Sunvilla News, Gandhinagar After failing to get Presidential assent for its anti-terror bill thrice, Gujarat government introduced Gujarat Control of Organised Crime (GUJCOC) Bill in a new form by adding terrorism related provisions to it. While GUJCOC was only about organized crime, GUJCOTOC covers terror activities too. The GUJCOC bill, which is on the lines of the stringent Maharashtra Control of Organised Crime Act (MCOCA), was rejected in 2004 and 2008 by the then President AJPAbdul Kalam and Pratibha Patil respectively who had suggested some amendments in the provisions related to telephone interception and confession made before police officer being considered as evidence in court. The state government once again prepared a new draft of the bill and rechristened it Gujarat Control of Terrorism and Organised Crime (GUJCOTOC) Bill-2015. It was tabled for discussion and approval of the House Tuesday and passed. While the bill has been renamed , it still contains the provisions that had led to Gujarat Assembly its rejection by Presidents in the past. One such provision is the admissibility of evidence collected through intercepted calls of the accused. This provision empowers the police to intercept calls and admit it as evidence in the court. Justifying the provision, the ‘Statement of Objects and Reasons’ in the bill states that it is necessary in the contemporary day where organised criminal syndicates make extensive use of wire and oral communication. It says that the interception of such communication to obtain evidence is inevitable and an indispensable aid for the law enforcement. The statement provides a detailed justification on the issue by adding that the existing laws are inadequate to curb the menace of organised crimes. It further says, “It is therefore, considered necessary to enact a special law with stringent provisions, including the power to intercept wire, electronic or oral communication.” As per the clause-14 of the bill, evidence collected through ‘interception of wire, electronic or oral communication… shall be admissible as evidence against the accused in the court’. Former President APJ Abdul Kalam had in 2004 objected over the particular clause-14 and returned the bill to the government led by the then chief minister Narendra Modi, asking it to remove the clause. Later in 2008, the bill was passed after deleting the clause related to interception of communication, as per the suggestion of Kalam. However, President Pratibha Patil rejected it and had suggested some more amendments. One of them was to eliminate the provision which allows confession made before a police officer, be admitted in the court as evidence. However, ignoring the suggestion, the state government had once again passed the bill in 2009 for the third time and sent it for President’s approval. The bill is still pending with the President. As per the clause- 16, “A confession made by a person before a police officer not below the rank of SP.. shall be admissible in the trial of such accused, co-accused, abettor or conspirator for an offence under the provisions of this Act.” Rehearsal of British Aerobatics at Sabarmati River Front Sunvilla News, Ahmedabad The areas along Sabarmati River Front in Ahmedabad again witnessed rehearsal acts of Four British Aircraft that are in city to perform Aerobatics for general people. "Despite reservations from past presidents, no changes have been made. The government has just changed the nomenclature and the content remains same," Congress leader Shaktisinh Gohil said. The first version of the law was sent to the Centre in 2004, when Modi was the state chief minister. The Union government then headed by Atal Bihari Vajpayee had sent it back, asking for major changes. Later, the UPA government had also objected to the bill. Danish woman gang-rape case: Statements of prosecution witnesses recorded Agency : New Delhi A Delhi court Tuesday recorded the statements of two prosecution witnesses, including a hand writing expert, in a case in which a 52-year-old Danish woman was allegedly gangraped by eight persons here last year. Additional Sessions Judge Kaveri Baweja recorded the testimonies of AK Gupta, Director (documents) of Truth Labs in Delhi, and Delhi Police sub inspector and incharge of the crime team, Pankaj. During the proceedings, Gupta, who was earlier director incharge of Delhi Government's Forensic Science Laboratory, said on January 20 last year, certain documents were received at the Delhi office of Truth Labs sent by SHO of Paharganj Police Station and the case was assigned to him. He said the packet contained a book and an envelope of a book store. "After examining the writing on the book and the copy of complaint given by the woman (to the police) with the help of scientific aid and equipments, I gave my report. "After examining them I opined that writing .... Are of the same person," the handwriting expert said, adding that he had also given the reasons for his opinion. The court also recorded the deposition of sub inspector Pankaj who said on the intervening night of January 14-15, last year, he along with other police officials and a photographer had gone to the site of incident and inspected the place. DAYGujarat anti-terror Billis a replica of POTA....?The BJP government in Gujarat passed the contentiousGujarat Control of Terrorism and Organized Crime Bill(GCTOC) on March 31. Rejected on three earlier occasionsby two Presidents (President Kalam and President PratibhaPatil) for violating basic principles of justice, this bill is amodified version of the 2003 law that originated during Modi'sregime as chief minister. Before this issue degenerates intothe typical either/or debate: Either we protect our peoplefrom terror or we protect our most cherished principles letme state this unequivocally that this is a false choice. Here'swhy. It would be pertinent to note that in 2004, the centralgovernment headed by BJP's very own Bharat Ratna AtalBehari Vajpayee, had sought the return of the bill back toGujarat government, asking for 'major changes'. TheCongress-led UPA government later on, continued withposition taken by the previous NDA government and whenthe bill was passed this time around, in the Gujarat Assemblyyet again, the Congress abstained from voting. The BJP hasa majority in the Gujarat Assembly and hence the bill sailedthrough, notwithstanding the boycott by the opposition andthe larger questions on legality and constitutional propriety,that remain unaddressed! The bill in question has Modi'sfingerprints all over. Modi not only pioneered this law butpursued it as an article of faith and that saw Gujaratgovernment pass the law four times in 12 years- 2004, 2008,2009 and 2015! In all these instances, despite the reservationsexpressed by the President, the Gujarat governmentcontinued to push with provisions in the bill, that prima-facieseemed ultra vires the constitution and violative offundamental rights and civil liberties. The current bill is oldwine in new bottle and in many ways worse than POTA andTADA which had been repealed. The worrying provisionscontinue to remain in the bill. The bill seek to give police farreaching powers to make arbitrary arrests, presentconfessions in custody as evidence as per clause 16 whichis currently inadmissible as such and to even intercept phonecalls as per clause 14! The bill provides for extending theperiod of investigation from the stipulated 90 days to 180days. It makes offenses under the bill non-bailable. It alsogrants, vide section 25, immunity from legal action to thestate government and its officers against suits, proceedingsand prosecutions for anything they do in 'good faith inpursuance of the Act'. This bill will only alienate scores ofminorities who have in the past, as per hard data and records,been at the receiving end of illegalities of such bad laws. Itwill hurt the trust quotient and social cohesion in our societythat is essential to fight terrorism.While introducing this law,the Gujarat Home Minister said this bill was the "need of thehour" to fight terror especially with " Pakistan become theepicentre of world terror ". It betrays the sense of fear andcommunal politics that has driven the passage of this bill.Fighting terror cannot happen with laws that curb ourfreedoms and damage our own social fabric. We don't haveto settle for this bill, which is essentially a replica of "POTAwith saffron lipstick". We don't have to settle for a law thatsacrifices our liberties or our safety. We can have one thatsecures both. This one does neither.

