A 5-member bench of the SC led by Justice Tassadaq Hussain Jillani took up the NAB chairman’s appointment case for hearing on Monday. Akram Sheikh advocate appeared in the court on behalf of former opposition leader in National Assembly Chaudhry Nisar Ali Khan. He took the plea that the formality of consultation with the opposition leader had not been met while appointing the NAB chairman. A letter was sent asking him to propose a name which was not a consultation in any way, he added. The opposition leader’s reply to this letter was declared illogical. The consultative process has been devised in several courts decisions. The president should have called the opposition leader to make consultation with him. Justice Tassadaq inquired from Akram Sheikh what was consultation in his views. Akram Sheikh replied: “If it is meaningful, purposeful and with a view to developing consensus, it can be called consultation.” Justice Khosa remarked: “If there is no consensus in the consultation process, how will chairman be appointed?” Akram Sheikh said: “The matter is then referred to the chief justice of Pakistan. The role of chief justice has been given in connection with the appointment of the chief justice in the Asfand Yar Wali case. The role of president is ceremonial in the matter of appointment.” Justice Jillani remarked: “The purpose behind the consultation with the chief justice with regard to the appointment of the NAB chairman is to make the appointment non-controversial. In the parliamentary system, the president is bound to accept the advice of the prime minister.” Justice Khosa remarked: “The president has written in his letter that the opposition leader had not opposed the name recommended by the prime minister.” Akram Sheikh said the proposal in connection with consultations with the chief justice was given in the Deedar Shah case. Justice Khosa remarked: “This proposal was given in the light of proposals of larger benches. The parliament can enhance the powers of the supreme court under the constitution but it cannot curtail its powers.” Justice Jillani observed: “The president wrote a letter to the opposition leader for consultation.” Upon this, the court was told that no such letter was available in the record. On summoning by the court, Attorney General (AG) Irfan Qadir presented the original notification on the appointment of NAB Chairman Fasih Bokhari in the court. Akram Sheikh said the role of chief justice in the appointment of the NAB chairman is mentioned in four decisions by the court. Justice Khosa said: “Implementation of court directives is essential as per the Constitution of Pakistan.” Akram Sheikh said the supreme court’s remarks cannot be ignored. Justice Khosa remarked: “The chief justice has been given the role of arbitrator in the decisions which have been cited by you. The opposition leader raised no objection on Fasih Bokhari in his letter. It is a centuries- old tradition that silence is considered yes.” Concluding his arguments, Akram Sheikh said the opposition leaders stressed consultation in the light of court decisions. Latif Khosa, counsel for Fasih Bokhari, argued that the opposition leader had raised objection to former chairman Deedar Shah but he did not raise any objection over Fasih Bokhari. He said whether he wants to bring back the era of Saifur Rehman when the NAB chairman influenced judges. Justice Jillani remarked: “Now the era has changed and no illegal work can be done.” Latif Khosa said the man who is going to become prime minister had attacked the supreme court. The session was summoned after Prime Minister Mir Hazar Khoso sent advice to President Asif Ali Zardari who gave approval on Monday. Soon after the house convenes on June 1, the newly-elected members will take oath. According to parliamentary sources, the formal election of the new prime minister will be held on June 5 and PML- N chief Mian Nawaz Sharif is all set to become the prime minister for an unprecedented third term. His party has already nominated him for the top post. The party has attained a majority in the 342-member lower house of the parliament. The election to the prime minister’s position will be a mere formality as the party has the required strength in the house. Nawaz Sharif had earlier served as premier from 1990 to 1993 and from 1997 to 1999. The sources said that nomination papers for the posts of speaker and deputy speaker of the National Assembly will be submitted on June 2 and elections will be held the next day. The nomination papers for the post of prime minister will be submitted on June 4 and the election will be held the following day. Moreover, the annual budget session would take place on June 7 in the National Assembly. Online adds: Caretaker Minister for Information and Broadcasting Arif Nizami said that the caretaker cabinet will relinquish his responsibilities on the 5th of next month. Talking to newsmen at National Press Club in Islamabad on Monday afternoon‚ he said it is for the first time that a caretaker set up conducted free‚ fair and transparent elections in the presence of independent judiciary and media. Arif Nizami said there are complaints about rigging in the elections and the Election Commission is busy in addressing these complaints. To another question‚ the Minister said there should not be any secret fund. Another report from Lahore adds: The first session of newly elected provincial assembly of Punjab is likely to be held on June 1 and Shahbaz Sharif is all set to resume his duties as chief minister. The interim government of Punjab has sent a summary to provincial governor in this regard, official sources said. After the approval of the governor, the session will be held in which newly elected members of assembly would take oath. With an overwhelming majority in the assembly, Pakistan Muslim League Nawaz will form the government while Pakistan Tehrik-i- Insaf with about two dozen members would be serving as opposition. Meanwhile, sessions of Khyber- Pakhtunkhwa (KPK) and Sindh assemblies have been summoned on