Please refer to the reply furnished by the CPIO in respect of my RTI application wherein he has stated that the dossiers of non selected candidates have been wiped out and the dossiers of selected candidates are in electronic medium with SSC ER. He has also given me dates to inspect those records on 28th and 29th of January, 2019. On basis on the following ground, I am filing RTI appeal before you: Please find attached the final results by declared by SSC ER in respect of ADVERTISEMENT NO.ER-01/2016 wherein you can see that two candidates have appeared for the exam and none of the candidates are selected finally in this recruitment as they were not able to score minimum score in CBM Examination. Whether the officers of SSC ER are unable to inspect the records of two candidates and send the required information to me. If in case no records are available in view of that none of the candidates are finally selected then on what basis SSC ER is calling me there to inspect document. Simple copy pasting the same content for my different two RTIs put doubt on the intention behind the reply furnised by the CPIO and the public service delivery by SSC ER. In view of the above, I request you to provide me the information sought by me at the earliest in the format mentioned in my RTI application, if the records of those two candidates are available with SSC ER or give me the reason for simply calling to the office, if no records are available with SSC ER. I further request the Appellate Authority concerned not to physically send the letter. Reference is invited to the application dated 23/07/2018 filed by Shri Vijay Kumar Mastakar, FL-307, B-Block, Amritdham Apartment, Nityanad Nagar, Near Bakultala Check Post, Andul Road, Howrah-711109 seeking certain information in regard to selection made under Advt. No. ER-01/2004 & ER-02/2004 for the post of Preservation Asstt Grade-I under post category ER-03 & ER-12, respectively. The point-wise information, as proposed on pre-page, found to be partially deviating the provision of the RTI Act, 2005. Hence, the desired information is herein asunder:- Query No.1- As per the records available in the office, the RTI applicant was nominated for the post of Preservation Assistant Grade I for the O/o Botanical Survey of India advertised at Post category ER-03 under Advt. No. ER-01/2004, through operation of Reserve List while providing substitute in place of Shri Sabapathy C.M. [Roll No. 3010105] {Rank-SL-01} Category-SC. The rank of the RTI applicant is RL-02. Since as per records, no further reserve list was operated, as per the merit list, the nomination of the RTI applicant would be placed below the nomination of the candidates as recommended in the final Selected Panel for the said post category. In regard to publication of nomination of the RTI applicant operating Reserve List in the Employment News, no such record is available in the office. Query No. 2- As per records available in the office, 05 [04-OBC & 01-SC] candidates were recommended for the post of Preservation Assistant Grade I for the O/o Botanical Survey of India advertised at Post category ER-12 under Advt. No. ER-02/2004. Since, the extract/copy of the Employment News wherein the result for this post category/advertisement is not readily traceable, the copy of Acknowledgement letter No. 4-26/ESH/862 dated 07/07/2006 issued by the Indenting Department, thereto receipt of nominations/dossiers of selected 05 candidates, as placed at F/X, may be provided to the RTI applicant. Query No. 3- The fixation of seniority of the recommended candidates against the above recruitment conducted by the Staff Selection Commission are to be determined by the Indenting Department following the guidelines issued by the Nodal Ministry i.e DoP&T issued from time to time as may be enshrined at para 2.1. of “Instructions and Guidelines on Seniority” given at the following link : http://persmin.gov.in/DOPT/Seniority_Instructions_Guidelines/Seniority_Instructions_Guidelines.pdf. i. & ii. Yes, but the petitioner was not finally selected. As per para 4 (C) of the notice of the Constable (GD) Examination , 2013 published in the Rozgar Samachar dated 15.12.2012, all candidates had to submit caste/category certificate as per the proforma of the Commission given in the notice of the examination as Annexure VII published by the Commission in Employment News dated 15.12.2012 and in the website of the Commission (ssc.nic.in) failing which their claim for SC/ST/OBC would not be considered by the Commission and they would be treated as Unreserved category candidate. While preparing the Verified Data it was observed that the OBC certificate submitted by you at the time of document verification was not in prescribed format (There was no resolution number of Govt. of India). Thus you could not establish to belong an OBC category as on closing date of receipt of application form and your OBC status. Hence you were considered as an UR category candidate as per the provision mentioned in para 4(C) of the notice of the said examination. As per the notice of the said examination the upper age limit of UR category candidates was 23 years as on 01.01.2013. Your date of Birth is 15.08.1988 as per your application form and the supporting documents submitted at the time of document verification. Hence your age was more than 23 years as on 01.01.2013 and you were found overaged as UR category candidate therefore, your candidature was rejected for the said Examination.

iii & iv. W.P. No. 26285(W) of 2014 Hiralal Yadav vrs. UOI & Others was disposed of on dated 26.09.201. A MAT No. 2017 of 2014 Hiralal Yadav vs UOI & ors has been filed against the said order in the Hon’ble High Court of Calcutta. The matter is still subjudice.

a) As per available records, you applied for Constable (GD) in CAPFs and Rifleman (GD) in Assam Rifles Exam, 2015 through offline mode and you were assigned roll number 4205500555. As per the scheme of the examination, the verification of documents of the candidates have been done by the CAPF authority on the basis of which the data regarding particulars of the candidates have been used by the Commission while processing of final result. According to the electronic verified data of the candidates received from CRPF authority, you belong to SC category and Naxal affected district of the state of Bihar. You did not exercise any preference of forces for the examination in your application form. As per the write-up of the result prepared by the CRPF those who exercised blank option have been considered in default options (A,B,C, D, E & F) after filling up the vacancies by candidates who has exercised complete preference. You obtained 54 marks in total and 18 marks in part A of the written examination and were declared FIT in the medical examination. As per the write up of the force allocation published by the CRPF authority on 06.02.2017 on their website www.crpf.nic.in, www.crpf.gov.in and www.crpfindia.co.in, the marks obtained by the last selected candidate corresponding to your category and state for both naxal and general vacancy type for different forces are as under:-

c) Shri Pradeep Sagar, Roll No. 3206008232, whose example have been cited in your application, is also an SC candidate and belongs to Naxal affected district of Bihar. Shri Pradeep Sagar has exercised all the force preference for the examination (ADCBEFGH) and obtained 54 marks in total and 16 marks in part A of the written examination. Hence he has been selected in CRPF (code C) as per merit cum preference.

d) This office has not demanded for any information regarding your RTI application and you have sent all the information to the DIG CRPF Durgapur, as stated in your RTI application dated 27.12.2018.