From April 1, museum, zoo ticketsto turn cheaper, air travel costlier

Agency : NEW DELHIEntry tickets to museums,zoo and tiger reserveswould become cheaper,while business class airtravel, investment in MFsand chit funds wouldbecome expensive withsome of the service taxproposals announced in theBudget coming into effectfrom tomorrow. FinanceMinister Arun Jaitley hadcome out with a host ofproposals last month torationalise service tax,which is levied at aneffective rate of 12.36 percent. These also includeraising the rate to 14 percent, but that will come intoeffect from a date to benotified later by thegovernment after thepassage of the Finance Billby Parliament. However,the proposals which willcome into effect from April1, 2015, include taxexemption granted toservices like admission to a

museum, zoo, nationalpark, wild life sanctuary anda tiger reserve. Similarly, lifeinsurance scheme VarishthaPension Bima Yojna,ambulance service, retailpacking of fruits andvegetables, too will notattract service tax levy. Onthe other hand, air travel willbecome expensive asservice tax will now belevied on 60 per cent of thevalue of the ticket as against40 per cent now. “Atpresent, service tax ispayable on 40 per cent ofthe value of air transport ofpassenger for economy aswell as higher classes, forexample, business class.“The abatement for classesother than economy is beingreduced and service taxwould be payable on 60 percent of the value of suchhigher classes,” said thememorandum to theFinance Bill, adding that theproposal will come intoeffect from April 1, 2015.

