44 The Public Body indicated in the Bid +ata ,heet (B+,# is the Contracting 'uthority for this

procurement process and it is bound by the rules go&erning public procurement in the .ederal+emocratic 0epublic of -thiopia *t has the powers and duties to conclude a Contract for the

pro&ision of "orks 'ccordingly$ this procurement process is being conducted in accordance

with the recent editions of the -thiopian .ederal 2o&ernment Procurement and Property'dministration Proclamation and Public Procurement +irecti&e under the procurement method

indicated in the B+,

45 By the issue of this Bidding +ocuments the Public Body in&ites interested Candidates to submit

64 The 2o&ernment of the .ederal +emocratic 0epublic of -thiopia (herein after called the

2o&ernment# represented by the Public Procurement and Property 'dministration 'gency

(herein after called the 'gency# re1uires Contracting 'uthorities$ as well as Bidders to obser&e

the highest standards of ethics during the procurement and the execution of contracts *n pursuance of this policy$ the 2o&ernment:

(a# +efines$ for the purposes of this pro&ision$ the terms set forth below as follows:

(i# FCorrupt practiceG is the offering$ gi&ing$ recei&ing or soliciting$ directly or

indirectly$ of any thing of &alue to influence improperly the action of a public

official in the procurement process or in contract execution

(ii# F.raudulent practiceG is any act or omission$ including misrepresentation$ that

knowingly or recklessly misleads$ or attempts to mislead$ a party to obtain

financial or other benefit or to a&oid an obligation

(iii# FCollusi&e practicesG is a scheme or arrangement between two or more parties$

official or procurement staff of the Public Body to influence the result of the Bid in his fa&or

shall be dis1ualified from the Bid$ prohibited from participating in any future public procurement and the bid security deposited by them shall be forfeited

67 Bidders are re1uired to indicate their acceptance of the pro&isions on fraud and corruption$ as

defined in this clause through the statement in the Bid ,ubmission ,heet

writing to any re1uest for clarification$ pro&ided that such re1uest is recei&ed no later than ten(4# days prior to the deadline for submission of Bids The Public Body shall forward copies of

its response to all Bidders who ha&e recei&ed the Bidding +ocuments directly from it$ including

a description of the in1uiry but without reference to the identity of the prospecti&e Bidder

the "orks included in this Bidding +ocuments in addition to its other ongoing proDects

been expressly so authoriIed in writing by the members of the Doint &enture or consortium$ and

the authoriIing contract$ notarial act or deed must be submitted to the Public Body 'll

signatures to the authoriIing instrument must be certified in accordance with the national laws

and regulations of each party comprising the Doint &enture or consortium together with the

powers of attorney establishing$ in writing$ that the signatories to the Bid are empowered to

enter into commitments on behalf of the members of the Doint &enture or consortium -ach

member of such Doint &enture or consortium must pro&e to the satisfaction of the Public Body

that they comply with the necessary legal$ professional$ technical and financial re1uirementsand ha&e the wherewithal to carry out the contract effecti&ely

@4 )nless otherwise indicated in the B+,$ alternati&e Bids shall not be considered

@5 *f permitted in B+,$ the Public Body may consider alternati&e technical solutions prior to the

notification of the successful Bidder pro&ided that the Bidder:

(a# Has submitted Bid in accordance with the Bidding +ocument as issued and

(b# Has submitted Bid based on alternati&e(s# to the Bidding +ocument as issued

(c# Has included with the Bid a demonstration of the ad&antages of the alternati&e technical

solution o&er the initial solution$ including a 1uantifiable Dustification of any economic

andor technical ad&antages and(d# Has included with the Bid sufficient descripti&e information for a complete e&aluation of

the proposed alternati&e technical solution by the Public Body$ including calculations$

technical specifications$ breakdown of prices$ proposed work methods and other rele&ant

details

@6 nly the technical alternati&e(s#$ if any$ of the lowest e&aluated Bidder conforming to the basic

technical re1uirements shall be considered by the Public Body

@7 *n e&aluating a Bid containing an alternati&e technical solution the Public Body may use any

e&aluationaward criteria as indicated in the B+, and ,ection 6$ -&aluation !ethodology and

Criteria

@8 'lternati&e Bids not re1uested by the Public Body shall be reDected10$ Period of 2alidit of Bids

