1 TECHNICAL MATTERS

1.1 Meeting on Ethanol Blending upto 20%, 5th

March 2013, New Delhi As a follow-up to the earlier meeting on Ethanol blending with Mr Praful Patel and Mr Nitin Gadkari on

9th

January 2013, a meeting on the above subject was held on at MoHI to explore the possibility of introducing higher blends of Ethanol in Gasoline. MoPNG informed that they have already iss ued a notification allowing 10% blending of Ethanol in Gasoline. It was also mentioned that presently Oil

companies are only able to achieve on 30-35% coverage of 5% Ethanol blended fuel in the country. However, Oil companies are now allowed to import ethanol in-case of shortfall. Tenders have also been floated by Oil companies for procurement of ethanol for blending. Indian Oil informed that limited

studies of blending of Ethanol has been done with Diesel Fuel, but the exercise has not been easy as it requires additives for blending with Diesel. Ethanol also has lower Cetane number. Further, the volume of Diesel fuel sold is so high, ethanol blending will not be feasible in the present context. Purti

representatives requested allowing higher blend, upto E20, in areas where Ethanol is available. They were also of the opinion that the committee could consider allowing them to undertake a pilot project to blend E20. They would tie up with private oil companies for undertaking this pilot project around

Nagpur. In view of the above, MoHI decided that a study project onE20 be commissioned by IOC & ARAI.

1.2 SIAM Proposal for Next Stage of Two Wheeler Emission Norms, 31st

December 2012, New Delhi

BSIII emission norms for Two Wheelers were notified vide GSR 84(E) dated 9th

Feb 2009 and implemented from 1st April 2010 in some parts of country and from 1

st October 2010, all over India.

SIAM has proposed a further stringent BSIV Emission norms for two wheelers following the meetings

with EPCA and MoRTH in August 2012. World Forum for Harmonization of Vehicle Regulations (WP.29) under the United Nations Economic Commission for Europe (UNECE) has developed Global Technical Regulation (GTR) No. 2 which is the emission measurement procedure for two-wheeled

motorcycles and prescribes Worldwide Harmonized Motorcycle Test Cycle (WMTC) under 1998 Agreement. GTR 2 is applicable for two wheelers with engines greater than or equal to 50cc and having a maximum speed of more than 50 km/h. India, being a signatory to this agreement, i s

committed to follow these test cycles. In the first instance India has implemented WMTC prescribing emission norms which are equivalent to the existing Indian BS III emission norms as an alternate. For BS IV SIAM has proposed only WMTC based norms. Further, SIAM has committed to implement

evaporative emission limit for two wheelers from the next stage BSIV emission norms. The above proposal has been submitted to MoRTH to initiate discussion on the subject.

1.3 SIAM Affidavit on Diesel Case, March 2013, New Delhi An application has been moved by Amicus Curiae at the Hon’ble Supreme Court on 26

th November

2012 praying for a direction to tax Diesel Cars in Delhi. SIAM’s draft affidavit has been prepared and kept with our Lawyers M/s Sri Narain & Co to file the same at appropriate time. SIAM has already briefed Senior Advocate, Mr Mukul Rohatgi to appear on behalf of SIAM in this case. It is understood

that the case is likely to be listed for hearing in the month of April 2013.

1.4 SIAM Proposal for Next Stage of Idle Emission Norms for Two Wheelers, 22nd

February 2013, New Delhi

SIAM has proposed a revision of the idle emission limits for two wheelers manufactured from 1st

April 2010. It is proposed that the CO limit be tightened from 3.5% to 3.0%, while the HC limit be tightened from 6,000 ppm to 4,000 ppm for Two-Stroke vehicles and from 4,500 ppm to 3,000 ppm for Four

Stroke vehicles. 1.5 SIAM 21

st Two-Wheeler Group Meeting, 26th February 2013, New Delhi

The SIAM Two-Wheeler group held its 21st meeting at Hotel Lalit, New Delhi on the 26th day of February, 2013. The meeting was chaired by Mr. Harjeet Singh of HMCL along with Mr. R Narasimhan

of Bajaj Auto as co-chair. Members discussed various issues primarily related to next stage emission norms, evaporative emission testing procedure and ethanol blending in fuel. Further to this, issues like CO2 / fuel consumption, inspection and maintenance of vehicles and developments in Europe for

1.6 EPCA Meeting to review corrective actions in view of the Fire Incident on a DTC Bus 2

nd

March 2013, New Delhi

EPCA noted that the cooperation between DTC and vehicle manufacturers was not existing. During repair of the buses it was suggested that a representative of DTC should be present and all buses

leaving the depot every day, should have a signature of both the DTC staff and the vehicle manufacturer certifying that the vehicle is fit for operation. Issues related to lack of training of DTC bus drivers to handle a situation in the case of an eventuality was also observed. It was also mentioned

that the life of catalytic converter of new buses is 1,50,000 kms, while it was 80,000 for the old buses. Hence, the catalytic converter of the old buses should be replaced. Finally a joint audit of the CNG leakage test centres will be undertaken in the month of March / April 2013.

