Upon call of the roll, the following Committee members were recorded present: Committeeman Doug Tomson, Committeeman Robert Wagner, Committeeman Frank DelCore, Deputy Mayor Gloria McCauley and Mayor Carl Suraci. Also, in attendance were Township Attorney Albert E. Cruz, Township Administrator / Acting Clerk Mike Merdinger and Assistant to Administrator Dianne Borngesser. SALUTE TO THE FLAG Following roll call, Mayor Suraci advised that notice of this meeting was made in accordance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975, by posting on the bulletin board at the Hillsborough Township Municipal Complex and notifying the officially designated newspapers that this meeting would take place at the Hillsborough Township Municipal Complex at 7:30 p.m. on April 24, 2012. APPROVAL OF MINUTES Approval of the March 13, 2012 Regular Meeting Minutes Upon motion by Deputy Mayor McCauley, seconded by Committeeman Wagner, the minutes of the March 13, 2012 Regular Meeting was approved upon the call of the roll. Committeeman DelCore thanked a long list of people who were involved in making the program happen at the high school, including area businesses, various emergency first responders, high school staff, and especially the high school students who played parts in the reenactment. Committeeman Tomson Committeeman Tomson announced that Dena Centofanti, Dana Boguszewski, and Lorraine Soisson have all been elected to a three year term for the Hillsborough Board of Education. Committeeman Tomson added that Thomas Kinst will serve as President of the Board and Judith Haas will serve as Vice President.

Minutes of the Regular Meeting of the Township Committee of the Township of Hillsborough, in

the County of Somerset, State of New Jersey, held in the Municipal Complex at 7:30 p.m. on the above

date.

Upon call of the roll, the following Committee members were recorded present: Committeeman

Doug Tomson, Committeeman Robert Wagner, Committeeman Frank DelCore, Deputy Mayor Gloria

McCauley and Mayor Carl Suraci. Also, in attendance were Township Attorney Albert E. Cruz,

Township Administrator / Acting Clerk Mike Merdinger and Assistant to Administrator Dianne

Borngesser.

SALUTE TO THE FLAG

Following roll call, Mayor Suraci advised that notice of this meeting was made in accordance

with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975, by posting on the bulletin

board at the Hillsborough Township Municipal Complex and notifying the officially designated

newspapers that this meeting would take place at the Hillsborough Township Municipal Complex at

7:30 p.m. on April 24, 2012.

APPROVAL OF MINUTES

• Approval of the March 13, 2012 Regular Meeting Minutes

Upon motion by Deputy Mayor McCauley, seconded by Committeeman Wagner, the minutes of

the March 13, 2012 Regular Meeting was approved upon the call of the roll.

Committeeman DelCore

Committeeman DelCore announced that the next Economic Business Development Commission

(EBDC) Social will be held on Wednesday, May 16th at the Roycebrook Golf Club and if any area

business owners would like to attend they may register on the township website or by calling Gene

Strupinsky, the Business Advocate, or the Administration office.

Committeeman DelCore also spoke about the program called “Every 15 Minutes” which was

held at the Hillsborough High School the previous week.

Committeeman DelCore explained that the program is a 2-day event which simulates what

happens when there is a drunk driving accident including a simulated crash, a video that shows the

courtroom hearing of the drunk driver and an assembly where senior students who played the role of

people killed in the accident share letters that they and their parents wrote in response to the event.

Committeeman DelCore stated that the program was started in Hillsborough last year by Regina

Santangelo as a Girl Scout Gold Project and stated that he hopes it will continue in the township.

Committeeman DelCore thanked a long list of people who were involved in making the program

happen at the high school, including area businesses, various emergency first responders, high school

staff, and especially the high school students who played parts in the reenactment.

Committeeman Tomson

Committeeman Tomson announced that Dena Centofanti, Dana Boguszewski, and Lorraine

Soisson have all been elected to a three year term for the Hillsborough Board of Education.

Committeeman Tomson added that Thomas Kinst will serve as President of the Board and Judith

Haas will serve as Vice President.

Committeeman Tomson congratulated the Hillsborough High School RoboRaiders team for

winning their competition the previous weekend which now qualifies them for the national competition

in St. Louis.

Committeeman Tomson wished the RoboRaiders continued success and congratulated them on

all of their successes.

Committeeman Wagner

Committeeman Wagner announced that the Hillsborough Police Department will host

Operation Take Back on Saturday, April 28, 2012 at the Hillsborough Police Department, located at

379 South Branch Road.

Committeeman Wagner added that this is an opportunity to dispose of your unwanted and

unused prescription drugs in a safe manner and the collection will be held between 10am and 2pm

this Saturday, April 28th here at the Police Department.

Committeeman Wagner advised residents to check out the Township website for more

information on the FREE rabies clinics available to Hillsborough residents.

Committeeman Wagner stated that the next one is May 5th at the Bradley Gardens Firehouse

- Dogs only 10-11am and Cats only from 11am – noon.

Committeeman Wagner added that the Spring Recreation Brochure including the summer

camp program is available online on the Township website.

Committeeman Wagner reminded all of township Veterans – Hillsborough’s Salute to

Veterans Breakfast will be on Saturday, May 26th.

Deputy Mayor McCauley

Deputy Mayor McCauley reiterated Committeeman DelCore’s comments regarding the “Every

15 minutes” program and thanked all who were involved in making the event happen.

