Pursuant t o Section 5(b) (7 ) o f Public Law 2-51 o f t h e Commonwealth o f t h e Nor thern Mariana Islands, t h e subject regulat ions are hereby proposed fo r promulgat ion.

To establ ish un i fo rm regulat ions govern ing hun t ing , f i sh ing and endangered and threatened species w i t h respect to law as set f o r t h in Section 5(a) (b) (c) o f Publ ic Law 2-51.

For t h e purposes o f these regulations, t h e term

l1ACTl1 means CNMI P.L. 2-51, "The Fish, Game and Endangered species act."

llAnimalll means a n y species o r organism in t h e animal kingdom inc luding, but n o t l imited to, mammals, b i rds , rept i les, amphibians, f ish, mollusks, crustaceans, and corals.

llChiefll means the Chief o f the Div is ion o f Fish and Wildlife o f t h e Department o f Natura l Resources, CNMI.

"Director" means the Director , Department o f Natural Resources, CNMI.

llDepartmentlr means Department o f Natural Resources.

"Subsistence Ta kingff means t h e customary, t rad i t iona l t ak ing o f res t r i c ted game to p rov ide sustenance f o r t h e taker and h is immediate family when no o the r means o f p rov id ing sustenance is available o r when cur ta i lment would resu l t in sever malnutr i t ion.

I1Take" means to harass, harm, pursue, hun t , shoot, angle, wound, k i l l , t rap , spear, capture o r collect, o r t o attempt to engage in any such conduct.

"Threatened Species" means a n y species which i s l i ke l y t o become an endangered species w i th in t h e foreseeable f u t u r e th roughou t a l l o r a s igni f icant po r t i on o f i t s range.

ItWasteful Manner" means any t a k i n g o r method o f t ak ing which i s l i k e l y to resu l t in t h e k i l l i ng o r i n j u r y o f wi ld l i fe inc lud ing endangered a n d threatened species beyond those needed fo r subsistence purposes, o r which resu l ts in t h e waste o f a substant ial por t ion o f a populat ion o f wi ldl i fe, a n d includes w i thout l imitat ion the employment o f a method o f tak ing which is no t l i ke l y t o assure the capture o r k i l l i n g o f t h e wi ldl i fe, o r which i s not immediately followed by a reasonable e f f o r t to re t r i eve the wi ldl i fe.

"Southern island^^^ lnc ludes Saipan, B i r d Island, Forbidden Island, Managaha, T in ian, Agui jan, Naftan Rock, Rota and Anjota Island.

"Nor thern IslandsI1 lncludes Farallon de Mendinil la, Anatahan, Sariguan, Guguan, Alamagan, Pagan, Agr ihan, Asuncion, Maug Islands and Farallon de Pajaros .

Section 4. Exemptions

Div is ion s t a f f and conservat ion of f icers shall be exempt from provis ions o f t h e Act and regulat ions issued under t h e Act when ac t ing in t h e course o f t he i r off ic ial dut ies, p rov ided those dut ies are consistent w i th t h e overal l purposes o f the Act.

Section 5. Penalties

Violation o f a n y o f the prov is ions o f t h i s chapter shal l be penalized in accordance wi th section 1 0 o f P.L. 2-51.

No Person shal l be issued a l icense if he has :

1. been convicted o f a n y v io lat ion o f these regulat ions o r a n y o the r law which re la t ing t o t h e tak ing o f any f i s h and game; o r

2. fai led t o prov ide t h e information requ i red t o issue a l icense o r has made false statements in h i s application; o r

3. no va l id CNMI ident i f icat ion ca rd al lowing h im t o possess a f irearm, if he i s app ly ing f o r a h u n t i n g license.

d. Durat ion o f License

A l icense shal l be va l i d f rom 0000 h o u r o f January 1 until December 31 a t 2400 hours, regardless of t h e date o f i t s issuance. However, a l icense may be suspended o r revoked by t h e Ch ie f o f t h e Division a f t e r a c i v i l hear ing conducted by t h e Division.

f. T rans fe r o f License

It is un lawfu l t o borrow, loan, o r in any way t rans fe r one's own license o r receive another 's license.

g. Display o f License

Sect ion 2. Scient i f ic Research License :

a. Purpose

Section 3.