The 3rd

Meeting of the Joint Working Group on AFP was held under the chairmanship of Dr R K Malhotra, Director, IOCL, was held on 21st May 2013 at ARAI. It was pointed out that high oil dilution is likely to happen in the Indian context and therefore, the technology may have to be developed for

Indian specific conditions. After discussion it was felt that a pilot study may be required before taking any view on the subject.

2.1 Union Budget 2013-14 : 28

th February, New Delhi

Mr S Sandilya, President, SIAM welcomed the Union Budget 2013-14 tabled by Mr P Chidambaram, Hon’ble Finance Minister, and said that under the current economic environment, the Finance Minister has tried to balance the need for growth with fiscal compulsions. The announcement of investment

allowance reintroduction is very positive. Focus on infrastructure is also a welcome move which will help growth of the economy.

While there are several innovative proposals, the auto industry had expected that the Finance Minister would come out with more specific roadmap for implementation of Goods & Services Tax (GST). The industry would be keenly looking forward to full implementation of GST at the earliest.

SIAM appreciates the Finance Minister’s gesture of allocating double the funds under JNNURM scheme enabling substantial part for purchase of upto 10 thousand buses. This was very much

needed for revival of CV sector. Finance Minister has also accepted SIAM recommendation to lower excise duty on commercial vehicle chassis from 14% to 13% which was raised in the last budget and led to significant drop in off-take of chassis by the body builders.

With a view to deteriorating market sentiments, SIAM had also recommended reduction of excise duty for passenger cars by 2% which could have led to significant improvement in sales.

However, the Finance Minister has accepted SIAM’s recommendation on extension of concession for import of electric and hybrid electric vehicle parts till 31

st March 2015.

The increase in customs duty for luxury cars and motorbikes seems to be an effort to raise more revenue and to encourage local manufacturing, value addition and employment. The proposal to increase duty on second hand vehicle from 100% to 125% is the right step. It clearly conveys that

India is not ready to accept second hand old vehicles from other countries. The other area which the industry did not expect was the increase in excise duty on SUVs used as

personal vehicles. This is the only segment in the industry which has been doing well this year and increasing price of these vehicles would dampen sales and impact market sentiments further.

Mr S Sandilya thanked the Finance Minister for accepting various suggestion of SIAM and hoped that the budget will help take us back to growth path and improve performance of the industry. The critical thing, however, will be speedy implementation of the policies.

2.2 SIAM Logistics group meeting held on 12th

March 2013 in New Delhi A meeting of the SIAM Logistics Group was held under the chairmanship of Mr M M Singh (Chairman

of the SIAM Logistics group and Chief Operating Officer - Production, Maruti Suzuki India Ltd.) on 12th

March 2013 at the India Habitat Centre, New Delhi.

The meeting had been called to deliberate upon the revised AFTO Policy (Automotive Freight Train Operators Policy) and the draft freight rates of the new BCACBM wagon. All the members expressed their concern over the revised policy as well as the freight rates and that the revised policy would not

be beneficial to the industry in its present form. The group decided that a communication be sent to the Railway Board outlining the shortcomings in

the Policy and the freight table. It was also decided that a presentation be made to the Chairman Railway Board to express these concerns. All the member companies would share their suggestions/feedback with SIAM

The group then discussed the proposed visit of the Logistics Group Delegation to Germany, to look at the best practices being followed there in the area of Automotive Rail logistics. The visit may take

place in 3rd

week of May 13. It was also decided to take forward the earlier recommendation of the group to have a Research

Study done on the topic - “Improving efficiencies in Automotive logistics in India ”, where all the aspects of automotive logistics, including Inbound and Outbound Logistics, will be evaluated, and all modes of transportation will be covered.

2.3 BIS sub group meeting standard for steel sheets for Automotive Applications on 8th

March 2013

A meeting of the BIS sub group on formulating standard for Steel Sheets for Automotive Appl ications was held on 8

th Match 2013 at Kolkata.

