—T he grantee shall p ay th e purchase m oney or rent to th e Governm ent A gent in tw elve equal m onthly instal­

m ents.(2) D u e da te o f In sta lm en t.—

T he first instalm ent of th e rent shall be deemed to b e due and payable on Septem ber 30, 1934, and succeeding «*" instalm ents Email be deem ed to b e severally due and payable on th e last day of each succeeding month.

(3) In terest.—Interested, th e rate of 9 per centum per annum shall be payable in respect of all arrears.

12. (1) C ost P r ic e a n d D u ty .—

(2) E x tra C ost P r ic e fo r S p e c ia l A rra ck .—•In respect of “ Special M atured P o t Still Arrack ” a t 27 degrees underproof, sold in scaled bottles, th e grantee

shall p ay to th e G overnm ent A gent in addition to th e rent, such duty, cost price, and additional cost price as are prescribed for sealed b ottles in Schedule A , and extra additional cost price at th e rate of R e. 1 per gallon.

13. (1) (a) C an ce lla tio n o f L icence a n d P r iv ile g e fo r N o n -p a ym en t o f R en t, & c .-—■If a n y in stalm ent or part of an y instalm ent of the purchase m oney, or rent or an y duty, fee, cost price, or other

sum due to th e Crown from th e grantee remains unpaid after th e sam e shall have becom e duo and payable, th e Govern­m ent A gen t shall h ave pow er, after fourteen days’ notice to th e grantee of h is intention to do so, w ithout further process of law , to cancel th e licence or licences issued to th e grantee and to resell th e privilege at th e risk of th e grantee.

(6) N o tic e o f C a n cella tio n .—•Such n otice m ay b e served personally on the grantee or addressed to th e post office elected under th e foregoing

condition 9 (4) as th e Governm ent A gent thinks fit.(2) R e-g ra n t o f P r iv ile g e after Cancellation.-—

In th e event of th e cancellation of a licence, th e Government Agent shall have power to grant th e privilege to an y person approved by him for any period intervening betw een such cancellation and th e resale of the privilege, and for th is purpose m ay issue to such approved person a tem porary licence upon such term s as he m ay th ink fit.

(3) N o R e m iss io n o f R e n t.—N o rem ission of the rent payable in respect of the privilege w ill be granted on any ploa of the grantee’s having

over-estim ated th e value of any tavern or on any other ground.(4) N o C om pen sa tion fo r L osses .—

The grantee shall not have or m ake any claim to any reduction, or to the remission, of any sum due and owing b y him to th e Crown by reason of any loss alleged to have been sustained by him , whether on account of any closing of th e tavern or taverns during the passage of troops or during the encampm ent of troops in the v icin ity of the tavern or taverns or during the holding of any poll, or through any other cause whatsoever.

(5) P o w er o f R e fu sa l to issu e A rra ck ti l l A rrea rs p a id .—The Governm ent A gent shall have power, at h is discretion, to refuse to issue any order on the warehouse for

the supply o f arrack to the grantee till all arrears of rent in respect o f the privilogo have been settled w ith interest.14. (1 ) P a y m e n ts not V a lid w ithou t K achcheri R eceip t.—

N o p a y m e n t o f a n y stun du e b y th e grantee to the Crown shall be deemed to have been du ly m ade, unless the grantee produces a Kachcheri receipt in respect thereof.

(2) M o n ey le ft w ith Officers not reckoned as M o n ey p a id .—.N o m oney w hich, for his own convenience, the grantee m ay think fit to leave in the hands of any Shroff or an y

other officer o f any Kachcheri shall be deem ed to be m oney paid under this contract.15. (1) O pen in g of T avern on due date, a n d A p p ro v a l o f S ite .—

(а) The grantee shall open tho tavern or taverns on the day on w hich the privilege comm ences to run.(б) The Governm ent A gent shall not be bound to find a site for any tavern in the even t o f the grantee not being

able to procure a site.(c) The grantee shall not open a tavern on an y site otherwise than w ith the approval o f the Government A gent,

such approval being obtained from the Governm ent A gent at lea st 14 days before the privilege com m ences to run.(2) O b ta in in g o f L icences fo r S a le o f A rra ck .—

Tho grantee shall, n o t less than five days before the dato on w hich the privilege com m ences to run, obtain from the G overnm ent A gent a licence or licences for the sale b y retail o f arrack a t the tavern or taverns w ithin th e area covered b y th is privilege.

