SITE RESTRICTIONS
The Contractor is to adhere to the instructions and regulations set by the Project Manager as
per site requirement / management
SITE ACCESS AND CONTRACTOR'S SET-UP
The site accsess is as per the site layout drawing and the Contractor is expected to visit the
site prior to submission of tender and aquaint themselves with the site, and shall submitt
together with their tender proposals for site establishment and set up.

GENERAL
The Contents of this Section are intended to assist the Contractor to appreciate the project and
the conditions under which the works shall be executed. Should the Contractor feel that there
shall be costs associated with the compliance with any of the conditions set out below, such
costs should NOT be priced within this section but should be included in Bill No. 1 (General
Conditions of Contract & Preliminaries) or within the rates for the measured works as the
Contractor may deem appropriate.
GENERAL SCOPE OF THE PROJECT
The project comprises construction of a Lecture and Laboratory block inclusive of all
Mechanical and electrical installations plus all general External works and Landscaping.
The Contractor is required to mint details on how they intend to set out their Temporary Works
and Equipment on site, including any changes thereto as the works progress. This MUST be in
the form of a Site Layout Drawings. The layout MUST show items such as the Crane/Hoist
Position and, location of concrete batching/mixing plant (if any) etc

GENERAL CONDITIONS & PRELIMINARIES
Wherever in these Bills No. 1 the contractor does not insert his price against an item,
the value of such items will be held to include his rates for all items in the following
Bills of Quantities.
The Contractor shall be deemed to have satisfied himself before tendering as to the
correctness and sufficiency of his Tender for the Works and of the rates and prices
stated in the Schedule of rates which rates and prices shall cover all his obligations
under the Sub-Contract and all matters and things necessary for the proper completion
and maintenance of the works

Site
No claims will be allowed for travelling or other expenses which may be incurred by the
Contractor in visiting the Site for the Tender of the Works.
Limitation of site: The site of the works shall be solely for the purposes of
executing and completing the Contract to the satisfaction of the Architect.
Contract Drawings: The term “Contract Drawings” wherever used
hereinafter and in all contract documents shall be deemed to imply the
drawing referred to in these Bills of Quantities.
Site: The term “Site” wherever used hereinafter and in all contract
documents shall mean the lands and other places on, under, in or through
which the Works are to be executed or carried out and any other lands or
places provided by the Employer for the purpose of the contract.
Approved, Directed and Selected: The terms “Approved”, “Directed” and
“Selected” wherever used hereinafter and in all contract documents shall
mean the approval, direction and selection of or by the Architect.
Singular and Plural: Words importing the singular only wherever used
hereinafter and in all contract documents shall also include the plural and
vice versa where the context requires.
The contractor shall make every effort to avoid any disturbance amounting
to nuisance by hmself or his sub-contractors to the occupiers of the
contigious properties by reasons of noise, dust, traffic and the like or by
neglect to control workmen and materials
The contractor shall comply with all reasonable instruction of the Architect
on movements in the areas of the site other than those of areas necessary
for carrying out the works
Materials excavated from site: All building materials or other objects
found on site or prodeuced as a reasult of building operations shall remain
the property of the employer. Such materials maybe utilised for the
execution of the contract only with written consent of the Architect. The
quantity so used shall be measured and the value assessed by the Q.S and
deducted from the contract sum
The site of the proposed work is on PLOT XX, BLOCK XX, XXXXXX - DISTRICT
The Contractor is recommended to visit the Site and he shall be deemed to have
acquainted himself therewith as to its nature and position and means of access, etc. and
no claim for extra payment whatsoever shall be entertained as a result of the
Contractors failure to make allowance in his tender for costs arising in connection with
site conditions of which contractor ought reasonably to be aware following the site and
inspection

