CANDIDACIES FOR THREE VACANCIES THAT WILL OCCURON THE INTER-AMERICAN JURIDICAL COMMITTEE
This document will be presented to the General Assemblyat its thirty-sixth regular session.
EXPLANATORY NOTE
In resolutions AG/RES. 1757 (XXX-O/00), “Measures to Encourage the Timely Payment of Quotas,” Annex A, section B, paragraphs 3a., b., and c., and AG/RES. 2157 (XXXV-O/05), “Program-Budget of the Organization for 2006; Quotas and Contributions to FEMCIDI for 2006,” section III.A.7, the General Assembly established that the following procedures would apply to elections conducted by the General Assembly or by the councils of the Organization:
AG/RES. 1757 (XXX-O/00):
“a. When circulating to the member states documents presented by a member state nominating a candidate the General Secretariat shall indicate in the transmittal notice” the member state’s payment status;
“b. Within one week prior to holding the election and, again, immediately prior to taking the corresponding vote, the General Secretariat shall circulate a statement among all delegations indicating the countries which are ‘current,’ ‘considered current,’ and ‘not current.’ The statement shall also show the number of years each such country is in arrears. No vote shall be held until this information has been circulated and the delegations so notified; and”
“c. The respective electing organ can specifically take into account the condition of those states which are ‘not current.’”

“ c. To amend the definitions in part A of Annex A of resolution AG/RES. 1757 (XXX-O/00), so as to eliminate the term ‘Current’ and replace it with two new payment categories, ‘Current A’ and ‘Current B,’ as further indicated in the text in italics below:
1. ‘Current A’: For purposes of this resolution, a member state that has paid all its Regular Fund quota assessments for all prior years shall be in ‘Current A’ status for the current year if:
a. It has paid its entire Regular Fund quota assessment for the entire current year; or
b. It has agreed to a written payment plan with the General Secretariat for the payment of its entire Regular Fund quota assessment for the current year by January 1 of that year and is in compliance with that plan.
Notwithstanding subsections a and b above, a member state that has paid all its Regular Fund assessed quotas for prior years and has indicated its intent in writing to the General Secretariat prior to

January 1 of the current year to pay its entire Regular Fund quota assessment for the current year by March 31 of the current year shall also be in ‘Current A’ status through to March 31 of that year. If it does not pay its entire assessed Regular Fund quota by that date, it will lose its Current A status on the following April 1 and shall not regain it for that year until it pays its entire quota obligation in full.
2. ‘Current B:’ For purposes of this resolution, a member state that has paid all its assessed quotas to the Regular Fund for prior years, has agreed to a written payment plan with the General Secretariat for the payment of its entire Regular Fund quota assessment for the current year by January 1, and is not in compliance with that plan shall be considered in ‘Current B’ status, provided it:
a. Has agreed with the Secretariat to a new written payment plan for the current year; an
b. Is in compliance with that new payment plan.
Nonetheless, a member state may not remain in Current B status if it has defaulted on two consecutive agreed-upon payment plans in the current year.
These amendments to the definitions given in part A of Annex A of resolution AG/RES. 1757 (XXX-O/00) shall remain in force indefinitely until modified by the General Assembly.”
With a view to implementing the above-mentioned resolutions, the General Secretariat hereby forwards the attached information on the status of quota payments by member states as of May 10, 2006.

Curriculum vitae
Es Licenciado en Derecho por la Universidad Nacional Autónoma de México e hizo los estudios correspondientes al doctorado en Derecho en esa Universidad y a la Maestría en Filosofía en la Universidad Iberoamericana.
A partir del 1° de junio de 2005 es profesor investigador del Departamento de Estudios Internacionales de la Universidad Iberoamericana; imparte las cátedras de Derecho Internacional Público y de Tratados Internacionales.
Desde el 1° de agosto de 2003 hasta el 31 de mayo de 2005 fue Director del Departamento de Estudios Internacionales de la mencionada Universidad.
Es autor de los siguientes trabajos: "Tratados internacionales, Legislación y práctica en México", (tres ediciones); "Análisis crítico jurídico de la Ley sobre la celebración de Tratados"; "La defensa del petróleo mexicano al trazarse la frontera submarina con Estados Unidos"; "La doctrina internacional de Francisco Suárez" (tesis profesional de licenciatura); numerosos artículos sobre temas de derecho internacional.
Como miembro de carrera del Servicio Exterior Mexicano fue Embajador en Egipto, Sudán, Argelia, Túnez, la República Árabe Saharahui e Indonesia. En la. Secretaría de Relaciones fue Director General de Organismos Internacionales, del Servicio Exterior Mexicano y de Tratados internacionales. Asistió a numerosas conferencias internacionales, entre otras, sobre Derecho del Mar, del Espacio, Derechos Humanos, Agricultura, Alimentación y fue integrante de la delegación mexicana en varios períodos de sesiones de la Asamblea General de las Naciones Unidas.
Participó, como miembro de la delegación mexicana en las reuniones preparatorias que se celebraron en Nueva York y en la conferencia de plenipotenciarios que se celebró, en Roma, en 1998, para establecer la Corte Penal Internacional. Asimismo, fue miembro de la delegación mexicana, como asesor jurídico que negoció el Tratado entre México y Estados Unidos para delimitar la Plataforma Continental de una zona del Golfo de México firmado, en Washington, el 9 de junio de 2000.
En la Secretaría de Comunicaciones y Transportes, durante siete años, fue Director del Departamento de Transporte Aéreo Internacional así como Vocal directivo de la Comisión Nacional del Espacio Exterior.

The status of member status with respect to payments of their assessment to the Regular Fund as of May 10, 2006 is as follows:
1) Current A: Member states that have paid all their quotas owed to the Regular Fund for prior years and who have either:
i. Paid their entire Regular Fund quota assessment for the current year:

ii. Agreed to a written payment plan with the General Secretariat for the payment of their entire Regular Fund quota assessment for the current year by January 1 st of that year and are in compliance with that Plan:

Notwithstanding subsections i and ii above, a Member State that has paid all its Regular Fund assessed quotas for prior years and has indicated its intent in writing to the General Secretariat prior to January 1st of the current year to pay its entire Regular Fund quota assessment for the current year by March 31st of the current year shall also be in “Current A” status through March 31st of that year.5
2) Current B: Member States that have paid all of their assessed quotas to the Regular Fund for prior years, have agreed to a written payment plan with the General Secretariat for the payment of their entire Regular Fund quota assessment for the current year by January 1 st, but are not in compliance with said plan, provided they have agreed with the Secretariat to a new written payment plan for the current year and are in compliance with the new Payment Plan:

5 . Failure to pay the entire assessed Regular Fund quota by March 31 st will result in losing Current A status on the following April 1st until such time as the quota obligation is paid in full.

5) Years in Arrears: This is the number of years for which quotas are still owed by a member state as of May 1 of the current fiscal period, regardless of whether the member state has entered into a payment plan and it is in compliance with that plan. For reports dated January 1-April 30, arrears include amounts owed for all prior years; for reports dated May 1-December 31, arrears include amounts owed for the current fiscal year and all prior years.