Deputy Mayor McCauley congratulated the RoboRaiders on their win and acknowledged Miss

Betsy Skeele for receiving a top honor of being named as a finalist in the FIRST Dean’s list.

Deputy Mayor McCauley stated that Community Clean Up day was held here in Hillsborough

on April 15th and over 40 bags of trash was collected along Hillsborough roads by 53 residents including

the township committee members.

Deputy Mayor McCauley thanked Buck Sixt, the township’s Public Works department head, for

applying and acquiring for the township the Clean Communities Grant which is used for some of the

part time summer work and used for this event to do clean up in the community.

Deputy Mayor McCauley thanked everyone that came out and helped with the clean up and told

residents to look for the event again next year.

Mayor Suraci

Mayor Suraci offered condolences to Lt Gov. Kim Guadagno and her family as they mourn

the death of the Lt Governor’s father, Mr. Charles McFadden, Jr. who passed away the previous

day after battling cancer.

Mayor Suraci announced that Homestead Road is now closed for bridge work over the CXS

Railroad and that this detour is anticipated to be for several months.

Mayor Suraci also announced that Amwell Road between East Mountain and Zion Road is

being paved during the overnight hours.

Mayor Suraci thanked the Hillsborough Baseball League for inviting him to their opening

day ceremonies the previous Saturday.

Mayor Suraci wished all the participating teams much success in the season.

Mayor Suraci stated that this Saturday, April 28th is Healthy Kids Day at the Hillsborough

YMCA.

Mayor Suraci said this is a free community event that is designed to help families find fun

through activity and educational opportunities to improve overall health and well-being.

Mayor Suraci encouraged residents to stop by the YMCA, located at 19 East Mountain Road for

this family event.

PROCLAMATIONS / PRESENTATIONS / APPOINTMENTS

• Proclamation declaring April 28, 2012 as YMCA Healthy Kid’s Day

WHEREAS, the mission of the YMCA is to build strong kids, strong families and strong

communities through programs that focus on developing healthy mind, body and spirit; and

WHEREAS, as a community, we must work together to ensure the health and safety of all our

children; and

WHEREAS, parents must be ever mindful that they are role models for their sons and daughters,

and all children need to be taught healthy eating and exercise habits if they are to grow into strong,

healthy adults; and

WHEREAS, the Hillsborough Family YMCA is dedicated to providing programs and services to children

and adults throughout Hillsborough Township; and

WHEREAS, community-based programs are vital to helping alleviate the epidemic of childhood obesity and

physical inactivity, particularly among young people; and

WHEREAS, on April 28, 2012, the Hillsborough Family YMCA will sponsor the YMCA Healthy Kid’s Day

to help our youth become healthier.

NOW, THEREFORE, BE IT PROCLAIMED that we, the members of the Hillsborough Township

Committee, do hereby proclaim April 28, 2012 as YMCA Healthy Kids Day in Hillsborough, New Jersey and

encourage all residents to support the efforts of the Hillsborough Family YMCA to promote healthy living in

our community.

• Proclamation declaring April as National Multiple Birth Awareness Month

WHEREAS, since the 1980s, the rate at which mothers are giving birth to multiple children during

the same pregnancy has doubled. The occurrence of multiple births poses special challenges,

highlighting the need to educate expecting mothers on the issues related to multiple births; and

WHEREAS, multiple births can come in the form of twins, triplets, quadruplets, and so on. In 2009, the

twin birth rate was 33.2 per 1,000, with 137,217 live births, rising 76 percent between 1980 and 2009.

The 2009 triplet birth rate was 153.5 per 100,000, rising more than 400 percent since 1980; and

WHEREAS, the Raritan Valley Mothers of Multiples, a local chapter of the National Organization of

Mothers of Twins Club, Inc., is dedicated to providing education and support to expecting mothers of

multiples and families who have already given birth to multiple children; and

WHEREAS, the Raritan Valley Mothers of Multiples organization targets its efforts at making parents

of multiples aware of the issues they may face, including high-risk pregnancy, pre-term labor, fetal issues,

and important tips during the pregnancy; and

WHEREAS, April is recognized as National Multiple Birth Awareness Month to give mothers who have

given birth to multiple children, and their families, a chance to celebrate the joy of child birth while

spreading awareness about this issue; and

WHEREAS, the Township of Hillsborough is proud of the partnerships that exist with local

organizations who dedicate their efforts to supporting families in our community by sharing life

experiences and important, health-conscious information.

NOW, THEREFORE, BE IT PROCLAIMED, that we, the Mayor and Township Committee, of the

Township of Hillsborough hereby declare April as National Multiple Birth Awareness Month and urge

all citizens to join us in recognizing those organizations that are committed to educating expecting

mothers about the challenges of multiple births while celebrating the joy of new life.

Committeeman Tomson, a father of twins, was invited down with members of the Moms of

Multiples to receive the proclamation.

One of the members of the group mentioned that they will be holding an educational

outreach program the following night at St. Peter’s from 7 – 9 pm for all new or expectant

parents of multiples.

• Presentation by the Credit Card Advisory Committee

Mayor Suraci stated that the Credit Card Rewards program is a wonderful opportunity here

in Hillsborough for residents and businesses to give back to the community through their normal

purchasing activity.

Mayor Suraci asked Ms. Toni Natale, chair of the Credit Card Advisory Committee, to come

forward and give a presentation regarding the Credit Card program and grant recipients.

Ms. Natale spoke about of how the credit card grant program has grown as proven by the

large group of grant recipients in attendance at this meeting.

