ES 1.1 Project Description Summary The Environmental Compliance Certificate (ECC) being applied for involves the Construction Phase which is the creation of 286.86 hectare of reclaimed land in the waters of Manila Bay within the jurisdiction of the City and the horizontal developments on the reclaimed land. The Operations Phase involving vertical developments and activities of the locators will be undertaken after the full stabilization of the reclaimed land, The Operations Phase - will be governed separately by the applicable requirements of the Philippine EIS System (PEISS). The proposed project will occupy an area of 286.86 hectares of reclaimed land and will be located within the coast of Manila Bay in the territorial jurisdiction of the City of Paranaque. The site is approximately situated at a distance of 2.94 kilometer from the nearest corner of the reclamation layout to the nearest shoreline of Manila Bay.

ES 2.0 Process Documentation of the Conduct of EIA The EIA Report for this Proposed Reclamation Project has been prepared in compliance with the basic principle of the Philippine EIS System (PEISS), i.e. that an EIA/ECC is a planning tool and not a permit, substantiated hereunder.

c. Moreover, the details of a project are established post-ECC, as stipulated in page 10 of the Revised Procedural Manual, quoted verbatim below: iii) During the project’s Detailed Engineering Design (DED) stage, which is post-ECC, the generic

measures identified during the EIA study at the FS stage will now be detailed based on the project facility design and operational specifications. Additional baseline monitoring may also be required prior to construction or implementation of the project to provide a more substantive basis for defining the environmental management and monitoring plans.

The paradigm that an ECC is a planning tool is invoked. Under this prior to project implementation - which can only commence upon securing of a Notice to Proceed from the Philippine Reclamation Authority - several clearances have to be secured which require an ECC as input for decision making by various agencies in granting these clearances. This is reflected in Figure 3.1 and also shown below as Figure ES-2.

The Public Scoping Process as stipulated in DAO 2017-15. This DAO on Public Participation is faithfully complied with.

The Technical Screening Guidelines (Annex 1) are complied with.

ES 2.1 Document Types for ECC Application and Generic Contents

Following are the current guidelines under EMB MC 2014-05, otherwise known as:

Based on Table ES-2, an Environmental Impact Statement (EIS) Report is the appropriate document. A Programmatic EIS type of report invoked in several public meetings is not appropriate because the activities involved are only dredging; reclamation and horizontal works which are short term in duration and the responsibility for these rests on one entity only, i.e. the Project Proponent and its private sector partner/project developer. During the operations phase a Programmatic EIS may be applicable because of several types of activities involved and of the participation of various locators.

The composition of the EIA Team with compliance with EMB MC 2011-005 is shown in Table ES-3. Resource Persons/Expert Companies were also engaged and are also listed hereunder.

ES 2.5 Public Participation Activities

1. Information, Education and Communication (IEC) Activity

IEC AND FGD WITH THE CONCERNED STAKEHOLDERS IEC activities were conducted with the concerned stakeholders on 20 February 2018 at San Dionisio Sports Gymnasium and 16 July 2018 at Parañaque City Hall. Among these invited were LGU Officials, Government Offices, Non-Government Organizations (NGO) / People’s Organization (PO), Private Offices and Impact Barangays. The Environmental Impact Assessment (EIA) Preparer discussed the proposed project and the initial perceived environmental issues. The location of the identified lift nets and mussel farms was also presented. Moreover, the other participants appreciated the IEC as the chance to raise issues and feedback. The presentation gave background and understanding on the proposed project as well as the potential impacts that could arise. Provided below are the top key issues raised during the IEC and FGD conducted. Key Issues and Concerns raised during IEC and FGD conducted:

2. Public Scoping

The Public Scoping conducted on 27 February 2019 at Barangay San Dionisio Sports Complex, Paranaque City and was attended by participants from different sectors. The concerned stakeholders, especially those known to have opposing on reclamation projects, as well as those located in the Impact Areas were invited to participate. Among those invited were LGU Officials, Government Offices, Non-Government Organizations (NGO) / People’s Organization (PO), and others. On the other hand, there were also participants that are not included in the official list of invitees but attended the said scoping. The Summary of Participants during the Public Scoping is provided in Annex 3. Summary of Issues and Concerns Raised during Public Scoping Activity The objective of the conducted Public Scoping Activity and other continuing IEC to be conducted is to ensure that the Environmental Impact Assessment (EIA) will address the relevant issues and concerns

Territorial Jurisdiction

Must not be in or conflict with ECAs or Protected Areas as declared in the NIPAS, principally the LPP Wetland Park and mangrove communities

The site should be legally within the juridical jurisdiction of the LGU-Proponent, which for this project is Parañaque City. Conflict on jurisdiction with other LGUs should be avoided.

The site should not be populated with mangroves.

It should not be in conflict with Presidential Proclamations e.g. Presidential Proclamation 141. On Technology Selection Technology is primarily based on proven option and experience of dredging/reclamation contractor and also considers:

The proposed project is perceived to have potential disturbance to existing sedimentation/erosional processes in the adjacent areas of the bay, including the LPPCHEA area. Change in morphology including changes in shoreline alignment and bottom topography can cause wave transformation from deep water to nearshore that could in turn cause deposition in one area and erosion in another. the project and its environs. Factors to consider include prevailing longshore currents, tidal currents, morphology, sedimentation patterns, wave behavior, longshore sediment transport rates, etc. In addition, the proposed reclamation project will be vulnerable to a number of geological hazards such as ground shaking, subsidence, settlement, tsunami, liquefaction, storm surge, and flooding. In general, these hazards pose risks to the project, and not the other way around. These factors are carefully being studied and considered in the Detailed Engineering Design phase (post-ECC) of the project to ensure safety and protection of property, lives and the environment. The major impacts on the water environment are sediment fluxes and re-suspension of silt, effects on fisheries, oil and grease contamination, impact on plankton community and increase in domestic wastewater around the reclamation site. These effects can be mitigated through the installation of appropriate pollution control devices. For the air environment, the impacts are temporary and minimal. These include noise and potential pollutants from emissions of power-generating equipment. During the operation phase, there may be perceptions on increase in vehicle emissions. However, by the time the project is fully developed and full of locator, For the people module, the main impact would be the displacement of liftnets and mussel farms during the pre-construction phase. This can be mitigated in consultation with the Bureau of Fisheries and Aquatic Resources (BFAR), the Local Municipal Agriculture Office and the affected fishermen, the transfer of all lift nets (sapra) and mussel farms to a more suitable site outside of the proposed reclamation area will be implemented, factoring in all necessary costs for re-starting operation and foregone production, if any. Risks and uncertainties relating to the findings and implications for decision making The risks and uncertainties considered relevant are those related to natural hazards; e.g. earthquakes, liquefaction, strong typhoons, storm surges and floods. These are discussed in Section 1 and summarized in Table ES-7.
