2. General Clarifications To Questions From Bidders

Q1. The 2015 MMM letter-report Environmental Sampling – Phase 2/3 Archaeological Investigation 92 Front Street East, Toronto, ON indicates that approximately 60% of the fill/soil above native soil is contaminated with concentrations of parameters that exceed the MOECC Table 3 ICC Standard. This fill material is classified as solid, non-hazardous waste. The report states that characteristics of the fill material are similar at each sample location such that segregation of impacted and non-impacted fill will not be feasible. The report states that all fill within the Subject Property located above native soil, which they estimate to be 2000 m3, should be managed as waste exceeding MOECC Table 3 ICC Standards. It is Golder’s understanding that the Archaeological Sub-Contractor (Golder/ASI) and the Archaeological Sub-Contractor’s excavator (Wm. Petrie & Sons Contracting Ltd.) will only be responsible for excavation and disposal of the soil required to be excavated to complete the Stage 4 Archaeological Assessment, regardless of contamination. Archaeological monitoring services only will be provided by the Archaeological Sub-Contractor to fulfill site environmental remediation requirements, subsequent to the Stage 4 Archaeological Assessment. As per Section 02 21 13.23, Sub-Section 3.4.1.2 the Archaeological Sub-Contractor (Golder/ASI) will “Hire a qualified excavation sub-contractor to perform archaeological mechanic excavation portions of project and appropriate offsite removal of contaminated soils. All archaeological spoils will be removed from the site and are not to be backfilled.” and, as per Sub-Section 3.4.1.4, the Archaeological Sub-Contractor will provide “Archaeological monitoring of the excavations required to fulfill the environmental remediation requirements for removal of contaminated soils”.

A. Please add the following sentence shown in bold to Section 02 61 00 Sub-Section 1.2.2 “Excavations as part of the enabling works and archaeological investigations must include for the removal of identified contaminated soil for offsite disposal”. The Archaeological Sub-Contractor and the Archaeological Sub-Contractor’s excavator are only responsible for the excavation and disposal of such soil required to be excavated to complete the Stage 4 Archaeological Assessment. Please add the following sentence shown in bold to Section 02 61 00 Sub-Section 1.4.2.2 “Complete removal of contaminated soil without further contaminating surrounding soil”. The Archaeological Sub-Contractor and the Archaeological Sub-Contractor’s excavator are only responsible for the excavation and disposal of such soil required to be excavated to complete the Stage 4 Archaeological Assessment.

B. Please indicate whether the General Contractor being hired under the current Tender or the new-build contractor will be responsible for the excavation and disposal of potentially contaminated soil remaining within the project area subsequent to the completion of the archaeological excavation and the receipt of archaeological approvals from the Ministry of Tourism, Culture and Sport and City of Toronto Heritage Preservation Services.

A1. It is assumed that there is 2000 m3 of fill and it will all require management as waste.

A) The scope of work for Phase 1A assumes a volume of soil to remove all known contaminants.

B) The General Contractor for this tender is responsible for the removal of all known contaminated soils that are excavated.

Q2. Please clarify, in reference to Section 01 40 00 Sub-Section 1.15.1.1.1, whether the General Contractor or the Archaeological Sub-Contractor’s excavator (Wm. Petrie & Sons Contracting Ltd.) is responsible for completing the excavation associated with the test hole excavations required to investigate the condition of the below grade foundations of St. Lawrence Hall, the enabling works to install the temporary chiller to service St. Lawrence Hall and excavations required to accommodate future utility installations to St. Lawrence Hall, prior to the demolition of the North Market.