T h e purpose o f the sc ient i f ic research l icense is to gain access to t h e research data fo r use in resource management.

b. Persons Requ i r ing License

1. Scient i f ic research l icense a re requ i red f o r al l persons conduct ing biological research in t h e CNMI.

2 . When t h e research is being conducted by a team, o n l y t h e Team Leader i s r e q u i r e d to have a l icense p rov ided :

A. T h e team leader i s always present d u r i n g f ie ld studies.

B. A l l o the r members o f the team a r e under the team leaders d i rec t supervision.

c. lssuance o f l icense

1. Pr io r t o issuing t h e l icense the d i rec to r o r chief shal l analyze t h e benef i t o f t h e par t icu lar research t o t h e CNMI and determine whether it outweights any harm t o t h e resource involved .

2. T h e l icense wi l l be issued o n l y upon agreement by t h e licensee t h a t a complete data r e p o r t be submit ted t o t h e d iv is ion w i th in one (1 ) year .

d. Exemption f rom Regulations

The Di rec tor may exempt, fo r a specif ic per iod o f time, t h e licensee f rom specif ic regulat ions.

Expor t License :

a. Persons Requ i r ing License

Any person who f o r gain removes a n y f i sh o r wi ld l i fe f rom t h e ju r isd ic t ion o f t he Commonwealth fo r e x p o r t must obtain an e x p o r t license.

b. lssuance o f License

2. Based upon such an assessment t h e Director may deny issuance o f an expor t l icense o r g r a n t it issuance upon specif ic terms and conditions. Such specif ic terms shal l inc lude any l im i t necessary fo r t h e protect ion of f i sh and game on t h e number, size, repro- duc t ive state and geographic location o f t h e species covered b y t h e license.

c . Record Keeping

a. A person granted a n expor t l icense shal l be r e q u i r e d t o maintain t h e fol lowing records which must be presented upon annual renewal o f the e x p o r t license.

HUNTING REGULATIONS

Section 1. General Regulations

Leaal Hunt ina Time:

It shall be legal to hunt w i ld game in season f rom one-half h o u r before sunr ise to one-half hou r a f t e r sunset . Hun t ing License Required:

It shal l be un lawfu l fo r any person t o take a n y wi ld l i fe w i thout f i r s t obta in ing a general hunting license f rom t h e Ch ie f o r a n y author ized agent. A l l persons obta in ing a hunting license shal l complete hun te rs r e p o r t cards (attached to each l icense) whether t h e y ha rves t game o r not.

U n ~ r o t e c t e d Wildlife:

T h e fo l lowing wi ld l i fe may be taken a t any t ime o f year during t h e legal shoot ing time as specif ied in Part 3 Section l a w i thout a hunting license.

Hunt ing Age:

On ly persons 21 years o f age o r o lder may hunt wi th f irearms. Persons 18 years o f age o r o lder may hunt w i t h bows and ar rows o r cross bows.

No person shall h u n t at a n y t ime whi te under t h e inf luence o f alcohol o r a narcot ic o r another d isabl ing drug.

I t shall be presumed t h a t a person i s u n d e r t h e inf luence o f alcohol when the alcohol content o f h is blood i s .10 percent whether t h e resu l t is o f a test o f h is blood, breath, o r ur ine.

Hunt ing from Moving Vehicle Prohib i ted:

No person shal l take any wi ld l i fe while operat ing o r riding in o r on a moving automobile, power propel led vehicle o r o the r mechanical contr ivance. Nor shal l a n y person take any wi ld l i fe whi le mounted upon an animal's back.

Use of L iah ts and F i re Prohibi ted:

The use o f f i r e o r a r t i f i c ia l light o f any kind as an a id t o t h e tak ing o f game is prohib i ted.

Villaaes and Roads Closed to Hunt ina :

T h e f i r i n g o f a n y g u n o r bow and a r row t o take any wi ld l i fe i s p roh ib i ted w i th in a vi l lage o r w i th in 100 ya rds thereof o r w i th in 100 ya rds o f an occupied dwel l ing, o r across a pub l ic road, o r w i th in twenty- f i ve ( 2 5 ) feet o f a road.

