RNAO members practise in all roles and sectors across the province.Our mandate is to advocate for healthy public policy and for the

role of registered nurses in enhancing the health of all of Ontario'scitizens.

We welcome this opportunity to present our views to the StandingCommittee on Social Policy on Ontario's Bil l 64, An Act to amend thePesticides Act to PROHIBIT THE USE AND SALE OF PESTICIDES that may beused forCOSMETICpurposes.

Bill 64 has the potential to be an important step in the right direc-tion, but were not popping the champagne corks yet.

RNAO and its members have been working hard to achieve protection

against NONESSENTIAL use of pesticides across this province for manyyears.

We were delighted to attend Premier McGuinty's press conference tointroduce this important legislation, and we were especially pleasedthat during that announcement the Premier stated unequivocallythat Ontario's legislation would serve as a floor and not as a ceil-ing .

We were, therefore, most distressed when this statement was latercontradicted by Minister Gerretsen's office.

The bill has some excellent features that could put Ontario at theforefront of protection of the pu blic AGAINST PESTICIDES.

WE ARE PLEASED THAT THE BILL WILL BAN THE USE AND SALE OF PESTICIDES FOR

COSMETIC PURPOSES, and will cover residential, industrial, commer-cial, institutional, municipal and provincial properties, includingrural residential properties.

STRONGLYSUPPORTS THEBAN

ON THE USE AND SALE OF PESTICIDES

FOR COSMETIC PURPOSES

We are also very pleased that the Minister of the Environment an-nounced that the implementation period would be swift, with theban to be in effect for the 2009 growing season.

We do, however, have serious concerns about certain features of thebill in its proposed form, and we will work to further necessarychanges to fix those problems.

Specifically, as presently written, the bill would empower the gov-ernment to introduce other exemptions by regulation.

This, in our view, is a dangerous and unnecessary provision thatcould put current or future cabinets under pressure from industry,and undermine the intent of the legislation.

Indeed, the lawn care industry organization, Landscape Ontario,makes clear in its briefing note on Bill 64 that it woul d seek exemp-tions for socalled weed and insect infestations.

These exemptions make implementing pesticide legislation morecostly and difficult, and represent loopholes to continue business asusual.

The bill, as presently written, would take away from municipalitiesthe right to exceed the provincial standard in pesticide protection.

This preemption strategy has been used with great success by the pesticide industry in the US, and we do not want to see it usedhere.

RNAO is most concerned with this, because MUNICIPALITIES HAVE ALWAYSHAD A LEADERSHIP ROLE IN PESTICIDE AND TOXIC CHEMICAL MANAGEMENT, andbecause municipalities are in a good position to respond to localhealth issues.

Some existing municipal protections for example, banned uses ofpesticides could be rolled back with the legislation, as currentlywritten.

THE BILL WOULD EXEMPT GOLF COURSES, WHICH IS INCONSISTENT WITHRNAO'S

BELIEF THAT EXEMPTIONS SHOULD BE LIMITED TO PUBLIC HEALTH PURPOSES.

The government has released a list of pesticides that could bebanned from use or sale for cosmetic purposes.

This list does not include all pesticides of concern; for example,Roundup.

An inclusion list of allowed minimally toxic substances would be apreferable app roach.

A PRECAUTIONARY APPROACH is essential when determining which sub-stances would be allowed on that list.

RNAO is also seeking assurance that the government will provide theneeded resources to implement the new legislation, including fund-ing for education and enforcement.

To summarize our recommendations, RNAO STRONGLY SUPPORTS THEBAN ON THE USE AND SALE OF PESTICIDES FOR COSMETIC PURPOSES.
