Playhouse Auction & Raffle to Make a Major Impact on Youth ProgramsI have been working for the SHBA for some time but am still impressed with how our members will rally to support a need in our community.

Late last year, I was sitting in my office and took a phone call from City Council member Steve Salvatori. He told me I was on a conference call with a couple of other council members and their staff. They were meeting to discuss the potential of creating a fundraising event to help offset budget cuts at the City’s community centers. The Executive Director of the West Central Community Center, Kim Ferraro, had seen a fundraiser in Montana where playhouses were auctioned off to benefit a local charity.

They asked me if I thought our members would be willing to help with a similar effort in Spokane. I cautiously said I was sure we could help in some way but warned them I could not guarantee a number of playhouses until I reached out to our builders. From past experience I knew how much time and cost goes into the construction of a playhouse.

Of course, when I began contacting our leadership I was pleasantly surprised by the positive response. Our current President, Deacon Band, stepped up and was joined by Past Presidents, Phil Folyer and Tim Ayers and our Vice President, Jason Lawrence in committing to build playhouses.

From there, the momentum continued and we ended up with a total of 12 uniquely designed playhouses that were featured at the Premier Home Improvement Show and were all successfully sold as part of a fun auction that generated over $30,000 for programs that benefit at-risk youth in our community.

There was great publicity for this event in the community, that included recognition for the builders, but I wanted to personally thank everyone who responded to my request. You will see from the following list that most of the builders received significant support from their suppliers and subcontractors in constructing their playhouses.

I also want to thank those who stepped forward to purchase the playhouses and to Ziggy’s, FMI Sales, Avista, ProSource and Hytopz for helping to deliver the playhouses to their final destination. It was a difficult task and we could not have done it without their support.

At the end of this experience I have reaffirmed my belief in our members and could not be more proud to represent this great industry. These individuals proved to me that we truly are focused on our core purpose of Promoting, Protecting and Supporting our industry and our local community.

THE SPOKANE INITIATIVE DEBATETIMELINE

November 2009 | Envision Spokane defeated 76% - 24%No on Prop 4 Campaign: Early polling on the Envision Spokane ballot title showed that 53% of likely voters would be inclined to support their proposal. Therefore, in conjunction with the Save Our Spokane opposition campaign and the REALTORS efforts, the JOBS Coalition spearheaded an operation to reverse these early favorable public opinion polls utilizing television, direct mail, radio ads, and grassroots volunteer efforts at the doors. Following the rigorous campaign activities, 76% of voters were persuaded to vote down the measure.

November 2011 | Envision Spokane defeated 51% - 49%No on Prop 1 Campaign: Envision Spokane returned with a smaller measure that they had hoped would be more palatable for the voters and more difficult for JOBS to counter. Again, many in the business community came together, although the threat and therefore the effort needed was underestimated following the strong defeat in 2009. The coalition was still successful, however this allowed Envision to gain a strong foothold and only lost at the ballot box by 1000 votes.

April 2012 | Initiatives Filed (Again) for 2013With the newly elected Spokane City Council looking to close a large loophole in the City’s initiative process, Envision Spokane and a new organization called Spokane Moves to Amend the Constitution (SMAC) quickly filed initiatives drafted by their national organization the Community Environmental Legal Defense Fund (CELDF) so as to be grandfathered into the old process.

May 2012 | Initiatives Filed (Again) for 2013The Spokane City Council passed a new ordinance requiring that the city attorney’s office must write the ballot summary and that a fiscal statement must be included with the measure. These new rules brought the City of Spokane into conformity with the State of Washington.

June - Aug 2012 | The Bellingham Community Bill of RightsCELDF, the same national organization behind the Envision Spokane group aided in the filing of a ‘Community Bill of Rights’ in the City of Bellingham, WA. The City Council realizing that the initiative was very likely illegal and unconstitutional voted 7-0 to challenge the validity of the initiative in a court of law. On Aug 6, the Whatcom CO Superior Court agreed with the City’s assessment and removed the initiative from the Bellingham ballot. July 2012 | Statewide Community Rights Network and ‘Spokane Declaration’A press release was issued launching the statewide ‘community rights network’ and a ‘Spokane Declaration’ that among other things described a new coalition in Spokane made up of the Envision Spokane, SMAC, CELDF, Occupy Spokane groups.