Use o f Doas:

Dogs may be used t o hunt and re t r i eve game b i r d s d u r i n g t h e legal bird season on ly . T h e y shal l n o t be used t o hun t , pu rsue o r k i l l any o the r game o r non-game species, inc luding unpro tec ted species; except as requ i red f o r subsistance tak ing.

Hunt ina Areas:

T h e Di rec tor shall, p r i o r t o any season opening, advert ise, in one newspaper d i s t r i bu ted in t h e Commonwealth, f o r one week t h e geographic boundaries o f allowable hunting fo r each species o f game. Hunt ing outs ide o f these of f ic ia l ly designated and advert ized areas wi l l be s t r i c t l y prohib i ted.

Tak ing o f Sambar Deer, Wild Goats and Wild Pigs:

1. Only Sambar deer hav ing v is ib le ant le rs may be taken.

A. Bows o r crossbows must have a minimum draw weight o f a t least fifty (50) Ibs.

B. Bow and Crossbow ar rows must be f i t t e d w i th arrowheads t h a t measure n o less t h a n seven-eights ( 7 1 8 ) o f a n i nch a t t h e widest po in t o r t ha t have n o fewer than two sharp c u t t i n g edges.

When us ing .410 gauge shotguns to hunt game b i rds , t h e shot shall be n o la rger than No. 6.

T h e Di rec tor may, f rom time to time, author ize special hun ts fo r t h e purpose o f cont ro l l ing wi ld l i fe populat ions tha t :

A. cause economic hardship.

B. present a danger o r sa fe ty hazard t o man.

C. cause adverse impact to hab i ta t environment.

When it is determined by t h e Director , in consultat ion w i th t h e ch ie f and s ta f f , t ha t a morator ium o n hunting o f a n y o r al l game species ident i f ied in these regulat ions i s requ i red , he shal l have t h e a u t h o r i t y t o do so. A moratorium shal l remain in e f fec t until it i s determined by t h e Director , t h e Chief, and h i s s ta f f t ha t the populat ion o f the af fected specie has reached levels sufficient t o susta in hunting pressure.


T h e Di rec tor may exempt persons from bag and season l imits fo r subsistence t a k i n g o f wi ldl i fe, as def ined in Part 1 sect ion 3t.

Section 2. No r the rn Islands :

a. Persons t ranspor t i ng game taken on t h e Nor the rn Islands to t h e is lands o f Saipan, T in ian o r Rota must check in a t t he Div is ion o f Fish and Wildlife on Saipan before t h e game is landed.

b. Bag l imits as promulgated in Par t 3 Section 1 . q shal l no t be in ef fect f o r t h e Nor the rn Islands.

c. Season l imi ts as promulgated in Par t 3 Section 1 . q shall be in effect.

Section 3. Marianas F r u i t Bat :

a. Moratorium:

It shall be unlawful to take fruit bats ( P t e r o ~ u s mariannus and P. tokudae) on the is lands o f ' Rota, T in ian . Aqu iqu=,andSaipan f o r a per iod o f two ( 2 ) years-from t h e e f fec t ive date o f these regulat ions. Fu r the r , it shal l be unlawful t o take f r u i t bats on a n y is land n o r t h o f Saipan fo r a per iod o f one (1) year f rom t h e ef fect ive date o f these regulat ions.

Section 4. Coconut Crab ( B i r g u s la t ro ) AYUYU

a. General Provisions:

These prov is ions app ly on ly t o coconut c rabs taken w i th in the Commonwealth o f t h e Nor the rn Marianas.

i. Other Nets

With the exception o f those nets permi t ted f o r use in Section 3 o f t h i s pa r t , a l l o ther nets found in a person's possession t h a t are o f s t retched mesh smaller than t h e allowable one and one h a l f (13) inch minimum wil l be in violat ion o f these regulat ions.

j. Use Restr ic t ions

Nets must be removed f rom a n area if they are:

1. Found t o be in te r fe r i ng w i th operat ions o f vessels in harbors o r customary o r off ic ial anchorages a n d / o r deep water approaches to ha rbo rs o r w i th in harbors.

