1 The Northern Municipalities Act, 2010 (the Act) empowers the Minister of Municipal Affairs to act as the Mayor and Council of the Northern Saskatchewan Administration District, and, in so doing, may enact bylaws on behalf of the District in the form of Minister’s Orders.

2 Clause 2(1)(n) of the Act provides that “district” means the Northern Saskatchewan Administration District not including any area within the boundaries of a town, northern village or northern hamlet.

3 Section 104 of the Act states a council may, by bylaw, require that every candidate submit a criminal record check in the form required by the Minister in addition to the nomination paper submitted pursuant to section 46 of The Local Government Elections Act and any such bylaw must be made at least ninety days before the day of a general election.

4 It is desirable for good government in the Northern Settlements that the Minister enacts a bylaw for candidates to submit criminal record checks.

BYLAW NO. NS 1/2012The Minister of Municipal Affairs, on behalf of the Northern Saskatchewan Administration District, under

the provision of section 104 of The Northern Municipalities Act, 2010, enacts as follows:

1 It shall be lawful to require each person submitting his/her nomination for committee chair or committee member to provide a criminal record check at the time of his/her nomination to the Local Advisory Committee.

2 No nomination shall be deemed complete and accepted by the Northern Municipal Administration Advisor without the criminal record check.

3 Criminal record checks shall be in the form required by the Minister and provided by the local royal Canadian Mounted Police detachment and shall display the signature of the commanding officer, date and seal.

4 Criminal record checks shall not be dated more than three months prior to the date of submission.

5 The Northern Municipal Administration Advisor shall make available the copies of accompanying documentation at the time of nomination.

6 This bylaw applies to all Northern Settlements in the Northern Saskatchewan Administration District.

1 The Minister of Municipal Affairs is the Minister responsible for The Northern Municipalities Act, 2010 and, as such, authorized to discharge any powers conferred on a council by that Act for and on behalf of the Northern Saskatchewan Administration District.

2 Clause 2(1)(n) provides that “district” means the Northern Saskatchewan Administration District continued pursuant to section 444, and includes any area within the boundaries of a northern settlement.

3 Subsection 13(1) of The Northern Municipalities Act, 2010 provides that:

“13(1) A council may, by bylaw, provide for closing, closing and selling or closing and leasing:

(a) any street or road the title to which is not vested in the Crown; or

(b) any street or road the title to which is vested in the Crown if:

(i) the council determines that the street or road is no longer needed for use by the travelling public; and

(ii) the consent of the minister responsible for the administration of The Highways and Transportation Act, 1997 is first obtained”.

4 It is desirable for local planning and development within the Northern Settlement of Sled Lake to authorize the closure of a portion of Mirasty Street.

5 I hereby order that on and after the date of this Order, Bylaw No. NS 2-2012, as contained in the Schedule 1 and attached hereto, shall be read, applied and enforced as a bylaw of the Northern Settlement of Sled Lake.

1 The portion to be closed may be described as all that portion of Mirasty Street commencing at a point on the southerly boundary of Mirasty Street, Plan No. 85B17691 intersecting with the most north-westerly corner of Lot 6, Block 4, Plan No. 101911171; thence south-easterly along the north-westerly boundary of said Lot 6, Block 4, a distance of 8.92 m; thence south-westerly along the north-westerly boundary of said Lot 6, Block 4 and Parcel A, Plan No. 77B13757, a distance of 30.48 m to a point; thence north-westerly along the north-westerly boundary of said Parcel A, a distance of 10.361 m to its intersection with Mirasty Street Plan No. 77B13757; thence north-easterly a distance of 26.8 m along a line being parallel with and perpendicularly distant 20.12 m from the north-westerly boundary of Mirasty Street, Plan No. 77B13757 to a point; thence north-easterly for a distance of 3.97 m to the point of commencement.

2 Bylaw No. NS 1-2011 is hereby repealed.

3 The Clerk shall do such other things necessary to affect the intent of this bylaw.

The Minister of Municipal Affairs, on behalf of the Northern Saskatchewan Administration District, under the provision of section 146 of The Northern Municipalities Act, 2010, enacts as follows:

Short title1 Bylaw No. NSAD 1/2012 is cited as “Northern Saskatchewan Administration District Public Notice Policy

Bylaw.

