THE UK has not had a serious oil spill since the Sea Em- press incident six years ago but the Maritime & Coast- guard Agency (MCA) came in for some criticism in a major report published this week. Among the key findings in a report called “Dealing with Pollution from Ships”, pub- lished by the National Audit Office (NAO), the MCA was told it should be able to demon- strate that the UK is meeting its commitments under inter- national counter-pollution conventions. This should be achieved by ensuring that all ports and harbours have plans in place to deal with a medium-size oil spill and have staff trained to be able to regularly test the plans. It was found that only about 40% of the 170 local coastal authorities have at- tended MCA training sessions and 53 authorities have con- tingency plans introduced be- tween five and 11 years ago. Despite a considerable sav- ing of around £1.7m by out- sourcing some of its services, further savings can be made by sharing surveillance air- craft and counter-pollution equipment with other regula- tory bodies or by signing con- tracts for its supply with com- mercial interests.The report also called on the MCA to re- view all the resources at its disposal, to assess its ability to cope with a major spill and in particular to be able to deal with more than one incident simultaneously. As part of its post-incident evaluation, records should be kept of how much pollution is prevented or how much of its potential damaging effects has been reduced. NAO also suggests that the MCA should work more closely with the relevant government department to bring the re- quirements of the interna- tional protocol on hazardous and noxious substances (HNS) into UK law.The MCA should also ensure that all major ports and harbours imple- ment measures as soon as possible to deal with any inci- dent involving HNS. The so-called “pay to be paid” type of insurance poli- cies are a major problem. Here the MCA is recommended to co-operate with the depart- ment and other maritime au- thorities to prohibit such in- surance.Wider recovery pow- ers should be investigated in the cases of “one-ship” com- panies, especially where there are sister concerns. The other major recom- mendation is that the Mer- chant Shipping legislation should be revised to ensure that pollution incidents may be prosecuted under the UK’s oil pollution laws wherever incidents occur within the UK Pollution Control Zone.(See also page 23.) Fifteen demonstrators at-tacked the German-owned,Swedish-chartered, Isle ofMan-flag 3,300-dwt generalcargoship Fagervik (built1980) when it arrived at Nor-rkoping, south of Stockholm,on 4 June.They accused theship of dumping about 1,000litres of oil in the Baltic last

year while sailing under thename of Figaros, despite aSwedish court acquittal of themaster and chief engineer.

Fagervik’s Norrkopingagent claims the demonstra-tors did not stop the loadingoperations and the vesselsailed for Vesteras on 7 June,returning to Norrkoping on 10June, when the activists struckagain. It sailed later that dayfor the UK.

At the time of the alleged oilspill, Figaros was chartered topaper group Sjowalls, whichwent bankrupt earlier thisyear.The Swedish Air Forcehad spotted an oil slick behindthe cargoship as it was sailingoff the Swedish coast on 13February 2001. Upon inspect-

ing the ship, the Swedish Na-tional Shipping Agency foundthat the oily-water separatorhad been bypassed eventhough it was functioning nor-mally. Figaros was detained inNorrkoping and oil samplestaken.

On 6 June, the Nykopingprosecutor handed a writ tothe Norrkoping Court accus-ing the master and chief engi-neer of deliberately dumpingthe oil.A fine of SEK10m ($1m)was demanded. Both the offi-cers denied the charge, sayingthat if any oil was spilled, ithad been unintentional.Theprosecution failed to prove itscase and the officers were ac-quitted.

Greenpeace also accuses

the present charterer Jon-ssonNova of operating fourships in the Baltic that havebeen detained by port-statecontrol authorities for variousreasons over the years.

As a result of the action,seven Greenpeace activistsare facing serious charges andtwo have been in prison forover a week.

The group claims that be-tween 1,000 and 2,000 oilspills occur in the Baltic annu-ally. Because of the Baltic’svery small tidal range and lit-tle or no current, concentra-tions of fossil hydrocarbonsare three times higher than inthe North Sea.

The IMO has classed theBaltic as a “Special Area”.

••• “Port-state control is a fact oflife,” pronounced Lloyd’s Register(LR)’s Alan Gavin at Posidonia. Atleast somebody’s got the message.He was explaining that LR was go-ing public on its port-state control(PSC) record.

