Wow! A Czech student browses the British library without going to London, and an Irish art lover just got close to the Mona Lisa without queuing at the Louvre. These are more than dreams thanks to Europeana’s Internet and digitalisation techniques, stated Viviane Reding, European Commissioner for Information So-ciety and Media.
On 20 November 2008, in the ‘Palais de Charles de Lorraine’ in the Royal Library of Belgium, Brussels, real progress in managing and integrating the EU’s knowl-edge resources was showcased to the public. The launch of Europe’s online multimedia library, Europeana, sparked much at-tention and international interest. The website of this transnational digital library attracted more than 10 million hits during the fi rst hour - more than double the number anticipated. The sheer volume of hits caused the Eu-ropeana network to technically break down on the very fi rst day. Instead of the rich colour-and-light texture of a Vermeer painting, there only was a stark black-and-white image saying: “The Europeana site is temporarily not accessible due to overwhelming interest after its launch.” The manage-ment promised to relaunch this giant database with a more robust version.
The digital content of Europeana is a selection of im-ages digitised and made available by Europe’s muse-ums, libraries, archives and audio-visual collections.
The prototype aims to include content from these four cultural heritage domains, plus a broad range of con-tent from across Europe. And the interface will be mul-tilingual. Initially, this may mean that it is available in French, English and German, but the intention is to increase the number of available languages following the launch. After the Europeana prototype is launched, the project’s fi nal task is to recommend a business model to maintain the website. It will also identify any further research and implementation needed to make Europe’s cultural heritage fully interoperable and ac-cessible through a truly multilingual service. The aim is
that, by 2010, the Europeana portal will give everybody direct access to well over six million digital sounds, pictures, books, archival records and fi lms.
Europeana opens up new ways of exploring Europe’s heritage: anyone interested in literature, art, science, politics, history, architecture, music or cinema will have free and fast access to Europe’s greatest collections and masterpieces in a single virtual library through a web portal available in all EU languages. But this is just the beginning. In 2010, Europeana will be the gateway to millions of items representing Europe’s rich cultural diversity and will have interactive zones such as communities for special interests. Between 2009 and 2011, some €2 million per year of EU funding will be earmarked to achieving this. The Commission also plans to involve the private sector to further expand Europe’s digital library.

哇!捷克學生不必遠赴倫敦就能瀏覽英國圖書館，愛
爾蘭的藝術愛好者無須在羅浮宮前排隊，也能親炙蒙
娜麗莎的微笑。歐洲委員會資訊社會與媒體部門的蕾
丁女士表示，拜Europeana網站與數位科技之賜，這些
都不再是夢想。
管理並統合歐盟知識資源的具體成就，於2008年
11月20日在比利時布魯塞爾皇家圖書館的「洛林樞
機主教館」亮相，供大眾瀏覽。歐盟多媒體網路圖書
館—Europeana（www.europeana.eu）推出後，不但眾
所矚目，也引起國際的關注。這個跨國的數位圖書館
上線後一個小時之內，就有高達一千萬的點擊數，比
預期的數量整整多出一倍。網路圖書館開張的第一
天，光是超量的點擊數就讓Europeana網站呈現技術故
障的狀態。網站首頁原來應該是色彩明亮、質地豐富
的維米爾畫作，此時僅存一個黑白的圖像標示：「超
乎預期的訪客數量，導致Europeana網站暫時無法進
入。」Europeana的管理團隊允諾，這個巨大的資料庫
將配備一個更強而有力的主機，另行開張。
Europeana網站的數位內容是許多精選的數位化圖像，
來自歐洲各大博物館、圖書館、檔案庫或影音資料的
典藏。這個原型網站鎖定前述四種文化傳承的專業領
域，再加上橫跨整個歐洲廣泛的資訊內容，網站介面
則是多國語言，這意味著網站初期只有法文、英文、
與德文版，但日後的目

