10. A f t e r l e a r n i n g o f the Judgment, the N a t i o n a l Post i n s t r u c t e d counsel t o

commence h i s appeal, which was s s u e d on September 20, 2012. By p r i l 23, 2013, l l

p a r t i e s had d e l i v e r e d memoranda o f argument on the m e r i t s i n the Appeals. A

R e q u i s i t i o n f o r Hearing was i l e d on May 3, 2013.9

11. On May 2, 2013, CIPPIC, which had n o t i n t e r v e n e d i n the A p p l i c a t i o n , served a

motion r e c o r d i n support o f i t s motion f o r leave t o i n t e r v e n e i n the Appeals. The N a t i o n a l

Post f i l e d i t s responding motion r e c o r d on May 13, 2013. The N a t i o n a l Post d i d n o t

oppose the motion t o i n t e r v e n e by CIPPIC per se, b u t requested t h a t a p p r o p r i a t e

l i m i t a t i o n s be placed on CIPPIC's p a r t i c i p a t i o n .

12. On May 15, 20 1 3, the CCIA served a motion r e c o r d i n support o f i t s motion f o r

32. None o f th e p a r t i e s i n t h i s proceeding have r a i s e d i n t e r n a t i o n a l t r e a t y

commitments, nor d i d J u s t i c e Rennie consider any such i s s u e s . To a i s e these issues a t

(C) CONCLUSION

50. Th e CCIA should n o t be g r a n t e d l e a v e t o i n t e r v e n e i n the Appeals. I t has no

d i r e c t i n t e r e s t i n the s u b j e c t m a t t e r o f the Appeals. R a t h e r , t has a mere u r i s p r u d e n t i a l

i n t e r e s t and i s a t t e m p t i n g t o t r a n s f o r m t h i s proceeding i n t o a way o c o l l a t e r a l l y and p r e -

emptively i t i g a t e issues t h a t i t s membe rs have faced i n o t h e r j u r i s d i c t i o n s .

51. F u r t h e r , the CCIA's i n t e n d e d p a r t i c i p a t i o n seeks o unduly expand the magnitude

and complexity of t h i s proceeding by f o c u s i n g on i n t e r n a t i o n a l law and r e q u i r i n g the

p a r t i e s t o respond on those i s s u e s . Addressing i n t e r n a t i o n a l law issues i s unnecessary

i n t h i s case, and the CCIA ought o be denied the b i l i t y t o r a i s e t h i s i s s u e .

52. F i n a l l y , the CCIA's p a r t i c i p a t i o n i s simply n o t necessary g i v e n t h a t CIPPIC has

already sought i n t e r v e n e r s t a t u s , i n t e n d s t o address t h e same i s s u e s t h a t the CCIA

seeks t o address, supports the Respondents, and i s b e t t e r p o s i t i o n e d t o r e p r e s e n t the

p u b l i c i n t e r e s t ( i f any e x i s t s ) . No u s e f u l purpose would be served by p e r m i t t i n g t wo

i n t e r v e n e r s t o address the same issues n the same way and the CCIA's request t o do

s o ought o be denied.
