ERRATA NOTICE/AVIS D’ERREUR

Pursuant to the authority given to me by section 12 of The Regulations Act, 1995, section 2 of The Home-based Education Program Regulations, 2015, as published in Part II of the Gazette on August 28, 2015, is corrected:

(a) in the English version by striking out:

“ ‘dispute resolution process’ means the dispute resolution process set out in section 21; (« Loi de 2015 modifiant la Loi de 1995 sur l’éducation ») ”

and substituting:

CHAPTER L-30.11 REG 1The Local Government Election Act, 2015

Section 186

PART IPreliminary Matters

Title1 These regulations may be cited as The Local Government Election Regulations, 2015.

Interpretation2 In these regulations, “Act” means The Local Government Election Act, 2015.

PART II Voters List

Voters list3 For the purposes of section 56 of the Act, the enumerator shall:

(a) register the given name and surname of every voter and include a notation for every voter of:

(i) P.S., for public school voter; or

(ii) S.S., for separate school voter;

(b) number the names on the voters list consecutively; and

(c) arrange the names on the voters list:

(i) in alphabetical order by surname; or

(ii) in geographical order by reference to streets and to house or apartment numbers.

PART III Voting Machines

Interpretation of Part4(1) In this Part:

“register tape” means the printed record generated from a voting machine that shows:

(a) the total number of ballots received;

(b) the number of ballots on which no vote is marked;

(c) the number of ballots on which the voter made more votes than the voter is entitled to make;

(d) the number of votes for each candidate; and

(e) if there is a vote on a bylaw or question, the number of votes for and against each bylaw or question;

“voter-assist terminal” means a voting device used by a voter with a disability to mark a ballot by selecting a candidate using:

(a) audio only voting;

(b) a touch screen;

(c) pressure sensitive paddles;

(d) punch cards;

(e) a sip/puff tube; or

(f) any other device designed to assist voters with a disability;

“voting machine” means any device that records how ballots are marked and produces election results by tabulating votes, including:

(a) vote recorders;

(b) optical scan vote tabulators; or

(c) other similar devices;

“zero tape” means a printed register tape of all totals on the voting machine’s memory card that indicates zero for all categories.

(2) Parts VIII, IX, X and XI of the Act apply, with any necessary modification, to the use of voting machines except as modified or extended by this Part.

Use of paper ballots 5(1) Municipalities must use paper ballots when using voting machines.

(2) If the voter makes a physical mark on a paper ballot, the municipality must ensure that the voter is able to:

(a) personally insert the ballot into the voting machine; or

(b) view an election official inserting the ballot into the voting machine.

(3) If the voter makes a mark through electronic means such as buttons or a touch screen:

(a) the electronic ballot must be printed on paper for the voter to insert into a ballot box; and

(b) the printed ballot must be treated in the same manner as other ballots pursuant to section 142 of the Act.

All counting to be done by voting machine6(1) If a municipality chooses to conduct an election using voting machines, all counting must be done by voting machines, including the counting of ballots cast in:

(a) advanced polls;

(b) special polls;

(c) election day polls; and

(d) mail-in ballots.

(2) In the case of machine malfunction or another circumstance in which the machine cannot be used during voting hours, the municipality shall take steps to ensure that the ballots are securely stored in a ballot box and inserted into a voting machine as soon as possible after voting hours in the presence of the deputy returning officer.

Rejected ballots7(1) Each voting machine must be programmed to accept ballots for which no vote is recorded without requiring an override function or giving an audible indication that the ballot is one for which no vote is recorded.

(2) For the purposes of subsection (1), a ballot for which no vote is recorded is any of the following:

(a) a ballot on which no vote is marked;

(b) a ballot on which the voter has made more votes than the voter is entitled to make.

(3) Ballots that are inserted into the voting machine for which no vote is recorded are deemed to be rejected ballots in accordance with section 129 of the Act.

(4) Rejected ballots mentioned in subsection (2) must be recorded as rejected on the Deputy Returning Officer’s Statement of Results for Voting Machines in Form AA of Appendix C.

Programming and testing of machines8(1) A municipality using voting machines shall cause to be conducted, in a manner approved by the municipality, programming and testing on all voting machines and voter-assist terminals before an election.

(2) Subject to subsection (3), a specified time frame and procedures for testing and programming of voting machines must be established by bylaw or resolution.

(3) Voting machines must be programmed and tested no more than six months before the scheduled election.

Online connection prohibited9 Voting machines must not be connected to the internet at any time before or during a poll.

Register tape10 At the close of the poll, the register tape must be printed and attached to the Deputy Returning Officer’s Statement of Results for Voting Machines found in Form AA of Appendix C.

Required bylaws11 A bylaw or resolution passed pursuant to section 90 of the Act must include procedures for:

(a) the programming and testing of machines pursuant to sections 7 and 8;

(b) pre-poll logic and accuracy testing, including:

(i) specifying who is to conduct logic and accuracy testing;

(ii) how voting machines are to be tested; and

(iii) the printing of a zero tape before the opening of poll;

(c) monitoring of voting machines during poll hours by election officials to ensure that the machines are accurately counting each vote;

(d) sending results to a central location after the close of poll;

(e) what actions are to be taken in the event a voting machine fails;

(f) mobile and special polls;

(g) accommodating voters with disabilities;

(h) advance voting if the municipality conducts advance polls;

(i) counting of mail-in ballots if the municipality uses mail-in ballots;

(j) recounting of votes;

(k) the secure storage and transport of machines and other hardware, including memory cards, before, during and after the election; and

(l) any other matter that the council or board considers necessary.