A2. Yes. All excavation below ground level shall be under the responsibility of the

Archaeologist sub trade for Archeology monitoring, remediation and removal of the site. The General Contractor is to determine means & methods 3 of 29

Q3. Item Nos. 5., 6., and 7. on the Pricing Form – Unit Prices, found on page 39 of 141 in the

Tender document, requests Unit Prices at Unit Measures of ‘Per 50 cubic meters’ to Excavate, remove, transport and dispose of soil meeting ICC site condition standards listed in MOECC Table 1, Table 2 and Table 3 of the Soil Ground Water and Sediment for Use under Part XV.1 of the Environmental Protection Act, April 2011, respectively. There is no exceedance limit indicated at which these Unit Prices take effect.

i. Please replace Item No. 5 to read: ‘Excavate, remove transport and dispose of soil meeting ICC site condition standards listed in MOECC Table 1 of Soil Ground Water and Sediment for Use under Part XV.1 of the Environmental Protection Act, April 2011, that exceed 1000 m3 of soil in total. Cost per 50 cubic meters.

ii. Please replace Item No. 5 to read: ‘Excavate, remove transport and dispose of soil meeting ICC site condition standards listed in MOECC Table 2 of Soil Ground Water and Sediment for Use under Part XV.1 of the Environmental Protection Act, April 2011, that exceed 1000 m3 of soil in total. Cost per 50 cubic meters.

iii. Please replace Item No. 5 to read: ‘Excavate, remove transport and dispose of soil

meeting ICC site condition standards listed in MOECC Table 3 of Soil Ground Water and Sediment for Use under Part XV.1 of the Environmental Protection Act, April 2011, that exceed 1000 m3 of soil in total. Cost per 50 cubic meters.

A3. The base scope of work includes removal of 2000 m3 of contaminated fill. The rates

identified will only become in effect if more than the 2000 m3 of fill requires removal to conduct the assessment, and if so, then soil would be managed to its quality, using the unit rates provided. i), and ii) 50 m3 is a reasonable quantity for which unit rates should apply. iii) will remain as is per Tender.

Q4. Reference to Section 5A -Specific Conditions of Contract:

(page 99 of 141 )-17. Contract Documents: Please confirm the hierarchy of the documents in relation to the Supplementary Conditions and Specific Conditions and the different limits required for Contractors pollution liability of $2M (94 of 141) vs. $5M (80 of 141)

A4 Refer to 5A – Specific Conditions of Contract, Item 18 for Order of Precedence Refer to 5A – Specific Conditions of Contract, Item 15 which amends the Pollution

Insurance amount to $5,000,000 (pg 94 of 141).

Q5. Section 5 - 11 .1.3 (79 of 141):- All Risk insurance is not amended by Section 5A (94 of 141). Please clarify if any coverage for All Risk Property insurance is required for this project as there is no new build associated with 92 Front Street East Demolition Enabling Work.

A5. Refer to Section 5 Supplementary Conditions to CCDC 2-2008 Stipulated Price Contract

Q6. If the temporary chiller service is considered as new build, then it is serving only the

building at 157 King Street East?

A6. Correct. The Permanent chiller service is serving only the building at 157 King Street.

Q7. Section 02 41 .16- Appendix provides list of salvaged items to be transported to various locations. Will the City provide the transportation?

A7. No, The City will not provide transportation. Transportation is part of the contract.

Q8. What is the approximate value of all the items including heritage to be salvaged, for Property in Transit coverage, if it is to be provided by the Contractor?

A8. The approximate value of heritage items to be salvaged for Property in Transit Coverage is

$2,000,000 dollars.

Q9. Reference to Available Information: 1.2.10, ECOH 2014 Pre-Demolition Survey indicates that ECOH was unable to access certain locations for survey with a note that it could possibly be aType-3 abatement. Please clarify if this information will be provided before the tender closing for us to assess the impacts on Construction Schedule and Tender Price. (Refer to NAR in the map Figure 1 - No access to Room)

A9 Only one room was not available for access. It was the ATM machine room at the south

end of the building. This room is approximately 10x10 and will be sampled by the owner once access is created. Assume contaminants are the same as the ATM vestibule outside of the room.

Q10 1.2.17, RWDI Pre-condition survey dated March 8, 2016 indicates that there are cracks in basement foundation walls, block walls, glass panes etc.,. In addition to this, notes on drawing AD1.050 indicate that foundation walls are to be waterproofed and applied with rigid insulation.

