    PESTICIDE BANMAY FACE LEGAL

    CHALLENGE

    JANUARY 28TH,2010

    JUDIE STEEVES

    THE DAILY COURRIER

Environmental activists will have to answer in a court of law, where

conjecture and hearsay are not admissible, says JEFFREY LOWES,who Tuesday [ January 26 th, 2010 ] filed 115 charges against23

individuals, groups and the PROVINCE OF ONTARIO, for its ban on

    the use of cosmetic pesticides.

He claims that the provinces legislation, enacted last year, is basedon fraudulent information as far as the health and environmentalrisks associated with the use of chemicals to maintain lawns andlandscapes, is concerned.

LOWES is guest speaker at the INTEGRATED EN-VIRONMENTAL PLANT MANAGEMENT ASSOCIA-

    TION s 14th

annual conference being held inKELOWNA [ Brit ish Columbia ] this week.

KELOWNA enacted a similar bylaw last year,

and LOWES said he will be investigating the ba-sis of that legislation as well.

The crux of it is whether there is an issue or whether there is just

the perception of an issue, he explained.

If legislation is enacted based on extensive testing, field trials, toxicology and epidemiology, thats one thing, but if it s based onmedical reports supplied by environmental activists or on apublic opinion poll thats another , he said. Were notquestioning the authority of a municipality to enact a bylaw, butthey need justification, he said.

TODD CASHIN and MICHELLE KAM from the CITY OF KELOWNA saidthe citys bylaw was the result of a grassroots movements concernsabout pesticide use. [ Wrong ! ]

Cashin is a socalled environmental technologist, and

Kam is a mere watershed coordinator. Both EnviroManiacs have ties to the EnvironmentalTerrorMo-vement, and used their posit ions to conspire to prohibitFEDERALLY LEGAL, SCIENTIFICALLY SAFE, and TO-TALLY IRREPLACEABLE pest control products in theCity of Kelowna. The socalled grassroots move-ment that led to Kelowna prohibition actually con-sisted of a small g roup of their maniac friends.

Both Cashin and Kam have NO recognized expertise, training, or background, in matters concerning PESTCONTROL PRODUCTS, TURF MAINTENANCE, or theGREEN SPACE INDUSTRY ! Overall, the opinions ori-ginating from Cashin and Kam on these matters areVALUELESS and WORTHLESS.

    5/22

KAM pointed out it only affects nonessential pesticides; those used

for esthetic [ sic ] purposes.

We have no concerns, commented CASHIN. CASHIN said thecity hasnt had to enforce the citys new bylaw yet.

LLOYD MANCHESTER ofCANADIAN EARTHCARE in KELOWNA, whichwas active in promoting the bylaw, said, The case on pesticidesis well known and the province has the right to ban any pesticideit so desires. [ Wrong ! ]

His ( Lowes ) actions do not concern me and are l ikely fundedby the propesticide industry. [ This response is typical En-viroManiac paranoid delusions and conspiracy theories. ]

Despite the fact that it calls itself Canadian EarthCare,it is simply a little alternativelifestyle club with En-viroManiacs that crave some fame, celebrity, money, and a bit of power. Formerly had the cutesy title ofC.O.M.A., an acronym for Citizens Opposed to Mala-thion Applications. ( Comatose EnviroManiacs ? Who knew ? ) It has an all iance with Okanagan Wild-life Recovery Centre ( O.W.R.C. ). NOT A SINGLEMANIAC within Canadian EarthCare has ANY recog-

nized expertise, training, or background, in mattersconcerning PEST CONTROL PRODUCTS, TURF MAIN-TENANCE, or the GREEN SPACE INDUSTRY ! Over-all, the opinions originating from this little club of ma-niacs are VALUELESS and W ORTHLESS.

LOWESalso plans a submission to the

    PROVINCE OF BRITISH CO-

LUMBIA, which is proposing a similar ban on pesticides used forcosmetic purposes.

It concludes its public consultation period FEBRUARY 15 [ 2010 ]on the proposed new legislation.

The lawn care industry is being told to lower their standards; to

use less effective products to do their job, LOWES said.

And, the industry is losing customers, he said, while turf is be-coming infested with weeds and insects.

By banning useful products for use by the lawn care industry, itsmembers are prevented from properly maintaining sports fields, parks, rightsofways, and other landscapes, he said.

It has cost the industry30 per cent of its business, or$350 million

    in ONTARIO, he claims.

Were assessing the monetary damage done to the industrynow and wil l sue to recover, he commented.

LOWES admits he has no background as a pesticide applicator or ascientist, and says theres nothing personal about this campaignagainst such bans on pesticide use.

He said he is not representing chemical companies.

He was asked to help out a group of lawn care companies in KING-

STON, ONTARIO and it grew from there.

Although he filed the charges personally, there is aFEBRUARY 17[ 2010 ] hearing with the Crown prosecutor and a judge to set adate for aPREENQUETEhearing on the charges.

That will result in a decision on whether the Crown will proceed

with the charges under the CRIMINAL CODE OF CANADA.

Allegations include thatfalse and misleading information regardingthe health and environmental risks of pesticide products regulatedby the federal government influenced the decision to ban pesticidesfor cosmetic use in Ontario.

As well, activists pretended to use PEERREVIEWED STUDIES and

endorsements by the CANADIAN PEDIATRIC SOCIETY to defraud thelawn care industry of access to products; and impeded access to

HEALTH CANADA approved pesticides byfraud, which directly af-

fected the ONTARIO lawn industrys $1.3 billion market, he alleges.