後，Europeana網站將是人們接觸數以百萬計，代表歐
洲豐富、多元文化物品的管道，屆時Europeana網站將
有屬於特定興趣或利益的互動專區與社群。2009年
至2010年間，歐盟每年將撥出大約200萬歐元的款
項，來實現網站目標。歐洲委員會計劃邀請民間單位
參與這項計劃，俾進一步擴大歐洲數位圖書館的規
模。

This year, the International Compe-tition Network (ICN) Merger Work-shop was hosted by the Taiwan Fair Trade Commission (TFTC) in the Grand Hotel on March 10 and 11. It is the fi rst time in the history of the ICN that Taiwan hosts a technical workshop. The 60 participants were offi cials of competition law authori-ties and lawyers specialising in this fi eld from 22 countries. The two-day workshop had brief introductory presentations with a procedural and analytic structure to each plenary session, and mirrored the success-ful format of past merger workshops by presenting a hypothetical merger case at each breakout session. All moderators and speakers at each session were experts on economics and jurisprudence from experienced competition authorities.
The Chairman of the TFTC, Mr Tang, Jinn-Chuan, stated in his opening address that, with the advent of economic globalisation and rapidly growing inter-national trade, inter- and multi-jurisdictional mergers have become inevitable. More and more cross-border transaction cases may fall within two or more jurisdic-tions at the same time. In response to these practical needs, we share a strong common interest in enhanc-ing procedural and substantive convergence in anti-trust enforcement. Merger review should be a major issue within this context.
Chairman Tang continued, saying that over the past few years, the ICN Merger Working Group has pro-duced a number of pragmatic and valuable profes-sional products, including the 2005 Investigative Tech-niques Handbook, the 2005 Merger Remedies Review
Project, and the 2006 Merger Guidelines Workbook. The Rec-ommended Prac-tices for Merger No-tifi cation Procedures is also worth noting. This practical writ-ten paper provides many agencies, par-ticularly those ready
to adopt or in the process of developing merger re-gimes, with clear guidance on setting transparent and streamlined procedures for notifi cation. Building on this robust groundwork, the ICN Merger Working Group subsequently developed recommended prac-tices on substantive merger analysis, with expected benefi ts due to be felt soon.
On March 12, two EU offi cials from DG Competition, Mrs Simon and Mr Ohrlander, visited Chairman Tang at the TFTC, accompanied by Dr Guy Ledoux, Head of the European Economic and Trade Offi ce in Taipei and a brief meeting was held. Chairman Tang ex-pressed his hope to continue promoting cooperation between the competition authorities in EU and Taiwan, and he felt there was the potential to create a more benefi cial competitive environment. Mrs Simon and Mr Ohrlander both appreciated the quality of the or-ganisation of the merger workshop and the lively dis-cussions that took place.
The International Competition Network (ICN) was launched on October 25 2001 by top antitrust offi cials from 14 jurisdictions - the European Union, Australia, Canada, France, Germany, Israel, Italy, Japan, Korea, Mexico, South Africa, the United Kingdom, the United States, and Zambia. It is the only international body devoted exclusively to competition law enforcement, and its members are competition authorities.