April 2013 | Signatures Submitted on 2013 InitiativesBoth Envision Spokane and the SMAC group submitted their signed petitions to the City Council.

The Council forwarded the petitions to the County Auditor for Verification and asked the City Attorney to complete a legal review of both proposed initiatives.

May 2013 | Legal ReviewAs expected, the legal review completed by the City confirmed that both initiatives are very likely in violation of both the State and Federal Constitutions as well as established state and federal law.

May – Nov 2013 | Ensuring Validity in a Court of LawDebate still in process.

Among many other things, the Envision Spokane initiative attempts to strip the zoning powers away from the Spokane City Council and illegally grant them to neighborhood majorities. In a 2011 study of a nearly identical measure, the Washington Policy Center stated that this provision could lead to neighborhoods blocking “commercial, industrial, or residential development it its area, effectively ending building and modernization in many parts of the city.”

The SMAC initiative seeks to take away our right to advocate for sound policies and our right to support pro-growth candidates. The measure even takes away corporate protections identifying boards and directors as potentially being criminally responsible for any violation. We have nearly 700 members in the Spokane area who are incorporated businesses and from time to time communicate with their elected officials, and support good candidates for elective office, and this measure takes away their rights to do both.

Prepare for the Unexpected -Prepare Your Company for a LawsuitImagine that 4-years ago you started to work on a new custom home, a new spec home or a large remodel for a residential customer. During the 7-month project, starting in March 2009 and ending in September 2009, you utilized the services of a framing contractor, siding contractor and roofing contractor. For the sake of discussion we will assume that you used one of the Model Residential Construction Contracts put out by the Construction Law Section of the Washington State Bar Association (http://www.wsba.org/Legal-Community/Sections/Construction-Law/Construction-Contracts), and that the customer (“Owner” as defined in the Contract) was required to be named as an additional insured under your Commercial General Liability (CGL) policy. Also, during the course of completing the project, your insurance was up for renewal and you switched brokers and carriers in July 2009.

Today you have just received a lawsuit brought against your company by the Owner, alleging that the weather-resistive barrier (WRB) installed over the OSB, beneath the lap

siding, was incorrectly installed. The Owner also alleges that the window installation and window flashing work was improperly performed, resulting in water intrusion into the home. The Owner also alleges that the tile roof was improperly installed and the $40,000 deck was improperly framed and needs to be completely replaced. [Do you know whether your insurance policies and/or your subcontractors’ insurance policies will cover any of the alleged damages? Do you know whether your insurance company and/or your subcontractors’ insurance company will hire an attorney to defend you from the lawsuit?]

If, over the past 4+ years, you have relied on the expertise of a knowledgeable banker, accountant, attorney and insurance broker, it is likely that the lawsuit is not something that you will lose considerable sleep over, regardless of whether or not the framing contractor, siding contractor and/or roofing contractor are solvent and/or adequately insured. That being said, often times the first

1) Legitimacy Value: We are composed of the absolute best businesses in Eastern Washington. Put our membership roster to the test. My business joined just to be recognized as a legitimate builder. I wanted the SHBA logo on my website to show that. It is that valuable. I believe in the quality of our members and stake my success on being one.

2) Opportunity: Do you have a vendor or contractor that is not a member? Now would be a good time to get them on board. Help them strengthen their business by leading the way to new contacts and opportunities. There will be many doors opening for those with the proper network. I encourage you to invite all of your vendors and even friends in the industry to a Nothing But Networking event. We will help them find that next big opportunity.