The meeting had been specially held at the behest of SIAM to take into account the views of the Automotive OEMs in formulation of the Draft Standard for steel sheets for Automotive applications. The meeting was attended by the major OEMs. Their views and suggestions on modifying the draft

standard were discussed in great depth and most of the suggestions were accepted. The revised draft would now be placed before the concerned committee and sent for wide circulation

2.4 Meeting of SIAM Taxation Group for Post Budget Suggestions: 11

th March, New Delhi

A meeting of the taxation group was held on March 11, 2013 in Indian Habitat Center, New Delhi under the chairmanship of Mr Shekar Viswanathan, Chairman, SIAM Taxation Policy Group to discuss on the various concerns arising out of the developments of the Union Budget 2013-14.

The agenda of the meeting is provided below:

A. Arriving at a consensus on SUV Definition to be recommended to Ministry of Finance

B. Recommendations for SIAM Post Budget Submission The definition agreed upon by members (barring a few who were against the value proposition) for the

30% excise duty category is as given below: “Motor Vehicles falling under tariff heading 8703 and meeting all the four parameters mentioned

below: 1) Engine capacity exceeding 1500 CC 2) Motor Vehicle length exceeding 4000 mm

3) Ground Clearance exceeding 200 mm 4) Transaction value exceeding Rs 12 lakhs per vehicle”

It was also decided that SIAM Post budget policy submission (key policy concerns) would include the following concerns:

1) Clarification on transaction value as the base of excise duty under section 4 arising out of the FIAT case.

2) SUV duty

3) Abolition of NCCD 4) Continuation of MNRE scheme for electric vehicles

The other concerns as highlighted by the post-budget submission by members would be included in the other policy concerns.

SIAM post budget procedural submission would remain the same as the pre-budget submission, as no

major announcement on the procedural concerns have been addressed in the budget or post -budget notification of CBEC.

nd April 2013, New

Delhi An inter-ministerial meeting was organized by Shri Ambuj Sharma, Joint Secretary, MoHI to discuss

the proposal of IMACS for Automotive Mission Plan 2026. A team from IMACS, led by Mr R Raghutama Rao, MD, IMACS, was present during the meeting.

The IMACS team presented the detailed scope, approach and methodology of the study to all present. Various ministries present during the meeting presented their views on the proposal.

Subsequent to the meeting, it was decided that IMACS would present an initial paper on the study in two weeks. The initial paper should indicate the various sub-groups that are to be formed and also

highlight the various Ministries that needs be involved in these sub-groups, so that MoHI can send a correspondence and get the name of the representatives.

New Delhi CEO’s of SIAM member companies called on Mr. P. Chidambaram, Finance Minister, on 29

th April

2013 to apprise him of the difficulties being faced by the car manufacturers in respect of the Supreme Court Judgment in the FIAT Case.

Mr. S. Sandilya, President briefed the Finance Minister on the impact of the Supreme Court decision in the FIAT case and mentioned the following points:-

The Supreme Court decision was given specifically in the case of FIAT, but the Excise Department is applying the decision to the entire industry and demanding model-wise cost data from the manufacturers for the purpose of excise valuations. Moreover, the companies which have provided the

model-wise cost data have been served with demand notices for paying Excise Duty based on cost of production + notional profit margin. The actual transaction value is not being considered by the Excise Department.

The Supreme Court judgment itself says that companies may have to resort to selling at a price which is below cost in certain instances e.g. where the manufacturers have goods which could not be sold

within a reasonable time. Therefore the principle of charging Excise Duty on cost of production + notional profits cannot be applied in every case. Moreover, this is a matter of general principle and would impact manufactured products in all the sectors.

After giving a patient hearing to the views expressed by the automobile industry, the Finance Minister

SIAM Taxation Group called on Ms Praveen Mahajan, Chairperson, CBEC, on 15

th May, 2013 to

apprise her of a few key concerns being faced by the industry. The SIAM delegation led by Mr Shekar

Viswanathan, Chairman, SIAM Taxation Policy Group, meet Ms Mahajan and her team at North Block, New Delhi. The concerns that were highlighted to the Chairperson is provided below:

Excise Valuation Concern (Issues arising out of the Supreme Court Judgment in the FIAT case)

Power to Arrest Provision

Excise Duty on SUVs The Chairperson, along with her team, gave a patient hearing to all the concerns. She then informed that the department is seized of both the issues and has been working to formulate guidelines for field

formations on implementation of the above and that the guidelines will be issued very soon. The chairperson informed that the power to arrest provision is exercised rarely and in extreme cases, and therefore the industry should not be worried about this.

