I really wish I had Attorney Stick’s
creativity and ability to draw; I’d
have a “Sorry, ya’ll—message next
month” update for you. It’s been that
type of month!
B ut, since I don’t have a gift of
creativity or artistic ability to draw
clever cartoons, I come to you with a
simple president’s message this month.
F irst, I’d like to thank everyone who
donated clothing and cash to the
Bakersfield Rescue Mission last month.
We inundated Kristen with clothing to
deliver. I love how dedicated our
members are to each of the different
charities. We have had a great turn out for
2015 thus far!
I really hope you’ve signed up for the
April luncheon! We hope you enjoy
the new topic we have to offer—
Intellectual Property! If you have a topic
or speaker that you think would be
beneficial to hear, please let us know and
we will try to coordinate it!

personal information before donating) for
emergency use by Alliance clients. Cash

general meeting to help the Alliance

KCPA is collecting items to benefit the Alliance
Against Family Violence and Sexual Assault.
Donation of cash is needed for the purchase of
underwear, bras, toiletries/ personal hygiene
products and blankets, sheets and towels for
women and children of all ages. Also, we will be
accepting used cell phones (be sure to remove any
personal information before donating) for
emergency use by Alliance clients. Cash or any of
the listed items may be submitted at the April
general meeting

May
Our Community Affairs opportunity for
May is a canned/packaged food drive to
benefit the Gleaner’s Senior Sack Program. There
are currently 24 sites throughout Kern County in the
Senior Sack Program. Each site receives food twice
per month. Food is delivered to the site twice each
month for distribution to registered seniors. “Sacks”
include at least ten items including fresh fruits and
vegetables, bread, snack items, and staples. This
program is to be both food relief and encouragement
of social interaction for seniors. Each site is run by
volunteers who help unload the Gleaners’ delivery
truck, bag the individual food orders for the
recipients, greet the seniors and distribute the food.
The site is to provide refreshments and a chance for
socializing. Please bring canned or packaged
(cereal, rice, beans, snack items, etc.) food to the

Getting your hands on investigative
reports and documents for civil cases
that arise from criminal incidents can
be nearly impossible without the use of
a subpoena. Even with a subpoena,
some agencies require a court order
to release certain evidence, such as
coroner’s photographs. The downside
to using a subpoena is the cost and
time involved. To avoid this, I have
turned to the Public Records Act with
various levels of success to obtain
reports, photographs, and other
records from the District Attorney’s
Office that handled the criminal
action related to the civil case.
The California Public Records Act
permits anyone to obtain, subject to
certain exemptions, “any writing
containing information relating to the
conduct of the public’s business
prepared, owned, used, or retained
by any state or local agency
regardless of physical form or
characteristics.” [Gov. C. §6252
(e)] Specific exceptions to disclosure
are listed in Sections 6253.2, 6253.5,
6253.6, 6254, 6254.1 through 6254.22,
6255, 6267, 6268, and 6276.02 through
6276.48.
Obtaining Criminal Records in a Civil Action

To get criminal records, you can make
a Public Records Act request to the
District Attorney’s office for a copy of
their entire investigation file. A form
letter for a Public Records request is at
the bottom on this Newsletter. It is
important to note that the District
Attorney’s office is not necessarily
required to produce some of the
documents. Government Code §
6254(f) covers the pertinent exclusions
for this request.
However, if the request is successful,
you can get your hands on some
great evidence at a reasonable cost
and with limited time spent on the
task. An example of why it is
important to obtain the District
Attorney’s investigation file occurred
on a recent wrongful death case
involving a DUI. The District Attorney’s
office produced a copy of the full
accident report, including the DUI
narrative, transcripts of witness
statements, toxicology report, a CD of
the 911 calls, photographs not
previously produced by the police
department, and references to
additional videotaped interviews.
The Public Records Act is a great tool
for obtaining evidence, and should be
used if at all possible in place of
a Deposition Subpoena for the
Production of Business Records. It will
save your client case costs and you
the headache of processing a

I’ve been involved in KCPA since 2010 and have had various roles during the past 5 years. I currently
work as a litigation paralegal at Klein, DeNatale, Goldner,
but I do a little bit of everything. I like encountering the
different stories and situations that each case brings with
it. When I’m not a work (or thinking about work), I enjoy
spending my free time with my husband and dogs in
Tehachapi or at a hockey game. I’m also really excited to
attempt running my first 5k on the Fourth of July!

Chocolate Sandwich Cookie Cake
Ingredients:
2 1/2 cups whipping cream 1/2 cup almond flavored liqueur or 1 tsp. almond extract plus 3 Tbsp. confectioners’ sugar 1 package (16 oz.) Oreos Halved strawberries and Oreos (for garnish) Directions: 1. Lightly grease 7-8 inch springform pan. 2. Mix whipping cream and liqueur in a large
bowl. Chill for 30 minutes. 3. Coarsely chop Oreos and place in a medium
sized bowl. 4. Add 2 cups cream mixture to chopped
Oreos and mix well with rubber spatula. 5. Press 1/3 mixture evenly over bottom of
pan. 6. Spoon 1/3 of the remaining cream mixture
on top and spread evenly to edges. 7. Crumble 2 cups of the remaining cookie
mixture evenly over the cream. 8. Repeat layers, ending with cream. 9. Freeze at least 2 hours, or wrap airtight and
freeze up to 3 days. 10. About 1 hour before serving, run thin knife
around edges of cake to loosen. 11. Remove sides of pan. 12. Place cake in refrigerator for 15 minutes to
soften slightly (serve semi-frozen). 13. Garnish with strawberries and Oreos. *Provided to KCPA for a cookbook.
Spaghetti Pizza
Ingredients:
8 oz. cooked spaghetti 1 Tbsp. olive oil 1 beaten egg 1/2 cup grated parmesan cheese Directions: 1. Mix together and placed in
greased 13”x9” pan. 2. Bake at 425 degrees for 20
minutes. 3. Top with pizza sauce, cheese
and favorites toppings. 4. Bake at 425 degrees for 15
minutes. *Provided to KCPA for a cookbook.