Purpose2 The purpose of this bylaw is to establish a policy setting out the minimum notice requirement, the

methods of notice to be followed and the minimum time for giving notice with respect to any matters for which public notice is required to be given by the Minister as Mayor and Council for the Northern Saskatchewan Administration District.

Public notice policy3 The Northern Saskatchewan Administration District will provide public notice as required in accordance

with the Public Notice Policy attached as Bylaw Appendix ‘A’.

Coming into force4 This bylaw applies to the Northern Saskatchewan Administration District.

BYLAW APPENDIX “A” NOrTHErN SASKATCHEWAN ADMINISTrATION DISTrICT (NSAD)

Policy Title: Public Notice

Origin/Authority: section 146 of The Northern Municipalities Act, 2010.Purpose

1 The Northern Municipalities Act, 2010 requires that a municipality shall adopt a public notice policy. The policy sets out the minimum notice requirements, the methods of notice to be followed and the minimum time for giving notice with respect to any matters for which public notice is required to be given by the municipality.

Definitions2 Affected Areas/Parties – for the purposes of this policy, affected areas/parties will be those members of the

public who, in the sole discretion of the NSAD, may be specifically affected by the matter under consideration by the District.

Seven Days – for the purposes of this policy, seven days will be calculated using calendar days and including the day it is posted but excluding the day of the public meeting.

Matters for which notice must be given3 Public notice in accordance with this policy shall be given before the matter is initially considered:

(a) permanently closing or blocking off a street, lane or walkway;

(b) borrowing money, lending money or guaranteeing the repayment of a loan;

(c) moving capital monies to an operating budget or reserve;

(d) imposing a special tax or determining the use to which excess revenue from a special tax is to be put;

(e) selling or leasing land for less than fair market value and without a public offering;

(f) selling or leasing park lands and dedicated lands except where the land is covered by public notice provision in an Act other than The Northern Municipalities Act, 2010;

(g) amending or establishing a purchasing bylaw;

(h) increasing or decreasing the number of members of a Local Advisory Committee;

(i) smending or repealing a bylaw for which public notice was a requirement at the time the bylaw was passed;

(j) sny matter where holding a public hearing is required in The Northern Municipalities Act, 2010 or any other Act except where the Act contains its own public notice provisions;

(k) discussing a matter at a public meeting held as a result of a petition signed by the required number of electors;

(l) the amendment or repeal of a bylaw or resolution when the resolution or bylaw was passed as a result of a vote of the electors;

(m) any matter regarding procedures for incorporating, altering, restructuring or changing of the District;

(n) the sale or lease of mines and minerals owned by the District;

(o) setting remuneration for committee members of the Local Advisory Committee;

(p) prohibiting or limiting the operation of a business or class of business.

Notice to the general public4 Notice shall be given to the general public for all matters set out in section 3 in accordance with this

section:

(a) notice of the matter shall be published in a local newspaper circulating in the NSAD or the portion of the NSAD affected by the matter, at least seven days prior to the meeting at which the matter will be considered; and

(b) notice of the matter shall be posted in a conspicuous place in the NSAD or the portion of the NSAD affected by the matter, at least seven days prior to the meeting at which the matter will initially be considered.

Discretion of council5(1) The notice requirements of this policy are the minimum requirements that must be complied with by

the NSAD. The District may at its discretion require additional notice in specific cases.

(2) Additional notice at the discretion of the District as described in subsection 5(1) shall be given by any of the following methods:

(a) by mailing notice of the matter to all affected parties by ordinary mail which is to be postmarked no later than seven days prior to the public meeting at which the matter will initially be considered; or

(b) by leaving notice of the matter in a mail receptacle at the address of the affected party at least seven days prior to the public meeting at which the matter will initially be considered; or

(c) posting a notice on the land to be sold or leased at least seven days prior to the public meeting at which the matter will initially be considered.