A10 The existing walls are not to be insulated and waterproofed. Only the new wall at the closure of the existing tunnel is to be insulated and waterproofed.

Q11 Please confirm the extent of consolidation wall repair work, if any, required to be done on existing building prior to demolition work begins.

A11 No repairs to the existing St. Lawrence Hall (157 King Street) are required.

Q12 What are the conditions of the Demolition Permit that we should know of. A12 Refer to Revision #1 – Page 1 of this addendum

Q13 1.2.18, 1.2.19, & 1.2.21: Do the scope of work and conditions stipulated in the Prequalification documents form part of Tender or Contract?

A13 The Scope of Work in the pre-qualification documents has been modified. The Scope of

Work for this contract is as per the Tender Documents 162-2016. Yes, Conditions do form part of the Tender specifically identified on page 44 of 141 Item 6.0 Pre-qualified Contractors and Sub-Contractors.

Q14 1.2.23, MMM Arc phase 2-3 Addendum, dated October 26, 2015 recommends that a quantity of 2,000 m3 of fill to be managed as waste. Please confirm the scope that all the excavated materials from the trenches will be disposed of by the Archeological subcontractor.

A14 All excavation required to complete the environmental remediation removal of

contaminated soils, shall be removed by the Archaeologist Excavation contractor including and monitored by the licensed archaeologist as per specified in the Tender Documents.

Q15 Will the trenches and unexcavated areas be left on site for the next phase after the Phase

1A completion date? A15 Yes. Q16 What are the site security requirements other than the lockable hoarding site enclosure

specified in the documents?

A16 The Contractor shall be responsible to employ whatever means as required to maintain security of the Work of this contract from the time the site is turned over to the contractor until all Work has been completed.

Q17 Are any security guards, patrol required for the project? A17 The Contractor shall be responsible to employ whatever means as required to maintain

security of the Work of this contract from the time the site is turned over to the contractor until all Work has been completed.

Q18 Please provide specific site security requirements, if needed, during night time and for

the. period of Phase 1 A Archeological investigation work and findings (Section 01 4000-1.15.1.5).

A18 The Contractor shall be responsible to employ whatever means as required to maintain

security of the Work of this contract from the time the site is turned over to the contractor until all Work has been completed.

Q19. Reference to Tender Submission Package: Section 3 - Tender Submission Package, Unit Price #8, GC monthly cost: Where do we find Bid form item '3.1.2 for the archeological filed mitigation work on the site'?

A19 Bid form item 3.1.2 does not exist. This should read Section 3, Item 1. Schedule to be read

with Section 4, Item 5.2

Q20 Section 2. (25 of 141) indicates that the List of Subcontractors (39 of 141), Corporate

Profile Report are to be provided upon request.

A20 List of Contractors Form (page 40 of 141) is requested during the bid submission as part of Bid Pricing Submission. Corporate profile is upon request within 5 days as noted on page 25 of 141.

Q21 Can we also fill in the Schedule (41 of 141 and submit upon request due to the unpredictability of project schedule mentioned heretofore.

A21 No. You may not fill in the schedule at a later date. The Schedule on page 41 of 141 is a

requirement of the Bid Pricing Submission as requested.

Q22 Reference to Tender drawings & Project Manual: Section 02 41 16 -3.5.1.6: indicates that the removals of structural slab as sequenced and shown on the drawings. We do not have a sequence on drawing. 3.2.4.1: indicates 'locate steel tendons and include recommendations for detensioning'. Isn't the precast pre-stressed? Please confirm.

A22 Refer to Revision # 5 above on page 1 of this addendum. In reference to pre-stressed,

General Contractor to verify on site. As built information has been provided. 7 of 29

Q23 Section 00 31 19.13: Vibration Controls Consultant is retained by the Owner for

monitoring vibration levels. Please clarify if any other vibration consulting/monitoring services are to be retained by Demolition/General Contractor than cooperation and communication with VCC.

