ISSUES AND CLARIFICATIONS - GENERAL SAFETY REGULATION

1. ABOUT THE GENERAL SAFETY REGULATION

Regulation (EC) 661/2009 of the European Parliament and Council concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units intended therefor1, was published in the Official Journal in July of 2009.

The General Safety Regulation (GSR) foresees on the one hand the adoption of new measures (i.e. ESC, TPMS, etc), on the other hand the repeal of 50 old Directives and their replacement by the equivalent UNECE regulations or by new EU Regulations when such UNECE regulations do not exist. The GSR also provides transitional provisions for the timing of entry into force of such new rules. Finally, the GSR is to provide the possibility of type-approval of a vehicle with regard to its general safety (including all the items covered by the GSR).

Since 2009, the GSR has been amended twice, namely by Commission Regulations (EU) Nos 407/20112 and 523/20123, both focussing on complementing Annex IV of the GSR with the list of UNECE regulations which apply on a compulsory basis.

This document addresses several issues linked to the practical application of the GSR.

2. APPLICATION OF THE GSR IN PRACTICE

2.1. UNECE REGULATIONS IN ANNEX IV

Annex IV lists which version of the UNECE regulations is compulsory for the purpose of EU whole vehicle type-approval. The list of UNECE regulations which apply on a compulsory basis does not mean that each and every UNECE regulation listed must be fulfilled, since only the UNECE regulations which are pertinent for the specific type will apply. This list however defines precisely which series of amendments and which

supplement is as a minimum mandatory for the purpose of EU type-approval. Translations of UNECE regulations and the publication in the Official Journal are ongoing continuously. Therefore the list in Annex IV will have to be updated regularly to reflect the evolution of UNECE regulations.

The transitional provisions of the officially translated and listed version of the UNECE regulations (for granting/ recognizing UNECE approvals) apply together with the transitional provisions of the GSR (for the mandatory application of UNECE approvals for EU approval). For instance (DRL), if the 04 series of a UNECE regulation is listed in Annex IV to the GSR, and if the 03 is still allowed through the 04 series during a transitional period, the 03 series may still be used. However, if the GSR explicitly requires specific additional requirements (e.g. fitting of ESC, EU implementing dates for ESC and R100 electric safety) for EU vehicle type-approval, these requirements shall also be taken into account for EU type-approval.

Updated (e.g. new and more stringent) requirements may be applied on a voluntarily basis even if not yet listed in Annex IV, as by virtue of the European Union voting in favour of the relevant new requirements. Such newer supplement or series of amendments to such a UNECE regulation must be accepted for EU type-approval. However, they are not mandatory for EU whole vehicle type-approval.

If such newer UNECE regulation supplement or amendment is not yet officially translated and published in the Official Journal, but already requires compliance on UNECE level due to incorporated transitional provisions, this has no effect on GSR compliance as the older version is still prescribed here. It should however be noted that it is likely that in such a case a UNECE type-approval certificate according to the superseded version may no longer be issued, but test reports can remain to be used for the EU whole-vehicle type-approval procedure instead.

2.2. WHEN TO USE EU REGULATIONS, UNECE REGULATIONS AND OLD DIRECTIVES?

Article 13(2) of the GSR (covering most of the items except tyres and ESC) requires that, from 1 November 2012, new types be approved according to this Regulation and its implementing measures. Furthermore, according to Article 19 of the GSR, all but one of the used old Directives will be repealed from 1 November 2014. However, as set out in Article 13(14) of the GSR, extensions to these Directives may be granted (with no date limitation) unless the requirements applying to these vehicles have been updated. It was not the intention of the GSR to create a burden for the industry by requiring a new EU type-approval when the technical requirements applying to the concerned vehicles have not changed.

For the installation of tyres, Article 13(3) of the GSR states that from 1 November 2013 new types shall be type-approved only according to the new EU Regulation and type-approvals granted under the old Directive concerning tyre installation (still possible until 1 November 2013 for new types) will cease to be valid on 1 November 2014. This means that vehicle type-approvals granted under the old Directive will remain valid and can be extended, but only until that date. Tyres as components are discussed in item 2.3. below.