48 ' Bidder not agreeing to extend the &alidity period of hisits bid security shall be treated as a

Bidder refusing the Public Body%s re1uest for extension of Bid &alidity period$ and as such$

shall be dis1ualified from further bid proceeding

11$ Bid Securit

444 )nless otherwise specified in the B+,$ the Bidder shall furnish as part of its Bid$ a bid securityin original form and in the amount and currency specified in the B+, ' copy of bid security$ if

submitted without original form$ shall not be accepted

445 The bid security shall be$ at the Bidder%s option$ in any of the following forms:

(a# 'n unconditional Bank 2uarantee

(b# 'n irre&ocable >etter of Credit

(c# Cash$ check certified by a reputable bank or financial institution$ or payable order

1!$ Format and Signing of Bid

464 The Bidder shall prepare one original of the documents comprising the bid as described in *TB

Clause 55 and clearly mark it F0*2*N'>G 'lternati&e bids$ if permitted in accordance with

*TB 4@$ shall be clearly marked '>T-0N'T*/- *n addition$ the Bidder shall submit copies of

the bid$ in the number specified in the B+, and clearly mark each of them FCPLG *n the

e&ent of any discrepancy between the original and the copies$ the original shall pre&ail *f

re1uired in B+,$ Bidders shall be re1uired to submit bid documents in two en&elopes

containing the technical and financial proposals separately465 The original and all copies of the bid shall be typed or written in indelible ink and shall be

signed by a person duly authoriIed to sign on behalf of the Bidder This authoriIation shall

consist of a written statement by a power of attorney (or notary statement$ etc# pro&ing that the

person$ who signed the bid on behalf of the companyDoint &entureconsortium is duly

authoriIed to do so and it shall be attached to the bid The name and position held by each

person signing the authoriIation must be typed or printed below the signature 'll pages of the

bid$ except for nonG and FCPLG These en&elopes containing the original and thecopies shall then be enclosed in one single en&elope

2$ Deadline for Submission of Bids

54 Bidders may always submit their bids by registered post or by hand Bids must be recei&ed by

the Public Body at the address and no later than the date and time indicated in the B+,

55 The Public Body may$ at its discretion$ extend the deadline for the submission of Bids by

amending the Bidding +ocuments in accordance with *TB Clause @$ in which case all rights andobligations of the Public Body and Bidders pre&iously subDect to the deadline shall thereafter be

subDect to the deadline as extended

!$ 8ate Bids

64 The Public Body shall not consider any Bid that arri&es after the deadline for submission of

Bids$ in accordance with *TB Clause 58 'ny Bid recei&ed by the Public Body after the

deadline for submission of Bids shall be declared late$ reDected$ and returned unopened to theBidder

,$ Wit!dra0al- Substitution- and 5odification of Bids

74 ' Bidder may withdraw$ substitute$ or modify its Bid after it has been submitted by sending a

(b# *f rectified would unfairly affect the competiti&e position of other Bidders presenting

substantially responsi&e Bid

66 *f a Bid is not substantially responsi&e to the salient re1uirements of the Bidding +ocuments it

shall be reDected by the Public Body and may not subse1uently be made responsi&e by the

Bidder by correction of the material de&iation$ reser&ation$ or omission

67 +ecisions to the effect that a bid is not substantially responsi&e t must be duly Dustified in thee&aluation minutes

68 *f only one Bid meets all salient re1uirements of the Bidding +ocuments and is not otherwise

dis1ualified$ the Public Body may still complete the full e&aluation of that Bid and sign contract

with that Bidder if the Bid submitted by such Bidder is satisfactory to the Public Body and the

price offered by the Bidder is comparable to or less than the market price of the re1uired obDect

of procurement

85 The Public Body shall correct the detected errors in calculation and notify the Bidder in writing

of the corrections made without any delay$ re1uesting the Bidder to confirm that he accepts the

44 *t is a general principle throughout this ,pecification that the payment for each work item

is inclusi&e of all operations$ resources and inputs necessary to complete the work *tem

The cost of operations or works not included in the ,pecifications or the Bill of 9uantities$

but are all necessary for the completion of the "orks$ shall be deemed to included withinother items

number of times or not at all and in any 1uantity during the currency of the Contract4; "here the ,chedule of 0ates includes separate pay items depending on work 1uantity$ this