3) Advocacy: Our collective voice is powerful and should be that of all small businesses. So many of our friends, neighbors, colleagues, and co-workers are looking for a megaphone pointed at our local and state government officials. Let them know that the search is over. We are the voice of the small business owner and the local construction industry. We have direct access to the decision makers. You would be happy to know that they are listening and taking notes. Let everyone know that as a member, your voice can be heard.

So now that you have all of the answers, and are ready to build upon and shore up your existing network of businesses, do you have any questions? President’s Letter

Falls are the most frequent cause of fatalities at construction sites and annually account for one of every three construction-related deaths. Workers have fallen off edges of every description, especially floors and roofs, and through openings in floors, roofs, and walls.

Identifying fall hazards and deciding how best to protect workers is the first step in reducing or eliminating fall hazards. Whether conducting a hazard assessment or developing a comprehensive fall protection plan, thinking about fall hazards before the work begins will help to manage fall hazards and focus attention on prevention efforts. If personal fall protection systems are used, particular attention should be given to identifying attachment points and to ensuring that employees know how to properly don and inspect the equipment.

You should develop a written fall protection plan and maintain it on the job site. The plan must describe how your company will protect workers on a given work site when employees are working 10 feet or more above the ground, other work surfaces, or water.

The plan should:

✓ Identify all fall hazards in the work area.

✓ Describe the method of fall arrest or fall restraint to be provided.

✓ Outline the correct procedures for the assembly, maintenance, inspection, and disassembly of the fall protection system to be used.

✓ Explain the method of providing overhead protection for workers who may be in or pass through the area below the work site.

✓ Clarify the correct procedures for the handling, storage, and securing of tools and materials.

✓ Communicate the method for prompt, safe removal of injured workers.

Before you can develop a fall protection plan, you must understand two important definitions:

1. Fall Arrest System. This equipment protects someone from falling more than 6 ft. or from striking a lower object in the event of a fall, whichever distance is less. This equipment includes approved full-body harnesses and lanyards properly secured to anchorage points or to lifelines, safety nets, or catch platforms.

2. Fall Restraint System. This apparatus keeps a person from reaching a fall point; for example, it allows someone to work up to the edge of a roof but not fall. This equipment includes standard guardrails, a warning line system, a warning line and monitor system, and approved safety belts (or harnesses) and lanyards attached to secure anchorage points.

To develop a fall protection work plan, you must identify your company and the work site to which the plan applies. This information should be listed as the first item in your plan. After you identify your company and work site in the plan:

a. Identify all fall hazards in the work area. To determine fall hazards, you must review all jobs and tasks to be done. After all fall hazards have been identified, list those requiring employees to work 10 feet or more above the ground, other work surfaces, or water.

e. Describe the method of providing overhead protection for workers who may be in or pass through the area below the work site. This could be one or more of the following:

✓ Hard hats are required on all job sites.

✓ Warning signs will be posted to caution of existing hazards.

✓ The area under the material handling areas of the roof will have a warning line installed at a distance at least as great as the height of the building and a minimum of 8 ft. on either side to prevent workers from accidentally walking into the hazard area.

✓ Debris nets will be used.

✓ Toe boards must be installed on all walkways and decks where workers may be below.

✓ Screens will be installed between the toe board and the midrail at all locations where employees work below or if conditions warrant.

f. Describe the method for prompt, safe removal of injured workers.

g. Include where (on the job site) a copy of this plan will be posted.

h. Train and instruct all personnel in all of the above items.

i. Keep a record of employee training and maintain it on the job.

“As the housing market stabilizes, it might be easier to sell a home and relocate as job opportunities present themselves,” he says. “Usually there’s a one-year lag between when we see surges in employment growth and an increase in population growth.” Even though 2012 out-of-state driver’s license numbers were nearly level with the previous year’s total, calculations by the state Office of Financial Management indicate net migration into Spokane likely edged upward, says Patrick Jones, executive director of the Eastern Washington University Institute for Public Policy and Economic Analysis. “More people were moving into the county than were moving out of the county,” Jones says. Most

new residents here have moved to the region because of job opportunities, he says, adding. “This isn’t a retirement destination like Florida.”

