Dear Ms. Marshall:
BFI Waste Systems of Arkansas (BFI) has received your letter dated January 23, 2015. This letter requires a written response for your review of the facility's records during the inspection conducted on December 18, 2014. Specifically you are requesting an explanation for the difference between airspace consumed reported in the Annual Engineering Inspection Report (AEIR) and the reported waste recorded in the Quarterly Disposal Fee Reports for the years 2011 and 2012.
BFI agrees the airspace consumed reported in the 2011 and 2012 AEIR differs from the airspace consumed calculated from the Quarterly Disposal Fee Reports. One reason for the variation could be due to the actual onsite waste density achieved by the facility versus the assumed waste density used in the conversion factor. However the main reason for the variation is due to soil placement on the landfill. These soils were placed as daily and intermediate cover for the establishment of vegetation as well as to achieve proper drainage and stormwater controls. Soil used as cover and site improvements are not included in the reported tonnage on the Quarterly Disposal Fee Reports and make up the remainder of the airspace consumed.

Dear Mr. Linker,
On December 18, 2014, Susan Speake and I performed a review of the facility's records for the Class 4 landfill to assure compliance with Regulation No. 11 (Solid Waste Disposal Fee Program). The Department would like to extend their appreciation for your assistance during the facility's review. At this time, the Department found your Class 4 landfill in compliance with the regulations set forth in Ark. Code Ann.§ 8-6-601 and Ark. Code Ann. § 8-6-701.
One of the reasons for the review was to understand the difference between the reported landfill space recorded in the Annual Engineering Inspection Report (AEIR) and the reported waste recorded in the Quarterly Disposal Fee Reports. I studied the AEIRs and the Quarterly Disposal Fee Reports for the years 2011 and 2012 which I have enclosed with this report.
For the year 2011, the facility's AEIR recorded 2,983 cubic yards in section 2(b). Using specified conversion rates from industry standards, I converted the reported cubic yards into 1938.95 tons of used landfill space. Quarterly Disposal Fee Reports for this same period reported 1.37 tons of waste received, resulting in a difference of 1937.58 tons.
Similarly, for the year 2012, the AEIR reported 1364 cubic yards in Section 2(b). Using the same conversion rates, I converted the reported yards into 886.60 tons of used landfill space. Quarterly Disposal Fees Reports for this same period reported 0.02 tons of waste received, resulting in a difference of 886.58 tons.