A23 The General Contractor is to provide vibration control monitoring.

Refer to Quality Control Section 01 40 00 all testing required by code or governing authorities and required by the contract documents shall be arranged and paid by the contractor. With regards to Vibration Control refer to Movement & Vibration Information, Monitoring & Control Section 00 31 19.13

Q24 Drawing SD-001: Considering the proximity and depth of existing hall footings as shown, confirm if any underpinning to existing foundation is required for the excavation and removal of service trench.

A24 The existing SLH footing elevations are unknown. The test pits specified refer to drawing

SD-001 will confirm. Based on the findings of the test pits the requirements of Detail 1 /SD-001 are to be employed.

Q25 What is the fill-in detail for the service trench opening at the hall foundation wall? Can

we abandon the service trench below the ground for removal by next phase? Please confirm.

A25 Refer to dwg AD1.050 Rev G, as shown on details 8 and 9. The existing service trench must

be removed in this contract. Q26 Section 26 05 01.00-1.16 notes that temporary light and power for construction shall be

provided by the electrical trade. Please provide us the power source and if it can be obtained from 157 King Street East building?

A26 Power is by the General Contractor and is not available from 157 King Street East.

Q27 Who is responsible for paying the power consumption charges? A27 The General Contractor is to arrange and pay for all temporary services including power.

Q28 Provide details on temporary lighting for perimeter of hoarding, if required in addition to

the existing light poles.

Q29 Section 260001-1.4: Is there an approved fire alarm contractor for this work? A29 The current maintenance contractor is FireTronics. The current monitoring company is

Grahame Alarm.

Q30. Drawing MD1.000: Is the existing gas service from Jarvis abandoned or removed? A30 General Contractor to make arrangements with Enbridge for removal of gas service to 92

Front St.E Q31. Section 01 7846: Please provide the required extra stock materials for mechanical and

electrical items in the respective drawings and specification sections.

A31 Refer to section Extra Stock Materials section 01 78 46

Q32 Where is the section 330523.00 - Excavation for Electrical required? A32 This section is required based on the General Contractors means and methods for power

and services to the site.

Q33 As per Report #23 there are portions of the underlying material beneath the existing building and surrounding that are contaminated and are noted to be treated as a Table #3 remediation. In discussion with the Archeologists Contractor that is specified we are being told that they will not be removing this material unless it is in direct contact or excavation of their work to complete the Stage 4 report.

A33 Removal and remediation of all excavated contaminated material is to be completed under Phase 1A scope

Q34 Can you please confirm that this material is to remain on site and will be dealt with on the next phase of work or if it is to be removed by the successful G.C.

A34 All excavated material shall be remediated and removed from the site under this contract.

Q35 Please note that as per drawings there is a requirement to remove an existing trench and

complete excavation for the new location for the temporary chiller, please advise if this work is to be carried/included with the work of the Archeologists or if the G.C. is to include this scope of work.

Clarifications

1. Refer to Table of Contents in spec documents and Table of Contents Page 47 of 41 and Tender Breakdown Table – page 36 of 141. Division 21 – Fire Suppression should read Division 21 - Mechanical

2. In reference to the following information on the front cover (page 1 of 141) of the tender

document under the heading, DESCRIPTION:

"This Tender is for the pre-qualified bidders only that have pre-qualified from RTP No. 3910-15-5029, 3910-15-5030 and 9176-16-5021 Refer to Section 2, Article 2 of this Tender document."

Please note bid submissions are requested from the Pre-qualified General Contractors only that have pre-qualified from Request To Pre-qualify No. 3910-15-5029.

Request To Pre-qualify No. 3910-15-5030 (Building Demolition Sub Contractors) and 9176-16-5021 (Archeological Services) refers to the sub trades that have been pre-qualified to provide pricing to the General Contractors for the mentioned work they pre-qualified for this project.

