Supplemental briefing ordered

The application dated October 21, 2015, of appellant Huber Joel Mendoza to file a supplemental

letter brief in the above-captioned case is granted. The Attorney General is directed to serve and

file a responsive letter brief in hard copy in our Clerk’s Office no later than Wednesday,

November 18, 2015. Appellant may serve and file a responsive reply brief within 10 court days

after the Attorney General’s responsive brief is filed under this or any subsequent order of this

court. The provisions of California Rules of Court, rule 8.25(b)(3) will not apply.

The court vacates the submission of the matter that occurred on October 6, 2015, to afford time

for the briefing and consideration of the issue raised in appellant’s supplemental letter brief. This

matter will be resubmitted, without further order, as of the date that the last supplemental brief is

or could be timely filed under this or any subsequent order of this court. (See Cal. Rules of Court,

rule 8.524(h).

June 21, 2015. Accordingly, the proceeding in People v. Craig Huntsberry, S225982, is

permanently abated. The cause is transferred to the Court of Appeal, Fourth Appellate District,

Division One with directions to enter an order in case no. D066332 permanently abating all

proceedings with respect to defendant and to require the Superior Court for San Diego County to

enter an order to that effect in case no. SCE332867. (Cal. Rules of Court, rule 8.528(d); People v.

Dail (1943) 22 Cal.2d 642, 659; People v. Bandy (1963) 216 Cal.App.2d 458, 466.) The request

to retain the cause for decision, made in a letter filed by appellant’s counsel on August 6, 2015, is

denied.

4. Within 30 days after the effective date of discipline, he must contact the Office of Probation

and schedule a meeting with his assigned probation deputy to discuss the terms and

conditions of probation. Upon the direction of the Office of Probation, he must meet with

the probation deputy either in person or by telephone. During the period of probation, he

must promptly meet with the probation deputy as directed and upon request.

5. Subject to the assertion of applicable privileges, he must answer fully, promptly, and

truthfully any inquiries of the Office of Probation that are directed to him personally or in

writing, relating to whether he is complying or has complied with the conditions contained

herein.

6. He must submit written quarterly reports to the Office of Probation on each January 10,

April 10, July 10, and October 10, of the period of probation. Under penalty of perjury, he

must state whether he has complied with the State Bar Act, the Rules of Professional

Conduct, and all of the conditions of probation during the preceding calendar quarter. In

addition to all quarterly reports, a final report, containing the same information, is due no

later than 20 days before the last day of the probation period and no later than the last day of

the probation period.

7. Within one year after the effective date of the discipline herein, he must submit to the Office

of Probation satisfactory evidence of completion of the State Bar’s Ethics School and the

State Bar’s Client Trust Accounting School and passage of the tests given at the end of those

sections. This requirement is separate from any Minimum Continuing Legal Education

(MCLE) requirement, and he shall not receive MCLE credit for attending Ethics and Client

Trust Accounting rules. (Rules Proc. of State Bar, rule 3201.)

8. The period of probation will commence on the effective date of this order. At the expiration

of the period of probation, if he has complied with all conditions of probation, the period of

stayed suspension will be satisfied and that suspension will be terminated.