Additional matters12 The bylaw or resolution passed pursuant to section 90 of the Act may include procedures for:

(a) marking a ballot;

(b) informing voters how to properly deposit a ballot;

(c) post-poll testing of machines; and

(d) the safekeeping of machines between elections and between the testing of the machines and the opening of the poll.

PART IV Voter Identification

Interpretation of Part13 In this Part:

“address” means a residential mailing address, legal land description or post office box number;

“person” means a person seeking to vote;

“valid” means:

(a) in the case of documents with an expiry date, not yet expired;

(b) in the case of documents issued annually, dated within the year in which the election is being held; and

(c) in the case of documents issued monthly and all other correspondence and documents not mentioned in clause (a) or (b), dated within the six months before the date of the election.

Alternative forms of identification14 The pieces of information prescribed for the purposes of subclause 110(a)(ii) of the Act are set out in Table 1 of Appendix D.

Evidence of residence15 If the address contained in the piece of identification or pieces of information provided pursuant to clause 110(a) of the Act does not provide evidence of a person’s residence but is, in the opinion of the deputy returning officer, consistent with information relating to the person that appears on the voters list or voter’s registration form, the person’s residence in the municipality is established for the purposes of voting.

Use and disclosure of information16(1) Every election official, candidate or candidate’s agent who, in the course of his or her duties, acquires or accesses any information or document presented by a person as evidence of identity shall:

(a) keep the information or document confidential; and

(b) not disclose or make use of the information or document other than for the purpose of providing a ballot to the person to whom the information or document relates.

(2) No election official, candidate or candidate’s agent shall copy or record any information or document presented by a person as evidence of that person’s identity.

Vouching17(1) Subject to subsections (2) to (5), a person seeking to vote may prove his or her identity by being accompanied by a voter who is entitled to vote in the same municipality and who:

(a) for the purpose of establishing the voter’s own identity, provides to the deputy returning officer and the poll clerk the piece of identification or pieces of information mentioned in clause 110(a) of the Act; and

(b) vouches for the person seeking to vote on oath or affirmation in the prescribed form in the presence of the deputy returning officer using Form B of Appendix A.

(2) No voter shall vouch for more than one person in an election unless the persons to be vouched for are living at the same address as the voucher and are related to the voucher in one of the ways set out in Table 2 of Appendix D.

(3) A person who has been vouched for at an election shall not vouch for another person at that election.

(4) No election official shall vouch for the identity of any person.

(5) No candidate or candidate’s agent shall vouch for the identity of any person.

Identification for mail-in ballot systems18(1) A bylaw establishing a mail-in ballot voting system pursuant to subsection 92(1) of the Act must provide that, before being issued a mail-in ballot, a person shall:

(a) complete a voter’s registration form and a Declaration of Person Requesting Mail-in Ballot in Form C of Appendix A; and

(b) establish his or her identity to the satisfaction of the returning officer or other person authorized in the bylaw.

(2) The bylaw mentioned in subsection (1) must also provide for:

(a) the maintenance of the secrecy of mail-in ballots;

(b) the inspection of the voter’s registration forms and the declarations of persons requesting a mail-in ballot by candidates or candidates’ agents on election day and at any other time provided for in the bylaw until the close of polls on election day;

(c) the right of candidates or their agents to object to a person’s eligibility to vote pursuant to subsection 112(1) and to request pursuant to clause 112(2)(b) of the Act to verify that the procedures set out in clause 110(b) of the Act have been followed;

(d) the counting of the mail-in ballots after the close of polls on election day; and

(e) the retention and destruction of the mail-in ballots and forms with other election materials pursuant to section 142 of the Act.

PART V Elections of Board Members Who Represent Indian Reserves

Interpretation of Part19 In this Part:

“band” means a band as defined in the Indian Act (Canada), and includes the council of a band;

“band member” means a member of a band;

“chief” means the chief of a band who is elected in accordance with section 73 of the Indian Act (Canada);

“education committee” means a group of three or more members of a band who are appointed by the chief or elected by the band to deal with matters on the reserve relating to education;

“Form” means a form set out in Appendix B;

“Indian Reserve subdivision” means a subdivision consisting of one or more reserves;

“reserve” means a reserve as defined in the Indian Act (Canada).

“subdivision” means a subdivision as defined in The Education Act, 1995.

Application of Act and regulations20 Except as otherwise provided in these regulations, the Act and these regulations apply, with any necessary modification, to elections in Indian Reserve subdivisions.

Nomination paper21(1) Form A is the form prescribed for the nomination paper for an election in an Indian Reserve subdivision.

(2) The form mentioned in subsection (1) must:

(a) be signed by at least five persons who are:

(i) 18 years of age or more; and

(ii) band members residing in the Indian Reserve subdivision; and

(b) contain a part entitled “Candidate’s Acceptance” that is signed by the candidate being nominated.

First election in Indian Reserve subdivision22 For the first election in an Indian Reserve subdivision, the secretary of the division shall cause to be delivered to the chief of each band council in the subdivision, on or before a date to be determined by the minister to whom for the time being the administration of The Education Act, 1995 is assigned, at least two copies of Form A.

Poll23(1) For the first election in an Indian Reserve subdivision, if more than one person is nominated, a poll must be taken in each reserve within or partly within the subdivision:

(a) on a date to be fixed by the minister to whom for the time being the administration of The Education Act, 1995 is assigned; and

(b) at a place designated by the chief of the affected reserve.