BULLETIN - CONSTRUCTION SAFETY

The responsibilities of the City of Toronto under the Occupational Health and Safety Act apply to all our employees regardless of the location at which they are working.

Responsibilities for the Construction Safety Regulations on construction sites are clearly spelled out in the Act under the definitions of constructor, employer, supervisor and worker.

The City of Toronto believes that the goal of safe and injury free construction sites is a priority for all parties involved in building construction.

Safety training for the City of Toronto Building Inspectors is mandatory. However the delivery of a safe working environment on construction sites must include the compliance of individual builders with the Occupational Health and Safety Act.

Safety measures include the following:1. Temporary guards on all openings,2. Correct use of ladders,3. Temporary or permanent stairs above or below grade by the time the sub floor is complete,4. Clear and safe access to the site,5. Protection of trenches and excavation below four feet deep, and 6. Correct use of fall prevention equipment where required.

As the employer responsible for the safety of building inspectors, the City of Toronto has instructed its BuildingInspectors not to conduct inspections on sites where conditions exist that could jeopardize their health and safety.

4. Access to the site has impediments or hazards, or5. Trenches or excavations lack required shoring or slope of bank.

Prior to calling for an inspection the appropriate safety measures shall be in place as a site inadequately provided with these measures is not ready for inspection. The City of Toronto Building Inspectors will cooperate with builders regarding the timing of making provision for these safety measures. However, if the measures are not provided, an Order Not To Cover could be issued and the Ministry of Labour informed.

PROTECTION NOTE

Implement measures necessary for the protection of adjoining structures from damages that may result from

demolition.

Pre-Demolition Notes:

1. Disconnect and cap all services to the building.

2. Remove all designated substances and hazardous materials in accordance with applicable legislation and

guidelines.

3. Remove all glass.

4. Erect hoarding/fencing and necessary to secure site.

5. Mitigate/suppress dust migration as outlined in accordance with the Healthy Environment’s requirement.

The attached demolition permit has been issued on condition that where the structure to be demolished is part of

a semi or abuts another structure:

1. Basement walls exposed by the demolition will be dampproofed, waterproofed and provided with

adequate drainage in accordance with Part 5 or Section 9.13 and 9.14 of the Ontario Building Code.

2. All holes created by the removal of joists from the dividing wall will be properly filled.

3. The dividing wall will be insulated to provide adequate thermal resistance in compliance with Part 5 or

Section 9.25 of the Ontario Building Code.

4. Flashing and cladding is provided to prevent penetration of rainwater into the dividing wall; and

5. Adequate steps will be taken to protect the remaining building from demolition damage, and from fire in

conformance with Part 9 of the Fire Code.

Demolition Clean Up Notes

The site shall be left: free from holes or excavations; clear, clean, graded and with suitable ground cover, to

prevent ponding and soil erosion.

Fire Prevention during Demolition:

Prevention or control of fire, and protection from fire of adjacent occupied spaces and adjoining properties, shall

conform to Part 8 of the Ontario Fire Code.

Building Ontario Fire Code Demolition Requirements

Demolition work shall comply with the following Ontario Fire Code requirements:

SECTION 8.1 GENERAL

Subsection 8.1.1. Application

Application 8.1.1.1. This Part applies to the prevention or control of fire during any demolition and the protection from fire of adjacent occupied spaces and adjoining properties. Subsection 8.1.2. Requirements

Building services 8.1.2.1. Existing building services that may be affected by demolition so as to cause a fire hazard shall be protected or be shut off and capped. Firewatch 8.1.2.2. (1) During periods when demolition operations will create a fire hazard to neighbouring properties or partially occupied spaces, a firewatch shall be provided.

(2) Where a firewatch is required, the demolition site shall be toured at least once each hour.

(3) The firewatch personnel shall be provided with a means of communication with the fire department, and be equipped with portable illumination and protective equipment.

(4) Prior to commencement of demolition, a plan conforming to Sentence (5) shall be prepared and implemented for the demolition site.

