CLIMATE CHANGE (GREENHOUSE GAS EMISSIONS) REGULATIONS 2012

Notice

I, PETER CARL GUTWEIN, for the purposes of regulation 6 of the Climate Change (Greenhouse Gas Emissions) Regulations 2012, give notice of Tasmania’s baseline figure and reduction in greenhouse gas emissions for the financial year ending 30 June 2015.

The total reported carbon dioxide equivalent emissions for Tasmania in the baseline year ending 30 June 1990 were 19.40 mega-tonnes. Reported carbon dioxide equivalent emissions for the year ending 30 June 2015 totalled 0.89 mega-tonnes.

This represents an overall reduction in net emissions of approximately 18.51 mega-tonnes, or 95 per cent, from 1989-90 levels.

A copy of the Tasmanian Greenhouse Gas Accounts 2014-15 report can be found on the Tasmanian Climate Change Office website: www.climatechange.tas.gov.au.

Pursuant to the powers under the Fisheries (Rock Lobster) Rules 2011 ("the Rules") that were delegated to the Director (Marine Resources) on 19 August 2015 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), I hereby determine that the part of the rock lobster fishery that comprises of the activities of the taking of rock lobster, diving for rock lobster, the setting of a rock lobster pot or the use of a rock lobster ring in the “Maria Island Zone” and the “Storm Bay Bruny Zone” is closed from 28 July 2017,

where:

"Maria Island Zone" is defined to mean the area of State waters adjacent to the east coast of Tasmania bounded in the north by the line of latitude at 42º 10’ South and bounded in the south by the line of latitude at 42º 49’ 00” South, and also including all the waters within Great Oyster Bay north of latitude at 42º 10’ South; and,

“Storm Bay Bruny Zone” is defined to mean the area of State waters adjacent to the south coast of Tasmania bounded in the east by the line of longitude running due south of Cape Pillar at 148° East and bounded in the west by the line of longitude running due south of Lighthouse Bay, Bruny Island, at 147° 09’ 44” East.

Any expression used in this public notice having a particular meaning under the Act or the Rules has the same meaning in this public notice as it has in the Act or the Rules.

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Marine and Safety (Pilotage and Navigation) Regulations 2017

These regulations –

(a) provide for a range of matters relating to pilots, pilotage, navigation and unseaworthy vessels under the Marine and Safety Authority Act 1997; and

(b) are made consequentially on the repeal of the Marine and Safety (Pilotage and Navigation) Regulations 2007 under section 11 of the Subordinate Legislation Act 1992.

(2) Explosive Amendment Regulations 2017

These regulations amend the Explosives Regulations 2012 to correct a reference to the Marine and Safety (Pilotage and Navigation) Regulations 2017.

(3) Marine and Safety (Infringement Notices) Amendment Regulations 2017

These regulations amend the Marine and Safety (Infringement Notices) Regulations 2008 to update references in relation to the Marine and Safety (Pilotage and Navigation) Regulations 2017.

(4) Marine Farming Planning Amendment Regulations 2017

These regulations amend the Marine Farming Planning Regulations 2016 by prescribing the method for calculating a special penalty for an offence against section 91 of the Marine Farming Planning Act 1995 that involves exceeding the total dissolved nitrogen output permissible under a marine farming development plan.

(5) Registration to Work with Vulnerable People Amendment (Regulated Activities) Regulations 2017

These regulations amend the Registration to Work with Vulnerable People Regulations 2014 by prescribing certain child education services to be regulated activities for the purposes of the Registration to Work with Vulnerable People Act 2013.

(6) Traffic (Compliance and Enforcement) Regulations 2017

These regulations –

(a) prescribe traffic infringement notice offences for Part IVB of the Traffic Act 1925; and

(b) prescribe and specify offences for certain other provisions of that Act; and

(c) provide for certain other compliance and enforcement matters under that Act; and

(d) rescind the Traffic (Compliance and Enforcement) Regulations 2011 and its amending legislation.