No notice of subsequent meetings6 Notice will be given in accordance with this policy only when the matter is initially considered. Unless

otherwise directed, no notice will be given of any subsequent meeting at which the matter will be considered.

Responsibilities7(1) The Clerk of the District will be responsible for publishing the required notice in accordance with the

policy with a copy of the notice as advisement that the proper notification has taken place.

(2) The Clerk of the District will be responsible for completing the notices required to be given by mail or left in the mail receptacles with a copy of the notice to show proper notification has been completed.

(3) The Clerk of the District will be responsible for posting any site signs and a copy will be retained to show that proper notification has been completed.

(4) The Clerk of the District will be responsible for ensuring that items are not placed on the public meeting agenda unless notice has been given in accordance with this policy.

MILK PrICINGOrder No. 14/12. THE SASKATCHEWAN MILK MArKETING BOArD, pursuant to the provisions of The

Milk Marketing Plan Regulations and The Agri-Food Act, 2004 hereby determines and orders as follows:

1 In this Order, licensed processor utilization of milk, partially skimmed, skim milk, creams, concentrated milk or a mix for milk products are listed in the following classes:

(a) “class 1(a)” means milk and milk beverages, partly skimmed or skimmed, whether or not treated for lactose intolerance, whether flavoured or not, with or without vitamins or minerals added, for retail and food service (egg nog, cordials, cultured milk, concentrated milk to be reconstituted as fluid milk), and all types of milk shake mixes for retail sale;

(b) “class 1(b)” means all types of cream with a butterfat content not less than 5% for retail and food service;

(c) “class 1(b)ii” means fresh cream with a butterfat content of 32% and higher used to make fresh baked goods which are not eligible for a Class 5 permit – any utilization of this class would require a Class 1(b)ii permit issued by the Canadian Dairy Commission;

(d) “class 1(c)” means new 1(a) and 1(b) fluid products for retail and food service as approved by the provincial authorities during an introductory period;

(e) “class 1(d)” means 1(a) and 1(b) fluid products marketed outside the ten signatory provinces but within Canadian boundaries (e.g. Yukon, NWT, Nunavut and cruise ships);

(f) “class 2” means all types of ice cream, ice cream mix, yogurt, kefir, whether frozen or not, all types of sour cream, all types of milk shake mixes that are not for retail sale, other frozen dairy products and the following products: fudge, puddings, soup mixes, caffeinate and Indian sweets;

(g) “class 3(a)” means all cheeses other than those identified in class 3(b), all types of cheese curds other than stirred;

(h) “class 3(b)” means all types of cheddar cheese, stirred curd, cream cheese, creamy cheese bases (cheese mixes), cheddar and cheddar-type cheeses sold fresh. A cheese of descriptive nomenclature will be recognized as a cheddar-type cheese for the purposes of classification if it is a firm or semi-soft, unripened, unwashed curd cheese, with a minimum milk fat content of 25% and a maximum moisture content of 45%;

(i) “class 4(a)” means all types of butter and butteroil, all types of powder, concentrated milk as an ingredient in the food industry used to make other milk products, all other products not elsewhere stated;

(j) “class 4(a)1” means milk components for the manufacture of rennet casein (dry or curd), milk protein concentrate (dry or liquid) or skim milk (dry or liquid) to be used in the manufacture of non-standardized final products in the processed cheese category;

(k) “class 4(b)” means concentrated milk for retail sale whether sweetened or not;

(l) “class 4(c)” means new industrial products as approved by provincial authorities for an introductory period;

(m) “class 4(d)” means inventories and explained losses (ex: dumps, fluid returns, dead vats, etc.);

(n) “class 4(d)i” means interprovincial milk or cream movement;

(o) “class 4(m)” means milk components for marginal markets as established from time to time by the Canadian Milk Supply Management Committee (CMSMC);

(p) “class 5(a)” means cheese used as ingredients for further processing for the domestic and export markets;

(q) “class 5(b)” means all other milk products used as ingredients for further processing for the domestic and export markets;

(r) “class 5(c)” means milk products used as ingredients for the confectionary sector destined for domestic and export markets; and

(s) “class 5(d)” means planned exports and other exports approved by the CMSMC, the total of which shall not exceed Canada’s WTO commitments.

