2. To be a judge, you need to be handed official papers. (Like a badge to an officer).
3. Thomas Jefferson tells James Madison to not give Marbury his papers.
4. Marbury is upset and takes this to the Supreme Court (the highest court in America), which is why it is called Marbury V. Madison
5. The Chief Justice (leader) of the Supreme Court is John Marshall, who is a Federalist like John Adams unlike Thomas Jefferson (Democratic-Republican).
6. Marbury thinks that Madison will be forced to give him his papers because of the Judiciary Act of 1789.
7. The Judiciary Act of 1789 gives the Supreme Court power over the Executive Branch.
8. John Marshall rules that the Judiciary Act of 1789 is unconstitutional or illegal and should not be followed.
9. Therefore, John Marshall rules that the Supreme Court cannot force Madison to give Marbury his papers to be a judge.
10. This established judicial review: The Supreme Court can rule laws to be unconstitutional.