Ms. Natale asked residents who are not currently enrolled in the Affinity Credit Card

program to consider enrolling as a way to help give additional grant money to local senior/youth

programs.

Mayor Suraci and Ms. Natale invited up the following groups that are receiving grants

through the program:

• Pack 1776 – Boy Scout, Nicholas Tabereno thanked the Mayor, the Township

Committee, and the Affinity Credit Card Committee for the grant money which will be

used to purchase tents for the many trips they go on.

• Cub Scout Troop 1776 – Cubmaster, Alan Ramono, thanked the committee and said the

grant money will be used for camping gear including stoves, lanterns, tents, etc.

• Woodfern HSA – Tammy Hammer, HSA President, stated that they will use the money

to purchase cameras to be used for many purposes.

• Resource Center of Somerset – thanked the Hillsborough community for their constant

support for fundraising.

• Hillsborough YMCA said they are very grateful for the grant which will be used for

expanding the program for seniors especially their senior aquatic program.

• Hillsborough Heat Youth Baseball – a team representative explained that their program

is down to two teams since it is a privately funded program by the parents and thanked

the Affinity program for their help in financial support.

• Hillsborough Senior Rockettes and Rocket dance group stated that they are a group of

25 women and one man that dance at local nursing home, senior centers, etc. They

thanked the program for the support to be able to purchase additional costumes.

• Hillsborough Senior B group – Nancy Bertin, group president, said that they will use the

grant money to purchase storage bins to store their items between meetings

Deputy Mayor McCauley said she is very proud of the Credit Card Committee for their time

and work in processing the grants and stressed how the program has grown.

Mayor Suraci thanked the Affinity Credit Union for offering this program to the township.

NEW BUSINESS

• None at this time

PUBLIC COMMENT ON NEW BUSINESS AND MATTERS NOT ON THE AGENDA

Mr. Richard Underok, 921 Lewis Street Manville and Councilman in Manville Township,

addressed the Township Committee regarding concerns in Manville with flooding issues and the

concern about newly approved developments on Falcon Road and Valley Road.

Mayor Suraci explained that the two developments that Mr. Underok mentioned were COAH

obligations and could be addressed at the State level also.

Mayor Surcai stated that one development was court mandated and one is to meet COAH

obligations.

Mayor Suraci also mentioned the Raritan Millstone Flood Control Commission which

Hillsborough is a member of and was established to represent the surrounding areas affect by floods.

Mr. Michael Merdinger, the township Administrator and Acting Clerk, stated that he attends the

commission meetings and they are working on trying to move the process of the Army Corp of

Engineers along but it does take time.

Mr. Merdinger stated that the commission was started by Manville’s Mayor so Mr. Underok

could also speak to the Manville Mayor.

Mr. Underok came to the microphone again and addressed a concern regarding an intersection at

West Camplain Rd and Sunnymead Rd. He said the stop sign is obstructed by telephone poles and trees

and asked if it could be looked into for public safety reasons.

Mayor Suraci asked Police Chief Kaminsky who was in attendance to follow up on that issue and

Chief Kaminsky agreed.

PUBLIC HEARINGS

Ordinance 2012-15 An Ordinance to amend, revise and supplement the Township Code of the

Township of Hillsborough, Chapter 188, “Land Use and Development”,

most notably Section 188-66, entitled “Nonconforming Uses, Structures or

Lots.”

WHEREAS, the Township Committee wishes to amend Chapter 188 of the Township Code,

entitled “Land Use and Development”, most notably Section 188-66, entitled “Nonconforming

Uses, Structures or Lots”.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey that the Township Code of the Township of

Hillsborough, most notably Chapter 188 of the Township Code, entitled “Land Use and

Development”, Section 188-66(D)(3) of the Township Code, entitled “Nonconforming Uses,

Structures or Lots” is hereby amended, revised and supplemented as follows:

“(D)(3) Excepting the Mountain Zone (MZ) District, an existing single-family residence that

was built under court mandated standards may have additions to the principal building

and/or accessory structures, paved driveways and patios constructed on the lot that create

impervious surface in excess of the current impervious surface standard for the zone

without the need for a variance, provided that the impervious surface coverage will not

exceed the court mandated standard or 25% of the lot area, whichever is greater, and

provided that the homeowner can provide a grading and drainage plan in accordance with

Township standards and approved by the Township Engineer.”

NOW, THEREFORE, BE IT FURTHER ORDAINED that:

(1) All ordinances or parts of ordinances which are inconsistent with this Ordinance shall be

repealed as to their inconsistencies only.

(2) This Ordinance shall become effective upon final passage and publication in accordance

with law.

Mayor Suraci stated that as discussed when this ordinance was introduced, it amends the

Township’s regulations with respect to single family homes built under court mandated standards.

Mayor Suraci added that this allows for impervious surface to be up to 25% for such homes

without the need for a variance application with the Board of Adjustment.

Mayor Suraci stated that this amendment requires the homeowner to provide a grading and

drainage plan be submitted to the Township Engineer in accordance with Township standards.

Committeeman DelCore moved to open the public hearing on Ordinance 2012-15. Said

motion was seconded by Committeeman Tomson and carried unanimously upon call of the roll.

Committeeman DelCore moved to adopt Ordinance 2012-15. Said motion was seconded by

Committeeman Tomson and carried unanimously upon call of the roll.

