POLLUTION OF WATERS BY OIL AND NOXIOUS SUBSTANCES ACT 1987

sewAge mANAgemeNt Directive

The Director of the Environment Protection Authority has made a Directive on The Discharge of Sewage from the Brig STV “Lady Nelson” into State Waters. The Directive is a risk-based approach to sewage discharge which specifies where sewage may and may not be discharged from the Lady Nelson.The Directive takes into account the special circumstances of the Lady Nelson as a training vessel for children and young people, by allowing the discharge of disinfected sewage closer to land than would otherwise be permitted.

This Directive is issued in accordance with section 25CC of the Pollution of Waters by Oil and Noxious Substances Act 1987.

The Directive gives effect to section 25CB (2) (ab) of the Pollution of Waters by Oil and Noxious Substances Act 1987.

The Directive applies to the Brig STV “Lady Nelson”.

The Directive on The Discharge of Sewage from the STV “Lady Nelson” into State Waters takes effect from Thursday 27 November 2014. Copies of the Directive can be found on the EPA website: http://epa.tas.gov.au/epa/whatsnew

I, JEREMY ROCKLIFF, Minister administering the Living Marine Resources Management Act 1995, acting under Section 94 of that Act, hereby:

1. Set the total allowable catch for the entire commercial abalone fishery for the year 2015 at 1,855 tonnes.

2. Determine that the parts of the commercial abalone fishery from which the total allowable catch for the year 2015 is to be taken are: I. The eastern blacklip abalone part of the fishery; II. The western blacklip abalone part of the fishery; III. The central western blacklip abalone part of the fishery; IV. The northern blacklip abalone part of the fishery; V. The Bass Strait blacklip abalone part of the fishery; and VI. The greenlip abalone part of the fishery, those parts of the fishery being respectively identified as follows:I. the eastern blacklip abalone part of the fishery is the

part of the commercial abalone fishery involving only blacklip abalone in State waters adjacent to the east, south-east and south coasts of Tasmania bounded in the north by an imaginary line starting from the northern side of the mouth of the Great Musselroe River at Musselroe Bay, running due west for 100 metres, following the shoreline 100 metres from shore to the northernmost tip of Musselroe Point, running due north until intersection with the line of latitude 40o 48' 00" South and running due east to the outer limit of State waters and bounded in the south by an imaginary straight line running due south from Whale Head near South East Cape to the outer limit of State waters;

II. the western blacklip abalone part of the fishery is the part of the commercial abalone fishery involving only blacklip abalone in State waters adjacent to the south and west coasts of the mainland of Tasmania between an imaginary straight line due south from Whale Head near South East Cape and an imaginary straight line due west from the mouth of the Wild Wave River near Sandy Cape;

III. the central western blacklip abalone part of the fishery is the part of the commercial abalone fishery involving only blacklip abalone in State waters adjacent to the west coast of the mainland of Tasmania bounded in the north by an imaginary straight line running due west from the mouth of the Arthur River to the outer limit of State waters and in the south by an imaginary straight line due west from the mouth of the Wild Wave River near Sandy Cape;

IV. the northern blacklip abalone part of the fishery is the part of the commercial abalone fishery involving only blacklip abalone in State waters adjacent to the north, north-west and north-east coasts of the mainland of Tasmania and King Island bounded in the east by an imaginary line from the northern side of the mouth of the Great Musselroe River at Musselroe Bay running due west for 100 metres, then following the shoreline 100 metres from shore to the northernmost tip of Musselroe Point, then running due north until intersection with the line of latitude 40o 48' 00" South, and running due east to the outer limit of State waters, and bounded in the west by an imaginary straight line running due west from the mouth of the Arthur River to the outer limit of State waters but excluding those waters within the Bass Strait blacklip abalone part of the fishery;

V. the Bass Strait blacklip abalone part of the fishery is the part of the commercial abalone fishery involving only blacklip abalone in State waters adjacent to the north coast of Tasmania, the Furneaux Group of islands, and in Bass Strait bounded in the west by the line of longitude 145° 22’ 42” East and in the east by an imaginary line beginning where the line of longitude 147° 27’ 00” East meets the high-water mark of the north coast of the mainland of Tasmania in Anderson Bay then running due north until its junction with the line of latitude 40° 39’ South then due east along that line of latitude to the limit of State waters; and

VI. the greenlip abalone part of the fishery is the part of the commercial abalone fishery involving only greenlip abalone.

3. Determine that the portion of the total allowable catch to be taken from each part of the commercial abalone fishery for the year 2015 is:

I. the eastern blacklip abalone part of the fishery – 528.5 tonnes;

II. the western blacklip abalone part of the fishery – 840 tonnes;

III. the central western blacklip abalone part of the fishery – 52.5 tonnes;

IV. the northern blacklip abalone part of the fishery – 224 tonnes;

V. the Bass Strait blacklip abalone part of the fishery – 70 tonnes; and,

VI. the greenlip abalone part of the fishery – 140 tonnes.

GENERAL PURPORT OR EFFECT OF THE ABOVEMENTIONED STATUTORY RULES

(1) Gaming Control Regulations 2014

These regulations –

(a) prescribe certain fees, certain refunds, and certain tax rates, payable for the purposes of the Gaming Control Act 1993; and(b) prescribe certain activities to be sports events for the purposes of that Act; and(c) prescribe certain offences in relation to which a prescribed licence holder may detain a person in certain circumstances; and(d) prescribe the period within which, and the manner in which, appeals may be made to the Supreme Court; and(e) are made consequentially on the repeal of the Gaming Control Regulations 2004 under section 11 of the Subordinate

Legislation Act 1992.

(2) Local Government (Rates and Charges Remissions) Regulations 2014

These regulations –

(a) prescribe the maximum remission allowable in rates and charges for the purposes of the Local Government (Rates and Charges Remissions) Act 1991; and

(b) define prescribed institutions and eligible pensioner for the purposes of that Act; and(c) are made consequentially on the repeal of the Local Government (Rates and Charges Remissions) Regulations 2004 under

section 11 of the Subordinate Legislation Act 1992.

(3) Public Account Regulations 2014

These regulations –

(a) prescribe $50 000 as the amount for the purposes of section 8(5)(e) of the Public Account Act 1986; and

(b) are made consequentially on the repeal of the Public Account Regulations 2004 under section 11 of the Subordinate Legislation Act 1992.

(4) Proclamation under sections 9A and 52A of the Roads and Jetties Act 1935

This proclamation amends an earlier proclamation (S.R. 1994, No. 105) by –

(a) declaring the intended new line of part of the South Arm Highway (to take effect 60 days after this proclamation is notified in the Gazette as specified in section 9A(4) of the Roads and Jetties Act 1935); and

(b) declaring that part of the South Arm Highway to be a limited access road and the places of access to that limited access road (to take effect on the opening of the relevant highway as specified in section 52A(2) of the Roads and Jetties Act 1935).

(5) TT-Line Gaming Regulations 2014

These regulations –

(a) prescribe the fee payable, under section 4(4) of the TT-Line Gaming Act 1993, by a State shipping company for the issue of a gaming licence; and

(b) are made consequentially on the repeal of the TT-Line Gaming Regulations 2004 under section 11 of the Subordinate Legislation Act 1992.