For Directives replaced by UNECE regulations, an explanatory list with information on the “validity and extension of approvals granted under EU Directives repealed by Regulation (EC) No 661/2009 on General Safety of motor vehicles” was published on

This list also reflects the fact that some UNECE regulations listed in Annex IV are more advanced than the old Directives. Therefore, for such UNECE regulations, new types according to the Directives in question may no longer be granted with effect from 1 November 2012 and existing approvals granted before 1 November 2012 will remain valid and may be extended up to 1 November 2014.

The list on the validity and extension of approvals granted under EU Directives will be updated at regular intervals to ensure the correct application of Art 13(14) of the GSR.

Examples:

For “audible warning”, Directive 70/388/EEC applies. From 1 November 2012 it is no longer be possible to grant type-approval for a new type under the Directive. As provided by the list in Annex IV of the GSR on UNECE regulations covering the same scope, the only option remaining is to fulfil the requirements of UNECE regulation No 28.

For “rear registration plate space”, Directive 70/222/EEC applies. In this case there is no UNECE regulation with the same scope, but a new EU Regulation was adopted and published to replace the old Directive, namely by Commission Regulation (EU) No 1003/20105, which is indeed an implementing measure of the GSR. Therefore, the latter shall be applied instead.

A more complicated matter exists with the replacement of Directive 75/443/EEC6 on the reverse and speedometer equipment of a vehicle. Namely, UNECE regulation No 39 only covers the speedometer equipment. In this case also EU Regulation (EU) No 130/20127, implementing measure of the GSR, must be applied as it contains the specific provisions for the device for reversing not covered by the UNECE alternative.

A similar situation can be observed with the replacement of Directive 70/221/EEC8 on fuel tanks and rear underrun protection. UNECE regulations Nos 34, 67 and 110 each cover a specific type of fuel tank (i.e. petrol/diesel, LPG and CNG), but none addresses the rear underrun protection which is encompassed in the old Directive. In order to also comply with this specific prescription, the aforementioned UNECE regulation (whichever is/are applicable) must be complemented by UNECE regulation No 58 which indeed covers that aspect for all vehicle categories.

During the Technical Committee – Motor Vehicles meeting of 10 July 2012, the Draft Commission Regulation amending Annex IV of Directive 2007/46/EC received a positive opinion. This revised Annex provides a far more clear application of which compliance is required in order to obtain a WVTA for a specific type of vehicle. This amendment is expected to be adopted by the Commission and published on the Official Journal by the end of 2012. An excerpt of the list is annexed to this document containing all GSR relevant topics for which compliance is required for the purpose of WVTA.

Type-Approval Authorities and Technical Services must ensure that in each case the appropriate Directive or alternative UNECE regulation(s) and/or EU Regulation(s) are applied, especially during this transitional period.

2.3. TYRES AND GSR TYPE-APPROVAL

Directive 92/23/EEC provides the type-approval requirements for tyres as components in the EU besides UNECE regulation Nos 30, 54 and 117. In short, the requirements incorporated in the Directive correspond to those as laid down in UNECE regulation Nos 30 and 54, in combination with sound level requirements which are more or less in line with sound limits of Stage 1 as laid down in UNECE regulation No 117. It is known that some types of tyres have been type-approved according to the Directive to cover the sound emissions, optionally or not in combination with one of the applicable UNECE regulations. Such tyres may still be available on the market and as new vehicles are not yet required to be fitted with tyres complying with the Stage 2 sound emission limits until 1 November 2016 as laid down in Article 13(6), the Directive is at least not repealed until after that date.

2.4. GRANTING OF A GSR TYPE-APPROVAL

It should be recalled that a GSR type-approval for the purpose of Whole Vehicle Type-Approval according to Directive 2007/46/EC is not mandatory. Furthermore, it is not possible yet to grant a GSR type-approval, as the administrative provisions to do so are not yet available. Instead, only compliance with the individual items as mandated through WVTA and the GSR is mandatory.

3. TYPE-APPROVAL NUMBERING SYSTEM

3.1. GSR TYPE-APPROVAL

When GSR type-approvals become possible, the numbering system as laid down in Annex VII to Directive 2007/46/EC should be used. The Section 2 of the number will be that of the base Regulation (EU) 661/2009 and Section 3 of the latest amending Regulation which today would be Regulation (EU) 523/2012 (i.e. e1*661/2009*523/2012*0001*00).