今年的「國際競爭網絡結合研討會」是由台灣的公平
交易委員會主辦，3月10日、11日在台北圓山大飯店
舉行。這是「國際競爭網絡」有始以來，台灣首度舉
辦的技術性研討會，有來自22國的60位競爭法主管
機關官員及律師與會。二天的研討會中，全體出席的
大會都有簡短的報告，輔以會議程序與分析架構介
紹。至於各分組研討會中則提出假設性的結合案例，
是以往「網絡結合研討會」成功模式的寫照。擔任分
組會議的主持人與演講者，每一位都是來自嫻熟競爭
法規的管理當局，同時也是經濟或法律專家。
行政院公平交易委員會的湯主任委員金全在開幕致詞
時提到，隨著經濟全球化的浪潮與日益熱絡的國際貿
易，在同一司法管轄區內或者跨轄區的結合行為顯然
無法避免。有越來越多的跨國交易案件，往往同時隸
屬二個或更多的司法管轄區。為了妥善因應這類實務
上的需求，我們對於反壟斷法的執行，加強程序與實
質上的匯合有著強烈的共識，就此而言，檢視聯合行
為應該是個重要議題。
湯主任委員接著表示，過去這些年來，國際競爭網絡
結合工作小組已經完成不少務實又寶貴的專業成就，
例如出版了「2005年調查技巧手冊」、「2005年糾
正結合案檢視計劃」、以及「2006年結合行為規範
手冊」等。特別值得一提的是「結合申報程序的建議
措施」，這份務實的書面報告對於如何訂定透明又有
效率的結合申報制度，提供明確的指導方針，許多行
政機構因而受益，尤其是那些即將採用或正在發展結
合法規的行政部門。有了這個堅實的基礎，接下來國
際競爭網絡結合工作小組可以針對數量龐大的結合案
件分析，提出可行的建議，成效不日可期。
歐盟競爭總署的二位官員賽門女士與歐藍德先生，在
歐洲經貿辦事處處長李篤的陪伴下，於3月12日拜會
公平交易委員會的湯主任委員，並進行一場簡短的會
議。湯主任委員表示，他希望歐盟與台灣掌理競爭法
的部門，能繼續推動雙方的合作。湯主任認為，創造
一個彼此互惠的競爭環境極

The European Parliament received a del-egation from Taiwan’s Legislative Yuan led by Mr Jin-pyng Wang on 11 Febru-ary 2009. The delegation members were the lawmakers from KMT Party including Ms Li-wun Cheng, Mr Yu-fang Lin, Mr Shou-chung Ting, Mr Hsueh-chang Lu, Ms Fong-chi Chu, Ms Hsiu-chu Hung, Ms Li-huan Yang and lawmakers from the Democratic Progressive Party, including Ms Ying Chen and Mr Shiing-jer Twu.
The European Parliament incumbent President Hans-Gert Pottering welcomed Mr Wang with great hospitality. The two men shared views on cross-strait rela-tions, Taiwan’s efforts to combat the glo-bal downturn and its role in spreading democracy in Asia. Mr Wang explained to Mr Pottering that the ROC government was committed to deepening Taiwan’s democracy and protecting human rights. In response, Mr Pottering re-affi rmed the Parliament’s support for Taiwan uphold-ing these values.
Dr Georg Jarzembowski, Chairman of the European Parliament-Taiwan Friendship Group, on behalf of the European Parliament gave the highest accolade to Mr Wang Jin-pyng for his endeavours to consolidate and enhance the relationship between the European Par-liament and the Legislative Yuan. “As the longstand-ing Speaker of the Legislative Yuan, our distinguished friend Mr Jin-Pyng Wang has an outstanding record for his dedication and fi ght for democracy and human rights” said Dr Jarzembowski.
“EP-Taiwan Friendship Group is the basis for impor-tant and trusted exchanges of views between two fully-fl edged parliaments developing more and more infl uence as the representative bodies of the people in Taiwan and in the European Union. The European Par-liament wholeheartedly supports Speaker Wang’s ap-proach to improving the bilateral relationship through confi dence-building measures, without giving up the values of democracy, human rights and the rule of law that have been established in the ROC on Taiwan,” Dr Jarzembowski continued.
As Belgium was the fi nal leg of Mr Wang’s European trip, he used the speech to wrap up an 11-day offi cial visit to Europe and to thank the Parliament for its 5 February Resolution backing Taiwan’s observer sta-
tus in international organisations. He also noted that the EU’s integration experience, where countries re-spect each other and pursue common goals, sets a good example for Taiwan and mainland China. “We hope the EU’s integration model and interaction can inspire leaders on both sides of the Taiwan Strait to abandon counterproductive action,” he said. “Pursu-ing East Asian stability and world peace must be the new focus.”
To further promote trade, cultural exchange, invest-ment and tourism, Mr Wang urged, the European Parliament should support visa waivers for Taiwanese citizens, who make approximately 260,000 trips to Eu-rope each year. In particular, he suggested that the European Parliament help Taiwanese citizens secure visa-free access to EU countries to further bilateral co-operation and exchange.
Following Mr Wang’s speech, Dr Jarzembowski pre-sented an award to Mr Wang, who is also chairman of the Taiwan Foundation for Democracy, in recognition of his contribution to promoting Taiwan’s democracy and human rights. In return, Mr Wang gave a medal to Mr Jarzembowski to honour his contribution to promot-ing inter-parliamentary relations with Taiwan. A similar medal was later bestowed on Graham Watson, leader of the Alliance of Liberals and Democrats for Europe, who is known for his long-term support for Taiwan. Mr Watson has announced his bid to run for the presiden-cy of the European Parliament at the parliamentary elections in June.

