2. The Water Act was enacted by ParliamentAct, 1974 purpose to provide for theprevention of control of water pollution andthe maintaining or restoring ofwholesomeness of water. As on day, it isapplicable in all the states of India. In thisact, unless the context, otherwise requires(i) Occupier(ii) Outlet(iii) Pollution(iv) Trade effluentIntroduction 3. It means such contamination of water or suchalteration of the physical, chemical or biologicalproperties of water or such discharge of any sewageor trade effluent or of any other liquid, gaseous orsolid substance into water (whether directly orindirectly) as may, or is likely to, create a nuisanceor render such water harmful or injurious to publichealth or safety, or to domestic, commercialindustrial agricultural or other legitimate uses, or tothe life and health of animals or plants or of aquaticorganisms. (section 2(e) of the Act)Pollution defined in the Act 4. Features of Act4 It provides for maintenance and restorationof quality of all types of surface and groundwater. It provides for the establishment of centraland state boards of pollution control. It confers them with powers and functions tocontrol pollution. It has provision for funds, budgets, accountsand audit of the central and state pollutioncontrol boards. It also makes provision for various penaltiesfor the defaulters and procedure for thesame. 5. The Act prescribed constitution of two typesof Legal Corporate Entities for properdischarging of the functions and forexercising the powers under the Act. One Central Board constituted under section3 of the Act. State Pollution Control Boards constituted inrespective states under section 4 of the Act.Legal Corporate Entities 6. 6 7. 7 8. It is the main governmental organizationat central level for prevention and controlof water pollution.Central Pollution Control Board 9. A member Chairman : being a person having specialknowledge or practical experience in respect of mattersrelating to environmental protection or a person havingknowledge and experience in administering institutionsdealing with the matters aforesaid to be nominated by theState Government. (he may be either whole-time or part-timeas the State Government decides) The State Government can nominate not more than fiveof its officials as members to represent itself in the Board. The State Government can nominate not more than fivepersons to be members of the Board who are members oflocal authorities functioning within that state. of scientific, engineering or management aspects ofpollution control.Constituents of a central Board 10. The state Government can nominate notmore than three persons who are nonofficials but who can represent the interestof agriculture, fishery or trade or industry orany other interest which in its opinion to berepresented. The state Government can nominate twopersons from the companies or corporationsowned or controlled by it. A full time Member Secretary of the Boardhas to be appointed by the StateGovernment, who posses qualification,knowledge and experience of scientific,engineering or management aspects ofpollution control.Constituents of a central Board 11. The main function of the Central Board shall be topromote cleanliness of streams and wells in different areasof the States. In particular and without prejudice to the generality ofthe foregoing functions, the Central Board may-- Advice the Central Government on any matterconcerning the prevention and control of water pollution.- Provide technical assistance and guidance to the StateBoard, carry out and sponsor investigations and researchrelating to problems of water pollution and prevention,control or abatement of air pollution.- Perform such of the functions of any state board as maybe specified in an order made under sub-section 2 ofsection 18- co-ordinate the activities of the State Boards andresolve disputes among them.Functions of Central Board (sec. 16) 12. The Central Board may establish orrecognize a laboratory or laboratories toenable the Central Board to perform itsfunctions under this section efficiently. It organizes training programs for preventionand control of pollution at various places(seminars). To plan and cause to be executed anationwide programme for the prevention,control or abatement of water pollution.Functions of Central Board (sec. 16) 13. It also organizes comprehensive programson pollution related issues through massmedia. It collects, compiles and publishestechnical and statistical data related topollution. It prepares manuals for treatment anddisposal of sewage and trade effluents. Lays down standards for water qualityparameters.Functions of Central Board (sec. 16) 14. It plans nation-wide programs forprevention, control or abatement ofpollution.