3.2. GSR IMPLEMENTING MEASURE TYPE-APPROVAL

Following the same logic as the old Directives, an approval number according to a new EU Regulation implementing the GSR should look similar (i.e. for windscreen wash/wipe systems e2*1008/2010*1008/2010*0002*00).

To clarify this, Annex VII of 2007/46/EC should be amended as previously proposed in the draft document (GSR administrative procedures) under agenda item 9 of the 26th meeting of TCMV. It should be noted that the above proposed numbering scheme is already brought into practice by a number of Member States judging from the assessment of a number of new vehicle type-approvals granted recently, and this is a pragmatic and favourable approach.

3.3. UNECE REGULATION TYPE-APPROVAL

Provisions for granting type-approval for compliance with regulatory prescriptions of UNECE regulations will not be provided through the administrative provisions for the GSR.

UNECE type-approvals shall be granted directly under the provisions of the 1958 Agreement. An approval for a vehicle system, separate technical unit or component shall use the appropriate numbering system as provided in the respective UNECE regulation.

3.4. UNECE REGULATION TYPE-APPROVAL FOR NEW TECHNOLOGIES AND CONCEPTS, VIRTUAL TESTING AND SELF TESTING

The case of new technologies, virtual testing and self-testing will be covered by the future amendment of the GSR with the administrative provisions. The following approach is proposed.

It is recognised that there may be a need to provide specific type-approval provisions for vehicle systems, separate technical units and components covered by Article 20 of Directive 2007/46/EC, namely for the approval of new technologies or concepts falling under UNECE provisions. It is indeed feasible to include two models of the EU type-approval certificate for vehicle systems on the one hand and for separate technical units and components on the other, specifically approved under the provisions of the aforementioned Article 20.

The numbering is suggested to be as follows: Section 2 as normal (i.e. 661/2009), Section 3 would be the UNECE regulation number preceded by the letter “R” (e.g. R46 in case of new indirect vision technologies) and the sequential number of Section 4 as provided by the approval authority (e.g. e3*661/2009*R46*0001*00)

The distinguishing type-approval marking could be as normally prescribed and obtained through normal UNECE regulation type-approval, but in this case featuring the sequential number of Section 4 as provided by the approval authority following the type-approval in accordance with Article 20 of Directive 2007/46/EC, and with a lower case “e” followed by the distinguishing number of the Member State issuing the Article 20 type-approval placed in a rectangle (e.g. II 020001) rather than the circumscribed capital letter “E” required for conventional devices.

Annexes XV and XVI of Directive 2007/46/EC provide specific provisions for self testing and virtual testing. Whenever one of the listed Directives has been replaced by a new EU Regulation GSR implementing measure, the same provisions may be applied under the same conditions as valid for the old Directive. This may to a certain extent also be also applied for relevant UNECE provisions, however, UNECE regulation type-approval certificates may not be granted according to such tests, as these special provisions are not yet foreseen under the 1958 Agreement, but the test reports may be used for the EU type-approval procedure.

4. INFORMATION DOCUMENTS OF UNECE APPROVALS

It has been noted that a number of Member State representatives have indicated that there is a need to lay down detailed provisions with regard to the information documents to be

provided by the vehicle manufacturer for the purpose of UNECE regulation type-approval. Although this request is understood, it should also be noted that UNECE regulation type-approvals have been a part of the WVTA procedures, on a voluntary basis, for decades. Any lack of information document provisions has clearly not prevented Member States as Contracting Parties to the 1958 Agreement of issuing such UNECE type-approvals. Instead, the type-approval authorities are proven to be well equipped to relay its minimum requirements for an information document to manufacturers seeking type-approval.

However, if diverging interpretations occur in the future, the need to prepare provisions for UNECE regulation approvals in terms of the information documents will be assessed. It could be envisioned that a list of item numbers taken from Annex I of Directive 2007/46/EC is given for each UNECE regulation, to be included with the administrative provisions which have to be finalised in the near future. At a later stage, it could be proposed for the relevant Working Parties under UNECE to adopt such provisions on UNECE regulation level (as well).