SCOPE OF CONTRACT
The works to be carried out comprises construction to completion including all finishes
and fittings plus all services fitted to place in a manner comfortable to be occupied by
the client of the following:
Ground floor
First floor
Second Floor
in accordance with the Drawings, Specifications and Bills of Quantities.
Susbtructure: Works shall comprise site clearance, excavation to a depth determined at
site and approved by the Structural Engineer anti-termite treatment, concrete blinding
of class 10, reinforced concrete works of class 20 including all necessary
reinforcement, formwork, curing, backfilling and removal of debris from site
Description
RC Frame: Works shall comprise reinforced concrete class 25 for the structural
elements, including all necessary reinforcements, formwork, curing and removal of
debris from site
Walling: Works shall comprise concrete block works of different sizes as per
Architectural layout well laid on DPC for ground levels, blocks well jointed in mortar of
mix 1:4 complete with all necessary plumbing, curing and removal of debris from site
Roof: works shall comprise of green havey clay tiles, seated in well seasoned timber
elements including battens, rafters, tie beams, struts and ties, wall plate complete wth
all necessary plumbing, jointing and removal of debris from site

Finishes and fittings: All these works shall be in accordance to Architects design
layout, finishes schedule and opening schedules
External works: Works shall be in accordance to Architects layout and approval plus
client requirement
Landscaping works: Works shall be in accordance to the Landscaping specialist
approval and design layouts
Electrical and Mechanical installation: Works shall be in accordance with the well
detailed specifications in accordance with the approval of the Mechanical and Electrical
engineer
CORRECTION OF ERRORS
Tenders determined to be substantially responsive will be checked by the Client for any
arithmetic errors. Errors will be corrected by the Client as follows:
where there is a discrepancy between the amounts in figures and in words,
the amount in words will govern: and
where there is a discrepancy between the unit rate and the line item total
resulting from multiplying the unit rate by the quantity, the unit rate as
quoted will govern, unless in the opinion of the Client there is an obviously
gross misplacement of the decimal point in the unit rate, in which case the
line item total as quoted will govern, and the unit rate will be corrected.
The amounts stated in the Tender will be adjusted by the Client in accordance with the
above procedure for the correction of errors and with the concurrence of the Tenderer,
shall be considered as binding upon the Tenders. If the Tenderer does not accept the
corrected amount, the Tender will be rejected, and the Tender Security may be forfeited.
FORM OF CONTRACT
The form of contract under which terms the Contractor will be required to enter into a
contract with the Employer is contained in Part 4 (Contract) in Volume 1 of 4 of the
Bidding Documents.
If the Contractor considers that compliance with any of the Conditions of Contract as
particularly amended or qualified by the Special Conditions of Contract and of which
headings are set out hereunder involve expenses to him which are not included
elsewhere in his prices, he shall set down opposite any such condition the value he
attaches thereto:

All materials and workmanship used in the execution of the Works shall be of the best quality
and description unless otherwise described. Any materials for the Works condemned by the
Client shall immediately be removed from the Site at the Contractor’s expense.
The Contractor shall be responsible for the provision of all materials, scaffolding, tools,
plants, Vehicles and workmen required for the Works except insofar as may be stated
otherwise herein and he shall allow for the provision of the foregoing except for such items
specifically and only required for the use of the Nominated Sub-Contractors as described
herein.
No timber used for scaffolding, formwork or similar purpose shall be used afterwards in the
permanent Works.
GENERAL CONDITIONS & PRELIMINARIES
All such plant, tools, scaffolding and vehicles shall comply with all regulations whether
general or local in force throughout the period of the Contract and shall be altered or adapted
during the Contract as may be necessary to comply with any amendments in / or additions to
such regulations.
Operating and Maintenance Manuals
Setting out
The Contractor shall set out the Works in accordance with the dimension and levels shown on
the Drawings and shall be responsible for the correctness of all dimensions and levels so set
out by him and will be required to amend all errors arising from inaccurate setting out at his
own cost and expense. In the event of any error or discrepancy in the dimensions or levels
marked on the Drawings being discovered, such errors or discrepancies shall be reported by
the Contractor to the Client or his representative for his immediate attention.
No Work shall be commenced by the Contractor until he has received written instruction from
the Client or his representative to adjust such discrepancies which may be proved. Upon
receipt of such instructions, the Contractor shall thereupon be responsible for accurate
setting out of the Works, giving effect to the adjustments necessary to comply with such
instructions, and no claim for extra expense or relief from the provision of Clause 5 of the
Conditions of Contract based on any discrepancy or error in the dimensions or levels shown
on the Drawings may be made thereafter.
Before any Work is commenced by the nominated-Contractors or Specialized Firms,
dimensions must be checked on the Site and / or buildings and agreed with the Client,
irrespective of the comparative dimensions shown on the Drawings. The Client shall be
responsible for the accuracy of such dimensions.
The Contractor shall include in his prices for the transport of materials workmen, etc., to and
from the Site of the proposed Works, at such hours and such routes as are permitted by the
Authorities