(2) In general elections after a first election described in subsection (1), if a poll is required, it must be taken:

(a) on the date specified in an order made pursuant to section 42 of The Education Act, 1995; and

(b) at a place designated by the chief.

Deputy returning officer24 In an election in an Indian Reserve subdivision, the chief or the chief ’s nominee is the deputy returning officer.

Voters25 In order for a person to be entitled to vote in any election in an Indian Reserve subdivision, the person must:

(a) be at least 18 years of age; and

(b) have resided:

(i) in the school division in which the poll is taken for at least three consecutive months immediately preceding the day of the election; and

(ii) in Saskatchewan for at least six consecutive months immediately preceding the day of the election.

Poll book26(1) In an election in an Indian Reserve subdivision, the returning officer shall provide a supply of:

(a) poll books in Form B;

(b) registration forms for voters residing on reserves in Form C; and

(c) the statement of results in Form Z of Appendix C.

(2) The returning officer shall, not later than the day before the day of the poll, deliver to each deputy returning officer a sufficient number of each form mentioned in subsection (1).

Entries in poll book27 In an election in an Indian Reserve subdivision, the deputy returning officer shall keep a poll book in Form B in which the poll clerk shall:

(a) enter the name and residence of each voter; and

(b) number the entries made pursuant to clause (a) consecutively.

Voter’s registration form28 A person who wishes to vote in an election in an Indian Reserve subdivision shall be permitted to vote if the person establishes his or her eligibility to vote by completing a registration form in Form C.

Notice of person elected29 The returning officer shall, as soon as is practicable after an election, give written notice of the name and residence of any person elected as a board member in an Indian Reserve subdivision to:

(a) the minister to whom for the time being the administration of The Education Act, 1995 is assigned;

(b) the secretary of each education committee;

(c) the chiefs of the reserves in the Indian Reserve subdivision; and

(d) the board of education.

(4) The top of the first circle must be at least one millimetre below the lower border of the rectangles mentioned in subsections (2) and (3).

(7) The rectangles mentioned in subsections (2) and (3) and the circles mentioned in subsection (5) must be in the natural colour of the paper.

Notice of Application for Revision of Voters ListThe Local Government Election Act, 2015, in sections 58 and 59, states:

58(1) Any voter may apply to the chief enumerator at least 15 business days before the day on which a general election is to be held to have the name of any person struck off the voters list on the ground that the person is not eligible as a voter.

(2) Every application pursuant to subsection (1) must be in writing and must specify the grounds on which the applicant alleges that the person is not eligible to be a voter.

(3) An application pursuant to subsection (1) may be made by a person on his or her own behalf.

59(1) In this section, “applicant” means a person:

(a) who is eligible as a voter, but whose name does not appear on the voters list;

Directions for Voting1 Carefully read the instructions for voting that are printed in the upper portion

of the ballot paper.

2 Make only those marks on the ballot paper you are instructed to make and no other.

3 In marking the ballot paper, use the pencil provided in the voting compartment.

4 After you have marked the ballot paper, fold it so as to show only the name or initials of the deputy returning officer on the back of it.

5 After you have folded the ballot paper, hand the ballot paper to the deputy returning officer.

6 Do not let any person see how you have marked your ballot paper.

FORM P[Clause 93(1)(d) and Clause 101(2)(b) of the Act]

Sections 3, 4, 7 and 8 of The Controverted Municipal Elections ActBribery3(1) The following persons shall be deemed guilty of bribery and shall be punishable accordingly:

1 Every person who directly or indirectly, by himself or by any other person on his behalf, gives, lends or agrees to give or lend or offers or promises money or valuable consideration or gives or procures or agrees to give or procure or offers or promises any office, place or employment to or for any voter or to or for any person, in order to induce a voter to vote or refrain from voting at an election or to vote or refrain from voting upon a bylaw for raising money or creating a debt, or who corruptly does any such act on account of a voter having voted or having refrained from voting at an election or upon such bylaw or question;

2 Every person who directly or indirectly, by himself or by any other person on his behalf, makes any gift, loan, offer, promise or agreement as aforesaid to or for any person in order to induce that person to procure or defeat, or endeavour to procure or defeat, the return of any person to serve in the council, or to procure or defeat the passing of such bylaw or question or the vote of any voter at an election or at the voting upon such bylaw or question;

3 Every person who by reason of any such gift, loan, offer, promise, procurement or agreement procures, or defeats or engages or promises or endeavours to procure or defeat the return of any person in an election, or to procure or defeat the passing of such bylaw or question or the vote of any voter at an election or at the voting upon such bylaw or question;

4 Every person who advances or pays or causes to be paid money to or to the use of any other person, with the intent that the money or any part thereof shall be expended in bribery at an election or at the voting upon such bylaw or question, or who knowingly pays or causes to be paid money to any person in discharge or repayment of money wholly or in part expended in bribery at such election or at the voting upon such bylaw or question;

5 Every voter who before or during an election or before or during the voting on such bylaw or question directly or indirectly, by himself or any other person on his behalf, receives, agrees or contracts for any money, gift, loan or valuable consideration, office, place or employment for himself or any other person for voting or agreeing to vote, or refraining or agreeing to refrain from voting, at such election or upon such bylaw or question;

6 Every person who, after such election or the voting upon such bylaw or question, directly or indirectly, by himself or any other person on his behalf, receives any money or valuable consideration on account of any person having voted or refrained from voting or having induced any other person to vote or refrain from voting at such election or upon such bylaw or question;

7 Every person who hires horses, teams, carriages or other vehicles for the purpose of conveying voters to or from the polls, and every person who receives pay for the use of any horses, teams, carriages or other vehicles for the purpose of conveying voters to and from a poll.