Doug Tweedy, Spokane-based regional economist for the Washington state Employment Security Department, says the labor force is growing here. “Employment is up, but as opportunities increase, more people are out there looking for those jobs,” Tweedy says.

Spokane County also is showing an attractive mix of jobs, he says. “Spokane is

gaining some good jobs in skilled industries like manufacturing and health care,” he says.

In March, Spokane County gained, 3,200 jobs compared with the year-earlier month, while the unemployment rate also improved to 9.1 percent, compared with a 9.7 percent unemployment rate in the year-earlier month.

Statewide, out-of-state license surrenders were down 2.1 percent in 2012 and down 5.6 percent in 2011 following a 23 percent increase in 2010.

Glenn Crellin, Seattle-based associate director for research at the University of Washington Runstad Center for Real Estate Studies, doesn’t attribute much significance to the difference between the drivers’ license surrender rates in Spokane County and statewide as far as in-migration trends go.

“A significant part of the population growth in the state is in the greater Seattle area, and it’s concentrated in the city where the rate of vehicle ownership is lower, and there may be less pressure felt to turn in driver’s licenses,” Crellin says.

Crellin says the in-migration rate into Washington is higher than in surrounding states, particularly Oregon and California, because the job market is improving more rapidly in Washington.

Biomedical and high-tech jobs are driving job growth, and some of that growth is spilling over into Spokane County, he says.

California drivers surrendered 1,243 licenses in Spokane County in 2012, which was a three-year low. That number for Spokane County alone, though, was still nearly five times the total number of driver’s licenses surrendered from all counties in Washington State to California in 2012.

“California has had challenges in recent years after decades of leading the country in population growth,” Crellin says.

Other states collectively reported they received far fewer drivers’ licenses from Washington State than Washington receives from all other states. In 2012, a total of 41,376 Washington state driver’s licenses were reported surrendered outside of the state, the lowest total in more than 20 years. Conversely, out-of-state licenses surrendered in all of Washington State in 2012 totaled 147,674.

However, understanding the scope and limitations of a policy can be much more confusing than most contractors, subcontractors and non-construction accountants, bankers, attorneys and insurance brokers recognize.

Make sure that your insurance policy provides you with the type of protection you are looking for. You do not want to find out 4+ years later

that the policy you purchased was of little or no value. Make sure that you are utilizing valid contracts that clearly define the rights, duties and obligations imposed on all parties – as well as the mechanism for resolving disputes. While there may be situations where you change carriers during a project, make sure that your insurance broker is knowledgeable on how the switch (during and/or after the project) may impact your coverage (should something go wrong prior to completion or 4, 5, 6+ years after completion). Before you agree to name an Owner as an additional insured, or before you require a subcontractor to name you as an additional insured, make sure you understand that there are several different additional insured endorsements, and not all are created equal.

Falls are the most frequent cause of fatalities at construction sites and annually account for one of every three construction-related deaths. Workers have fallen off edges of every description, especially floors and roofs, and through openings in floors, roofs, and walls.

Identifying fall hazards and deciding how best to protect workers is the first step in reducing or eliminating fall hazards. Whether conducting a hazard assessment or developing a comprehensive fall protection plan, thinking about fall hazards before the work begins will help to manage fall hazards and focus attention on prevention efforts. If personal fall protection systems are used, particular attention should be given to identifying attachment points and to ensuring that employees know how to properly don and inspect the equipment.

You should develop a written fall protection plan and maintain it on the job site. The plan must describe how your company will protect workers on a given work site when employees are working 10 feet or more above the ground, other work surfaces, or water.

The plan should:

✓ Identify all fall hazards in the work area.

✓ Describe the method of fall arrest or fall restraint to be provided.

✓ Outline the correct procedures for the assembly, maintenance, inspection, and disassembly of the fall protection system to be used.

