Advertising Policy

AAO Guidelines for Acceptance of Advertising

The following information applies to the Annual Session ExhibitGuide sponsorship opportunities and also to Annual Sessionconference bag inserts.

You must be an Annual Session exhibitor to advertise in anyAnnual Session publication or to participate in a sponsorship.Advertised products must conform to the AAO’s official Guide-lines for Acceptance of Advertising. The AAO reserves the right

to reject advertisements that do not conform to these guide-lines. Copy for new advertisements must be submitted for review prior to the materials closing deadline. The advertisingguidelines are listed within this publication. Reading noticesand classified ads are not accepted. Space must be contractedin advance of published closing dates. Payment is due 30 daysfrom the date of invoice. First-time advertisers must prepayuntil credit is established.

The AAO welcomes advertising in its publications as an impor-tant means of keeping the orthodontist informed of new andbetter products and services for the practice of orthodontics.Such advertising must be factual and provide useful productand service information. These standards apply to advertise-ments in The Bulletin, the American Journal of Orthodonticsand Dentofacial Orthopedics (AJO-DO) and all Annual Sessionpublications, advertising on AAO’s websites, and inserts forthe Annual Session conference bags.

The publication of an advertisement is not to be construed as an endorsement or approval by the AAO or any of its sub-sidiaries, councils, committees or agencies of the product or service being offered in the advertisement unless the advertisement specifically includes an authorized statementthat such approval or endorsement has been granted. The factthat an advertisement for a product, service or company hasappeared in an AAO publication will not be referred to in collat-eral advertising.

The AAO reserves the right to accept or reject advertising at itssole discretion for any product or service submitted for publica-tion, regardless of whether it complies with these standards.

General Requirements 1. All advertisements submitted for display in an AAO publi-

cation are subject to review by the AAO or its designees,and except as to the AJO-DO, must contain the followingdesignation: “Paid Advertising*” in a conspicuous sizeand location.

2. All advertisements should be relevant to, and effectiveand useful in, the practice of orthodontics. Products orservices that are of interest to orthodontists or the dentalprofession may be considered for acceptance.

3. Advertisements must not be deceptive or misleading. Allclaims of fact must be fully supported and meaningful interms of performance or any other benefit. The Associa-tion reserves the right to request additional informationas needed.

4. Advertisements will not be accepted if they conflict with orappear to violate AAO policy, the AAO Principles of Ethicsand Code of Professional Conduct or its Bylaws, or if the

advertisements are deemed offensive in either text or art-work, or contain attacks of a personal, racial or religiousnature. The AAO reserves the right to decline advertisingfor any product involved with a government agency chal-lenge or denial of product marketing.

5. By submitting advertising copy, advertisers certify thatsuch copy and the advertised product(s) are in accordwith applicable government laws and regulations, such asequal opportunity laws and regulations covering new drugapplications and prescription drug advertising. For example,products that require approval by the U.S. Food and DrugAdministration for marketing must receive this approvalbefore being eligible and must include “full disclosure”when required. It is the responsibility of the advertiser toconform to regulations of the FDA and all legal requirementsfor the content of claims made for products. Acceptanceof advertising in AAO publications is not to be construedas a guarantee that the manufacturer has complied withsuch laws and regulations.

6. Complete scientific and technical data, whether publishedor unpublished, concerning product safety, operation and usefulness may, in the sole discretion of the AAO, be required.

7. The advertisement may cite, in footnotes, references fromdental and other scientific literature provided the refer-ence is truthful and is a fair and accurate representationof the body of literature supporting the claim made.

8. The following disclaimer shall be included in a conspicu-ous location in all AAO publications other than the AJO-DO: “*PAID ADVERTISING: Advertising in this publicationrepresents the opinions of the advertiser, and not theAmerican Association of Orthodontists (AAO). The AAOhas not verified, and is not under any duty to verify, any ofthe claims set forth therein. An independent determina-tion as to the accuracy of the claims and statementsshould be made by the reader.”

9. Display advertising and classified advertising with respectto employment, purchase of practice, participation or anyother contractual relationship with any dental care deliverymode or system may be accepted for publication only inthe AJO-DO.

10. Alcoholic beverages and tobacco products are not eligiblefor advertising.

11. Books and electronic media are eligible for advertising,but a sample may be required in advance for review.

12. An AAO publication will accept advertisements from an accredited university or college-affiliated dental educationcourse, either on a graduate level or on a continuing-edu-cation level, or by a national certifying board or specialtysociety recognized by the ADA.

13. The advertiser and the product or service being offeredshould be clearly identified in the advertisement. In thecase of drug advertisements, the full generic name ofeach active ingredient will appear.

14. Advertising that simulates editorial content must beclearly identified as advertising. The word “advertise-ment” must be displayed conspicuously.

15. Guarantees may be used in advertisements provided thestatements that are “guaranteed” are truthful and can besubstantiated. However, no guarantee should be usedwithout disclosing its conditions and limitations. Whenspace or time restrictions preclude such disclosures, theadvertisement must clearly reveal where the full text ofthe guarantee can be examined before purchase.