(2) Every person who becomes qualified to be registered as a voter at the election of any member of the council of a municipality by becoming the owner of land, or otherwise becoming entitled to be so registered, for the purpose of influencing the result of the vote is guilty of an offence against this Act.

(3) Every person who, directly or indirectly, by himself or by any other person on his behalf, counsels or procures any other person to become the owner of land, or to otherwise become qualified to be registered as a voter at the election of any member of the council of a municipality, for the purpose of influencing the result of the vote is guilty of an offence against this Act.

(4) Every person who, directly or indirectly, by himself or by any other person on his behalf, counsels or procures any other person who, for the purpose of influencing the result of the vote at an election of a member of the council of a municipality, is the owner of land or is otherwise entitled to be registered as a voter to vote at the election of a member of the council of a municipality is guilty of an offence against this Act.

(5) Every person who:

(a) prior to the coming into force of this subsection became qualified to be registered as a voter at the election of any member of the council of a municipality by becoming the owner of land, or otherwise becoming entitled to be so registered, for the purpose of influencing the result of the vote; and

(b) after the day on which this subsection comes into force:

(i) continues to be the owner of land, or otherwise entitled to be registered as a voter, for the purpose of influencing the result of the vote of the election of a member of the council of a municipality; and

(ii) votes at any election of a member of the council of a municipality;

is guilty of an offence against this Act.

(6) Every person who, directly or indirectly, by himself or by any other person on his behalf, counsels or procures any other person who, prior to the coming into force of this subsection, became qualified to be registered as a voter at the election of any member of the council of a municipality by becoming the owner of land, or otherwise becoming entitled to be so registered, for the purpose of influencing the result of the vote to:

(a) continue to be the owner of the land, or to otherwise remain qualified to be so registered, for the purpose of influencing the result of the vote; and

(b) vote at any election of a member of the council of a municipality;

is guilty of an offence against this Act.Threats, etc.4 Every person who directly or indirectly, by himself or by any other person on his behalf, makes use of or threatens to make use of force, violence or restraint, or inflicts or threatens to inflict by himself or by or through any other person any injury, damage, harm or loss, or in any manner practises intimidation upon or against any person in order to induce or compel that person to vote or refrain from voting at an election or at the voting upon a bylaw or question or on account of that person having voted or refrained from voting thereat, or who by abduction, duress or a fraudulent device or contrivance impedes, prevents or otherwise interferes with the free exercise of the franchise of a voter, or thereby compels, induces or prevails upon a voter to give or refrain from giving his vote at an election or at the vote upon a bylaw or question, shall be deemed to have committed the offence of undue influence.Forfeiture and disqualification7 A candidate elected at an election who is found by a judge, on the hearing of a motion in the nature of a quo warranto, guilty of an act of bribery or of using undue influence or of an offence against subsection 3(2), (3), (4), (5) or (6) shall forfeit his seat and shall be ineligible as a candidate at any election for four years.Disqualification8 A person, who is adjudged guilty of an offence within the meaning of section 3 or 4, shall incur a penalty of $1,000 and shall be disqualified from voting at any election or upon any bylaw or question for the next succeeding two years.

Title1 These regulations may be cited as The Vital Statistics (Statements of Events) Amendment Regulations, 2015.

R.R.S. c.V-7.21 Reg 1 amended2 The Vital Statistics Regulations, 2010 are amended in the manner set forth in these regulations.

Section 2 amended3 Section 2 is amended by adding the following definitions in alphabetical order:“ ‘health services number’ means a unique number assigned to an individual who is or was registered as a beneficiary to receive insured services pursuant to The Saskatchewan Medical Care Insurance Act; (« numéro de services de santé »)

“ ‘nurse practitioner’ means a person who is registered as a registered nurse pursuant to The Registered Nurses Act, 1988 and who is licensed to practise as a nurse practitioner in Saskatchewan; (« infirmière praticienne »)

“ ‘spouse’ means:

(a) the legally married spouse of a subject individual; or

(b) a person who is cohabiting with the subject individual as a spouse:

(i) continuously for a period of not less than one year; or

(ii) in a relationship of some permanence, if they are the parents of a child. (« conjoint »)”.

Section 4 amended4 Clause 4(1)(m) is amended by adding “, electronic” after “paper”.

Section 7 amended5 Subsection 7(1) is amended:

New section 3120 Section 31 is repealed and the following substituted:

“Eligible persons - authorization31(1) A person who provides authorization pursuant to clause 63(7)(a) of the Act shall:

(a) set out, in a form approved by the registrar, the name of the person to whom the authorization applies; and

(b) sign the authorization and note the date on which he or she signed the authorization.

(2) The person who provides authorization pursuant to subsection (1) may be required to include two documents that confirm his or her identity to the satisfaction of the registrar along with the authorization.

(3) If the registrar considers it to be necessary for the purposes of this section, the registrar may require additional particulars be set out in the authorization”.

