MEMORANDUM OF AGREEA1ENT

Whereas, RA 8435 otherwise known as the Agri'cuJture and Fisheries Modenuzation Act or AFMA aims to sfrengtheti the agriculture and fisheries_ sector through modernization, ·.greater · participation among the local government units, fanners and fisherfolk_s, non-government organizations, and peopl~ empowennent;

· Whereas, the Local Govenunent Code of 1991 allows the DA,. a national agency, to implement nationally fmided projects and prdgrams

Whereas, the formulation and implemeqtation of investment projects . for agricultural development concem.ing production, processing, marketing · are within the Strategic Agriculture and Fisheries Development· Zone

(SAFDZs);

. Further, the project ·implementatic;m shall be through efficient use of the resources of both the DA anc;l concerned LG U; ·

NOW THEREFORE, for and in consideration of the premises and mutual covenants and undertakings herein set forth, the parties have agreed as foIIows;

1. ON THE PART OF TUE DEPARTMENT OF AGRICULTURE

a. Evaluate and review project proposals of the LOU;

b. Allocate and rele·ase as grant One Million Pesos (Pl.OM) lo the LOU in tranches for the implementation of the approved ·project with

lhe first tranche amounting to fifteen percent. (15%) and subsequent tranches to be detemtined by ·DA and · LGU depending on the requirement of the project and _status of implementation;

c . Extend technical services as may be needed by the LG U relative .to project preparation and iinplementation;

d. · Monitor the implementation of the said proj~cts 11)

accordance with the approved work plan;

e. Require . the LOU to submit audited report of disbursement witfon sixty (60) ~ays after project • completion; and

f. Demand the returi1 of:

1. Unused ftmds after project completioi1; and 2. Disallowed amounts after financial audit. .,

2. ON THE PART OF .. THE LOCAL GOVERNMENT UNIT . (LGU)

a. Submit the DA . project proposals considering the followi11g:

a. I project must be located/situated within identified SAFDZ ofthe mimicipality;

a.2 project · must contribute· to a·griculture and modernization and shall confonn to the components of the AFMA; and

a.3 project must gei1erate new jobs in the municipality.

b. Issue at1 official receipt corresponding . to every amotuit released by the Department·of Agriculture;

.c. Implement the proposed project in accordance with the approved work plan;

3. MISCELLANEOUS/OTHER COVENANTS

a. The Agreements made by the parties may be amended only in writing and signed by authorized representatives of both parties. All runendnient(s) shall be appended to

· this Agreement. Notices to either .Pmly pursuant to this agreement shall be in writing and delivered to the addresses of the patties indicated herein.

b. The Mayor as the signatory to this MEMORANDUM OF AGREEMENT shall be accountable . for the implementation of the . project and disbw·sement of the grru1t fonds from DA. ·

I. INTRODUCTION ·

Agricullurnl development turned out lo be joinl concern of the Dcpm tmcnl ur Agriculture and the Local Government Unifs (LG Us) when R/\. 71 GO known as the Local Government Code of 199 ! , came into implementalion. programs such as Binhian sa Lalawigan and the Balikatan Sngip Patubig Program cncourngecl the active participation of the LGUs requiring them to raise certain a111ou11t as counterpart These programs cover. the use of certified seeds and rehabililnliun of com111unal irrigation system, respectively.

The strategy of the DA lo i.11itiate cuunterparliug agricultural programs was proven eOcctive. The LGUs are more than willing lo provide their counterparts nmJ very enthusiastic aboul the program. As such, the One Million Cou11lcrparli11g program expands its coverage based on the component co11lai11ed in the Agriculture and liisheries Modernization Acl (J\.FMA). This includes Irrigation, Credit . Assistance, Post Harvest, Research, Exlcnsion and Developmc11l. Other lnfrasltuclure, Marketing Assistance and other Livelihood Projects. . .

SCOPE OF COVERAGE ;

1. All municipalities nationwide. 2. Subject to availability of funds, possibly nil provincials and possibly all

cities where 60% of its to~al area is classified as agricultural land.

OBJECTIVES ~

1. To jump start implementation of projects i11 111u11icipalily/cily SAFDZs. 2. To strengthen the LGUs to be an active partner in modcrnizi11g agriculture

and fishery sector. 3. To empower the LG Us to unclerlake local food security pr.ogrnm.

IV. ELIGIBILITY FOR A VAlLMENT

The proposed projects shall be located in SAfDZ areas. The proposed project shall contribute to Agricultur c nnd flshcry modernization; conforin to the components of AFMA; and shall be part of the Municipal Agricultural Development Pinn Framework) or l'rovincial/City Framework as applicable). The proposed project shall be suppo1ted by a Resolution of .the concerned LOU Council) Sangguniang Pambayan/Panlungsod) to signify . their approval of the project.·

COUNTERPARTING )

1. The counterparling can be done in n variety of ways ( c. g. cash, machinery and e(1uipmcnt, other materials, etc.).

2. This counlerparting cnn be co11trilmled ideally at the same time as project iinplemenlatiou. In meritorious cases, this can be duuc nflcr i.mplemenlalion when the .. counterpart contribution is available. This contribution · wiII be a factor in <leter111ini11g the priority, which a municipality will gel for other future projects. However, because of the recent new directions, the inadequacy of the municipality counterpart shall not be an absolute cleterre11t to the release of !i.111<.ls for the project, though it rc111ni11s extremely dcsirnble lo gel the appropriate counterpart sometime in the future.

VI. IMPLEMENTATION PROCEDURE

1. The LOU shall submit the project proposal to the DA-RFU with the appropriate MOA. · ~

2. The DA RFU. shall evaluate and npprove the submitted project proposnl an<l MOA.

3. The DJ\ RFUs shall submit the list of approved project proposals to the · DA-FOS for information.

4: 'fhe DA shall provide Php 1.0 Milliou per municipality/city for the project aml Php 1.0 Million per province as applicable.

VII. TECHNICAL ASSISTANCE

I. The DA-RFU shall provide the necessary technical assistance to LGU ns needed in the implementation of the project whenever possible.

2. The DA-RFU shall call its line agencies to assists in the effective implementation of the project. ;