Wednesday (May 29) in Peshawar and Karachi respectively. As per media reports, meanwhile‚ Punjab Governor‚ Makhdoom Ahmad Mehmood has summoned the session of new Punjab Assembly on Saturday, the first of June. Newly elected Members will take oath followed by election of Speakers and Deputy Speakers of the three Houses. Sources say that the decision to convene the Balochistan Assembly will be taken in the coming days. ISLAMABAD: The Supreme Court of Pakistan has sought the details of rescheduled loans worth Rs 38 billion from the Bank of Punjab and turned down the request of the bank to postpone the case proceedings for six months. On Monday, a three-member bench of the apex court started hearing the case. Chief Justice Iftikhar Muhammad Chaudhry said in his remarks that the case is in the court and on the other hand, the Bank of Punjab is busy making deals. The court’s time is very precious and the bench would not allow misusing it. The bank lawyer, Anwar Mansoor, told the court that the Bank of Punjab has rescheduled loans worth Rs 38 billion. He said the court might allow the bank time period of six months for better results in this connection. The CJP said the court could not give so much time. The legal team of the bank should complete its arguments as early as possible so that the court may give its decision in the case. The court adjourned the hearing till today (Tuesday). –ONLINE SALMAN ABBAS ISLAMABAD: Amid rumours of former president Gen (retd) Pervaiz Musharraf ’s departure from the country, a misalliance petition was filed in the Islamabad High Court (IHC) on Monday requesting an early hearing of a case filed in May 2013 to seek an FIR against Musharraf for ordering a military operation at Lal Masjid which claimed more than 150 lives. The petitioner, Haroonur Rashid, son of late Ghazi Abdul Rashid, filed the misalliance petition seeking early hearing of his plea he had filed on May 7, 2013. In his application, the petitioner said that according to media reports, Musharraf is trying to leave the country, so his petition should be heard on a priority bases. During the last hearing, Justice Noorul Haq Qureshi had issued a notice to the Aabpara Police Station SHO. Haroon moved the court through his counsel M Tariq Asad Advocate and made the SHO and Gen (retd) Pervez Musharraf as respondents. In his petition, he mentioned an order of the Supreme Court dated 2-10- 2007 in which it was stated by the IGP Police that after recording the statements of all concerned, the police would proceed in the matter strictly in accordance with law. MIRPUR: After street violence all over the city, federal authorities have exempted Mirpur district, Kashmir, from power load-shedding. Since Monday morning, mobs had taken to the streets and paralyzed the whole city against power outages reaching 10 to 18 hours a day. During violent protests and clashes with police dozens of people were injured who were marching towards Mangla dam. Taking notice of the situation, federal officials asked Water and Power Development Authority to exempt Mirpur district from the load-shedding. Pakistan, a home to over 180 million, has been facing a spiralling power crisis with ocials themselves accepting up to 18 hours power outages in rural areas while nine to 14 hours outages in urban parts of the country. Meanwhile, the total power shortfall faced by the country has declined to 3900MW with the improvement in weather, leading to reduction in power outages. The total demand for power has come down after the recent rains in various parts of the country. According to latest statistics, the total power supply is 10,900 MW against a total demand of 14,800 MW, hence the gap has shrunk to 3,900 MW. However, the load- shedding is still being carried out on alternate hours in urban areas. According to officials, the power shortage will further slide in the next few days which will ultimately reduce the duration of load- shedding. –ONLINE Power crisis: Rs 10b released on PM’s orders ISLAMABAD: The Finance Ministry has released Rs 10 billion for procurement of oil in a bid to overcome crippling energy crisis gripping the country, Geo News reported Monday. A spokesman for the Prime Minister House said that PM Mir Hazar Khan Khoso chaired a high level meeting to review power crisis. The PM was apprised that Rs 10 billion had been released on his directives. The prime minister directed authorities to link 56.4 megawatt Wind Power Project to the national grid within 48 hours. The HESCO chief told the prime minister that transmission lines had been laid to link the project to the national grid. –MONITORING DESK KARACHI: Muttahida Qaumi Movement (MQM) – the party with the major mandate in Karachi – on Monday declared the current power crisis in the city as ‘artificial,’ DawnNews reported. Speaking to a news conference, newly appointed member of the party’s Rabita (Coordination) Committee Haider Abbas Rizvi demanded a probe over the apparent financial dispute between Karachi Electric Supply Company (KESC) and Sui Southern Gas Company (SSGC). Karachiites, who have been bearing the brunt of announced as well as unannounced loadshedding for the past many days, had to suer the power utility’s wrath on Sunday when they were deprived of electricity supply for nine to 11 hours in dierent areas. Sources told Dawn that KESC is pointing its finger at SSGC for short supply of gas which has led to less electricity generation. Hence, long spells of loadshedding during which the SSGC has accused KESC of not clearing its arrears amounting to over Rs48 billion. Rizvi alleged that supply of around 90 million MMCFD gas to Sui Northern Gas Company (SNGC) by the SSGC has led to the current electricity and water crisis in Karachi – the financial and economic hub of Pakistan. ISLAMABAD:Chief Jamiat Ulema-i-Islam-Fazl (JUI-F) Maulana FazalurRehman has asked the ElectionCommission of Pakistan (ECP) to holdbye-elections in August instead ofJuly, due to coming month ofRamzan-ul-Mubarik and scorchingsummer heat.According to the sources, Fazal has