2 Subject to section 3, the price per hectolitre of milk, or per kilogram of butterfat, protein or other solids, to be paid from the pool by the Board to a licensed producer is the price to be paid by the licensed processor as set out in the Board’s published milk prices that the Board may establish from time to time in accordance with:

(a) Western Milk Pool Coordinating Committee prices established for classes 1(a), 1(b), 1(d), plus a milk price add-on of $1.52 per hectolitre of milk for each of those classes;

(b) Western Milk Pool Innovation Program prices established for class 1(c), plus a milk price add-on of $1.52 per hectolitre;

(c) Western Milk Pool Coordinating Committee prices established for classes 2, 3(a), 3(b), 4(a), 4(b), 4(d) and 4(d)i;

(d) Western Milk Pool Innovation Program prices established for class 4(c);

(e) Canadian Dairy Commission prices established for classes 1(b)ii, 4(m), 5(a), 5(b), 5(c) and 5(d); and

(f) Canadian Milk Supply Management Committee – Market Committee prices established for class 4(a)1.

3 The price to be paid from the pool by the Board for milk produced in Saskatchewan determined in accordance with section 2 is the price to be paid by the licensed processor as set out in that section.

4 The Board’s published milk prices shall be issued in the form of a milk price directive which includes the class prices established in accordance with this Order.

OVEr-MArKETING PENALTIESOrder No. 52/12. The BrOILEr HATCHING EGG PrODUCErS’ MArKETING BOArD, pursuant to

the provisions of The Broiler Hatching Egg Marketing Plan Regulations and The Agri-Food Act, 2004, hereby determines and orders as follows:

1 Any producer who markets broiler hatching eggs in excess of 101% of the producer’s periodic quota allocation shall be assessed an over-marketing penalty if the aggregate amount of Saskatchewan production during that period exceeds 101% of provincial allocation.

2 Over-marketing penalties will be calculated using data received from hatcheries on the number of broiler hatching eggs marketed by the producer to the hatchery and set in the hatchery’s incubator during the production period.

3 Broiler hatching eggs picked up at the producer’s premises by the hatchery in one production period and set in the hatchery’s incubator in the following production period will be included in the producer’s marketings during the period in which the eggs were picked up at the producer’s premises.

4 The over-marketing penalty per hatching egg shall be 17.5 cents per egg set.

5 With respect to over-marketing penalty payments, the Board shall invoice each over-marketed producer within 90 days of the end of the production cycle and provide each producer with 30 days to remit the invoiced penalty.

6 The failure to pay any over-marketing penalties referred to in section 5 will result in the Board requesting that the producer’s hatchery deduct the over-marketing penalties from the producer’s marketing proceeds and remit that deduction to the Board.

7 If two or more producers market broiler hatching eggs through a common business entity and are therefore designated by the Board as a single production unit:

(a) the calculation of an over-marketing penalty will be based on total broiler hatching eggs marketed and total quota allocation for all producers included in that single production unit; and

(b) all producers involved in that production unit are jointly and severally liable for full payment of any over-marketing penalties applied by the Board.

8 Order No. 42/07 – Over-Marketing Penalties is hereby rescinded.

9 This Order will remain in effect for a period no longer than ten years from the date this Order is approved by the Agri-Food Council.

PLEASE NOTE: The deadline for submissions to The Saskatchewan Gazette is 5 p.m. on the Monday of the week of publication. If a holiday occurs within the week of publication, the deadline is set back to 5 p.m. of the previous Friday. All material for publication in The Saskatchewan Gazette must be submitted electronically (MS Word or WordPerfect) accompanied by a signed hard copy to the Office of the Queen’sPrinter, Saskatchewan Justice, B19-3085 Albert St., regina SK S4S 0B1, tel. Each document or disk must be complete in the form required for publication and must be separate from the covering letter. Signatures on all documents must be typewritten or clearly printed immediately below the written signatures.

Prepayment is required for ALL notices placed in The Saskatchewan Gazette by non-government clients. Cheques or money orders must be made payable to the Queen’s Printer revolving Fund.