CANCER PREVENTION ARGUMENTCHALLENGED FOR PESTICIDE BANS

    JANUARY 29TH,2010

    JUDIE STEEVES

    KELOWNA CAPITAL NEWS

Since 45 per cent of cancers can be prevented, atoxicology professor from the school of environ-

mental sciences at the UNIVERSITY OF GUELPHsuggests society begin with that, rather than en-acting pesticide bans when there is no scientificbasis for concern.

LEN RITTER was addressing about140 members of the INTEGRATEDENVIRONMENTAL PLANT MANAGEMENT ASSOCIATION OF WESTERN

CANADA (I.E.P.M.A.), at its annual conference in KELOWNA.

[ BACKGROUND INFORMATION Len Ritter. Professor,School of Environmental Sciences, Universi ty of Guelph. Coor-dinator, Metals in the Human Environment Strategic Network.Executive Director, Canadian Network of Toxicology Centres. ]

Tobacco use is the cause of cancer in 30 per cent of men and 20per cent of women, while sunlight, drugs, viral infections, carcino-gens in the workplace and obesity are other known causes of cancerthat we can take action on to prevent deaths.

All of that matters far more than pesticides

in cancer prevention, he commented, addingthat pesticides arent even on the l ist. Yet,

CANADIAN CANCER SOCIETY does not supportthe use of ornamental pesticides, based on in-accurate information, he said.

RITTER is also EXECUTIVE DIRECTOR of the CA-NADIAN NETWORK OF TOXICOLOGY CENTRESand said he has been interested in issues

around pesticides and cancer for 32 years.

He is also COORDINATOR of the METALS IN THE HUMAN ENVIRON-

MENT STRATEGIC NETWORK, in GUELPH, ONTARIO, and chair of an

expert panel convened by the COUNCIL OF CANADIAN ACADEMIES at

the request of the PEST MANAGEMENT REGULATORY AGENCY OF

HEALTH CANADA on toxicity testing of pesticides.

He emphasized he does not work for CANADIAN CANCER SOCIETY,

nor for the IEPMA [ Integrated Environmental Plant ManagementAssociation of Western Canada ].

He said the European community based its regulations on pesti-cides on a scientific report that contains arithmetic errors andmadeup assumptions.

All the data was made up, he concluded, referring to material

from MARK BLAINEYs report to the EUROPEAN PARLIAMENTS COM-

MITTEE ON THE ENVIRONMENT,PUBLIC HEALTH AND FOOD SAFETY.

He said no one disagrees with such common sense cautions asavoiding the use of pesticides that are known to be carcinogenicaround playgrounds, for instance, but he said regulations on theuse of pesticides must be based on sound science.

PESTICIDE BAN NO PROBLEMFOR MOST RESIDENTS,

    SAYS REPORT

    FEBRUARY 6TH,2010

    RON SEYMOUR

    THE DAILY COURRIER

Kelowna homeowners have embraced a new bylaw that restricts theuse of pesticides on lawns, city council will hear on Monday.

Yeah right ! In fact, homeowners in Kelowna wereCOERCED into accepting a NEEDLESS, SENSELESS,and MALICIOUS prohibition of FEDERALLY LEGAL,SCIENTIFICALLY SAFE, and TOTALLY IRREPLACE-ABLE pest control products.

Nearly 80 per cent of residents are aware of the bylaw, and morethan twothirds of those say theyve eliminated or reduced theirpesticide use, according to staff who conducted a telephone surveylast fall. [ Big deal ! ]

With continued public education, the numbers of pesticide us-ers should be further reduced, reads part of a report to council

    by stafferTODD CASHIN.

KELOWNAs bylaw, which came into effect last year [ 2009 ] , pre- vents homeowners from using products such as Weed N Feed ontheir lawns. While there were said to be hundreds of calls to thecity about the bylaw, only five complaints were made by peopleabout their neighbours supposedly using pesticides.

All complaints were followed up by city staff, information wasprovided and an educational package was sent to residents,

CASHIN writes, although his report does not indicate whether any-one suspected of using pesticides was fined.

One homeowner asked for an exemption to use pesticides, but thisrequest was denied.

Critics, whose ranks include the owners of lawnandgardencarecompanies, say theres no scientific evidence that the pesticides areharmful, and note the products have all been approved for sale anduse by the federal government.

At a meeting in Kelowna last week of owners of lawnandgardencare companies, there were calls for Ottawa to stand up to the bul-lies in the environmental movement who have lobbied for pesticidebans in the absence of studies that show the products are harmful.

Kelownas bylaw allows licensed commercial applicators to continueusing pesticide products. However, one ALTERNATE RECOMMENDA-

TION to be presented on Monday [ February 8th, 2010 ] wouldalso ban them from using pesticides in favour of products said to bemore friendly to the environment.

GAL ACTION AGAINST THE PROHIBITION OF PEST CONTROL PRODUCTS IN THE TOWN OF HUDSON,QUEBEC. FOR FIFTEENYEARS, THESTRATEGIES DESIGNED AND IMPLEMENTED BY MR.GATHERCOLE AND HIS COLLEAGUES GUARANTEED THE CONTROL OF ENVIROTERROR

FOR THE ENTIRE MODERN GREEN SPACE INDUSTRY ACROSS CANADA. ALTHOUGH HE CAN BE ACCUSED OF BEING ANTIENVIRONMENTMOVEMENT, HE IS, IN FACT, SIMPLY A STRONG ADVOCATE FOR THE MODERN GREEN SPACE INDUSTRY.
