2. The New IPC Planning Regime for the UK:
National Policy Statements (NPSs) for Nationally Significant Infrastructure Projects (NSIPs) to
be submitted through the Infrastructure Planning Commission (IPC) process
Everything is geared towards speeding up the authorisation of major infrastructure,
mainly in England, some types in Wales and one type in Scotland.
The IPC combines eight planning systems into a single process: (Planning Policy
Statements; Good Practice Guidance and Advice; Circulars and Statements;
Regional Spatial Strategies; Mineral and Waste Local development Frameworks;
Local Development Frameworks; Development Plan Documents; and,
Supplementary Planning Documents).
It will also cut the time taken to make decisions from up to seven years to under a
year (saving up to 300 million a year).
The new planning system will give communities a greater say in planning decisions
for major infrastructure projects. The IPC will insist on seeing evidence that
communities have been consulted about proposed projects.

National Policy Statements (NPSs)
There are going to be 12 of these, issued by the government in draft starting this autumn, subjected to
consultation, and then finalised in turn over the next two or so years. These will set out national policy
on a particular area of national infrastructure in a single accessible document, and will state to a
greater or lesser degree what infrastructure is needed over the next 15-20 years, sometimes where it
should go, sometimes who should build it, and sometimes what it should look like.
The 12 NPSs proposed are to have the following titles:
1. Overarching Energy (i.e. energy of all types, to sit above the other energy NPSs);
2. Nuclear Power;
3. Fossil Fuels;
4. Renewable Energy;
5. Electricity Networks;
6. Gas and Oil Infrastructure;
7. Ports;
8. National Networks (i.e. railways, motorways, trunk roads and rail freight interchanges);
9. Airports;
10. Water Supply;11. Waste Water; and
12. Hazardous Waste

Nationally Significant Infrastructure Projects (NSIPs)
Legislative Context:
The Planning Act 2008 (Parts 1 to 8) sets out, for each type of project, (16 in total), how big itneeds to be for it to become an NSIP and provides for the grant of development consent for
development consisting of nationally significant infrastructure projects including:
1. Generating Stations;
2. Overhead Electric Lines;
3. Underground Gas Storage;
4. LNG Facilities;
5. Gas Reception Facilities;
6. Gas pipelines;
7. Other Pipelines;
8. Highways;
9. Airports;
10. Harbours;
11. Railways;12. Rail Freight Interchanges;
13. Dams/Reservoirs;
14. Water Transfer Facilities;
15. Waste Water Treatment Plants; and,
16. Hazardous Waste Facilities.

The Infrastructure Planning Commission (IPC) and
National Policy Statements (NPS)
Where Development Consent is required under the Act, there is no need for
certain other consents to be obtained such as planning permission,
pipeline authorisation, an order under the Transport and Works Act 1992,
consent under the Electricity Act 1989 or listed building consent. The Act
also provides for the establishment of the Infrastructure Planning
Commission (IPC) who will examine and, where a National PolicyStatement (NPS) has been designated, determine applications for
development consent.
Section 5 of the Act provides for the designation by the Secretary of State of
NPSs. A NPS may, in particular, set out, in relation to specified descriptions
of development, the amount, type or size of development, the criteria in
deciding appropriate locations and the weight to be given to specific criteria.Section 74 provides that where a NPS has effect in relation to development
of the description to which the application relates, the IPC will examine and
determine the application.

Personal View of Possible Requirements for Transport
and Utility Infrastructure
It is impossible, at this stage, in advance of any necessary
engineering studies, to give an outline of any necessary
mitigation measures / contributions that any promoter will be
required to provide to mitigate the impact of their development
However, my personal view, on the following slide, gives an
indication of the kind of infrastructure I think, may be
necessary and appropriate
The list is by no means exhaustive and is indicative only

Strengths Weaknesses Opportunities Threats
1. 50+ years of civil nuclear power
at Sellafield.
2. Perceived public support and
employment opportunities forNew Build (at Sellafield).
1. Remoteness of Copeland from
existing major transport and utilities
infrastructure.
2. Absence of Copeland from 20-30
year masterplans for transport and
utilities infrastructure.3. Lack of appropriate planning
policies and strategies at National,
Regional and local levels, under-
pinning the draft NPSs.
4. Base data that Promoters will be
submitting to IPC needs robust
validation by consultants acting to
Copeland and Cumbria authorities.
5. Political lobbying by Copeland
councillors needs beefing-up?
6. Strategies, policies, fundingsources, organisational and
operational needs of Copeland and
Cumbrian authorities are woefully
lacking in what may be coming from
the private sector.
7. Copeland and Cumbrian authorities
need to appoint an NSIP
Coordinator for the duration of life
of the project cycle.
8. Little, if any, of the necessary
consultancy work has been briefed,
in advance/parallel, with the
Promoters that are undoubtedly
already talking to IPC/DECC at al.
1. 3 of 11 SSI sites for New Build are
within Copeland.
2. Governments chief scientific
adviser on climate change,
professor David McKay, believes
(4th October 2009) that the countryshould aim for between 40 and 50
gigawatts of nuclear capacity by
2050 four times the present 12
gigawatts. The expected rise in
electricity demand, as more people
switch to electric vehicles, makes
that case even stronger.
3. NSIPs are not just about nuclear.
4. Copeland and Cumbria authorities
need to put appropriate strategies,
policies, organisational andoperational structures in place to
deal with New Build and NSIPs.
5. The private sector is looking for
decent PPP and PFI schemes that
can be brought to market.
6. Copeland and Cumbria should
explore a Strategic Asset
Management Programme that will
maximise the benefits and
opportunities to the area. This
should be integrated with a Low
Carbon Strategy Management
Programme. It should also accord
with a Strategic Policy Review.
1. Some of the remaining 11 proposed
New Build sites may be better
equipped to handle what may be
coming in terms of NSIPs, in
general. Urgent requirements for:
2. Resources; Management set-up;3. Location to existing transport and
utility infrastructure and their long-
term plans;
4. Lobbying;
5. Closeness to American allies in
powerful political circles, etc.
6. Private sector will leave a lasting
legacy in Copeland and Cumbria
that is not a credit to anyone.

are not, on the page, in terms of long-term
planning for transport and utilities
infrastructure.
This is the largest threat to any New Build, orNSIP, that may be considered for the area
A massive, and urgent, lobbying exercise
with UK Government et al, needs to be
instigated as soon as possible

All data sources confirm the serious problem we already have: EU Stats show only four of 250 sub-regions in the 25 EU States
suffered an absolute decline in GDP, Cumbria is one, the others are
in the former Eastern Europe (eurostat 2004)
UK has its fair share of slow growing regions..
annual GDP growth (2005-2015) is likely to be the slowest in thenorthern regions of Cumbria (1.5%) and the Highlands and Islands
(1.6%)
Cumbria ranks 188 out of 214 Western European sub-regions