(5) The plan required by Sentence (4) shall include

(a) the designation and organization of site personnel to carry out fire safety duties, including firewatch if applicable,

(b) the emergency procedures to be used in case of fire, including

(i) sounding the alarm throughout the building ,

(ii) notifying the fire department , and

(iii) instructing site personnel on procedures to be followed when the fire alarm sounds,

(c) the control of fire hazards in and around the building , and

(d) the maintenance of fire fighting facilities. Storage of combustible salvage 8.1.2.3. (1) Combustible salvage, combustible waste material and rubbish shall not be permitted to accumulate on site in such quantity or such location as to cause a fire hazard.

(2) Where temporary chutes are installed on the exterior of a building they shall

(a) be of noncombustible material, or

(b) be installed a distance of at least 3 m from any opening in the building face.

Removal of combustible waste 8.1.2.4. Rubbish shall not be burned on the premises unless permitted in accordance with Article 2.6.3.4. Welding and cutting 8.1.2.5. Electric or gas welding and cutting equipment and the installation, operation and maintenance of electric or gas welding and cutting equipment shall be carried out in conformance with the requirements of Section 5.17. Standpipe systems 8.1.2.6. (1) During the demolition of any building with a standpipe system, the standpipe system complete with fire department connections, valves, couplings and hose, shall be maintained two floors below the level of the floor being demolished.

(2) Where no fire department standpipe connections exist in buildings 4 storeys or more in building height in buildings under demolition, a temporary connection shall be provided.

(3) In buildings not equipped with a standpipe system and over 8 storeys in building height, a temporary standpipe shall be provided.

(4) Standpipe systems shall be kept in such condition that they may be connected near street level, to a fire department pump, so as to supply water to every outlet on each floor.

(5) In buildings over 84 m in height, primary water supplies serving standpipe systems, including fire pumps, shall be maintained in operating condition in buildings under demolition. Access 8.1.2.7. (1) Fire fighting access routes shall be maintained in conformance with Section 2.5.

(2) Elevating devices shall be accessible for the use of firefighters for buildings more than 36 m in building height, measured between grade and the floor level of the top storey. Portable extinguishers 8.1.2.8. (1) Portable extinguishers shall be provided in buildings under demolition in conformance with Subsection 6.2.6. as if the building were graded for ordinary hazard under Subsection 6.2.5.

(2) Portable extinguishers required under Sentence (1) shall be maintained in conformance with Section 6.2.

Thank you for your request for comments on the above referenced application to carry out demolition and/or alteration of site building(s) located at 92 Front Street East (the Subject Building[s]) in the City of Toronto. Section 30 of the Occupational Health and Safety Act (OHSA) requires that a designated substance audit be conducted and a list of hazardous materials be presented to a contractor and sub-trades prior to tendering or offering work on a construction or demolition project. An owner that fails to comply with Section 30 is liable to contractors and sub-contractors in the event that they suffer any loss or damages as a result of non-compliance with the OHSA. The eleven designated substances are acrylonitrile, arsenic, asbestos, benzene, coke oven emissions, ethylene oxide, isocyanates, lead, mercury, silica, vinyl chloride. Polychlorinated Biphenyl’s (PCBs) and Ozone Depleting Substances (ODSs) as well as other materials considered hazardous are usually noted in the Designated Substances Survey as they may require special handling, storage and disposal measures in the construction/demolition process. The applicant submitted the following document(s) for review: 1. Pre-Demolition Survey for Designated Substances, prepared by ECOH Management Inc.