Ordinance 2012-16 An Ordinance to exceed the 2012 Municipal Budget appropriation

limits and to establish a Cap Bank (N.J.S.A. 40A:4-45.14).

WHEREAS, the Local Government Cap Law, NJSA 40A:4-45.1 et seq., provides that in the

preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5%

unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations,

subject to certain exceptions; and

WHEREAS, NJSA 40A:4-45.15a provides that a municipality may, when authorized by

ordinance, appropriate the difference between the amount of its actual final appropriation and the

3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding

years; and,

WHEREAS, the Township Committee of the Township of Hillsborough, County of

Somerset, finds it advisable and necessary to increase its CY 2012 budget by up to 3.5% over the

previous year’s final appropriations, in the interest of promoting the health, safety and welfare of

the citizens; and,

WHEREAS, the Township Committee hereby determines that a 3.5% increase in the budget

for said year, amounting to $819,370.90 in excess of the increase in final appropriations otherwise

permitted by the Local Government Cap Law, advisable and necessary; and,

WHEREAS, the Township Committee hereby determines that any amount authorized

hereinabove that is not appropriated as part of the final budget shall be retained as a cap exception

to final appropriation in either of the next two succeeding years;

NOW, THEREFORE BE IT ORDAINED, by the Township Committee of the Township of

Hillsborough, in the County of Somerset, a majority of the full authorized membership of this

governing body affirmatively concurring that, in the CY 2012 budget year, the final appropriations

of the Township of Hillsborough shall, in accordance with this ordinance and NJSA 40A:4-45.14. be

increased by 3.5%, amounting to $819,370.90 and that the CY 2012 municipal budget for the

Township of Hillsborough be approved and adopted in accordance with this ordinance; and,

BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not

appropriated as part of the final budget shall be retained as an exception to final appropriation in

either of the next two succeeding years; and,

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed

with the Director of the Division of Local Government Services within 5 days of introduction; and

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with

the recorded vote included thereon, be filed with said Director within 5 days after such adoption.

Mayor Suraci stated that under state budget law, the unused portion of the appropriations

cap which is different than the tax levy cap may be reserved to be available in the next two years.

Mayor Suraci added that each year since 2002, Hillsborough has been able reserve some

appropriation authorization in the cap bank and that the cap bank has no impact on taxes.

Deputy Mayor McCauley moved to open the public hearing on Ordinance 2012-16. Said

motion was seconded by Committeeman Wagner and carried unanimously upon call of the roll.

motion was seconded by Deputy Mayor McCauley and carried unanimously upon call of the roll.

Committeeman DelCore moved to adopt Ordinance 2012-16. Said motion was seconded by

Ordinance 2012-17 An Ordinance authorizing acceptance of a Deed of Roadway

dedication for a portion of Block 6, Lot 21, as shown on the Tax Map

of the Township of Hillsborough, County of Somerset, State of

New Jersey.

WHEREAS, the Township Committee of the Township of Hillsborough, County of

Somerset, State of New Jersey, wishes to accept a Deed of Roadway Dedication, dated October 17,

2011 for a portion of Block 6, Lot 21, as shown on the Township of Hillsborough Tax Map,

conveyed unto the Township by Scott McCall and Jennifer L. McCall; and

WHEREAS, the purpose of this conveyance is for road widening purposes; and

WHEREAS, the Township Attorney for the Township of Hillsborough reviewed the

abovementioned Deed and finds it acceptable in all respects.

NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the

Township of Hillsborough, County of Somerset, State of New Jersey, that it hereby

authorizes acceptance of the aforementioned Deed and conveyance attached hereto and

directs the Township Attorney to record same.

This Ordinance shall take effect upon its adoption, passage and publication

according to law.

Mayor Suraci stated that this ordinance allows the Township to accept a parcel of land for

the purpose of road widening. Land and Building Use Law allows a municipality to accept land

only through the adoption of an Ordinance.

The Township Attorney has reviewed the above mentioned deed and finds it acceptable.

Deputy Mayor McCauley moved to open the public hearing on Ordinance 2012-17. Said

motion was seconded by Committeeman Wagner and carried unanimously upon call of the roll.

Committeeman DelCore moved to close the public hearing on Ordinance 2012-17. Said

motion was seconded by Committeeman Tomson and carried unanimously upon call of the roll.

Deputy Mayor McCauley moved to adopt Ordinance 2012-17. Said motion was seconded by

Ordinance 2012-18 An Ordinance Repealing Chapter 145 (Uniform Construction

Code) Section 3 (Construction Fee Schedule) of the Code of the

Township of Hillsborough, County of Somerset, State of New

Jersey.

BE IT ORDAINED by the Township Committee of the Township of Hillsborough, County

of Somerset, as follows:

Section 1: Chapter 145-3 of the Municipal Code of the Township of Hillsborough is hereby

repealed and replaced as follows,

A. Waiver of construction permit surcharge and enforcing agency fees for construction to

promote accessibility by disabled persons, as stated in 52:27D-126e, the “State Uniform

Construction Code Act.”

(1) No person shall be charged a construction permit surcharge fee or enforcing agency fee,

except those fees for sub-code inspections not performed by Township employees, for any

construction, reconstruction, alteration, or home improvement designed and undertaken

solely to promote accessibility by disabled persons to an existing public or private structure,

or any of the facilities contained therein.