歐洲議會友台小組主席亞森柏斯基博士代表歐洲議會，
高度肯定王金平院長致力鞏固並增進歐洲議會與立法院
關係所做的各項努力。亞森柏斯基博士表示：「王金平
先生是位十分傑出的朋友，他長期擔任立法院院長，一
直為爭取民主與人權奮戰，表現極為優異。」
亞森柏斯基博士進一步強調：「歐洲議會友台小組是二
個功能完備，且分別在台灣與歐盟影響力日增的民意機
關，彼此信賴與溝通的重要管道與基礎。歐洲議會衷心
支持王院長對於建立彼此互信，並增進雙方關係所做的
努力，同時不放棄中華民國多年來已建立的民主、法
治、與人權價值。」
比利時是立法院赴歐代表團的最後一站，王院長在臨別
演說中，對該團在歐洲11天的正式訪問做個總結，也
特別感謝歐洲議會在2月5日達成支持台灣在國際組織
獲取觀察員身分的決議。王院長表示，歐盟各國的整合
經驗，以及會員國之間的相互尊重與共同目標的追求，
已為台灣與中國大陸立下一個值得效法的楷模。「我們
期盼歐盟的統合與互動模式，能對海峽兩岸的領導者有
所啟發，進而揚棄對雙方可能造成不良後果的任何措
施。」王院長說道：「追求東亞地區的穩定與世界和
平，應該是兩岸關係的新焦點。」
每年台灣民眾赴歐旅遊的次數大約有26萬次，為了進一
步推動雙方經貿、文化、投資與觀光的交流，王院長極
力促請歐洲議會支持台灣民眾赴歐盟免簽證的待遇。王
院長建議歐洲議會協助推動台灣民眾赴歐盟各國免持簽
證入境，俾進一步加強雙方的合作與交流。
同時擔任台灣民主基金會主席的立法院王院長演說完畢
後，亞森柏斯基博士特別頒贈獎狀給王院長，表彰他推
動台灣民主與人權的貢獻。王院長則頒贈榮譽獎章予亞
森柏斯基博士，感謝他促進歐洲與台灣兩個國會之間的
夥伴關係。隨後，王院長又頒發一個類似的榮譽獎章給
長期支持中華民國的「歐洲自由暨民主同盟」黨團主席
華森。華森已經宣佈將角逐下屆歐洲議會主席職位，這
項選舉將在今年6月舉行。

● Setting priorities
Priority must be given to partners, sectors and policies with a high actual or potential economic interest. The EU’s broader political objective of economic integration with its neighbours means that engaging with these countries will also be a priority.
● Listening to stakeholders
The closer partnership forged between the Com-mission, Member States and business under the Market Access Strategy has proven to be very ef-fective. This should now penetrate all work on mar-ket access and regulatory cooperation.
● Making full use of the range of instruments
The EU needs to make focused and coherent use of all available instruments to improve opportuni-ties for European exporters and the global regula-tory set-up.
The Communication sets out ways to remove regu-latory obstacles, increase market access and create growth and jobs. The Commission will pursue these objectives actively in 2009, including work to boost regulatory cooperation. This will go hand in hand with further work on the Lisbon Strategy for Growth and Jobs post-2010.