Comments: Based on the application submitted to the City of Toronto Buildings Department it is understood that demolition is planned for the Subject Building(s) (the “Work Area”). ECOH was retained to conduct an assessment of designated substances and hazardous materials within the Work Area. A representative of ECOH conducted a site visit(s) on November 7-9, 2011. The following comments provided by staff at Healthy Environments refer only to those designated substances and/or hazardous materials confirmed present or presumed to be present in the Work Area: Designated Substances Asbestos Bulk samples of suspect Asbestos Containing Materials (ACM) were collected and submitted for laboratory analysis to determine if asbestos is present. The analytical results indicated the following materials are confirmed or assumed ACM in various areas throughout the Work Area:

Parging cement mechanical pipe insulation on pipe fittings in: the Custodian Closet (Location 4), Snack Bar (Location 5), Electric Room (Location 14), Chiller Room (Location 15), and HVAC Room (Location 16)

Aircell mechanical pipe insulation on straight sections of piping in: the Electric Room (Location 14), HVAC Room (Location 16), and Garage Area (Location 20)

Transite cement board on walls throughout the Main Hall (Location 1) Smooth white plaster on ceilings in the Main Hall (Location 1), Women's Washroom

(Location 2), Men's Washroom (Location 3), Snack Bar (Location 5), Office (Location 6), Garage Washroom (Location 19), Storage Washroom (Location 22), and on the Stage (Location 17)

3 types of vinyl floor tiles: (1) 12"x12" beige with white streaks; 12"x12" brown; 12"x12" peach; 12"x12" cream

It is possible for ACM to remain in several hidden structural components of the building(s) warranting further investigation prior to commencing work in the current Work Area. For example, asbestos-containing pipe insulation may also be present within the wall, ceiling, and floor cavities throughout the building. The following materials can be presumed ACM: adhesives; components or wiring within motor controls centers, breakers, motors, or lights; concrete levelling compound; fire-door cores; insulation on or in high voltage wiring; mechanical packing, ropes and gaskets; and paper products where inaccessible (e.g. under wood flooring or under

metal or slate roofing). Further materials that may be present in the Work Area (e.g. buried services, such as underground piping; floor levelling compounds; packing materials and gaskets in valves and fittings; roofing materials; etc.) should be considered to be ACM. Should suspect ACM be uncovered during demolition activities, all work in the areas that may disturb the material should be stopped and samples of the suspect material should be collected and submitted for laboratory analysis to determine the presence of asbestos fibres. Confirmed ACM should be handled in accordance with all applicable regulations and guidelines. Lead Lead is reported to be present in the Work Area as: glaze on ceramic tiles on walls in Women's Washroom (Location 002), Men's Washroom (Location 003) and the TD Bank ATM Room (Location 24). Moreover, lead may be present within the copper domestic water pipes as well as in the following building components: (1) in lead acid batteries in emergency lighting; (2) a component in ceramic building products such as tiles and bricks; (3) a component of the solder on sweated joints between copper pipe and fittings; (4) a component of solder on wire connections of electric components; (5) a component of solder used to seal the bell fitting of cast iron water leader pipes; and (6) as a malleable metal sheeting/flashing around roof edges, vent stacks, HVAC fixtures, etc. A lower limit has not been set where precautions are not necessary to protect workers from exposure to lead. Therefore, it is important to apply general health and safety measures that include dust suppression, proper respiratory protection and protective clothing as appropriate. Exposures by inhalation, ingestion or absorption through skin may result from lead dust generated by sanding, grinding, polishing and sawing operations. Heating lead containing materials to temperatures above 500 degrees Celsius will result in the production of lead fumes. Handling of all lead-containing materials should be conducted in accordance with the Ministry of Labour Guideline, Lead on Construction Projects. Disposal of lead waste materials is regulated by Ontario Regulation 347 (O. Reg. 347). Mercury Mercury is reported to be present within possible paints and adhesives as well as fluorescent light tubes (in vapour form) within the Work Area. Specifically, approximately 10 fluorescent light tubes were observed throughout the Work Area. However, mercury is also commonly reported to be present in materials such as: (1) in liquid filled reservoirs in thermostats and sump pump level switches; (2) as a gas in fluorescent light tubes; and (3) as a bactericide or stabilizer in paints and caulking.