written a letter to the ECP demandingbye-elections in the month of August.The constitution says “When, except bydissolution of the National Assembly ora Provincial Assembly, a general seat inany such Assembly has become vacantnot later than one hundred and twentydays before the term of that Assemblyis due to expire, an election to fill theseat shall be held within sixty days fromthe occurrence of the vacancy”. JUI-FChief Maulana Fazalur Rehman haswon three national assembly seats

including NA-24 (Dera Ismail Khan),NA-25 (D.I.Khan-Cum-Tank) and NA-27 (Lakki Marwat) in the May 11elections.Article 223 of the constitution puts

a bar against double membership. chairman Imran Khan has beenelected on more than one seat. All ofthem have to resign from all but oneseat and subsequently the ECP wouldannounce bye-elections in the vacantconstituencies. The demand of FazalurRehman who heads the religio-politicalparty is incomprehensible as theconstitution clearly says that electionon a vacant seat would be held within

60 days. As the national assembly andall the four provincial assemblies aremeeting in June and the memberselected on more than one seats arelikely to attend respective sessions, theywill have to leave all but one seat,otherwise they would not be able totake seat in the house. In case, all thoseelected on more than one seats leaverest of the constituencies, the bye-elections, under the constitution, islikely to be held maximum by first weekof August. However, the month ofRamzan-ul-Mubarik will go beyondsecond week of August. Under thecircumstances, Fazal’s demand isunlikely to be met by the ECP.