16. T a k in g over o f B a lan ce A rra ck b y In co m in g G rantee b y M u tu a l A greem en t.—•The grantee shall take over from the outgoing grantee and pay to him an am ount, w hich m ay be agreed on, in

respect o f th e cost o f—(а) th e balance o f arrack rem aining in a tavern, after th e closing hour o f th e date o f expiry o f the privilege o f

th e outgoing grantee, and(б) an y b ottled arrack, and(c) transport, w astage, and other m iscellaneous charges.

17. I n d efa u lt o f A greem en t, outgoing G rantee to deliver B a lan ce A rra ck a t nearest W arehouse__(1) W here th e incom ing and ou tgoing grantees-cannot agree w ith regard to the sum to be paid as aforesaid

tile outgoing grantee shall forthw ith rem ove the balance o f arrack o f a strength not below 29 degrees underproof on a perm it, to th e nearest E xcise W arehouse, and deliver i t to the E xcise W arehouse Officer in charge thereof and obtain a receipt.

(2) The outgoing grantee shall present such receipt to the E xcise Commissioner who shall pay to such grantee the value o f the arrack as delivered a t the rates o f du ty , cost price, and extra cost o f bottled arrack, i f any, a t w hich such grantee purchased such arrack.

(3) I f the sum payable as du ty and cost price by the incom ing grantee a t the tim e the arrack is so taken over b y him , i s higher than the sum actu ally paid for the said arrack by the outgoing grantee, the incom ing grantee shall, w ithin fourteen days o f the com m encem ent o f h is privilege, pay the difference to the nearest Kachcheri.

18. C onviction o f Grantee or A g en ts__If the grantee, or any agent, or person em ployed by the grantee is during the continuance o f the privilege,

convicted o f an offence under Chapter X III . o f the Ceylon Penal Code, the Governm ent A gent m ay, take any o f the steps prescribed by section 30 o f the Ordinance.

19. Grantee responsib le fo r A g en t’s A c ts .—The grantee shall be responsible for a ll acts o f h is agents and em ployees in relation to the privilege.

20. P ro h ib itio n o f “ O ff S a le s .”—The grantee of the taverns specified in schedule B hereto shall n o t se ll any arrack for removal from such tavern.

21. Grantee to have no interests in T o d d y a n d F oreign L iq u o r S a les .—The grantee shall have no concern or interest direct or indirect (a) in the sa le o f ferm ented toddy, or (6) in the

purchase o f an y privilege o f selling toddy, or (c) in the sale o f foreign liquor w ith in the area to w hich the privilege o f selling arrack relates.

22. (1) P u rch a se o f A rra ck fro m W arehouse, M in im u m Q u a n tity .—The grantee shall purchase arrack on ly from the Governm ent W arehouse, specified in schedule C hereto in

respect o f th e district w ithin which the tavern is situated , and in quantities n ot less than those prescribed in the said schedule.

(2) N o issu e on H o lid a ys a n d S u n d a y s .—N o arrack w ill be issued from a warehouse on. Sundays or Public H olidays w ith ou t the prior approval o f the

A ssistant Commissioner o f E xcise.(3) T ra n sp o rt P a sse s .—

W here arrack is transported by road from a warehouse to a tavern, the W arehouse Officer w ill n o t issue a trans­port pass available for use a t a later hour than 6 .3 0 p .m . on the d ate o f issue.