Mercury-containing equipment should be removed and recycled by a licensed contractor and discarded at a receiver licensed by the Ministry of the Environment. Handling and disposal of all mercury-containing materials should be made in accordance with all pertinent regulations and guidelines. Silica Silica is reported to be present in the Work Area in (1) concrete and masonry elements and (2) brick and mortar. A number of building materials within the Work Area may also contain crystalline silica, namely: concrete base; drywall surfaces; plaster finishes; brick/block finishes; and lay-in ceiling tiles. Other similar materials may contain silica in the Work Area. During a demolition, it is likely that silica dust will be generated and steps such as wetting down the area are to be taken to minimize the silica dust. Proper personal protective equipment is to be provided and worn as necessary. The Ministry of Labour Guideline, Silica on Construction Projects provides guidance in controlling exposure to silica during construction activities. Other Hazardous Materials Polychlorinated Biphenyls (PCBs) PCBs are reported to be present in the Work Area within fluorescent light ballasts. However, PCBs may also be present as an additive in caulking and elastic sealant materials as well as roofing material. All fluorescent lights should be disassembled to observe serial codes and then be compared to standard PCB Identifier Code Literature. Ontario Regulation 362 governs the maintenance of PCB waste storage and movements of PCB waste. Prior to the demolition, all PCB wastes must be removed from the building, packaged in accordance with SOR/2008-273 and incinerated at a provincially or federally permitted destruction facility. Electrical equipment containing liquids or compounds which contain PCB’s in excess of 50 ppm is also considered a PCB waste and should be handled and disposed of in accordance with all pertinent regulations. Dust Control Measures Appropriate dust control measures and personal protective measures embedded in Occupational Health and Safety legislation including applicable guidelines and regulations designed to provide protection for workers onsite. It is presumed that the area to be demolished will not be publicly accessible during construction/demolition and renovation activities nor will the Work Area be a public through-fare at any time during said activities. Therefore the protective measures mandated by Occupational Health and Safety Law are supported by the Medical Officer of Health.

Based on the information provided by the applicant, Healthy Environments, Toronto Public Health staff have no objection to the issuance of the demolition permit. It is recommended that the demolition permit be issued contingent on strict adherence to the following recommendations: Recommendations: 1. The removal, disposal and handling of all hazardous materials including, but not

limited to asbestos, lead, mercury, silica and PCBs shall be conducted in accordance with the Ministry of the Environment and the Ministry of Labour regulations and guidelines.

2. The owner shall ensure the implementation of mandated dust control measures during demolition/construction approved by the Medical Officer of Health.

BULLETIN - CONSTRUCTION SAFETY

The responsibilities of the City of Toronto under the Occupational Health and Safety Act apply to all our employees regardless of the location at which they are working.

Responsibilities for the Construction Safety Regulations on construction sites are clearly spelled out in the Act under the definitions of constructor, employer, supervisor and worker.

The City of Toronto believes that the goal of safe and injury free construction sites is a priority for all parties involved in building construction.

Safety training for the City of Toronto Building Inspectors is mandatory. However the delivery of a safe working environment on construction sites must include the compliance of individual builders with the Occupational Health and Safety Act.

Safety measures include the following:1. Temporary guards on all openings,2. Correct use of ladders,3. Temporary or permanent stairs above or below grade by the time the sub floor is complete,4. Clear and safe access to the site,5. Protection of trenches and excavation below four feet deep, and 6. Correct use of fall prevention equipment where required.

As the employer responsible for the safety of building inspectors, the City of Toronto has instructed its BuildingInspectors not to conduct inspections on sites where conditions exist that could jeopardize their health and safety.

4. Access to the site has impediments or hazards, or5. Trenches or excavations lack required shoring or slope of bank.

Prior to calling for an inspection the appropriate safety measures shall be in place as a site inadequately provided with these measures is not ready for inspection. The City of Toronto Building Inspectors will cooperate with builders regarding the timing of making provision for these safety measures. However, if the measures are not provided, an Order Not To Cover could be issued and the Ministry of Labour informed.