Let me take you on a brief guidedtour, but prepare yourself: thelandscape is particularlydisheartening to anyone whoremembers what America used to be.The executive branch:Whether it'sthe Obama administration'scrackdown on whistleblowers, thesystematic surveillance of journalistsand regular citizens, the continuedoperation of Guantanamo Bay, or theoccupation of Afghanistan, BarackObama has surpassed hispredecessors in terms of his abuse ofthe Constitution and the rule of law.Despite his prior stint as a professor of

constitutional law, President Obama,like many of his predecessors, hasroutinely disregarded the Constitutionwhen it has suited his purposes,operating largely above the law andbehind a veil of secrecy and speciouslegal justifications.Drone strikes on American citizens:

For almost two years, the UnitedStates government has been targetingAmerican citizens abroad for death bydrone, with at least four Americancitizens assassinated by dronesoutside the battlefields of Afghanistanand Iraq. These assassinations ofindividuals entitled to the fullprotection of the Constitution havebeen carried out without any dueprocess whatsoever--no chargesdetailing their alleged wrongdoingswere brought before them, no trialwas conducted to determine theirguilt or innocence, and no convictionsof guilt were found. Obama has alsogone to great lengths to give theimpression that the droneassassination program is a carefullycontrolled, highly selective process,within the bounds of the rule of law.Yet when hundreds of individuals,innocent women and children amongthem, are being killed as a result ofthese drone strikes, clearly the processis far from controlled or selective.These "signature strikes," whichinvolve targeting groups of unknownmen who resemble al-Qaedamembers, are the equivalent ofbombing a fraternity house becausethere are youngmen inside whomaybe up to no good. It is a practice that isinhumane, immoral and illegal, andno amount of legal parsing or politicalwhitewashing will remove thisparticular stain.Expanding the war on terror:

Although Obama insists that he hasno intention of continuing the wars inwhich the United States is embroiledbut the administration oRcials aresending an altogether diSerentmessage - namely that America'sengagement in the ongoing war onterror spans the entire globe. At arecent congressional hearing, MichaelSheehan, the assistant secretary ofdefense for special operations, cited

the Authorization to UseMilitaryForce (AUMF) law as justification forthe administration's ability to sendAmerican troops to places such asYemen and the Congo without firstseeking congressional authorization.Sheehan also asserted that the UnitedStates conflict with al-Qaeda will lastfor another ten or twenty years. AsSenator Angus King (I-Maine)remarked to Sheehan: "You guys haveessentially rewritten the Constitutionhere today... I don't disagree that weneed to fight terrorism. But we needto do it in a constitutionally soundway." Law enforcement: By and largethe term "law enforcement"encompasses all agents within amilitarized police state, including themilitary, the police, and the variousagencies such as the Secret Service,FBI, CIA, NSA, etc. Having beengiven the green light to probe, poke,pinch, taser, search, seize, strip andgenerally manhandle anyone they seefit in almost any circumstance, allwith the general blessing of thecourts, America's law enforcementoRcials, no longer mere servants ofthe people entrusted with keeping thepeace, are part of an elite ruling classdependent on keeping the massescorralled, under control, and treatedlike suspects and enemies rather thancitizens.The legislative branch: It is not

overstating matters to say thatCongress may well be the most self-serving, semi-corrupt institution inAmerica. Abuses of oRce run thegamut from elected representativesneglecting their constituencies toengaging in self-serving practices,including the misuse of eminentdomain, earmarking hundreds ofmillions of dollars in federalcontracting in return for personalgain and campaign contributions,having inappropriate ties to lobbyistgroups and incorrectly orincompletely disclosing financialinformation. Pork barrel spending,hastily passed legislation, partisanbickering, a skewed work ethic, graftand moral turpitude have allcontributed to the public's increasingdissatisfaction with congressional

leadership. Thus, it is little wonderthat a recent Gallup poll showsCongress with a 79 percentdisapproval rating.The judicial branch: The Supreme

Court was intended to be aninstitution established to interveneand protect the people against thegovernment and its agents when theyoverstep their bounds. Yet throughtheir deference to police power,preference for security over freedom,and evisceration of our most basicrights for the sake of order andexpediency, the justices of the UnitedStates Supreme Court have becomethe architects of the American policestate in which we now live. As aresult, sound judgment and justicehave largely taken a back seat tolegalism, statism and elitism, whilepreserving the rights of the peoplehas been deprioritized and made toplay second fiddle to bothgovernmental and corporateinterests.A suspect society: Due in large part

to rapid advances in technology and aheightened surveillance culture, theburden of proof has been shifted sothat the right to be consideredinnocent until proven guilty has beenusurped by a new norm in which allcitizens are suspects. TLOs reportback to "fusion centers," which are adriving force behind the government'squest to collect, analyze, anddisseminate information on Americancitizens.I haven't even touched on the

corporate state, the military industrialcomplex, SWAT team raids, invasivesurveillance technology, zero tolerancepolicies in the schools,overcriminalization, or privatizedprisons, to name just a few, but what Ihave touched on should be enough toshow that the landscape of ourfreedoms has already changeddramatically fromwhat it once wasand will no doubt continue todeteriorate, unless Americans can finda way to wrest back control of theirgovernment and reclaim theirfreedoms.