2. Hazards to any coastwise travel.

k. Net Mark ing

Nets placed in o r near waters considered t o b e used fo r f requent passage o f vessels in t rans i t , shal l be marked a t bo th ends w i t h e i ther b r i g h t colored f loats o f a t least twelve (12) inches in diameter, o r f loats w i t h at tendant red flags. Nets so removed may no t be o f fe red f o r sale in t h e Commonwealth and must be disposed o f in some o ther manner.

In addi t ion t o general requirements in Part 2 Section 1 o f these regulat ions, a Net License:

1. Shall be requ i red f o r a l l ne ts except fo r cast ne t ( talaya) and Aquar ium nets used to col lect f i sh fo r personal use.

I t wi l l also be t h e respons ib i l i t y o f all licensees t o submit monthly repo r t s to t h e Chief t ha t l i s t a l l dates o f useage, species and numbers o r weights captured and location and disposit ion o f t he catch. Section 4. Collection o f Hard Corals

a. Prohibi t ions

T h e collection a n d / o r removal from t h e water o f t he Commonwealth o f a n y a n d al l species o f Hermatypic ree f bu i ld ing h a r d corals is p roh ib i ted w i th the fol lowing exception. A l icense may be issued b y t h e Chief f o r t h e collection o f dead coral f o r t h e purpose o f manufactur ing l1Afukl1 (Calcium Carbonate).

1. A l l coral landed b y t h e licensee may be inspected to insure t h a t a n y coral taken was dead a t t ime o f col lect ion.

Section 5. Harvest o f Trochus Ni lot icus (A l i l i ng )

a. Harvest ing

1. No t rochus may be taken except during open season declared by Director .

2. No Trochus shal l be taken whose shel l i s less than th ree and one-half (33) inches in diameter a t t h e base.


b. Sanctuaries

Two closed areas a re hereby established. These areas a r e designated to i nsu re cont inuous high levels o f p roduc t i v i t y o f Trochus. These closed areas are:

1. An area encompassing t h e b a r r i e r reef from t h e Carapan channel marker ( l ighthouse) south one mile. T h e inshore boundary ex tents 50 yards inshore o f the inshore edge o f t h e reef. The of fshore b o u n d r y i s the 40 ft dep th contour .

2. T h e ent i re reef a t Tank Beach, Kagman (Chacha) , extend ing from t h e n o r t h e r n r o c k y headland t o the southern r o c k y headland and bounded inshore b y t h e mean high t i d e l ine and o f fshore by t h e 40 ft d e p t h contour .

c. License.

Commercial harves t ing , buying o r sel l ing o f Trochus shal l hereby be subject t o l icensing and repor t i ng requirements as out l ined below:

1 . Harvest ing :

A. A permi t f o r t h e harves t ing o f Trochus for commercial sale a n d / o r b u y i n g o f Trochus shel l o r meat from fishermen must be obtained p r i o r to the opening of any season.

Pursuant t o Sect ion 4 ( 2 ) , T i t l e 1 7 , of the Trust T e r r i t o r y Code, Sect ion 7 , T i t l e 41 of the Trus t T e r r i t o r y Code, and Sect ions 4(a) and 4(b) of CNMI Executive Order No. 25, t h e Board of Education hereby promulgates emergency regu la t ions f o r the reasons and i n the manner he re in provided.

The Board of Education, wi th the concurrence of t h e Governor of the Commonwealth of t h e Northern Mariana I s l a n d s , f i n d s t h a t the c u r r e n t t i t l e of the head of t h e Northern Marianas Community College, t o w i t : "Dean," a s s p e c i f i e d i n Sect ion 5 of CNMI Executive Order No. 25 i s an inappropr ia te and confusing term f o r purposes of des ignat ing the o f f i c i a l charged wi th supervis ing t h e o v e r a l l funct ions of t h e Northern Marianas Community College. PUBLIC NOTICE OF PROPOSED REGULATIONS --

BOARD OF EDUCATION

The CNMI Board of Education, pursuant to Section 4(1) of Title 17 of the Trust Territory Code, Section 7, Title 41 of the Trust Territory Code, and Sections 4 (a) and 4 (b) of CNMI Executive Order No. 25, hereby issue proposed regulations in order to change the name of the head of the Northern Marianas Community College, established under Section 5 of CNMI Executive Order No. 25, from "Dean" to "President."