✓ Explain the method of providing overhead protection for workers who may be in or pass through the area below the work site.

✓ Clarify the correct procedures for the handling, storage, and securing of tools and materials.

✓ Communicate the method for prompt, safe removal of injured workers.

Before you can develop a fall protection plan, you must understand two important definitions:

1. Fall Arrest System. This equipment protects someone from falling more than 6 ft. or from striking a lower object in the event of a fall, whichever distance is less. This equipment includes approved full-body harnesses and lanyards properly secured to anchorage points or to lifelines, safety nets, or catch platforms.

2. Fall Restraint System. This apparatus keeps a person from reaching a fall point; for example, it allows someone to work up to the edge of a roof but not fall. This equipment includes standard guardrails, a warning line system, a warning line and monitor system, and approved safety belts (or harnesses) and lanyards attached to secure anchorage points.

To develop a fall protection work plan, you must identify your company and the work site to which the plan applies. This information should be listed as the first item in your plan. After you identify your company and work site in the plan:

Therefore, in conjunction with the Save Our Spokane opposition campaign and the REALTORS efforts, the JOBS Coalition spearheaded an operation to reverse these early favorable public opinion polls utilizing television, direct mail, radio ads, and grassroots volunteer efforts at the doors. Following the rigorous campaign activities, 76% of voters were persuaded to vote down the measure.

November 2011 | Envision Spokane defeated 51% - 49%No on Prop 1 Campaign: Envision Spokane returned with a smaller measure that they had hoped would be more palatable for the voters and more difficult for JOBS to counter. Again, many in the business community came together, although the threat and therefore the effort needed was underestimated following the strong defeat in 2009. The coalition was still successful, however this allowed Envision to gain a strong foothold and only lost at the ballot box by 1000 votes.

April 2012 | Initiatives Filed (Again) for 2013With the newly elected Spokane City Council looking to close a large loophole in the City’s initiative process, Envision Spokane and a new organization called Spokane Moves to Amend the Constitution (SMAC) quickly filed initiatives drafted by their national organization the Community Environmental Legal Defense Fund (CELDF) so as to be grandfathered into the old process.

May 2012 | Initiatives Filed (Again) for 2013The Spokane City Council passed a new ordinance requiring that the city attorney’s office must write the ballot summary and that a fiscal statement must be included with the measure. These new rules brought the City of Spokane into conformity with the State of Washington.

June - Aug 2012 | The Bellingham Community Bill of RightsCELDF, the same national organization behind the Envision Spokane group aided in the filing of a ‘Community Bill of Rights’ in the City of Bellingham, WA. The City Council realizing that the initiative was very likely illegal and unconstitutional voted 7-0 to challenge the validity of the initiative in a court of law. On Aug 6, the Whatcom CO Superior Court agreed with the City’s assessment and removed the initiative from the Bellingham ballot. July 2012 | Statewide Community Rights Network and ‘Spokane Declaration’A press release was issued launching the statewide ‘community rights network’ and a ‘Spokane Declaration’ that among other things described a new coalition in Spokane made up of the Envision Spokane, SMAC, CELDF, Occupy Spokane groups.

April 2013 | Signatures Submitted on 2013 InitiativesBoth Envision Spokane and the SMAC group submitted their signed petitions to the City Council.

The Council forwarded the petitions to the County Auditor for Verification and asked the City Attorney to complete a legal review of both proposed initiatives.

May 2013 | Legal ReviewAs expected, the legal review completed by the City confirmed that both initiatives are very likely in violation of both the State and Federal Constitutions as well as established state and federal law.

May – Nov 2013 | Ensuring Validity in a Court of LawDebate still in process.

Among many other things, the Envision Spokane initiative attempts to strip the zoning powers away from the Spokane City Council and illegally grant them to neighborhood majorities. In a 2011 study of a nearly identical measure, the Washington Policy Center stated that this provision could lead to neighborhoods blocking “commercial, industrial, or residential development it its area, effectively ending building and modernization in many parts of the city.”