5. UNDERSTANDING THE ARTICLES AND IMPLEMENTATION DATES OF THE GSR

The GSR comprises a very large list of items which makes it challenging to navigate through the requirements and associated implementation dates. Furthermore, the amending Regulations also contain specific transitional provisions. The EU Regulations implementing the GSR do not contain transitional provisions which divert from those as set out in the GSR. A comprehensive implementation table is annexed to this guide for easy reference.

In this implementation table, the date specified in the “new types” column next to the relevant GSR Article number applies in all cases listed below it for new vehicle type-approvals. If a “new vehicles” date is not specified at a specific entry (only “-”), then the existing Directive approval remains valid until a particular vehicle is no longer produced or when the “validity and extension of approvals” list discussed in the third section of item 2.2. is updated in the future and with that superseding the information in the annexed table.

5.1. PRAGMATIC APPLICATION OF THE GSR ITEM MASSES AND DIMENSIONS

Directives 92/21/EEC and 97/27/EC may according to Article 13(2) of the GSR no longer be used for the type-approval of new types from 1 November 2012. It was recalled in the Type-Approval Authorities Expert Group (TAAEG) of 20 October 2012 that vehicles may already be tested in accordance with the new draft EU Commission Regulation on masses and dimensions (adopted by the Commission on 12 December 2012) and type-approval certificates can formally be issued based on the relevant test reports once the new EU Regulation has entered into force. Type-approvals granted before 1 November 2012 in accordance with Directive 92/21//EEC or 97/27/EC will remain valid as provided by the new draft Regulation.

5.2. STRENGTH OF CABS UNECE REGULATION NO 29

Article 6(4) in the GSR states that the strength of cabs shall be sufficient to protect the occupants, taking into account UNECE regulation No 29. This unclear wording is the

result of the legislative process and could be interpreted as new types and new vehicles shall comply with UNECE regulation No 29 in accordance with the timeline of the GSR (i.e. 1 November 2012/2014). This was not the intention of the text, which simply requests the Commission, when drafting the implementing measures on strength of cabs, to take into account UNECE regulation No 29. Since the Commission has not yet adopted implementing measures on this topic and has not included UNECE regulation No 29 in Annex IV of the GSR, the application of UNECE regulation No 29 is not yet mandatory.

Once an amendment to the GSR is prepared, it will include both references to the GSR and Directive 2007/46/EC and adequate transitional provisions will be taken into account as agreed by the Technical Committee – Motor Vehicles.

5.3. BRAKING REPLACEMENT PARTS UNECE REGULATION NO 90

Replacement components for systems which are covered by the GSR are subject to equivalent safety requirements and approval procedures as original equipment of vehicles. This is therefore also the case for braking replacement parts such as braking pads and shoes (i.e. brake lining assemblies), and in the future also discs and drums. The UNECE regulation No 90 has therefore been included in the list of compulsory measures.

Under Directive 71/320/EEC as amended by 98/12/EC, separate technical unit type-approval for brake lining assemblies to be installed on motor vehicles and trailers of categories M1 ≤ 3,5 tonnes, M2 ≤ 3,5 tonnes, N1, O1 and O2 as replacement parts has been mandatory when intended for fitment to vehicle types for which 71/320/EEC braking type-approval was granted on or after 7 April 1998. Such separate technical unit type-approvals according to the Directive will remain valid even beyond 1 November 2014.

UNECE regulation No 90 has been applicable for M1 ≤ 3,5 tonnes, M2 ≤ 3,5 tonnes, N1, O1 and O2 already since 1 November 1992. In the same analogy, R90 compliance of brake lining assemblies could therefore have been applied instead for vehicles in the EU which were type-approved according to R13 or R13H after 7 April 1998, the date of the Directive.

Replacement braking parts for the remaining vehicle categories, and therefore all vehicles of category M, N and O, are covered by UNECE regulation No 90 since 5 March 1997. However, in the EU this UNECE regulation is mandated for new types only from 1 November 2012 and will not be mandatory for existing types until 1 November 2014.