In December 2008 the European Commission issued the “Communication From The Commission on The Ex-ternal Dimension Of The Lisbon Strategy For Growth And Jobs: Reporting on market access and setting the framework for more effective international regulatory cooperation”. It gives an initial report on market access and proposes ways for the Union to achieve its objec-tive of openness at home and abroad, and for it to en-sure fair and open access to the third-country markets that matter most to EU businesses, including through regulatory cooperation.
Since open markets are key to the global economy and create opportunities for growth, employment and in-vestment, they are important for businesses in the EU and in developed and developing economies around the globe. There is a risk that the ongoing fi nancial and economic crisis will give rise to more protection-ism. It is important to learn from the past and counter such tendencies. At their recent Washington meeting, Heads of State and Government of the G20 placed a clear emphasis on realising the full potential of the trade agenda.
This new Communication aims to secure greater op-portunities for EU businesses in third countries and brings together external and internal policies. To foster this goal, the EU’s future activities should be guided by the following principles:
● A coordinated approach
All efforts to improve market access and export op-portunities for European business, and other issues related to regulatory cooperation and convergence, should be coordinated and clearly linked to the ex-ternal competitiveness agenda.

的關鍵，可以創造就業與
投資機會，並促進經濟
成長，這對歐盟以及全
球不論已開發或開發中國家的工商業發展都非常重要。
目前金融經濟危機很可能引發各國的保護主義，這是個
危機，大家有必要從過去的經驗獲取教訓，避免重蹈覆
轍。最近在華盛頓舉行的G20高峰會議，各國政府的領
導人都明確地表示，將貿易潛力發揮到極致將是未來的
工作重點。
這項新的歐洲委員會通訊的重點在於確保歐盟企業在第
三國市場享有更多的貿易機會，並提出歐盟會員國之間
以及歐盟對外貿易政策。為達成此一目標，歐盟各國未
來的相關活動，都必須符合下述原則：

Taiwan’s Accession to the GPATaiwan’s Accession to the GPAOn 9 December 2008, the European Commission warmly welcomed the formal decision by the members of the Committee on Government Procurement to adopt the accession of The Separate Customs Territory of Tai-wan, Penghu, Kinmen and Matsu (Chinese Taipei) to the WTO Government Procurement Agreement (GPA).
Commissioner for Trade Catherine Ashton said: “This accession will provide new opportunities in public pro-curement for businesses in both the European Union and Taiwan. The Commission will continue to seek market access for European companies, especially to help our small and medium-sized enterprises.” Com-missioner for the Internal Market Charlie McCreevy added: “Expansion of GPA membership has always been one of the key objectives of the EC as it leads to further business opportunities for European suppliers. Also, GPA membership guarantees fair, transparent and non-discriminatory procurement procedures. The EC believes that the accession of Chinese Taipei to the GPA will pave the way for expansion of GPA member-ship and that other WTO members will join the Agree-ment soon”.
Taiwan committed to joining the GPA within one year of joining the WTO in 2002. However it took six long years of diffi cult negotiations between Taiwan, the EU and other major trading partners to resolve some is-sues related to nomenclature.
The GPA is a multilateral WTO agreement, which cur-
rently applies to 40 WTO Members. Taiwan will become the 41st WTO Member to join the multilateral Agree-ment. The GPA requires its signatories to give national treatment to the goods, services and suppliers of the other signatories. The Agreement also requires pro-curements to be conducted in a fair, transparent and predictable manner in accordance with specifi ed prin-ciples and procedures. Undeniably, the GPA will help Taiwan secure more international resources to help it build high-quality infrastructure. According to a press release from DG Trade, European Commission, on 1 December 2008, Taiwan's market for government pro-curement was worth €14.3 billion in 2006 and €16.8 bil-lion in 2007. Foreign suppliers have had a 20% share of total government procurement worth more than €120 billion in Chinese Taipei over the past 10 years. EU companies accounted for 3% of the total, worth around €3.7 billion.
The European Chamber of Commerce Taipei (ECCT) issued statements welcoming Taiwan’s accession to the GPA. It believes that, with Taiwan about to begin implementing the i-Taiwan 12 projects, being a party to the GPA will help it secure greater international re-sources, enable it to build high-quality infrastructure and enhance long-term public benefi ts. The ECCT commended this development, expressing the hope that it could establish a fair and transparent competitive platform for government procurement, and also that off-set requirements for procurements covered by the GPA could be eliminated as soon as possible. The Invest-ment Commission of the Taiwan Ministry of Economic Affairs (MOEA) is planning a number of explanatory meetings for foreign fi rms and assists Taiwan’s over-seas representative offi ces in carrying out promotional work in their host countries, with a view to attracting for-eign fi rms to participate in procurement and investment in Taiwan’s major construction projects.

