Is it right to reject a „P“ substance in IMDS because the use is prohibited?

Definition in GADSL Guidance Document:

P = ProhibitedA substance designated “P” is either prohibited by regulation for use in certain applications or may not exceed regulated threshold limits.

Prominent examples:

� Lead (ELV exemptions) or� Diorgano tin compounds

Dioctyl tin compounds:

Following the GADSL rules it was newly published as „P“

�Check legislation if the legal prohibition covers the substance applicationin the material or part.

If not: there is no reason for rejectionin IMDS!

Legal text:

Dioctyltin (DOT) compounds shall not be used after 1 January 2012 in the following articles for supply to, or use by, the general public, where the concentration in the article, or part thereof, is greater than the equivalent of 0,1 % by weight of tin:

There are also other reasons why the legal text should be read carefully

Dibutyltin (DBT) compounds shall not be used after 1 January 2012 in mixtures and articles for supply to the general public where the concentration in the article, or part thereof, is greater than the equivalent of 0,1 % by weight of tin:

Knowing the concentration of Tin in the substance you can calculate the:

� the concentration of Tin in the material and

� the concentration of Tin in the part.

According to a decision of the ACEA WG M&S “part thereof” is to be interpreted as “detachable component of an assembly”.

Still missing: Definition of „part thereof“

GASG doesn‘t provide interpretation of legislation!