No guarantee or warranty is given as to the availability or suitability of power at the site.
Sanitation of the Works shall be arranged and maintained by the Contractor to the satisfaction
of the Government and Local Authorities, Labor Department and the Client.

GENERAL CONDITIONS & PRELIMINARIES
Prior to the commencement of any Work, the Contractor is to ascertain from the relevant
Authorities the exact position, depth and levels of all existing electric cables, water pipes or
other services in the area and he shall make whatever provisions may be required by the
Authorities concerned for the support and protection of such services. Any damage or
disturbance caused to any service shall be reported immediately to the Client and the
relevant Authority and shall be made good to their satisfaction at the Contractors expense.
The Contractor will be required to make good, at his own expense, any damage he may cause
to the present road surfaces and pavements during the period of the Works. In particular all
the existing lawns, gardens, storm water channels, hedges, fences etc., which may be
destroyed or damaged during the progress of the Works are to be made good by the
Contractor to the approval of the Client.
The Contractor shall be entirely responsible for the security of all the Works, stores,
materials, plant, personnel, etc., both of his own and nominated-Contractors’, and shall
provide all necessary watching, lighting and other precautions as necessary as to ensure the
security and the protection of the public.
The Contractor shall allow for providing all temporary water supplies required for the works,
including Sub-Contract Works, together with all necessary storage tanks and distribution
systems for the same and must allow for bearing all expenses incurred and paying for all
water consumed without charge to any nominated-Sub Contractor. Expenses in connection
with Nominated-Sub Contractors should be allowed for in the attendance items under the
relevant P.C. Sums.
The Contractor shall allow for providing all temporary lighting and power supplies required
for the works, including nominated Sub-Contract works, together with all necessary
distribution systems for the same and must allow for bearing all expenses incurred and
paying for all current consumed without charge to any nominated Sub-Contractor. Expenses
in connection with Nominated Sub-Contractors should be allowed for in the attendance items
under the relevant P.C. Sums.

The said Works shall be executed under the direction and to the entire satisfaction of the
Client, who shall at all times during normal working hours have access to the Works and to
the yards and the workshops of the Contractor and Nominated Sub-Contractors or other
places where work is being prepared for the Contract.
The Contractor shall take every precaution to avoid damage to all existing property including
roads, cables, drains and other services and he will be held responsible for all damage
thereto, arising from the execution of this Contract, and he shall make good all such damages
when directed at his own expense.
The Contractor shall cover up and protect all finished works liable to damage including
provision of temporary roofs, gutters, drains, etc., until the completion of the Works.
In the event of any damage occurring to the Works, materials, sewers, drains, gullies, paths
or other Works on the Site temporarily in the possession of the Contractor, for the purpose of
this Contract, either from the weather, want of proper protection, defects or insufficiency of
the Works, the Contractor alone shall be responsible and shall without extra charges, make
good all damages and pay all costs which may be levied.