One must ask this question,what was he doing in the PresidentHouse. Was he summoned by thepresident or it was a courtesy call.The real story begins from a letter

which was written by our lawyerfriend Naeem Bokhari whichbecame a basis of the referenceagainst the sitting chief justice who

was clearly in the wrong. Thatreference became the bone ofcontention and an attack on theindependence of the judiciary. Thelawyers community became activeand initiated country widemovement for the restoration of theimprisoned judges. The referencewas shelved conveniently. Thisreference must be investigated bythe Supreme Judicial Council afterhis last day in the court.President Musharraf acted on the

advice of the then Prime MinisterShaukat Aziz who had sent thereference drafted by the law ministerafter checking the evidence onrecord. Where is the President'sfault? It is incomprehensible that theintelligencia was misled and theynever bothered to find the truth.Our PM became the loser in all

Now the responsibility to comeup to the expectations of thepolitically rejuvenated nation heavilyfalls on the shoulders of those whohave been voted by them to thecitadel of power.People in whom the nation has

vested its trust must bear in mindthat no more games can or should beplayed. If they make any attempt todo so they will have to face the wrathof the people like those who did inthe May 11, 2013 elections. MQMchief Altaf Hussain has restructured his party’s centraldecision-making Rabita Committee, and relieved some seniorleaders with a view to strengthening his control over the party. Thereis a perception that this action has been taken to punish those whofailed to defend him. He announced the names of 23members of thenew central coordination committee and 10members of KarachiTanzimi Committee. In his telephonic address to general workersmeeting held at Jinnah Ground in Azizabad area, Altaf said: “I willnot allow anyone to run an unjustified parallel systemwithin theparty inmy presence…There is no place for the corrupt and the landgrabbers in the party”. It appears to be a belated realization. Had hecleansed the party of criminals a fewmonths before elections whenbhattamafia was active and there were target killings, his act wouldhave been appreciated. The fact remains thatMQM chief AltafHussain had himself unilaterally formed the previous RabitaCommittee, and he has once again nominated his loyalists in thecommittee. Earlier, in his address atMQMheadquarters AltafHussain had incited his workers by complaining that the RabitaCommittee members were not defending him.The question is how could they defend the indefensible? After theMay 11 elections, Altaf Hussain in his address asked the establishmentto separate Karachi from the rest of Pakistan if they did not like thepublicmandate of his party. Later in a telephonic address toMQMactivists staging a sit-in before the ElectionORce in Karachi, he saidthat anchorpersonsmay criticiseMQMbut should stop accusationsagainst the descendents of those who created Pakistan. “If somebodyloses his head and fatally hit them, they should not blame theMQM”.In a pointed reference to themediamen he said ‘dogs continuebarking and the convoy passes’. People of Karachi in general were nothappy over Altaf Hussain’s outbursts. It appears that by losing onenational assembly seat in Karachi, and PTI candidates securingthousands of votes inmany constituencies, Altaf Hussain feelsKarachi is slipping out of his hands. During the last twenty years, theMQMhas been in coalition with elected as well asmilitarygovernments. TheMQMwas in coalition government with the PPP atthe centre and also in Sindh, but it could not prove if its members evermoved resolutions for housing, education, hospitals or bettertransport system for the people of Karachi. However, theMQMcutdeals for power sharing and lucrativeministries. Starting from landmafias and turf wars to target killings, the city remained in the grip ofmafias that pinpointed traders, industrialists and businessmenwhowere facing serious threats from extortionists and receiving bullets fornon-payment of extortionmoney. Perceptibly the underworld, withwhich they have their links, is gaining upper-hand in the city, makingthem irrelevant considerably.