(a) For the purposes of this section, “disabled person” means a person who has the

total and permanent inability to engage in any substantial gainful activity by reason

of any medically determinable physical or mental impairment, including blindness,

and shall include, but not be limited to, any person who is disabled pursuant to the

federal Social Security Act (42 USC §416), or the federal Railroad Retirement Act of

1974 (45 USC §231 et seq.), or is rated as having a 60 percent disability or higher

pursuant to any federal law administered by the United States Veterans

Administration. For purposes of this paragraph "blindness" means central visual

acuity of 20/200 or less in the better eye with the use of correcting lenses. An eye

which is accompanied by a limitation in the field of vision such that the widest

diameter of the visual field subtends an angle no greater than 20 degrees shall be

considered as having a central visual acuity of 20/200 or less.

B. The fee for a construction permit shall be the sum of the sub-code fees listed in

Subsection A (1) through (5) hereof and shall be paid before the permit is issued. Excluded

from the construction fee schedule set forth herein is any unattached structure under thirty

(30) inches in height which is accessory to landscaping development on the property. For

purposes of example only, not limitation, such landscaping structures may include railroad

ties, rock gardens, patio pallet construction, and similar items. All Use Groups and

construction classifications referenced herein are as defined by the New Jersey Uniform

Construction Code.

(1) The minimum building sub-code fee shall be fifty dollars ($50.00) for the R2 Use Group,

sixty dollars ($60.00) for the R3, R4, and R5 Use Groups and eighty dollars ($80.00) for all

other use groups.

(a) New construction and additions. Fees for new construction shall be based upon the volume

of the structure in cubic feet.

[1] For the following use groups, the fee shall be based on the formula of volume

times $0.045: B (Business), H (High Hazard), I-1 through I-4 (Institutional), A-

1 through A-5, (Assembly), M (Mercantile), R-1 through R-5 (Residential), E

(Educational).

[2] For the following use groups, the fee shall be based on the formula of volume

times two and one half cents ($0.025): S-1 through S-2 (Storage), U (Utility)

and F-1 through F-2 (Factory).

[a] $0.025 per cubic foot of volume for the first fifty thousand (50,000)

cubic feet or part thereof,

[b] $0.018 per cubic foot of volume for the second fifty thousand (50,000)

cubic feet or part thereof,

[c] $0.014 per cubic foot of volume of the structure over one hundred

thousand (100,000) cubic feet.

[d] Building Sub-code Fee for Commercial farm buildings, as defined by

the New Jersey Uniform Construction Code, NJAC 5:23-3.2(d) 1., shall

not exceed $2,290.00.

[3] Decks and raised patios shall be charged fees based on the

square foot area of each deck and patio as follows:

[a] The first one hundred (100) square feet = one hundred

($100.000) dollars.

[b] One hundred one through two hundred (101 – 200)

square feet = one hundred fifty ($150.00) dollars.

[d] Three hundred one through four hundred (301 – 400)

square feet = three hundred ($300.00) dollars.

[f] Five hundred one through six hundred (501 – 600)

square feet = three hundred fifty ($350.00) dollars.

[g] Six hundred one through seven hundred (601 – 700)

square feet = four hundred ($400.00) dollars.

[h] Over seven hundred (700) square feet = four hundred

fifty ($450.00) dollars.

(b) Renovations, alterations, and repairs. Fees for renovations, alterations, and repairs

shall be based upon the estimated cost of the work. (The applicant shall submit cost

data by an architect or engineer of record, a recognized estimating firm or by

contractor bid. The Department will review the construction cost for acceptability.)

The fees shall be as follows:

(c) Additions and renovations, alterations or repairs. Fees for additions and renovations,

alterations or repairs shall be a combination of rates set by Subsection A (l) (a) and (b) above.

[1] All roof replacements and overlays shall have a flat fee charged of sixty five

dollars ($65.00) for the R3, R4, and R5 Use Groups, and one hundred thirty

dollars ($130.00) for all other Use Groups.

[2] All siding replacements and overlays shall have a flat fee charged of sixty

five dollars ($65.00) for a townhouse. A fee of sixteen dollars ($16.00) per one

thousand dollars ($1000.00) of construction costs shall be charged for the R2

Use Group. A flat fee of one hundred thirty dollars ($130.00) shall be charged

for all other Use Groups.

[3] Radon vent stacks shall be charged the minimum fee for the first vent stack,

and fifty percent (50%) of the minimum fee for each additional vent stack.

(d) Pools shall be charged fees as follows:

[1] Swimming pools, above ground.

[a] R-5 Use group: one hundred dollars ($100.00).

[b] All other Use Groups: three hundred percent (300%) of the Minimum

Fee.

[c] Seasonal use pools, those which are not permanent in nature and

charged a fee of forty dollars ($40.00).

[2] Swimming pools, in-ground.

[a] R-5 Use Group: one hundred sixty dollars ($160.00).

[b] All other Use Groups: three hundred sixty dollars ($360.00).

[3] Pool Barriers.

[a] R-5 Use Group: seventy five dollars ($75.00).

[b] All other Use Groups: two hundred percent (200%) of the Minimum

Fee.

(e) Asbestos abatement fee: Two hundred percent (200%) of the Minimum Fee.

[1] Certificate of occupancy fee for asbestos abatement: Fifty percent (50%) of the

Minimum Fee.

(f) Fences [over six (6) feet in height], two hundred percent (200%) of the Minimum Fee.

(g) Sheds as defined in the New Jersey Uniform Construction Code:

[1] Those not requiring a foundation system: Minimum Fee.