GENERAL CONDITIONS & PRELIMINARIES
The working hours shall be those generally worked by good employers in the Building and
Civil Engineering Trade in Uganda. No work shall be carried out at night or on gazetted
holidays unless the Client shall so direct.
No work shall be covered up nor shall any concreting be carried out in the absence of the
Clerk of Works without the prior approval of the Client in writing.
The Contractor shall pay rates of wages and observe hours and conditions of labor not less
favorable than the minimum rates of remuneration and minimum conditions of employment
applicable in the district in which the works is carried out. The relevant notice must be posted
up and kept posted upon the Site where it can conveniently be read by the employees
concerned.
The Client’s attention is called to the requirement for payment by the Contractor of a training
Levy and the Contractor should allow in the Preliminaries of this Contract for all costs arising
or resulting there from.
No labor with the exception of the watchman, may be housed on the Site and the Contractor
shall allow for all transport and other charges in moving labor to and from the Site at such
hours and such routes as are permitted by the Authorities. The Contractor is to provide, erect
and maintain satisfactory housing for the watchmen and shall remove the same on
completion of the Works.

Adequate copies shall be made for distribution to the client (2 No.) and the Consultants (1 No.)
GENERAL CONDITIONS & PRELIMINARIES
All dimensions and measures, etc., shown on the Drawings and given in this Bills of
Quantities shall be metric.
The whole of the Works contained in these Schedule of rates is measured on the basis of the
Standard Method of Measurements of Building and Associated Civil Works for Eastern Africa
Where proprietary articles are specified herein, the Contractor may propose the use of
materials of equal quality but from other manufacturers with the approval of the Client, but
the decision of the Client will be final.

The Works and such sections of the Site necessary therefore shall be under the entire care
and control of the Contractor during the whole period of the Contract and he shall take all
possible precautions to prevent any nuisance, inconvenience or injury to the holders or
occupiers of the existing or surrounding properties and to the public generally, and shall at
all times keep all the paths and roads affected by the works in a safe and clear state and
shall use proper precautions to ensure the safety of all wheeled traffic and pedestrians.
The Contractor is required to control all visitors to the Site and to keep out unauthorized
visitors and to provide a visitors book and ensure that all the unauthorized visitors sign
therein.
The Contractor shall furnish at the earliest possible opportunity before work commences at
his own cost, any samples of materials of workmanship that may be called for by the Client
for his approval or rejection and any further samples in the case of rejection until such
samples are approved by the Client and such samples when approved shall be the minimum
standard for the work to which they apply.
The copyright of these Schedule of rates is vested in the Quantity Surveyor and they may not
be reproduced in whole or in part without the Quantity Surveyor’s written permission.
The Contractor shall take and develop (in both digital and still form) site progress
photographs every two weeks.

Access to site and temporary roads
Means of access to the Site shall be agreed with the Client and Contractor prior to the
commencement of the Works and the Contractor must allow for building any temporary
access roads for the transport of materials, plant and workmen as may be required for the
complete execution of the Works including the provision of temporary culverts, crossings,
bridges or any other means of gaining access.
Upon the completion of the Works, the Contractor shall remove such temporary roads,
culverts, bridges, etc., and make good and reinstate all Works and services disturbed to the
satisfaction of the Client.
Area to be occupied by the Sub-Contractor
The area of the Site which may be occupied by the Contractor for use as storage and for the
purpose of erecting workshops, etc., shall be defined on the Site by the Client based on
proposals by the contractor
The Contractor shall arrange for, provide and maintain a telephone on the Site from the
commencement to the completion of the Contract and shall pay all charges in connection
therewith.
The Contractor shall at his own cost, supply and erect all temporary buildings, sheds, mess
rooms and stores with floors at least 150mm above ground level. No office, stores or other
temporary buildings shall be erected on Site without first obtaining the consent from the
Client as to the type of temporary building to be supplied and the position in which they are to
be erected.
The Contractor shall provide and maintain on the Site, ample weatherproof sheds for storage
of cement and other perishable materials and shall clear the same away on completion and
make good any disturbed surfaces.
The works shall be enclosed by the contractor with a fence not less than 2.4m high, neat and
uniform in appearance to the approval of the Architect. The fence shall be sufficient obstacle
to prevent ingress of unauthorised persons or children and shall be complete with all
necessary padlocked entrance gates and directions as may be requisite to ensure safety of
public or adjoining owners and of the works
The contractor shall unless otherwise directed, obtain any necessary consent or license from
the Local Authority and immediately upon commencement of the works the contractor shall
in accordance with the details supplied by the Architect, make and erect a sign board showing
the name of the employer and such other information as shall be directed and approved by
the Architect