Core sector growth slowsto 1.4 per cent in February

Agency : New DelhiGrowth in eight coreindustries slowed to 1.4 percent in February due tooutput decline in five sectorsincluding crude oil andnatural gas. Besides thesetwo, the other three sectorswhich posted negativegrowth are refineryproducts, fertiliser and steel.The output of eight coresector industries coal, crudeoil, natural gas, refineryproducts, fertilizer, steel,cement and electricityexpanded by 6.1 per centin February, 2014. Thegrowth was 1.8 per cent inJanuary 2015. The coresector contributes 38 percent to the overall industrial

production, a parameter thatthe Reserve Bank of India(RBI) takes into accountwhile framing its monetarypolicy. Production of crudeoil and natural gascontracted by 1.9 per centand 8.1 per centrespectively, according tothe data released by theCommerce and IndustryMinistry. However, coal,cement and electricityoutput grew by 11.6 percent, 2.7 per cent and 5.2per cent respectively. Duringthe April-February period of2014-15, the eight sectorsgrew by 3.8 per cent asagainst 4.2 per cent in thesame period of the previousfiscal.

Big Income Tax defaulters:11 of 18 are from Gujarat

Agency : New DelhiThe Income Tax departmentof India on Tuesday took tothe strategy of ‘naming andshaming’ of some large taxdefaulters as it publishednames of 18 entities whoowe over Rs 500 crore taxto the exchequer. “The stepis aimed to publicise and putthese names in publicdomain so that the commonman can come forward tohelp the department inknowing the whereabouts ofthese. The step is to enhancepublic awareness againstthese entities who are actingagainst law. These nameswere put up on thedepartment’s websiteearlier,” a senior I-T officersaid. Newspapers onTuesday carried the namesof the tax defaulters and thedata published was quotedto have been published bythe Principal Chief

Commissioner of IncomeTax (Administration) basedin the national capital here.Adopting an aggressiveapproach, government hadfor the first time gone publicwith names of 18 taxdefaulters, includingGoldsukh Trade and SomaniCements which, accordingto I-T, have turned wilfuldefaulters. In a bid to forcethese entities to pay theirdues, the Central Board ofDirect Taxes (CBDT) hadasked the I-T department topost on its website, fewdays back, the names of 18defaulters, of whom 11 arebased in the western Indianstate of Gujarat. “Defaultersare advised to pay taxarrears immediately,” saidthe notice. “This is the firsttime the department has putin public domain a list ofthose wilful tax defaulterswho have a tax liability of Rs

10 crore and above,” asenior tax official had said,adding that in many casesthe assessees were not“traceable”. “Thedepartment, in the publicnotice, has provided thePAN number and the lastknown address of thesedefaulters for the public toknow,” the official added.The official said periodicallythe department has beenproposing “naming andshaming” of wilful defaultersand the step has now beentaken on the last day of thecurrent financial year onTuesday. The companies inthe list include SomaniCement with tax arrears ofRs 27.47 crore, BlueInformation Technology (Rs75.11 cr), AppletechSolutions (Rs 27.07 cr),Jupiter Business (Rs 21.31cr) and Hirak Biotech (Rs18.54 cr).

The courtrecently concluded thatcriminal liability cannot befixed on the principal for thekid's death. The school,however, can be held liablein a civil suit. The courtadmitted that it was not easyto come to the conclusion.Justice J B Pardiwala wrote,"Dictating this judgment wasa very painfulexperience.The verythought of a four-year oldchild getting crushedbeneath the tyres of his ownschool bus makes my heartbleed with pain and agony .I can also imagine the painand agony the parents of thedeceased must beundergoing even today .""However, such thoughtsshould not allow the mind of

a judge to get bogged,otherwise justice cannot bedone. However, harsh onemay find the law, but at thesame time, law remains lawand it has got to berespected," said the order.Adit's grandfather hadlodged an FIR against thedriver, cleaner, bussupervisor and the schooladministrator - GirishPandya - who also heldprincipal's post for notrepairing the vehicle despitetheir request.They werebooked for rash driving andculpable homicide amountingto murder. The lower courtinitiated proceedings againstthem. Pandya unsuccessfullyfiled a discharge plea beforethe magisterial court. WhenPandya moved the HC lastyear, the court concludedthat the principal was notresponsible.
