gentleman;
I have been thinking since this morning, what to speak on this
solemn occasion when the baton is about to be passed from
one Chief Justice to another. I am at my wits end as to what
to speak about Hori'blc Justice T .S. Thakur which would
holistically describe him.
My situation is somewhat like described by a shire as
"Sukon-c-dil ke liyc kuch to ihtcmaam karun

The quandary was of such a degree that while thinking, I
missed in my first official obligation to be present in the court
today. at the time of its rising for the day. My unequivocal
apologies; but Sir in all candidness you yourself are
responsible for the same.
Recently, there was talk of lack of role models for the young
lawyers and judges. We can all say without any dissent that
here is a tall person worthy of being emulated as a role model.
An ideal son to parents, an ideal advocate sincere to the cause
of his client, an ideal judge wedded to the constitutional
norms and ethos while delivering justice. whose heart bleeds
for have-riots and army soldiers, and steeped in the colours of
secularism and custodian of independence of judiciary and
rule of 1mV'. The tallness of a person is not his physical height
but how much has he grown in his lire in service to the
society . You Sir are one of the top peaks in the Himalayan
range.
l Ic throughout his judicial career ha s acted with great
Impartiality except one bias and that is: bias towards the Bar
in general and upcoming lawyers in particular.
This is reflected from his address at Nalsar Convocation
Speech given on 08.08.016 at Hydcrabad wherein he talked
about the Constitution's vision of an inclusive India and our
efforts to architect a just and inclusive society . He quoted Dr
Arnbcdkar and I quote "It was. indeed, a way of life. which
recognizes liberty. equality and fraternity as the principles o]

life and which cannot be divorced from each other; liberty
cannot be divorcedfrom equality; equality cannot be divorced
from liberty. Nor can liberty and equality be divorced from
fraternity. Without equality, liherty would produce the
supremacy of the few over the man}', Equality without liberty
would ki!! individual initiative. Without fraternity, liberty and
equality could not become a natural course of things." Indian
Constitution which enshrines the values of liberty, equality
and fraternity is thus a unique testament that recognizes the
above values avowed objective placed at the top of the
pyramid. This requires a paradigm shift so as to recognize the
dignity, value and importance of each individual, not only as a
moral imperative, but also as a legal principle, a societal goal
and eventually a practice."
With regard to Bar and Bench, he said "The Bar and Bench
constitutes the two wheels of the chariot of justice. The
success or the judicial process often depends on the dynamic
relationship _of cooperation between the two. As rightly
observed by Lord Denning: " It is a mistake to suppose that he
is the mouth piece of his client so say what he wants. or his
tool to do what he directs . I-Ie is none of these things, He
owes allegiance to a higher cause. It is the cause of truth and
justice. While judiciary has played a pivotal role in huilding a
society for all , Indian Bar too has a glorious history in this
regard. As integral part of justice delivery system. lawyers in
our country have historically and generously contributed to
cause or justice - whether it was the struggle for

Independence, the framing of our Constitution or governance .
The bar Association of country has a larger objective beyond
the furtherance of professional interests. It aims at promoting
public and national welfare in manifold directions and
upholding the Constitution and rule of law."
If the Bar is to perform such a noble task so important to the
society, would it be wrong to expect a decent living space and
a work place for an advocate so that he can think, work and
dedicate himself in the cause of justice? He can do it with due
diligence and hard work provided he is regularly updated on
the changing legal needs of domestic law and global law. For
this purpose, there is need of continuous legal education and
training of skills of advocacy. Our executive has yesterday
resolved that they would seek an area of 3 acres with the
assistance and the help of the Supreme Court judiciary and
executive for setting up a lawyers academy having facilities of
meeting rooms and auditoriums, chambers for the lawyers and
designated consultation rooms "Vhere clients can meet lawyers
who are ur1f ~rtunate not to have been allotted a chamber. This
complex should also have recreational facilities on the basis
of maxim :healthy mind in a healthy body '.
The Bar unanimously thanks you for the inlrastructural
enhancement facilities in the form of renovation of library 2,
provision of advocates ' lounge, a canteen where consumers of
1itigation can have food and renovated ladies bar room. Ihe
building across the road is almost under completion. the Bar

hopes that earmarked chambers can be allotted to them for
usage at the earliest.
The term of the Executive is only one year and every year
beginning is made from ground zero. This Executive has
decided to have some committees which would have life
longer than that of this Executive alter taking permission [rom
general body.
1. It is proposed to have a long range planning committee
constituting of all past Presidents and some nominee
besides current President. Vice President and Secretary
as ex-officio members . They would advise the
Executive Committee and the general body with regard
to future development of the Bar and are expected to
playa very vital role in ensuring that plans which arc
firmed up are duly executed.
2. Bar Journal Committee to be appointed for three years
committed to ensure publication of two journals in a
year C"ach spaced six months.
3 . A monthly e-news letter. The editorial board would be [or three "ears.
"
4. Sports Committee for three years as it has been felt that
intense expectation from lawyers requires provision of
stress busters for them .

5. Linking of senior Bar with the junior Bar through the
programme of mentoring. Say about 50 senior
advocates (not necessarily designated) to take under
their supervision and charge of five junior/upcoming
lawyers whom they would meet on every Saturday or
Sunday over a cup of tea. A positive stroke or a
reprimand would go a long way in shaping up career of
these youngsters. This would also ensure filling lip of a
deep gulf between elite senior and common member of
the Bar.
There arc many other decisions taken that I would apprise the
general house at an appropriate time.
I am confident that with the great executive committee that I
have got for the year 2017 which is bubbling with enthusiasm,
ideas and commitment, we would be able to lay down
foundation within next eleven months for the next ten years .
Looking at the expectation of painting the larger canvas than
mere professional interest, the Bar is deeply concerned with
the impasse between Executive and Judiciary. It originally
seemed part of classic check and balances built in the
architecture of constitution but now it seems to be affecting
the health of rule or law, We request and trust that both the
executive and judiciary would take a step back have a relook
at the constitutional intentions and ethos and sort the issues
before entire justice system is damaged irreparably.

On parameter of good behaviour towards Bar, Honble Justice
Thakur excels and is second to none. His philosophy that
when a matter comes before him then that is the moment
Ihour/ day of that litigant and his right to address the court is
not be curtailed in any manner whatsoever. This has resulted
in deep sense of satisfaction of all appearing lawyers as well
as consumers or litigation.
Justice Thakur is not Thakur as depicted in old films where
his feudal style of living is depicted in the first hour and in the
second half he is beaten and bashed up by the hero. Our
Justice Thakur ruled our heart in the first half and in the
second half not only he ruled our heart but also made us bow
down to him for his goodness, for his integrity, for his sense
of justice and application of judicial balm to all injuries which
required.
On behalf of the Bar, I can say without hesitation that the Bar
believes in finn commitment to the rule of law which includes
an independent judiciary as well as strong independent Bar.
We would not allow any injury to the judiciary and if required
we would be ready to take first blows.
Justice Thakur is a man of so many dimensions that it IS
impossible for me to describe him. In words of Ghalib

We also welcome on this solemn occasion on the eve of oath
or Justice Khehar as Chief Justice of India that he can trust the
Bar to give all cooperation to fructify his vision and direction
of justice. His elevation is once again indicative of maturity of
Indian state which gives hopes to minorities that they have all
the chance in life for rising in this multi lingual and multi
religious society.
Justice Thakur we bid you farewell with the hope and trust
that you would meet us as often as possible to guide us and to
shape us . .