Although many deficiencies arenot class related, this is a step in theright direction, which other soci-eties should follow. Only then willthe oft-quoted class-society claimof being top of the pile with a zeroPSC record be taken seriously.

One area being highlighted is“detentions related to ship flagstate”. This could prove to be quiterevealing. However, it must be re-

membered that many flags arespecifically targeted, meaning thatthe “blue chip” societies would nottouch them with a barge pole un-less their ships are managed by rep-utable concerns. LR is to present athree-month round-up at Septem-

ber’s Mare Forum meeting inAthens, which should make inter-esting listening.With flak flyingaround everywhere, often aimed atthe class societies, let us hope this isnot just a public relations exercise,nor just a piece of one-upmanship.

In February, it was held atVenice for 16 days.Althoughshown on the Equasis databaseas managed by a company call-ing itself Glyfada, it is stillthought to be connected withIlias Shipping, a company witha history of problems sur-rounding its rather elderlyfleet.

containership Alexandros T(built 1988) was released fromdetention at Hamburg after an11-day sojourn.

The 450,000-cbf veteranreefer Deneb Reefer (formerlyOceano Atlantico,built 1974)classed in Cuba, was releasedfrom St Petersburg on 17 Mayfollowing a 19-day detention.

One company regularly ap-pearing on port-state control(PSC) lists is Haugesund, Nor-way-based Alendal Rederi.

Alendal’s elderly 34,000-dwtchemical tanker Stripe (built1974) was released at Genoalast month after 43 days of de-tention.

PSC inspectors found 25 defi-ciencies before the ship was al-lowed to sail for India. Stripepassed through the Suez Canalon 23 May.

At Antwerp, a 24-year-old

bulker was released after 43days in the “sin bin” with 33 de-fects logged against it.The16,000-dwt Pigassos (built1978) was released on 16 Mayand sailed over a week later forLuanda.

Tankerska’s 22,700-bulkerNovigrad (built 1978) wasstopped at Rotterdam for 11days before sailing on 25 May.The Croatian vessel had alsoupset the inspectors at Chesa-peake (Virginia) in June 2001for 21 days.

An unusual entrant into thePSC bad books in May was P&ONedlloyd.The liner operator’s4,158-teu containership France(built 1996) was stuck at Naplesfor five days because, amongother things, it was was operat-ing in contravention of the SMSby lacking training and instruc-tion manuals.

Life-savingdeficienciesTWO LUXURY cruise vesselsand a modern ropax fell foul ofport-state control last month.Worryingly, both cruiseshipswere stopped with life-savingproblems.

Royal Caribbean’s 69,000-gtSplendour of the Seas (built1996) was held at Naples for aday as inspectors found faultswith its life-saving equipment.The ship is currently cruisingaround the western Mediter-ranean.

Also stopped at Naples for aday was Airtours’ 38,000-gtSunbird (built 1982).The Ital-ian authorities cited it too forproblems with its life-savinggear.

Non-closing watertight doorscaused a DFDS luxury ferry, the35,500-gt Crown of Scandi-navia (built 1994) to be haltedat Oslo. In Helsingborg it waslater given a clean bill of health.

Class acts onMSC boxship A 30-YEAR-OLD container-ship has had a condition ofclass slapped on it due tostructural defects.

Mediterranean Shipping’s1,838-teu MSC Pamela (built1972) was stopped by port-state control inspectors atFremantle last month with aholed hatch coaming andcover.A ClassNK surveyor at-tended the ship and moni-tored temporary repairs. Heissued a condition of class,stating that permanent re-pairs must be carried out by15 July. MSC Pamela joinedMSC’s fleet in 1996. It wasbuilt at Yokohama for NYK,entering service as the Ki-tano Maru, one of Japan’soriginal third-generationcontainerships.

Elsewhere,Yang Ming’s66,800-dwt panamax bulkerMing Courage (built 1984)was grabbed at Newcastle(NSW) while loading coal. In-spectors found Marpol-typeequipment problems, withoily-water separator, oil-con-tent meter and a non-func-tioning bilge pump.

Taiwan class society ChinaCorp Register of Shippingwas called and issued a tem-porary IOPP certificate de-manding the meter and sepa-rator be repaired when theship returns to Taiwan.