The SMAC initiative seeks to take away our right to advocate for sound policies and our right to support pro-growth candidates. The measure even takes away corporate protections identifying boards and directors as potentially being criminally responsible for any violation. We have nearly 700 members in the Spokane area who are incorporated businesses and from time to time communicate with their elected officials, and support good candidates for elective office, and this measure takes away their rights to do both.

Prepare for the Unexpected -Prepare Your Company for a LawsuitImagine that 4-years ago you started to work on a new custom home, a new spec home or a large remodel for a residential customer. During the 7-month project, starting in March 2009 and ending in September 2009, you utilized the services of a framing contractor, siding contractor and roofing contractor. For the sake of discussion we will assume that you used one of the Model Residential Construction Contracts put out by the Construction Law Section of the Washington State Bar Association (http://www.wsba.org/Legal-Community/Sections/Construction-Law/Construction-Contracts), and that the customer (“Owner” as defined in the Contract) was required to be named as an additional insured under your Commercial General Liability (CGL) policy. Also, during the course of completing the project, your insurance was up for renewal and you switched brokers and carriers in July 2009.

Today you have just received a lawsuit brought against your company by the Owner, alleging that the weather-resistive barrier (WRB) installed over the OSB, beneath the lap

siding, was incorrectly installed. The Owner also alleges that the window installation and window flashing work was improperly performed, resulting in water intrusion into the home. The Owner also alleges that the tile roof was improperly installed and the $40,000 deck was improperly framed and needs to be completely replaced. [Do you know whether your insurance policies and/or your subcontractors’ insurance policies will cover any of the alleged damages? Do you know whether your insurance company and/or your subcontractors’ insurance company will hire an attorney to defend you from the lawsuit?]

If, over the past 4+ years, you have relied on the expertise of a knowledgeable banker, accountant, attorney and insurance broker, it is likely that the lawsuit is not something that you will lose considerable sleep over, regardless of whether or not the framing contractor, siding contractor and/or roofing contractor are solvent and/or adequately insured. From there, the momentum continued and we ended up with a total of 12 uniquely designed playhouses that were featured at the Premier Home Improvement Show and were all successfully sold as part of a fun auction that generated over $30,000 for programs that benefit at-risk youth in our community.

There was great publicity for this event in the community, that included recognition for the builders, but I wanted to personally thank everyone who responded to my request. You will see from the following list that most of the builders received significant support from their suppliers and subcontractors in constructing their playhouses.

I also want to thank those who stepped forward to purchase the playhouses and to Ziggy’s, FMI Sales, Avista, ProSource and Hytopz for helping to deliver the playhouses to their final destination. It was a difficult task and we could not have done it without their support.

At the end of this experience I have reaffirmed my belief in our members and could not be more proud to represent this great industry. These individuals proved to me that we truly are focused on our core purpose of Promoting, Protecting and Supporting our industry and our local community.

Playhouse Auction & Raffle to Make a Major Impact on Youth ProgramsI have been working for the SHBA for some time but am still impressed with how our members will rally to support a need in our community.

Late last year, I was sitting in my office and took a phone call from City Council member Steve Salvatori. He told me I was on a conference call with a couple of other council members and their staff. They were meeting to discuss the potential of creating a fundraising event to help offset budget cuts at the City’s community centers. The Executive Director of the West Central Community Center, Kim Ferraro, had seen a fundraiser in Montana where playhouses were auctioned off to benefit a local charity.

They asked me if I thought our members would be willing to help with a similar effort in Spokane. I cautiously said I was sure we could help in some way but warned them I could not guarantee a number of playhouses until I reached out to our builders. From past experience I knew how much time and cost goes into the construction of a playhouse.

Of course, when I began contacting our leadership I was pleasantly surprised by the positive response. Our current President, Deacon Band, stepped up and was joined by Past Presidents, Phil Folyer and Tim Ayers and our Vice President, Jason Lawrence in committing to build playhouses.
