Highlights  

2013 Quarter 2  Quarterly Environmental Enforcement Summary     

 The Quarterly Environmental Enforcement Summary for Q2 2013 outlines 40 Administrative Sanctions, 517 Tickets, and 14 Court Convictions for a combined total of almost $125,000 in penalties.

Notable Highlights this Quarter:

The Quarterly Environmental Enforcement Summary is expanding its inclusion of Administrative Sanctions beyond actions under the Wildlife Act for the first time. Included in this Summary are five Administrative Sanctions against a pesticide company and the company’s principal, under the Integrated Pest Management Act. The Ministry of Environment plays a key role in regulating pesticide applicators and ensuring that they are compliant with provincial regulations in the interest of human health and safety and the protection of the environment. Nine tickets were also issued under the Integrated Pest Management Act for a range of infractions including improper sales of pesticides. The BC Conservation Officer Service, RCMP and policing agencies from other jurisdictions of Canada and the United States have been working cooperatively on a large-scale investigation into the illegal possession and trafficking of eagles and eagle parts. The investigation was sparked by the discovery of 50 eagle carcasses near North Vancouver and Squamish in 2006. To date, the courts have convicted 10 individuals connected to this investigation, resulting in a total of over $53,000 in penalties, as well as some jail sentences. Most recently, James Carl Joseph was convicted on 7 counts under the Wildlife Act for illegally possessing and trafficking eagle parts. Joseph was fined $4,000 and ordered to pay $7,000 to the Habitat Conservation Trust Foundation. Joseph’s claim of aboriginal right to possess and trade eagle feathers and parts was rejected by the provincial court judge who found that Joseph presented no evidence to support that this right existed in his First Nation’s culture. Cash rewards offered in exchange for key information by the British Columbia Wildlife Federation and the City of North Vancouver assisted the investigation.

The Ministry of Forests, Lands and Natural Resource Operations held an administrative hearing to deal with misconduct by a Guide Outfitting operation. Under section 61 of the Wildlife Act, a Regional Manager may hold a quasi-judicial hearing to consider licensing actions in response to the conduct of a Guide Outfitter, Guide Angler or Trapper. Through their licence, Guide Outfitters are representatives of the Crown in British Columbia. As such, they need to be held to a high standard of conduct and must always operate within the law. Guide Outfitters must also be aware of and monitor the actions of their employees and clients to ensure that they are also operating within the law. Shane Wakelyn was issued an Administrative Sanction under the Wildlife Act, suspending his guiding privileges for one year for employing an unlicensed Assistant Guide Outfitter and attempting to cover that by falsifying his report.