GENERAL CONDITIONS & PRELIMINARIES
The contractor shall allow for providing and maintaining suitable office accommodation
for the use of the Engineer and his team, The site office shall be partitioned into two-
one for Project supervision team (Size 3 x 3m) and another for contractor's team (Size 3
x 3m) seperated by a board room of (4 x 3m) for meetings, The offices shall have proper
storage for the drawings, and all documents necessary for use upon the work with
lockable desks and cushioned chairs, The Engineers office shall be equiped with one
Desk top Computers with hard drive capacity not less than 500GB, one-in two Printer
and Copier, Internet facilities, Electric power for lighting as shall be approved by the
Project Mnager.
The Contractor shall provide, erect and maintain where directed on Site approved
weatherproof lockup office for the sole use of the Consultants with a floor area not less
than 20 square meters. The office shall be constructed with concrete or wooded floor
and the walls and ceiling internally are to be lined with fiberboard. Glazed windows
shall be provided of not less than 1 meter square area and the door shall have a strong
lock or fastening. The office shall be provided with artificial lighting and electric power.
The office is to be furnished with a table of sufficient size to carry the drawings,
complete with drawers, and also stools and chairs. The table should be adequate to sit
at least 8 (Eight) people. The Contractor shall allow for regular cleaning of the office..

The Contractor shall provide, erect and maintain where directed on site an approved
weatherproof office for the sole use of 1 Clerk of Works. The office shall be not less than 4
square meters and shall be of construction similar to the office of the consultants. The office
shall be furnished with 1 No. desk with lockable drawers, 1 No. A0 Size drawing chest with
four drawers, 1 No. high level timber filing cabinet. The office shall also have all power and
lighting points as necessary. The Contractor shall allow for regular cleaning of the office.
The Contractor shall also supply and maintain the following for the full contract duration, with
and including all consumables and maintenance, to the Client's Approval, these to be used by
the consultant and shall not be property of the contractor upon expiration of the contract

WORK BY PUBLIC BODIES OR NOMINATED SUBCONTRACTORS OR GOODS AND MATERIALS
FROM NOMINATED SUBCONTRACTORS
The words “Prime Cost” (or the initials “P.C”) wherever appearing in these Schedule of
rates, shall mean net cost exclusive of any trade, cash or other discounts whatsoever
but inclusive of the cost of packing, carriage and delivery. Such costs shall be the sums
due to the Sub-contractor or suppliers after adjustment where applicable in respect of
measurements or rates.
Any increases or decreases in these Prime Cost Sums resulting from the adjustments
and properly paid by the Sub-contractor, shall be added to or deducted from the
Contract Sum in the final account. In substantiation, the Sub-contractor is required to
produce to the Quantity Surveyor, all quotations, invoices and receipted accounts as
shall be necessary to show the details of the sums actually paid.
Any sums added by the Sub-contractor in these Schedule of rates in respect of profit
upon any Prime Cost Sums will be deducted in the final settlement of accounts and a
sum will be added, the amount of which will bear the same the proportion to the sum
added as the net amount properly expended bears to the original P.C.Sum.
The Contractor shall be deemed to have made allowance in his rates generally to cover
items of Preliminaries expenses in connection with P.C Sums or other items if these
have not been priced against the respective items.

Particular care shall be taken in leaving windows clean and removal of all paint and cement
stains there from.