Replacement brake lining assemblies for vehicles of categories M1 ≤ 3,5 tonnes, M2 ≤ 3,5 tonnes, N1, O1 and O2 with a braking approval issued on or after 7 April 1998 currently already have to fulfil the requirements of either 71/320/EEC or R90. Replacement brake lining assemblies for vehicles of the remaining categories have to be approved according to UNECE regulation No 90, but only for vehicles with braking systems which are type-approved according to UNECE regulation Nos 13 or 13H from 1 November 2012 onwards. With effect 1 November 2014 all new vehicles of all categories have to be type-approved according to either to R13 or R13H and national authorities shall prohibit the sale and entry into service of new components or separate technical units intended for such vehicles which are not type-approved, and in this case not approved according to R90.

For clarification the following example. Replacement brake lining assemblies, meant for a N3 category type of vehicle of the braking system was approved according to either 71/320/EEC or optionally already according to R13 before 1 November 2012 and production of that N3 vehicle is discontinued before 1 November 2014, do not have to be type-approved according to R90, even when these replacement brake lining assemblies are available on the market after 1 November 2014. If the production of the type of vehicle in this example continues beyond 1 November 2014 however, compliance with R13 is no longer optional but becomes mandatory and the replacement brake lining assemblies must as a result also comply with R90 when offered for sale from that same date. Contrary to certain provisions in Directive 71/320/EEC as amended by 98/12/EC, Article 13(5) of the GSR does not provide for an exemption clause for components or separate technical units meant for vehicles which in this case obtained R13 type-approval before the effective date laid down in Article 13(2).

At present, the reference to UNECE regulation No 90 in Annex IV of the GSR is that to Supplement 11 to the 01 series of amendments as published in the Official Journal L 130, 28.5.2010, p. 19 on replacement brake and drum linings, not including replacement brake drums and discs.

It should be noted however that a more recent version is published in the OJ L 185, 13.7.2012, p. 24 also including replacement drums and discs. The reference in Annex IV of the GSR will be updated in the near future and will therefore include replacement brake drums and discs, making compliance compulsory for such parts. Once they are incorporated, the same timing as described for brake lining assemblies in connection with vehicles of categories other than M1 ≤ 3,5 tonnes, M2 ≤ 3,5 tonnes, N1, O1 or O2 will apply (i.e. same as the example provided two paragraphs above).

What this means in practise is that for the time being, only replacement brake and drum linings are covered by the General Safety Regulation, and not drums and discs. Such replacement equipment placed on the market shall therefore fulfil either the provisions of Directive 71/320/EEC or UNECE regulation No 90 as described in detail above.

5.4. ELECTRONIC STABILITY CONTROL (ESC)

Fitment of ESC is not required by Directive 71/320/EEC or UNECE regulation 13H for M1 passenger cars and certain N1 category vehicles, but according to R13H such systems do have to comply with the relevant provisions if fitted. As a result of this ‘if fitted’ approach in R13H, no explicit transitional provisions are provided for ESC fitment on UNECE level.

The GSR on the other hand clearly mandates the fitting of ESC on vehicles in Articles 12 and 13(1). The specific ESC provisions in the GSR are not in contradiction with those set out in UNECE regulation No 13H. In fact, since ESC fitting is not even required per UNECE regulation No 13H, but it is through the GSR, the transitional provisions that apply for EU whole vehicle type-approval are the ones set out in the GSR.

Given the above, if a R13H or 71/320/EEC braking type-approval has been granted for a new type before the relevant specified date in GSR, without ESC, compliance with the ESC prescriptions mandated by GSR still has to be demonstrated for EU vehicle type-approval purposes and GSR compliance, either by full integration in a braking system type-approval (i.e. R13H with ESC or R13 with ESC), or by means of a test report

concerning ESC issued by a technical service recognised by the type-approval authority responsible for GSR and WVTA.

As a result, 71/320/EEC or R13H type-approvals granted without ESC are not invalidated, but they will need to be supplemented with proof of compliance to ESC rules.

5.5. GSR AND MULTI-STAGE APPROVALS (WVTA)

Concerning multi-stage vehicle approvals and specific requirements covered by the GSR, the same methodology as used for WVTA concerning multi-stage approvals is adopted. This is especially the case where for instance the base vehicle is of another category than the one created by the subsequent stage. In practice this normally means that if a certain provision is not applicable for the base vehicle, this is also not the case for the subsequent stage unless otherwise noted and unless the system in question has been modified to the extent that it has to be (fully) retested for type-approval purposes. The need for complying with more stringent requirements must be based on a case-by-case decision of the Type-Approval Authority. If it is subsequently agreed that a certain modification in the next stage can indeed be based on the same level of compliance as valid for the vehicle’s previous stage, then the assessment shall be carried out according to that level and be for instance covered by a test report if a new type-approval certificate cannot be issued. For instance, adding side marker lamps and relocating tail lamps on a vehicle should not lead to a reassessment of the front lighting system (e.g. DRL).

