Malaysia – EU FLEGT VPA

1. Malaysia’s negotiations for a FLEGT VPA with the EU started in 2004 when the Ministry of Plantation Industries and Commodities commenced informal discussions with EU

2. Formal negotiations started in September 2006

Malaysia’s Approach in FLEGT VPA Negotiation

1. Main objective – to ensure the export of only legal timber to the EU

2. Malaysia agreed to implement a Timber Legality Assurance System (TLAS) to verify that timber products for shipment to EU are legally produced

3. Only timber products verified as such are issued with a FLEGT Licence and can be exported to the EU

4. Malaysia started to formulate its TLAS in late 2006; and TLAS had been subjected to several stakeholder consultations and JEMs

Focus on legality and not sustainability

Legality definition of timber would not involve new or amendment of existing legislations

TLAS would be built upon current timber licensing system

Timber Legality Assurance System (TLAS)

1. Based on Federal and State Legislations of Malaysia

2. Follow closely on the current licensing systems governing forest harvesting, mill processing, as well as import and export of timber products

3. Under the VPA, once the TLAS is fully operational, all timber products exported to the EU from Malaysia will have to be accompanied by a valid FLEGT Licence

The TLAS is develop based on the following :

1. Definition of legality

“ Timber harvested by licensed person from approvals area and timber products exported in accordance with the laws, regulations and procedures pertaining to forestry, timber industry and trade of Malaysia”

2. Existing laws and regulations governing forest harvesting, mill processing and trade of timber

3. TLAS comprised 6 agreed Principles and its associated criteria (24 Table) which are interpreted into the various TLAS Tables

Timber Legality Assurance System (TLAS)

1. Eleven Stakeholder Consultations were held so far; Discussion by six Joint Expert Meetings (JEM)

2. TLAS is subject to a Third Party Monitoring;

3. Implementation of TLAS involves 8 agencies from 5 different Ministries for Peninsular Malaysia

Timber Legality Assurance System (TLAS)

1. Product Scope of the VPA covers 11 products including wooden furniture, fibreboard, and joineries

2. In addition to natural forests and plantation forest, timber sources also include rubber wood harvested from replanting activities from rubber small-holdings and estates

3. Data monitoring at key stages of the timber supply chain is required

1. Consultation with stakeholders – an integral part of process undertaken by Malaysia in the development of the TLAS

2. Stakeholder Consultations in forestry sector - not new to Malaysia

Standard-setting process for timber certification by MTCC

3. To-date, 11 stakeholder consultations had been held

1. Pending the conclusion and signing of the VPA, Malaysia has decided to implement the TLAS as MYTLAS beginning 1 February 2013 purely as Malaysia’s own initiative in order to meet EUTR requirements [Peninsular only]

2. To assure its robustness, a Compliances Audit was conducted in March 2013 by a Third Party Auditor

3. The audit was based on a set of established Checklist and Guidelines developed by another independent consultant

1. The Report of the Compliance Audit demonstrated high level of compliance of all the criterion indicated in the 24 Tables of the TLAS

2. There were some criteria/tables of the TLAS which were rated as partial compliance

3. These partial compliances were discussed by the Implementation Agencies Coordination Committee (IACC) and remedial actions undertaken

4. The Technical Advisory Group (TAG) which comprises of representatives from NGO’s, industry groups, forest experts had also discussed the findings and actions taken by the IACC in order to strengthen the overall process

Conclusion

1. The VPA is an initiative to combat illegal logging and its associated trade

2. Malaysia is supportive of this initiative and it is now in advanced stage of negotiation with the EU

3. Pending conclusion of the FLEGT VPA, Malaysia is implementing MYTLAS to meet due diligence requirements under EUTR