Section 35 amended21 Clause 35(c) is repealed and the following substituted:

“(c) with respect to a death, the following persons:

(i) the administrator designated pursuant to The Traffic Safety Act for the purpose of:

(A) determining a claim arising out of an injury or a death involving a motor vehicle; or

(B) updating any records kept by the administrator respecting drivers;

(ii) the Saskatchewan Cancer Agency for the purpose of maintaining and verifying the accuracy of information in the cancer registry continued pursuant to subsection 12(1) of The Cancer Agency Act;

(iii) the Workers’ Compensation Board for the purpose of determining an injury or death claim pursuant to The Workers’ Compensation Act, 2013;

(iv) Veterans Affairs Canada for the purpose of determining an individual’s benefit entitlement pursuant to the Veterans Benefit Act (Canada)”.

Modification du Règl. 1 des R.R.S. ch. V-7.212 Le Règlement de 2010 sur les services de l’état civil est modifié de la manière énoncée dans le présent règlement.

Modification de l’article 23 L’article 2 est modifié par insertion, selon l’ordre alphabétique, des définitions suivantes :

« “conjoint” S’entend, selon le cas :

a) du conjoint légalement marié de l’individu en cause;

b) d’une personne qui cohabite maritalement avec l’individu en cause :

(i) soit de façon continue depuis au moins un an,

(ii) soit dans une relation assez permanente, s’ils sont les parents d’un enfant. (“spouse”)

Standard Conditions of a Tenancy AgreementThe Residential Tenancies Act, 2006

NOTE: These Standard Conditions are conditions of every tenancy agreement. Both landlord and tenant should consult The Residential Tenancies Act, 2006 (the ‘Act’) and The Residential Tenancies Regulations, 2007 (the ‘regulations’) to determine the full extent of their rights and obligations. If there is a conflict between a provision in these Standard Conditions and a provision in the Act or the regulations, the provision in the Act or regulations prevails.

Application of The Residential Tenancies Act, 20061(1) These standard conditions form part of every tenancy agreement.

(2) The terms and conditions of any tenancy agreement may not contradict or change any right or obligation under the Act, regulations or standard conditions.

(3) A term or condition of a tenancy agreement that contradicts or changes such a right, obligation or standard condition is void and cannot be enforced.

Written tenancy agreements2(1) Tenancy agreements do not have to be in writing. If a landlord and tenant enter into a written agreement, it must comply with the Act and the regulations. The landlord must give the tenant a copy of the signed agreement within 20 days after entering into the agreement.

(2) A fixed term tenancy for more than three months must be in writing, and must set out the date on which the tenancy is to end. A tenancy agreement that does not set out that date or is not in writing will be deemed to be a month-to-month tenancy.

(3) Whether or not a tenancy agreement is in writing, the landlord must provide the tenant with an address for service and telephone number as well as a telephone number for emergency repairs.

Security deposits3(1) A security deposit may not exceed the equivalent of one month’s rent. A tenant does not have to pay more than 50% of the security deposit on the date that the landlord and tenant enter into the tenancy agreement. The balance of the security deposit is to be paid within two months after the tenant takes possession of the rental unit. (Special rules apply if the Minister responsible for the administration of The Saskatchewan Assistance Act guarantees payment of the security deposit.)

(2) If a landlord accepts a security deposit that is greater than one month’s rent, the tenant may deduct the overpayment from rent or apply to the Office of Residential Tenancies (the “ORT”) to recover the overpayment.

Payment of rent4(1) A tenant must pay rent when it is due, whether or not there are problems with the landlord or the tenancy. If problems cannot be resolved, a tenant should, instead of withholding rent, apply to the ORT for an appropriate remedy.

(2) A landlord must provide a tenant with a receipt for rent paid in cash.

(3) A landlord must not terminate or restrict a service or facility without the tenant’s consent unless the landlord obtains an order from the ORT.

(4) A landlord is prohibited from imposing charges or increasing rent for a service or facility that was previously available at no cost, unless the tenant agrees or the landlord obtains an order from the ORT.

(5) A tenancy agreement must not include a provision that all or part of the rent payable for the remainder of the term of the tenancy agreement becomes due and payable if the tenant breaches a provision of the tenancy agreement.

Rent increase5(1) A landlord must give a tenant in a periodic tenancy:

(a) one year’s advance written notice of a rent increase, and the landlord shall not increase the rent more than once each year if the landlord is not a member of the Saskatchewan Landlord Association Inc.;

(b) six months’ advance written notice of a rent increase, and the landlord shall not increase the rent more than twice each year if the landlord is a member of the Saskatchewan Landlord Association Inc.

(2) If a landlord fails to give the required notice, the rent increase does not take effect until the applicable notice period has passed. If a landlord increases rent without proper notice, the tenant can apply to the ORT for compensation.

(3) A landlord under a fixed term tenancy must not increase the rent during the term of the tenancy unless the amount of the increase (expressed either in dollars or as a percentage) and time when an increase is to come into effect have been stated in the lease signed by the landlord and the tenant.

Assignment and subletting6(1) If a tenancy is for a fixed term (as opposed to a ‘month-to-month’ tenancy), a tenant may sublet a rental unit only with the written consent of the landlord. The landlord must not unreasonably withhold consent to the proposed sublease and may charge a tenant a fee of not more than $20 for considering or consenting to a sublease.

(2) If a rental unit has been sublet, the original tenant remains responsible for fulfilling the tenant’s obligations under the Act, the regulations and the tenancy agreement with respect to matters that arose before the date the unit was sublet.

Protection of tenant’s right to quiet enjoyment7 A tenant is entitled to quiet enjoyment of a rental unit. This includes a right to:

(a) reasonable privacy;

(b) freedom from unreasonable disturbance by the landlord or other tenants;

(c) exclusive possession of the rental unit; and

(d) use of common areas for reasonable and lawful purposes.