台北以台澎金馬個別關稅領域
的名義，加入世界貿易組織
(WTO)政府採購協定。
歐盟主管貿易的委員艾希頓女
士表示：「台灣加入協定後，
將為歐盟與台灣創造更多的公
共採購商機。歐洲委員會將繼
續為歐洲廠商，特別是中小企
業，尋求市場進入管道。」主
管歐盟境內市場的麥克格理維
委員補充道：「擴增政府採購
協定會員國的數量，將替歐洲
的供應商帶來商機，因此一直
是歐盟的重點目標之一。何況
政府採購協定會員國的身分，
可以確保公平、透明、平等對待的採購程序。歐洲委員
會相信中華台北加入政府採購協定，將為日後政府採購
協定會員國的擴增鋪路，其它WTO會員國的陸續加入，
將指日可待。」
台灣於2002年申請加入WTO，一年之後即承諾加入政府
採購協定，但是台灣、歐盟、及其他主要的貿易夥伴卻
花了六年的時間，歷經艱辛的談判，才解決有關入會名
稱的問題。
政府採購協定是WTO的一項多邊協定，目前有40個
WTO會員國適用，台灣是第41個WTO會員國參與這項
多邊協定。政府採購協定要求簽署國對其他簽署國的商
品、服務、與廠商提供國民待遇，同時要求所有的採構
案件必須符合既定的原則與程序，以公平、透明且可預
期的方式進行。政府採購協定無疑將協助台灣掌握更多
的國際資源，來建造高品質的公共設施。根據歐洲委員
會貿易總署2008年12月1日的新聞稿顯示，2006年台
灣的政府採購總金額達143億歐元，2007年有168億歐
元。過去10年，國外供應商占中華台北政府採購總數的
20%，金額超過1,200億歐元，其中歐洲廠商占3%，金
額大約是37億歐元。
台北市歐洲商務協會發表歡迎台灣加入政府採購協定的
聲明，該協會認為正在推動愛台12項建設的台灣，成
為政府採購協定會員國後，必然可以獲得更多的國際資
源，從事高品質的公共工程建設，增進長久的公共利
益。台北市歐洲商務協會針對這項成果，表達希望台灣
能建立一個公平、透明並具競爭性的政府採購平台，也
期盼能儘早撤除政府採購協定中一些枝微末節的繁瑣規
定。為了吸引國外廠商參與中華民國政府的採購案件，
投資台灣的重大建設計劃，中華民國經濟部投資審議委
員會正規劃一系列針對國外廠商的推廣說明會，同時協
助海外的代表辦事處向地主國推廣。