23. Such A rra c k a s ava ilab le to be accepted .—The grantee shall accept such arrack as is availab le a t the Government Warehouse, whether in bulk or in

bottles.24. P ro p o rtio n o f S ea led B ottles to B u lk .—

The grantee shall draw such proportion o f each consignm ent drawn by him as the Excise Commissioner or his D eputy or A ssistant m ay require in sealed bottles o f each description.

25. N o C o m p en sa tio n fo r fa i lu r e to deliver f u l l q u a n ti ty__The grantee shall have-no claim against the Crown for com pensation (beyond a proportionate refund o f the

am ount paid) in respect o f an y failure by the Crown for an y reason w hatsoever to delivor the fu ll quantity for w hich the grantee has m ade paym ent a t the Kachcheri as aforosaid.

26. N o n -tra n s fe ra b ility o f R e n t .—The privilege shall n ot be transferable otherwise than w ith the sanction of the Governor first had and obtained.

27. (1) G rantee to account fo r A r r a c k , W astage A llo w a n ce .—■The grantee shall account for a ll arrack purchased b y him from tim e to tim e. The allowance made on account

of w astage w ill in no circum stances exceed tw o per centum of the to ta l quantity purchased, since the last date of stock-taking.

(2) W astage to be w ritten o ff m o n th ly .—The to ta l w astage at every tavern shall be written off a t the end of each m onth and the actual balance in hand

of each kind of arrack brought forward on the 1st of the month following.28. T e rm in a tio n of P riv ile g e .—

The rent shall be determ ined by (a) the expiry of the term for which the privilege shall have been, granted ;(b ) the death of the grantee ; or (c) a breach of any of the conditions governing it .

29. L im i t o f S a le a n d T ra n sp o r t.-—The lim it of sale by retail w ith respect to the w hole Island and as regards purchasers generally shall be

one-third of an imperial gallon, and no arrack in excess of th a t quantity m ay be transported except under the pass prescribed for that purpose by the Ordinance.

30. Grantee bound to s u p p ly A rra c k fo r sale at F . L . p rem ise s ; A llo ca tio n o f such p re m ise s to grantee.—(1) The grantee of every tavern specified in schedule D hereto shall have the exclusive right of supplying,

and shall be bound to supply for sale in each of the foreign liquor prem ises specified in the corresponding item of that schedule, arrack in bulk, in quantities not less than those prescribed from tim e to tim e by the E xcise Commissioner, on tender of cash and production of a valid perm it issued b y the Superintendent of E xcise, in th at behalf.

(2) Where the grantee so supplies arrack to any foreign liquor prem ises, h e w ill, for the protection of h is exclusive privilege, have the supervisory rights provided for in the conditions of the licence issued to such foreign liquor premises.

or capsule of the E xcise D epartm ent.The licensee shall not keep in a tavern an y sealed b o ttles other than those bearing the seal or capsule of the

E xcise D epartm ent. H e shall p u t aside an y b ottle bearing a dam aged or obliterated seal or capsule and shall show it to th e Inspecting Officer on h is n ex t v is it , and an y such b ottle shall, if so ordered by the A ssistant Commissioner of E xcise for the division, he exchanged for a fresh bottle.

used in bottling arrack shall be k ep t in the tavern.

4. Stren g th o f A rra ck : P ro h ib itio n a g a in s t A d u ltera tio n .—A ll arrack exposed or kept for sale in a tavern shall be of a strength not below 29 degrees underproof according

to S ykes’s hydrom eter test. N o w ater, and no colouring, flavouring or other m atter w hatsoever shall be added thereto.

5. M in im u m S to ck .—The licensee shall a t all tim es keep a t h is tavern such m inim um quantity of arrack in bulk as the E xcise

Com m issioner or h is D ep u ty or A ssistan t m ay from tim e to tim e direct.