Landlord and tenant obligations to repair and maintain8(1) A landlord must maintain rental property in a good state of repair and fit for the use and enjoyment of the tenant. A landlord must keep all services and facilities included with the rent (e.g., appliances, heating and plumbing systems, etc.) in a good and functional state of repair.

(2) A tenant must maintain reasonable health, cleanliness and sanitary standards throughout the rental unit and must repair damage to the rental unit, services or facilities caused by the tenant or someone permitted on the property by the tenant. The tenant is not responsible for reasonable wear and tear.

(3) If the landlord grants the tenant the exclusive use of residential property (such as a single family dwelling), the tenant is responsible for the ordinary cleanliness of the exterior of the property, including the yard or surrounding land, unless the parties agree otherwise.

Landlord’s right to enter rental unit9(1) A landlord must not enter a rental unit unless one of the following applies:

(a) the tenant gives permission at the time of the entry;

(b) at least 24 hours (and not more than seven days) before the entry, the landlord gives the tenant written notice that sets out the date and time of entry and a reasonable purpose for entering;

(c) the landlord enters the unit to provide housekeeping or related services pursuant to a written agreement with the tenant;

(d) the landlord has an order from the ORT that authorizes the entry;

(e) the tenant appears to have abandoned the rental unit;

(f) an emergency exists and the entry is necessary to protect life or property.

(2) The notice provided by the landlord must state a maximum four-hour period during which the landlord will enter the rental unit.

(3) If a tenant has given notice to end the tenancy, the landlord may enter the rental unit for the purpose of showing it to prospective tenants, but only if the landlord complies with section 10 of these standard conditions.

(4) A landlord must not enter a rental unit for the purpose of showing it to a prospective purchaser without first giving the tenant 24 hours’ notice or obtaining the consent of the tenant.

(5) Entry can only be made between 8 a.m. and 8 p.m. on a day that is not a Sunday or a day of religious worship for the tenant, unless the tenant otherwise agrees.

Notice of entry to show rental unit to prospective tenants10(1) If a tenant has given notice to end the tenancy or if a fixed term tenancy is ending and there will not be a new tenancy agreement between the same landlord and tenant, the landlord may enter the rental unit for the purpose of showing it to prospective tenants, but only if:

(a) the tenant has given permission;

(b) the landlord gives notice (which the tenant has received) at least two hours before entry; or

(c) the landlord and the tenant have agreed in writing to the circumstances under which the landlord may enter the rental unit, provided that the terms are reasonable and the agreement is entered into after the tenant has given notice to end the tenancy or, in the case of a fixed term tenancy, the tenant is aware that the tenancy is ending and there will not be a new tenancy agreement.

(2) If a landlord does not have permission from the tenant and there is no written agreement, the landlord must make a reasonable effort, at least two hours before entry, to contact the tenant at a phone number or email address provided by the tenant. If the landlord is still unsuccessful in notifying the tenant, or the tenant has not provided contact information, the landlord may enter the unit without prior notice by posting a notice on the door of the rental unit that sets out the time and date of entry.

Tenant’s right of access protected11 A landlord must not restrict access to residential property (i.e., the rental unit and any common areas) by the tenant or a person permitted on the residential property by the tenant.

Prohibitions on changes to locks and other access12(1) Neither a landlord nor a tenant may change locks or security codes to a rental unit unless:

(a) they agree to the change and if the landlord changes the locks or security code, the landlord gives the tenant new keys or the new security code; or

(b) a hearing officer has ordered the change.

(2) A landlord must not change locks or security codes to a common area unless the landlord provides each tenant with new keys or new security codes for the area. Similarly, a tenant must not change locks or security codes to a common area unless the landlord consents to the change.

Notice at end of fixed term tenancy13(1) At least two months before a fixed term tenancy is to end, the landlord must serve a notice in writing on the tenant saying whether or not the landlord is prepared to enter into a new tenancy agreement, and if so, what the terms of the tenancy agreement would be.

(2) Within one month after receiving the landlord’s notice, if the tenant is willing to enter a new tenancy agreement on the landlord’s terms, the tenant must advise the landlord in writing of the decision. If the tenant does not provide written notice to the landlord within that time, at the end of the term of the tenancy agreement the tenant must vacate the premises.

Landlord entitled to make rules14(1) A landlord is entitled to make reasonable rules about the tenant’s use, occupancy or maintenance of the rental unit and the tenant’s use of the services and facilities.

(2) The rules must be in writing and brought to the tenant’s attention.

How a tenancy ends15(1) A tenancy can be ended only if:

(a) the tenant or landlord gives written notice to end the tenancy in accordance with sections 56 to 61 of the Act;

(b) the landlord and tenant agree in writing to end the tenancy;

(c) the tenant vacates or abandons the rental unit;

(d) the tenancy agreement cannot continue due to causes outside the control of the landlord or tenant (e.g., a fire renders the premises uninhabitable);

(e) the ORT orders that the tenancy is ended.

(2) A tenancy for a fixed term (as opposed to a ‘month-to-month’ tenancy) ends on the date specified in the tenancy agreement unless the landlord and tenant have entered into a new tenancy agreement.

Tenant’s notice16(1) A tenant may end a month-to-month tenancy by giving the landlord notice at least one month before the day of the month on which rent is payable.

(2) A tenant may end a week-to-week tenancy by giving the landlord notice at least one week before the day of the week on which rent is payable.