Under Section 4(a) of CNMI Executive Order No. 25, the Board of Education has authority to "establish rules, regulations, and policies for the operation of the College." Under Section 4(b) of CNMI Exective Order No, 25, the Board of Education has authority to "establish the qualification, term of office and compensation for the Dean. " Because the term "Dean" is generally accepted to represent different department heads within a college, rather than a head of a college, the term "President" is more appropriate.

Anyone interested in commenting on this proposed regulation may submit data, views, or arguments, in writing concerning the proposed regulation. Written comments must be submitted to the Board of Education, Cormnonwealth of the Northern Mariana Islands, no later than 30 days following the date of publication of this notice.

headed by a Pres ident who s h a l l be appointed by the Governor

upon t h e recommendation of the Board of Education, and who

s h a l l serve a s t h e Chief Elxecutive of t h e College. The

Pres iden t s h a l l be respons ib le f o r the o v e r a l l day-to-day

adminis t ra t ion of t h e College and s h a l l r e p o r t t o the Board

of Education through t h e Superintendent of Education. The

Pres ident may be removed from o f f i c e by the Governor f o r

cause o r upon the recommendation of t h e Board of Education.

Sec t ion 2 . Amendment of Executive Order No. 25.

Any references t o t h e word "Dean" i n Executive

Order No. 25 s h a l l h e r e i n a f t e r apply t o t h e "President ."

SECTION I . D e f i n i t i o n s .

a . e . "Off s h o r e Bank" o r "Off s h o r e Banking C o r p o r a t i o n s " means an e n t i t y i n c o r p o r a t e d i n t h e Commonwealth, whose p u r p o s e and a c t i v i t i e s a r e l i m i t e d t o :

1. N e g o t i a t i n g , making and e x t e n d i n g l o a n s t o b o r r o w e r s who a r e n o t r e s i d e n t s o r c i t i z e n s o f t h e Commonwealth; o r

2 . bor rowing f rom l e n d e r s who a r e n o t r e s i d e n t s o r c i t i z e n s of t h e Commonwealth. An o f f s h o r e b a n k i n g c o r p o r a t i o n s h a l l n o t t r a n s a c t b u s i n e s s a s a r e t a i l bank w i t h i n t h e Commonwealth.

SECTION 11. Banking L i c e n s e Requ i r emen t .

No p e r s o n s h a l l o p e r a t e a bank o r engage i n b a n k i n g b u s i n e s s w i t h o u t a l i c e n s e by t h e D i r e c t o r a u t h o r i z i n g him t o c a r r y on s u c h a b u s i n e s s e x c e p t o n l y o f f s h o r e banks a s d e f i n e d i n t h e s e r e g u l a t i o n s .

The following are proposed rules and regulations promulgated by the Director of Commerce and Labor pursuant to authority vested in him under Public Law 1-8 and Public Law 3-11. These proposed rules and regulations are issued for the purposes of establishing procedures and standards for the licensing of Off-Shore Banking Corporation.

The proposed rules and regulations include definition and other criteria for licensing of O ff-Shore Ranking.

Copies of the proposed rules and regulations may be obtained from the Department of Commerce and Labor's Office on the 4th Floor of the Nauru Building, Susupe , Saipan.

The Department of Commerce and Labor hereby solicits any views, opinion, facts and data for or against the proposed rules and regulations from the general public.

Anyone interested in commenting on the proposed rules and regulations may do so by submitting comments in writing to the Office of the Director of Commerce and Labor within 30 days from the date this notice is published in the Commonwealth Register.

Anyone interested in attending a hearing on this subject should contact the Director of Commerce and Labor and request that a hearing be set within 30 days from the date this notice is published in the Commonwealth Register.