6. C a p a c ity o f S torage V essels to be m a rk ed .—N o barrel, cask, keg, v a t, or other receptacle shall be used for the storage or transport of arrack, unless it bears

clearly m arked on it its correct capacity in term s of gallons.

7. S p e c ia l M ea su rin g T a p s , i f req u ired .—A ll sales from bulk shall, if the E xcise Commissioner a t any tim e so directs b y writing under his hand addressed

to the licensee, be m ade by m eans of special measuring taps of a pattern to be approved by him.

8. S ta n d a rd M easu res to be k ep t.—Standard m easures approved by the E xcise Commissioner, v iz ., l£ drams, 1 dram, £ dram, i dram, and £ dram

shall be k ep t in every tavern and shall on dem and by any custom er be used in m easuring the arrack he has purchased.

9. D rin k in g V essels to be o f tra n sp a ren t M a te r ia l a n d to be m a rk ed .—E very drinking vessel used or kept at a tavern other than the standard measures referred to in condition 8 shall

be m ade of glass or of some other transparent m aterial, and shall have clearly marked on it in coloured figures its capacity and the current authorized price for th at quantity. The quantity shall further be indicated by a horizontal line, coloured red, cu t a t least 2 inches round the circum ference of such vessel and not less than one-half of an inch below the top of the vessel. The price shall be marked in bold red figures im m ediately above the centre of the cut red line aforesaid and the quantity shall be m arked on the opposite side, i.e ., on the exterior side of the vessel furthest from the price. N o arrack shall be served for consum ption on the prem ises otherwise than in drinking vessel m arked as hereinbefore prescribed and filled up to such mark.

10. In sp e c tio n by E x c ise Officers.■—A ll arrack k ep t or exposed for sale in a tavern shall a t all tim es be m ade available for inspection and te s t b y

officers of the E xcise D epartm ent.

11. A ccou n tin g o f A rra c k .—■(а) The licensee shall account for all arrack in th e prescribed form of tavern register. H e shall also k eep

separate accounts on form E xcise C. S. 1 (5/26) in respect of arrack in bulk.(б) The to ta l w astage at every tavern shall be w r it te n off a t the e n d of each m o n th and the actual balance in

hand of each kind of arrack brought forward on the 1st of the m onth follow ing.(c) H e shall keep a separate account of the sales if an y to foreign liquor licensees.

12. R em o va l o f P roceeds o f S a le , & c .—(1) The licensee shall cause all the proceeds of an y one d a y ’s sa le of arrack to b e rem oved from the tavern

betw een the closing hour on th a t day and § a .m. on the follow ing day.(2) H e shall n ot perm it an y m oney other than the proceeds of th e sale of arrack to be k ep t in the tavern.(3) H e shall n ot perm it an y part of the proceeds of an y one d ay ’s sale of arrack to be rem oved from th e tavern

before the closing hour on th at day, unless before such rem oval a sta tem en t is filed in the tavern, duly signed and dated b y h im self or the tavern-keeper, and settin g out in words and figures the ex a ct sum of m oney so rem oved.

(4) The statem ent aforesaid shall be produced for inspection w hen called for b y any officer of the E xcise D epart­m ent, and shall be k ep t in the tavern for a period of one m onth from the date se t o u t in it.

13. P ro h ib itio n aga in st P ecu n ia ry D ea lin g s w ith E x c ise Officers.—N either the licensee, nor any agent or em ployee of the licensee, shall have an y pecuniary dealings w ith th e

Improvements in withering tea leaf.Abstract.—On oithor side of the lofts there are fans

and a vertical shaft provided with a damper. By means of the fans air can be drawn over the lofts in either direction. The damper on the shaft a t the end from which air is drawn is closed and the damper on the other partially opened through which some of the air escapes. This air is continuously replaced by spacially conditioned air meeting the main current in the middle of the horizontal passage

on the ground floor which therefore connects the two shafts. This passage also contains the condenser of a refrigerating system. The relative humidity of Jhe air is maintained a t 67 %.