6. ACTIONS TO BE CONSIDERED FOR THE FINALISATION OF THE ADMINISTRATIVE PROVISIONS OF THE GSR

The following actions may be prepared in order to arrive at a satisfactory solution with regard to the administrative provisions.

– investigate if the information contained in the list with validity and extension of approvals granted under EU Directives repealed by Regulation (EC) No 661/2009 on General Safety of motor vehicles, as published on the European Commission’s website, can be integrated for instance into Annex IV (see item 2.2.);

– include amendments to Annex VII of 2007/46/EC with respect to type-approval numbering especially concerning the GSR (see item 3.2.);

– include two models of the EU type-approval certificate for vehicle systems on the one hand and for separate technical units and components on the other, specifically approved under the provisions of the Article 20 of 2007/46/EC (see item 3.4.);

– investigate the available information (databases, existing lists, etc.) for the preparation of information documents to be used for UNECE regulation type-approvals, not to ‘reinvent the wheel’, and if there is a need to integrate this information in the GSR (see item 4.);

– prepare the amendment to the GSR including transitional provisions for the mandatory application of UNECE R29 in combination to the amendment of Directive 2007/46/EC for the purpose of WVTA (see item 5.2.);

– include in the amendment to the GSR all up-to-date references to the relevant publications in the Official Journal (see 5.3.).

The listed action items comprise of a significant workload, however, a number of Member State representatives have indicated their willingness to support the work by means of participating to informal meetings during the drafting of the administrative provisions. The Services of the Commission therefore proposes to coordinate such meetings in order to significantly aid the drafting process. Member State representatives are kindly requested to reconfirm their interest in participation to the Sustainable Mobility and Automotive Industry Unit.

Note: The series of amendments of the UNECE regulations which apply on a compulsory basis are listed in Annex IV to Regulation (EC) No 661/2009. Series of amendments adopted subsequently are accepted as an alternative.

(2) In case of vehicles equipped with a LPG or CNG installation, a vehicle type-approval in accordance with UNECE regulation No 67 or UNECE regulation No 110 is required.

(3) The fitting of an electronic stability control (‘ESC’) system is required in accordance with Article 12 of Regulation (EC) No 661/2009. Therefore, the requirements set out in Annex 21 to UNECE regulation 13 shall be complied with for the purposes of EC type-approval of new types of vehicles as well as for the registration, sale and entry into service of new vehicles. The implementation dates set out in Article 13 of Regulation (EC) No 661/2009 shall apply instead of the dates set out in UNECE regulation No 13.

(4) The fitting of an ESC system is required in accordance with Article 12 of Regulation (EC) No 661/2009. Therefore, the requirements set out in Part A of Annex 9 to UNECE regulation No 13-H shall be complied with for the purposes of EC type-approval of new types of vehicles as well as for the registration, sale and entry into service of new vehicles. The implementation dates set out in Article 13 Regulation (EC) No 661/2009 shall apply instead of the dates set out in UNECE regulation No 13-H.

(4A) If fitted, the protective device shall fulfill the requirements of UNECE regulation No 18.

(4B) This Regulation applies to seats not falling within the scope of UNECE regulation No 80.

(5) Vehicles of this category shall be fitted with a suitable windscreen defrosting and demisting device.

(6) Vehicles of this category shall be fitted with a suitable windscreen washing and wiping devices.

(9A) Applies only where such vehicles are fitted with equipment covered by UNECE regulation No 64. Tyre pressure monitoring system for M1 vehicles applies on a compulsory basis in accordance with Article 9(2) of Regulation (EC) No 661/2009.

(10) Applies only to vehicles equipped with coupling(s).

(11) Applies to vehicles with a technically permissible maximum laden mass not exceeding 2.5 tonnes.

(12) Only applicable to vehicles where the ‘Seating Reference Point (‘R’ point)’ of the lowest seat is not more than 700 mm above the ground level.