PROPOSED RULES AND REGULATION

DEPARTMENT OF COPAP.4ERCE AND LABOR

Section 1. An "Off-Shore Banking CorporationT1 shall be defined a s an entity incorporated in the Commonwealth of the Northern Mariana Islands, whose principal business activity is either:

(a) Borrowing from lenders who are not residents or citizens of the Commonwealth of the Northern Mariana Islands; and or

(b) Making, extending, and negotiating loans to borrowers who are not residents of the Commonwealth of the Northern Mariana Islands.

Section 2. An Off-Shore Banking Corporation shall record all of i ts loans, borrowings, and other business transactions in the Common- wealth of the Northern Mariana Islands for accounting purposes.

Section 3 . An Off-Shore Banking Corporation shall not accept deposits as retail bank within the Commonwealth of the Northern Mariana Islands.

Section 4 . An Off-Shore Banking Corporation may not be operated in the Commonwealth of the Northern PAariana Islands by any person or entity without having first obtained a written license authorized by the Director of Commerce and Labor before commencing business.

Section 5. A license to operate an Off-Shore Banking Corporation shall be issued after the following requirements are met by the applicant:

(a) The bank is duly incorporated according to the laws of the Commonwealth of the Northern Mariana Islands; and

(b) The bank has filed with the Director of Commerce and Labor a certified copy of i ts Articles of Incorporation, i ts By-Laws, and an application for a business license; and

(c) The bank has complied with all requirements imposed on domes- tic corporations according to the laws of the Commonwealth of the Northern Mariana Islands.

Section 6 . After a license to operate an Off-Shore Banking Corporation is issued, the licensee shall not conduct business until the following requirements are met :

(b) The local agent of the licensee has filed an affidavit with the Department of Commerce & Labor stating that Ten Thousand Dollars ($10,000.00) has been deposited in accordance with Section 6(a) herein, and

(c) The manager or agent of licensee, who resides in the Common- wealth of the Northern Mariana Islands, has taken an oath that he will, as far as the duty devolves upon h i m , diligently and honestly adminis- ter the affairs of the banking corporation and will not knowingly violate or willfully permit to be violated any of the provisions of law applicable to the Off-Shore Banking Corporation ;

(d) The above-mentioned oath made by the manager or agent of licensee has been transmitted to the Director of Commerce & Labor and filed in his office; and

(e) The licensee shall have provided to the Director of Commerce & Labor, such information regarding stockholders of the Off-Shore Bank- ing Corporation as he may reasonably require. In complying with this requirement, a review of the financial and criminal background of sub- stantial holders of voting stock for a period of seven (7) years by a reputable agency engaged in the business of investigation shall be sufficient. Information so provided shall not be furnished to any third party except upon court order, subpoena, other judicial process or the express consent of the parties involved. This duty to provide information regarding such stockholders shall be continuing duty, and every change of holders of voting stock shall be reported within thirty (30) days.

Section 7 . At no time shall an Off-Shore Banking Corporation maintain a local deposit of less than Ten Thousand Dollars ($10,000.00) as provided for in Section 6(b) herein, and upon notification by the local agent of the violation of this section the Director of Commerce & Labor shall suspend the license until such a deposit is once again made, and a new certificate executed by the resident agent pursuant to Section 6(c) of these regulations.

Section 8. The term of a license issued according to these rules shall be of one (1) year. The fee for such license shall be as provided by law.

Section 9. Director of Commerce & Labor may require an Qff-Shore Bank- ing Corporation to report on i ts condition two (2 ) times each calendar year, and such report shall be personally signed by the resident agent. The reports shall contain such information as may be necessary to ascer- tain whether or not the Qff-Shore Banking Corporation i s operating in accordance with these rules.


a $7 Section 10. Except as otherwise provided herein, the record of transactions -

between an O ff-Shore Banking Corporation and i ts individual customers shall be confidential. An Off-Shore Banking Corporation shall not furnish to third parties the record of any individual transaction between the Off-Shore Banking Corporation and any of i ts lenders, borrowers, or other customers except upon court order, subpoena, or judicial process or the express consent of the parties involved.

Section 11. In the event any provisions of these rules and regulations, or their application to any person or circumstance is held invalid, the remain- ing rules and regulations and their application to persons and circumstances other than those to which it is held invalid shall not be thereby affected.