[2} Sheds with a required foundation system: two hundred percent, (200%), of

the Minimum Fee.

(h) Temporary signs: Minimum Fee.

(i) Permanent signs:

[1] Wall or surface mounted signs: one hundred dollars ($100.00).

[2] Pylon and monument signs: two hundred dollars ($200.00).

(j) Demolition: flat rate, depending on building class when occupied as follows:

[1] Class 1: four hundred dollars ($400.00).

[2] Class 2: two hundred fifty dollars ($250.00).

[3] Class 3: one hundred ten dollars ($110.00).

[4] Demolition of swimming pools:

(a) Above ground: Minimum Fee.

(b) In-ground: Same as established rate for Class 3 demolition.

[5] Demolition of shed: Minimum fee.

(k) Installation or erection of temporary structures, tents, tensioned membrane

structures, canopies, and greenhouses, as defined in NJAC 5:23 shall be one hundred

dollars ($100.00).

(l) Buildings moved or relocated, unit rate: sixteen dollars ($16.00) per one thousand

dollars ($1,000.0) [minimum fee: two hundred fifty dollars ($250.00)]; unit rate times

(m) Fees for retaining walls shall be as follows:

[1] The fee for a retaining wall with a surface area greater than five hundred

fifty, (550), square feet that is associated with a Class 3 residential structure

shall be one hundred fifty dollars, ($150.00).

[2] The fee for a retaining wall with a surface area of five hundred fifty, (550),

square feet or less that is associated with a Class 3 residential structure shall

be seventy five dollars, ($75.00).

[3] The fee for a newly constructed retaining wall of any size at other than a

Class 3 residential structure shall be based on the cost of the construction,

and shall be charged fees at the rate of twenty four dollars, ($24.00), per one

thousand dollars, ($1000.00), of estimated cost of construction.

(n) Photovoltaic systems shall be charged a flat fee of one hundred forty dollars

($140.00) for Use Groups R3, R4, and R5. All other Use Groups shall be charged fees

based on the designated kilowatt rating of each solar photovoltaic systems as

follows:

[1] One to 50 kilowatts, the fee shall be two hundred sixty dollars ($260.00).

[2] Fifty-one to 100 kilowatts, the fee shall be five hundred dollars ($500.00).

[3] Greater than 100 kilowatts shall be seven hundred fifty dollars ($750.00).

(2) The Minimum Plumbing Sub-code fee shall be fifty dollars ($50.00) for the R2 Use Group,

sixty dollars ($60.00) for the R3, R4, and R5 Use Groups and eighty dollars ($80.00) for all

other use groups. All other fees shall be charged as stated below.

(a) The fee shall be twenty dollars ($20.00) per drip pan, humidifier, whirlpool tub,

combustion air, fixture, vent or stack. For the purpose of computing this fee, fixtures,

vents or stacks shall include but not be limited to water closets, urinals, bidets,

lavatories, sinks, showers, floor drains, washing machines, dishwashers, hose bibs,

drinking fountains, indirect waste or water connections, residential solar systems,

roof drains, storm drains, leaders, sump-pumps, and conductors.

(b) The fee shall be seventy five dollars ($75.00) per special device. For the purpose of

computing this fee, special devices shall include but not be limited to commercial-industrial

sewage ejectors, commercial gas piping, commercial water conditioning equipment, grease, oil,

sand or other type interceptors, backflow devices, reduced pressure backflow devices, booster

pumps, commercial-industrial water heaters, heat exchangers, boilers or furnaces, air

conditioning units, refrigeration systems and solar systems.

(c) The Minimum Fee shall be charged for each residential sewer, septic and water utility

connection. The fee for commercial, industrial, private on-site sanitary and storm sewers and

domestic water lines and combination mains shall be one hundred dollars ($100.00) for up to

and including the first one hundred feet (100’). Each additional ten feet (10’) or portion thereof

shall be charged an additional twenty dollars ($20.00) per ten feet (10’) or portion thereof.

(d) The Minimum fee shall be charged for each of the following:

Furnace, water heater, swimming-pool water heater, water heater coil, ultraviolet

system, central air conditioning, pool drains, backflow preventer reports, and

tempering valves. Gas piping, liquefied petroleum gas piping, and fuel oil piping,

shall each be charged the minimum fee, and include provisions for the installation of

up to four (4) appliances. For the fifth and each additional appliance, the fee shall be

an additional twenty dollars, ($20.00).

(e) Hot water and steam boilers:

One hundred sixty dollars ($160.00) shall be charged for each new or replacement

complete hot water and steam boiler system installation, consisting of a boiler,

backflow preventer, temperature mixing valve control, domestic hot water coil or

external water maker coil unit and tank, combustion air, or any combination thereof.

(f) The Minimum Fee shall be charged for single-boiler hydronic piping for the R-5 use

Group. For all other Use Groups, the Minimum Fee shall be charged per floor of

each structure.

(g) The Minimum Fee shall be charged per unit for commercial-industrial refrigeration

piping.

(3) Mechanical sub-code fees, which are only applicable to the R3, R4, and R5 Use Groups, shall

be sixty dollars ($60.00) minimum, and shall otherwise be charged as follows:

(a) The fee for the replacement of an individual Mechanical device shall be the

minimum fee for the first device, and fifty percent (50%) of the minimum fee for each

additional device, and shall include inspection for required combustion air.

(b) No separate fee shall be charged for gas, fuel oil, or water piping connections

associated with the mechanical equipment inspected.

