The petition for writ of habeas corpus, filed November 5, 1997, is denied on the merits as to all
claims except claim IX. C., which was resolved in a separate opinion (see In re Champion (2014)
58 Cal.4th 965), and claim XVII., which is denied as premature, without prejudice to its renewal
after an execution date is set. In addition, claim X. is procedurally barred on the ground that it
could have been, but was not, raised on appeal (In re Dixon (1953) 41 Cal.2d 756, 759) and
claims XII. and XIII. B. are procedurally barred on the ground that they were raised and rejected
on appeal (In re Waltreus (1965) 62 Cal.2d 218, 225).

Claim 1 is procedurally barred under In re Dixon (1953) 41 Cal.2d 756, 759, because it could

Claims 1 and 2 are procedurally barred under In re Clark (1993) 5 Cal.4th 750, 767-768, because