16. Advertisements must not quote the names, statements orwritings of any individual, public official, governmentagency, testing group or other organization without theirexpress written consent.

17. If evidentiary support for a claim required by these Guide-lines is not available (i.e., as to the AJO-DO), the adver-tiser must choose from among one of the following threeoptions:

a. Maintain the advertiser’s wording, and place an asteriskafter the claim or statement that will refer the reader toat least two published, peer-reviewed research articlesthat will be placed at the bottom of the advertisement.

b. Maintain the advertiser’s wording and, if no peer-reviewed references are available, place an asteriskafter the claim or statement that will refer the reader to the following statement that will be placed at the bottom of the advertisement: *Not yet verified by peer-reviewed research.

c. Change the wording of the advertisement to eliminatethe unfounded claim or statement. (In some cases onlyspecific phrases, adjectives or quantifiers may need tobe deleted, as opposed to entire statements.)

18. When the deliberations between the AAO and an adver-tiser in the AJO-DO warrant, the editor-in-chief of the AJO-DO will make contact with the advertiser.

Criteria for Substantiation of Comparative Claims The following Criteria for Substantiation of Comparative Claimsprovide guidance to advertisers on what constitutes “adequatesubstantiation,” and shall apply to the AJO-DO, and may, at thediscretion of the AAO, apply to all other publications. The ulti-mate test is whether the claim, when viewed in the context ofthe advertisement as a whole, is false or materially mislead-ing. Comparative advertisements may include the use of acompetitor’s name and the description of a comparable prod-uct or service, including price, if the comparison is made in amanner that is not false or misleading.

1. Comparative claims relating to clinical safety or efficacyshould be supported by results from at least one well-designed clinical study that directly compares the products.These studies should have been published in a peer-reviewed journal. Additional studies may be required.

2. Comparative claims that include references to productsand appliances being superior, the first or only in a specificmarket or product category, or claims concerning shortertreatment time, less discomfort, better treatment results,more biological or more stable must be substantiated. Suchclaims should be supported by results from at least twowell-designed clinical studies that directly compare theproducts. These studies should have been published inpeer-reviewed journals. Additional studies may be required.

3. Clinical studies should follow accepted principles of goodstudy design (e.g., independent, blinded if appropriate, ad-equately powered, well-controlled [should normally includea negative control, if ethical, to validate the study], random-ized, prospective, etc.), and study subjects should be repre-sentative of the population for whom the product is intended.

4. Indices used to measure various clinical outcomes (e.g.,gingival indices, plaque indices, radiographic indices, ABOObjective Grading System, etc.) should be reliable and re-producible, and should have been published in a peer-re-viewed journal.

5. All available studies comparing the products or formulationsin question should be submitted on request.

6. If other comparative studies give conflicting results, adver-tising claims will not be accepted unless they reflect theseresults.

7. Results should be both statistically analyzed and shown tobe clinically meaningful.

8. Studies should analyze and compare the change in themeasured parameter for the test product vs. the change inthat parameter for the compared product.

Review ProceduresAll advertisements must be submitted to the Advertising Man-ager. The advertisements will then be reviewed by AAO staff,including the General Counsel and any review committee asmay be established by the AAO. If an advertisement appearsto meet the guidelines, but is questioned by the AAO on thebasis that the advertisement fails to meet these Guidelines,the matter will be presented to any such review committee fordecision. The review committee (and the editor in the case ofthe AJO-DO) will confer and render a decision.

If the advertising review committee is unable to agree on theacceptance of an advertisement, then a decision to accept orreject an advertisement may be deferred to the ExecutiveCommittee of the Board of Trustees of the American Associa-tion of Orthodontists for further review at its next regularlyscheduled meeting. A decision by the advertising review com-mittee is final, or, if referred by the advertising review commit-tee to the Board of Trustees Executive Committee, a decisionby the Board of Trustees Executive Committee is final.

Advertising/Sponsorship Contract TermsI agree to pay the costs set forth above upon receipt of in-voice. First-time advertisers must prepay until credit is estab-lished. I have read the American Association of OrthodontistsGuidelines for Acceptance of Advertising, and represent thatthe advertising to be placed complies with the Guidelines.Cancellation of advertising will not be accepted after spacereservation deadline. Contracts will be short rated to the ac-tual rate earned on the basis of the AAO rates in effect at thetime this Contract took effect.

You are guaranteed this rate for one full year from the date ofthis Contract, provided that advertising rates are subject tochange without notice. (See advertising packet for additionalcontract terms.) You agree to indemnify and hold the AmericanAssociation of Orthodontists harmless from all damages, in-cluding attorneys’ fees, arising from any breach of this Agree-ment by the advertiser.

Hotel Reservation PolicyHotel ServicesThe following policy was developed to assist AAO Annual Ses-sion exhibitors in securing appropriate hotel accommodations.

All exhibiting companies at the American Association of Orthodontists’ Annual Session are expected to use the AAO official housing company to secure room reservations for allemployees registered for the Annual Session.

Accommodations for the Annual Session can be securedthrough OnPeak (AAO Hotel Services) after exhibit contract and deposit have been received.