For SUV excise duty, the Chairperson informed that there has been much deliberation on this duty hike within the Ministry. No roll back is possible in this case, however she informed that the duty was

specifically for SUVs/UVs and, as sedans were not to be a part of this higher duty structure (30%), a clarification in this regard would follow soon to get these vehicles excluded from the definition.

The meeting ended on a positive note. Mr Shekar Viswanathan thanked Ms Praveen Mahajan and her team for their time and patient hearing of our concerns.

th May 2013

A meeting of the Drawback Committee Chaired by Dr Sumanta Choudhary was held in Chennai on 4

th

May 2013. SIAM was given a 45 minutes slot to make a presentation. A SIAM team participated in the

deliberations and a presentation giving the issues of relevance to the Auto industry was made. The committee was apprised of the difficulties faced by the industry after the Drawback Rates were reduced in Oct 2012. It was also informed that exports have since dropped.

The issue regarding exports to Nepal being made eligible for Drawback was also raised.

The committee interacted with the members and requested the industry to make a representation with supporting data from all the manufacturers.

2.9 Meeting of the Acidloop Project.

A review meeting of the Acidloop project being undertaken by TERI with support from Switch Asia, ADELPHI etc as well as SIAM was held in Chennai and Pune in May 2013. Plant visits to some

factories who are doing Electroplating, and Die castings were undertaken along with foreign experts and the plant operators were advised regarding Resource and Energy Savings.

3.2 SAFE Annual Convention on 25

th April 2013 at Shimla, Himachal Pradesh

Every year SAFE organizes its annual convention in different states of India so that we can spread the knowledge and awareness on Road Safety across our country. This year SAFE Governing Council decided to organize SAFE Annual Convention at Shimla, Himachal Pradesh. Theme of this year is

Road Safety: Scientific Tools and Training. We have received positive response from Transport Department, Government of Himachal Pradesh

2013 at Shimla Society for Automobile Fitness & Environment (SAFE) – a initiative from Society of Indian Automobile

Manufacturers (SIAM), in association with the Ministry of Shipping, Road Transport & Highways and Transport Department, Government of Himachal radish organized its Annual Convention at Hotel Marina in Shimla on April 25

th, 2013. The theme for this year’s annual convention was „Road Safety:

Scientific Tools and Training.” This year objective to organize SAFE Annual Convention 2013 at Shimla was to spread knowledge on best practices implemented in the area of safety with enforcement and transport corporations, driver training and vehicular safety. Mr Ritesh Chuhan, Transport

Commissioner, Government of Himachal Pradesh and Mr Deepak Kapoor, Vice Chairman and Managing Director, MSRTC inaugurated the program in the presence of senior officials from government, industry and other stakeholders working in the area of safety.

Safety Awareness Program for School Students of DPS, The Mall Road, Shimla. Faculty from Hubert Ebner India conducted the workshop for senior students. Approximately 200

students gained the knowledge on road safety after attended the workshop.

3.7 Road Safety awareness workshop for Drivers at Shimla, Himachal Pradesh on 27th

April 2013

SAFE with the support from Transport Department, Government of Himachal Pradesh organized Road Safety Awareness workshop for Drovers at HPSRTC Tara Devi work station.

Faculty from Hubert Ebner India conducted the workshop for drivers and conductors.

3.8 UN Global Road Safety Week from 6

th – 12

th May 2013

The Second UN Global Road Safety Week was announced to be organized from -12 May 2013 . It

was dedicated to pedestrian safety. Requested by the UN General Assembly, the week had attention

to the urgent need to better protect pedestrians worldwide, generate action on the measures needed to do so, and contribute to achieving the goal of the Decade of Action for Road Safety 2011-2020 to save 5 million lives. Join the international community to ensure a fatality free Week and a significant and long-lasting contribution towards making walking safe for all.

3.9 World Environment Day on 5

th June 2013

On 5th

June, World Environment Day will be orgnaised around the world in different ways, including

street rallies, bicycle parades, green concerts, essay and poster competitions in schools, tree planting, recycling efforts, clean-up campaigns and much more.

On the occasion of World Environment Day in 2012, SIAM, along with its members, organized 4500 free of cost PUC checkup camps across India.

As an contribution from Automobile Industry, SIAM along with members and members dealer network will be conducting independently a pollution check camp and issue free certificates to all vehicles

reporting on this day. Under one banner all the dealers will be organizing various activities related to environment

awareness all across India. 4. Forthcoming Events