(3) A tenant may end a tenancy on one day’s notice if the landlord is in breach of a ‘material’ term of the agreement (e.g., the rental unit has become uninhabitable). If the breach is capable of being remedied, the tenant must give the landlord a reasonable period to remedy the problem before ending the tenancy.

(4) A notice to end the tenancy under subparagraph (3) must state the reason for ending the tenancy.

Landlord’s notice for non-payment of rent17(1) A landlord may end a tenancy immediately by serving a notice to end the tenancy if rent is unpaid for a period of more than 15 days after it is due. If a tenant does not vacate the unit in response to the notice, the landlord can make an application to the ORT for possession of the unit.

(2) If the tenant is responsible for the payment of utilities and any utility charges are unpaid, the landlord may treat the unpaid utility charges as unpaid rent if the tenant fails to make payment within 15 days after a landlord has requested that the tenant make payment.

Landlord’s notice for cause18(1) A landlord may end a tenancy by giving notice to end the tenancy if one or more of the following applies:

(a) the tenant does not pay the security deposit within 30 days after the date the payment is due;

(b) the tenant is repeatedly late paying rent;

(c) there are an unreasonable number of people living in a rental unit;

(d) the tenant (or a person permitted on the residential property by the tenant) has significantly interfered with or unreasonably disturbed other tenants or neighbours, has seriously jeopardized the health, safety or lawful rights of another tenant or neighbour, or has put the landlord’s property at significant risk;

(e) the tenant (or a person permitted on the residential property by the tenant) has engaged in noxious, offensive or illegal activity;

(f) the tenant does not repair damage to the residential property within a reasonable time;

(g) the tenant has breached an important term of the agreement and not remedied the problem within a reasonable time;

(h) the tenant attempts to sublet the rental unit without obtaining the landlord’s written consent;

(i) the tenant has repeatedly violated the landlord’s reasonable rules;

(j) the tenant knowingly gives false information about the residential property to a prospective tenant or purchaser viewing the residential property;

(k) the rental unit must be vacated in accordance with the order of any lawful authority, including the ORT;

(l) the tenant (or a person permitted in the rental unit by the tenant) after receiving notice, continues to smoke in a house that is also the landlord’s principal residence;

(m) the tenant has breached a municipal bylaw that could result in an assessment against the landlord’s property taxes.

(2) A notice to end the tenancy on any of the above grounds must be given in writing, no later than one day before one month (or one day before one week, in a weekly tenancy) before the day that rent is payable under the tenancy agreement. The landlord must give the tenant a reasonable period of time to remedy the circumstances on which the notice is based, if they are capable of being remedied. A tenant may dispute a notice by giving written notice to the landlord within 15 days after receiving the notice, failing which, the tenant will be expected to vacate the unit by the date specified in the notice.

Landlord’s application for order ending tenancy early19(1) A landlord may apply to the ORT for an order that will end the tenancy early if it would be unreasonable to require the landlord to give notice under standard condition 18.

(2) This type of order can become effective immediately and may be made if a tenant has done any of the following:

(a) significantly interfered with or unreasonably disturbed another tenant or another occupant of the residential property, the landlord or any persons in any adjacent property;

(b) seriously jeopardized the health or safety or a lawful right or interest of another tenant or another occupant of the residential property, the landlord or any persons in any adjacent property;

(c) put the landlord’s property at significant risk;

(d) engaged in a noxious, offensive or illegal activity that:

(i) has caused or is likely to cause damage to the landlord’s property;

(ii) has adversely affected or is likely to adversely affect the quiet enjoyment, security, safety or physical well-being of another tenant or another occupant of the residential property, the landlord or any persons in any adjacent property; or

(iii) has jeopardized or is likely to jeopardize a lawful right or interest of another tenant or another occupant of the residential property, the landlord or any persons in any adjacent property;

(e) caused extraordinary damage to the residential property.

Landlord’s notice at end of employment with the landlord20 A landlord may end the tenancy of his or her own employee after the employment is ended by providing at least one month’s notice.

Landlord’s use of property21 A landlord may end a tenancy for certain reasons related to the landlord’s use of the property (e.g., the landlord or a close family member or friend will occupy the property; renovations require vacant possession; demolition; sale to someone who will occupy the property).

[The provisions are set out in detail in sections 60, 61 and 62 of the Act.]

Leaving the rental unit at the end of a tenancy22 When a tenant vacates a rental unit:

(a) the tenant must return all keys to the landlord; and

(b) the rental unit must be reasonably clean and undamaged, except for reasonable wear and tear.

When landlord may regain possession of rental unit23 A landlord may not regain possession of a rental unit unless:

(a) the tenant has vacated or abandoned the rental unit; or

(b) the landlord obtains an order for possession, and a writ of possession has been directed to a sheriff, pursuant to subsection 70(13) of the Act.

Liability for not complying with the Act or a tenancy agreement24 If a landlord or tenant does not comply with the Act, the regulations or their tenancy agreement, the non-complying landlord or tenant must compensate the other for any resulting damage or loss, including loss of rent paid or payable. However, a landlord or tenant who claims compensation for any damage or loss must do whatever is reasonable to minimize the damage or loss.

Disputes25(1) Either the tenant or the landlord has the right to apply for a resolution of a residential tenancy dispute that cannot be resolved between themselves.

(2) Any application regarding a residential tenancy dispute must be made to the ORT in accordance with the Act and the regulations within two years after the date of the event that is the subject of the dispute.

Housing programs26(1) The Act and the regulations contain special provisions regarding:

(a) housing provided by public housing authorities; and

(b) living accommodation provided pursuant to a housing program.

