Section 106 Consulting PartiesSection 106 of the National Historic Preservation Act requires Federal agencies to consider the effects of their actions on historic properties that are listed or eligible for listing in the National Register of Historic Places. By working closely with the New York State Historic Preservation Office, the FHWA identifies consulting parties to participate in the Section 106 process.
Certain individuals or organizations with a demonstrated interest in the project may qualify for Consulting Party status based on a legal or economic relationship with the project or concern about the project’s effects on historic properties.

Welcome The New York State Department of Transportation (NYSDOT), along with the Federal Highway Administration (FHWA), thank you for attending this Scoping Meeting for the NYS Route 5 (Buffalo Skyway) Project.
Today’s Scoping Meeting FormatToday’s meeting is in an Open House format. The stations throughout the room provide a project description, describe the environmental review process, and identify opportunities for public involvement. Members of the project team are available at each station to answer questions, and a pre-recorded video presentation is available for viewing.

If you are approved as a consulting party, you will be invited to attend a meeting to discuss the potential effects that the project may have on historic resources and potential measures to avoid, minimize, or mitigate any adverse effects.

PROJECT NEEDSThe Buffalo Skyway/NYS Route 5 interchanges, approaches, and infrastructure extend approximately 3.5 miles from Tifft Street to Church Street. Over the past few decades, this area has undergone a substantial change in land use with a focus on recreational, mixed-use, and waterfront development. The needs for the project are as follows:
• Remove the Buffalo Skyway structure and elevated approaches between Tifft Street and Church Street to accommodate existing and planned recreational, mixed-use, and waterfront development and support waterfront economic development initiatives;
• Improve the transportation network to safely and efficiently accommodate the traffic currently carried by the Buffalo Skyway structure and approaches;
• Address the safety, operational, and capacity deficiencies of the highway connections that serve economic development areas and local communities within South Buffalo;
• Reduce commercial vehicular traffic traveling on local residential streets near the RiverBend site; and• Improve bicycle and pedestrian connections along the Tifft Street Corridor.
PROJECT PURPOSEThe purpose of the project is to realign the existing transportation network to support existing and planned recreational, mixed-use, and waterfront development in the Buffalo Outer Harbor and Inner Harbor areas. The project will also address the safety, operational, and capacity deficiencies of the highway connections that serve economic development areas and local communities within South Buffalo.
GENERAL PROJECT STUDY AREA
ENVIRONMENTAL REVIEW PROCESSScoping is an early and open process for determining the scope of issues to be addressed and for identifying the significant issues related to a proposed action. The Scoping Meetings are the first opportunities for the NYSDOT and FHWA to engage the public under the National Environmental Policy Act (NEPA) Environmental Impact Statement (EIS) process. The NYSDOT is seeking input and comments from the public and agencies on the issues of concern, potential impacts, and concepts under consideration.
A 30-day public comment period will follow the Scoping Meetings. The FHWA and NYSDOT will consider the comments received and identify the alternatives that will be advanced for further study in the Draft EIS. These alternatives, as well as the comments received and responses to substantive comments, will be documented in a Project Scoping Report.
The Draft EIS will document the potential social, economic, and environmental effects of implementing the project. The DraftEIS will be available for a 45-day public comment period,during which a public hearing will be held. The FHWA and NYSDOT will consider the comments received and identify a selected alternative.
The selected alternative will be documented in the Final EIS and Record of Decision for the project. The Record of Decision will conclude the EIS process.