(c) A flat fee of one hundred ten dollars ($110.00) shall be charged for each new or

replacement complete HVAC system installation, consisting of a furnace,

compressor, a-coil, drip pan, condensate pump or discharge line, humidifier,

combustion air, or any combination thereof.

(4) The minimum Electrical Sub-code fee shall be fifty dollars ($50.00) for the R2 Use

Group, sixty dollars ($60.00) for the R3, R4, and R5 Use Groups and eighty dollars

($80.00) for all other use groups. All other fees shall be charged as stated below.

(a) Electrical fixtures and devices;

[1] From one (1) to ten (10) receptacles, fixtures or switches: Minimum fee.

[2] Each additional twenty (20) receptacles, fixtures or switches or portion

thereof: fifty percent (50%) of the minimum fee.

[3] For the purpose of computing this fee, receptacles, fixtures or switches shall

include lighting outlets, smoke detectors, heat detectors, fluorescent fixtures

and receptacles, intercom devices, burglar alarm detectors, thermostats, CRT

(Cathode ray terminal) outlets and any similar device or motor of one (1)

horsepower or one (1) kilowatt or less.

(l) Commercial kitchen exhaust system and hazardous exhaust systems: Three hundred

fifty dollars, ($350.00), each.

(m) Installation of fuel storage tanks.

[1] Use Group R-5: Minimum fee each.

[2] All other Use Groups: one hundred twenty dollars ($120.00) each.

(n) Installation of Underground water storage tanks: Two hundred fifty dollars,

($250.00), each.

(o) Removal of underground storage tanks shall be charged fees as follows:

[1] Eighty dollars ($80.00) each for the R5 Use Groups.

The initial registration fee for each elevator device in any structure that is not in Use Group

R-5 shall be fifty dollars ($50.00). A re-registration fee of fifty dollars ($50.00) shall be

required for each structure containing one (1) or more elevator devices upon change of

ownership.

(a) Fees for witnessing acceptance tests and performing inspections shall be as follows:

[1] The basic fees for elevator devices in structures not in Use Group R-5 shall be

as follows:

(d) An administrative fee of fifteen percent (15%) will also be charged to each elevator

permit issued.

C. The fee for plan review shall be five percent (5%) of the amount to be charged for the

construction permit and shall be paid before the plans are reviewed.

D. The fee for review of any amendment or change to a plan that has already been released,

shall be charged at a rate of forty dollars, ($40.00), per one-half hour, per sub-code. Fees

shall be rounded to the nearest one-half hour. A minimum fee of forty dollars, ($40.00) shall

be charged.

E. Variation fees shall be charged as per the building class of the structure as follows:

(1) Class 1: Three hundred fifty dollars, ($350.00).

(2) Class 2: Two hundred twenty five dollars, ($225.00).

(3) Class 3: One hundred dollars, ($100.00).

(4) Re-submission of a variation shall be charged fifty percent, (50%), of the original fee.

F. The fees for Certificates of Occupancy shall be as follows:

(1) Certificate of Occupancy. The fee shall be in the amount of ten percent (10%) of the

new construction permit fee. The minimum shall be one hundred twenty dollars,

($120.00), except for one (1) and two (2) family dwellings (R-5) wherein the

minimum fee shall be sixty dollars, ($60.00). This shall apply whether the Certificate

of Occupancy is temporary or permanent in nature.

(2) Temporary Certificate of Occupancy: The fee for Temporary Certificate of Occupancy

or extensions is fifty percent, (50%), of the minimum Certificate of Occupancy fee

each. There shall be no fee charged for the first issuance of a Temporary Certificate

of Occupancy, provided the Certificate of Occupancy fee is paid at that time.

(3) (a) The fee for a Certificate of Continued Occupancy shall be two hundred dollars

($200.00), and shall be required for all changes in occupancy of non-residential Use

Groups.

(b) A Certificate of Continued Occupancy issued for a finished basement in a

residential Use Group, in which work was completed prior to the issuance of a

construction permit, shall be charged a flat fee of four hundred dollars, ($400.00).

(4) The fee for a Certificate of Occupancy granted to a change of use shall be two

hundred dollars ($200.00).

(5) Occupancy Placards: No fee for the first issuance. Fees for a replacement shall be

charged the same as those for a Temporary Certificate of Occupancy as stated in F(2)

above.

(6) The fee for a certificate of compliance for hazardous equipment maintained or

installed in accordance with the New Jersey Uniform Construction Code, delineating

the approval period, shall be one hundred dollars ($100.00).

G. Limited certificates of approval.

(1) Limitations. Equipment herein below listed, having been determined to create a

significant potential for hazard to public health and safety, shall be granted a

certificate of approval by the appropriate subcode official or other approved agency

for the duration specified herein:

(a) Elevators, six (6) months: twenty-six dollars ($26.00).

(b) Platform lifts, six (6) months: twenty-five dollars ($25.00).

(c) Dumbwaiters, twelve (12) months: twenty-five dollars ($25.00).

(d) High-pressure boilers, twelve (12) months: as provided by the state.

(e) Refrigeration systems, twelve (12) months: as provided by the state.

(f) Pressure vessels, twelve (12) months: as provided by the state.

(g) Cross-connections/Backflow preventers (Backflow Preventers Equipped with

Test Ports only), twelve (12) months: fifty dollars ($50.00).

(2) Such equipment shall be periodically reinspected or tested in accordance with the

provisions of the regulations prior to the expiration of such certificate of approval

and any violations corrected before a new certificate may be issued.