(2) The provisions contain different rules for security deposits, rent increases and termination for such tenancies.

Notices27 Notices required by the Act or the regulations must be in writing. Most notices and documents can be served by personal service, registered mail, ordinary mail or by electronic means. Refer to the Act and regulations for details.

13(1) Subject to subsections (2) to (5), these regulations come into force on the day on which they are filed with the Registrar of Regulations.

(2) Subject to subsection (3), section 9 comes into force on the day on which section 1 of The Fee Waiver Act comes into force.

(3) If section 1 of The Fee Waiver Act comes into force before the day on which these regulations are filed with the Registrar of Regulations, section 9 comes into force on the day on which these regulations are filed with the Registrar of Regulations.

(4) Subject to subsection (5), section 11 comes into force on the day on which section 21 of The Residential Tenancies Amendment Act, 2015 comes into force.

(5) If section 21 of The Residential Tenancies Amendment Act, 2015 comes into force before the day on which these regulations are filed with the Registrar of Regulations, section 11 comes into force on the day on which these regulations are filed with the Registrar of Regulations.

SASKATCHEWAN REGULATIONS 114/2015The Summary Offences Procedure Act, 1990

Section 55

Order in Council 600/2015, dated December 17, 2015(Filed December 17, 2015)

Title1 These regulations may be cited as The Summary Offences Procedure (Miscellaneous) Amendment Regulations, 2015.

R.R.S. c.S-63.1 Reg 2 amended2 The Summary Offences Procedure Regulations, 1991 are amended in the manner set forth in these regulations.

Section 4 amended3 Clause 4(v) is repealed and the following substituted:

“(v) the occupational health officers appointed pursuant to section 3-6 of The Saskatchewan Employment Act who are authorized by the minister responsible for the administration of that Act to issue tickets while enforcing the provisions of that Act”.

Section 5 amended4 Clause 5(nn) is repealed and the following substituted:

“(nn) The Saskatchewan Employment Act and The Occupational Health and Safety Regulations, 1996”.

Section 8 amended5 Clause 8(a) is amended:

(a) in the portion preceding subclause (i) by striking out “Tables 1 to 50” and substituting “Tables 1 to 51”;(b) by repealing subclause (xlix) and substituting the following:

“(xlix) the offences pursuant to The Saskatchewan Employment Act set out in Table 49”; and

(c) by adding the following subclause after subclause (l):“(li) the offences pursuant to The Environmental Management and Protection (General) Regulations set out in Table 51”.

Section 13 amended6 Clause 13(2)(b) is amended by striking out “Tables 2 to 7.1, 9, 10, 12 to 21 or 23 to 48” and substituting “Tables 2 to 7.1, 9, 10, 12 to 21 or 23 to 51”.

Appendix, Part 2, new Table 497 Table 49 in Part 2 of the Appendix is repealed and the following substituted:

“TABLE 49The Saskatchewan Employment Act

The provisions set out in Column 3 are the provisions of The Saskatchewan Employment Act that impose the prohibitions or requirements described in Column 2. Section 3-78 of that Act provides that a contravention of those provisions is an offence. Those provisions in Column 3 that are marked with an asterisk are the provisions for which a peace officer may withdraw the specified penalty sum option and require the defendant to appear in court.

Section 100

Title1 These regulations may be cited as The Saskatchewan Farm Security (Farm Ownership) Amendment Regulations, 2015.

R.R.S. c.S-17.1 Reg 1 amended2 The Saskatchewan Farm Security Regulations are amended in the manner set forth in these regulations.

Section 2 amended3(1) The following clause is added after clause 2(1)(c):

“(d) ‘resident person’ means:

(i) a Canadian citizen; or

(ii) a permanent resident of Canada within the meaning of the Immigration and Refugee Protection Act (Canada)”.

(2) Subsection 2(4) is repealed and the following substituted:“(4) For the purposes of Part VI of the Act, a land holding includes any interest held by way of a debt or obligation funded other than by:

(a) a resident person;

(b) a bank, credit union or other financial institution that is supervised or examined by a governmental authority in Canada; or

(c) a farm input supplier that has provided inputs to a producer”.Section 3 amended

4(1) Subsection 3(2) is repealed.(2) Subsection 3(3) is repealed.(3) Subsection 3(4) is repealed.

Section 6 amended5 Clause 6(1)(c) is amended by striking out “after May 1, 2006 and before May 1, 2016” and substituting “after May 1, 2006 and before May 1, 2026”.

New section 7.016 The following section is added after section 7:

“Statutory declaration pursuant to subsection 90(1) of Act7.01 A statutory declaration pursuant to subsection 90(1) of the Act must contain the following:

(a) the name and address of the person who is acquiring or proposing to acquire a land holding;

(b) a statement that the person mentioned in clause (a) is or is not a resident person;

(c) the legal description of the farm-land parcels being acquired;

(d) the source of any funding used to acquire the farm land;

(e) a statement that the person mentioned in clause (a) obtained independent legal advice regarding the provisions of Part VI of the Act”.

Section 8 amended7 Clause 8(f) is repealed.

Appendix amended8 Form F in the Appendix is repealed.

Coming into force9(1) Subject to subsection (2), these regulations come into force on the day on which The Saskatchewan Farm Security Amendment Act, 2015 comes into force.

(2) If The Saskatchewan Farm Security Amendment Act, 2015 comes into force before the day on which these regulations are filed with the Registrar of Regulations, these regulations come into force on the day on which they are filed with the Registrar of Regulations.