(3) No such system or assembly shall continue in operation unless a valid certificate of

approval has been reissued. It shall be a violation of the regulations for an owner to

fail to provide for such periodic inspection and testing.

(4) Revocation: the enforcing agency may revoke a certificate of occupancy whenever a

condition of a certificate has been violated.

(5) Time limit. The provisions of the regulations do not preclude periodic certification

pursuant to other applicable laws or ordinances.

H. Lapsed permits. The fee for the reinstatement of a lapsed permit, for which no changes are

made or required by mandated code changes, shall be fifty percent, (50%), of the original

lapsed permit fee.

I. The Construction Official shall, with the advice of the Subcode Officials, prepare and submit

to the Township Committee, biannually, a report recommending a fee schedule based on

the operating expenses of the agency and any other expenses of the municipality fairly

attributable to the enforcement of the State Uniform Construction Code Act.

J. State of New Jersey permit fees.

(1) In order to provide for the training, certification and technical support programs

required by the Uniform Construction Code Act, the enforcing agency, including

the Department when acting as the local agency, shall collect a surcharge fee of

$0.00334 per cubic foot of volume of new construction. The fee for all other

construction shall be $1.70 per one thousand dollars ($1,000.00) of value of

construction. The minimum permit surcharge fee shall be $1.00. Said surcharge

fee shall be remitted to the Bureau of Housing Inspection, Department of

Community Affairs, on a quarterly basis for the fiscal quarters ending March 31,

June 30, September 30 and December 31 and not later than one (1) month next

succeeding the end of the quarter for which it is due.

(2) The enforcing agency shall report annually at the end of each state fiscal year to the

Bureau of Housing Inspection, and not later than July 31, the total amount of the

surcharge fee collected in the fiscal year. In the fiscal year in which the regulations

first become effective, said report shall be for the third and fourth (state fiscal year)

quarters.

K. Annual permits. The fee to be charged for an annual construction permit shall be charged

annually. This fee shall be a flat fee based on the number of maintenance workers who are

employed by the facility and who are primarily engaged in work that is governed by a

subcode. Managers, engineers and clericals shall not be considered maintenance workers for

the purpose of establishing the annual construction permit fee. Annual permits may be

issued for building, fire protection, electrical and plumbing. Fees shall be as follows:

(1) One (1) to twenty-five (25) workers (including foreman): six hundred eighteen

dollars ($618.00) per worker; each additional worker over twenty-five (25): two

hundred fifteen dollars ($215.00) per worker.

(2) Prior to the issuance of the annual permit, a training registration fee of one hundred

thirty dollars ($130.00) per subcode shall be submitted by the applicant to the

Department of Community Affairs, Construction Code Element, Training Section,

along with a copy of the construction permit (Form F-170A). Checks shall be made

payable to "Treasurer, State of New Jersey."

L. Hourly charges and fees for development-wide inspection of homes after issuance of a

Certificate of Occupancy shall be in such amount as may be reasonable and necessary in

order to ascertain whether a violation exists or to verify that any work performed has abated

the violation.

(1) The hourly charge shall be the same as the hourly rate set forth in section D above,

times the number of hours spent by the code officials in determining whether a violation

exists or verifying that any work performed has abated the violations.

Section 2: If any section or provision of this Ordinance shall be held invalid in any court of

competent jurisdiction, the same shall not affect the other sections or provisions of

this Ordinance, except so far as the section or provision so declared invalid shall be

inseparable from the remainder or any portion thereof.

Section 3: The Ordinance shall take effect upon its adoption, passage and publication

according to law.

Mayor Suraci explained that this proposed increase is a direct result of the 2009 code

changes as adopted by the Department of Community Affairs which are costing the Township

more in overhead.

Mayor Suraci stated that the time it takes for the completion of the plan review and

inspections has increased which translates into higher expenses for the Township.

Mayor Suraci added that the intent of permit application fees is to cover the overhead of the

plan review and inspection for the subject project and that these proposed fees are more in line with

neighboring municipalities and will be closer to attempting to accomplish covering the costs

associated with the permit process.

Mayor Suraci introduced Mr. John Fiedler, Construction Official, who explained that these

fee increases bring Hillsborough in line with neighboring areas and is a direct result of the changes

to the code.

Committeeman Tomson moved to open the public hearing on Ordinance 2012-18. Said

motion was seconded by Committeeman Wagner and carried unanimously upon call of the roll.

• Resolution authorizing the 2012 Municipal Budget to be read by title only.

WHEREAS, pursuant to N.J.S.A. 40A:4-8, as amended by Chapter 78, P.L. 1964, the

municipal budget as advertised, may be read as its title at the public hearing, a complete copy of

the approved budget, as advertised, shall be posted, in the principal municipal building, and is

WHEREAS, the Township Committee of the Township of Hillsborough hereby determines

that the above conditions have been met.

NOW, THEREFORE, BE IT RESOLVED that the 2012 municipal budget shall not be read in

full, but by its title only.

Mayor Suraci stated that this resolution allows the budget to be read by title only instead of having

the entire document read prior to the public hearing. The full document is available in the Clerk’s Office

during regular business hours, on the Township’s website www.hillsborough-nj.org and at the Township

Library.

Upon motion by Committeeman DelCore seconded by Deputy Mayor the aforesaid

resolution was unanimously approved upon call of the roll.

• Public Hearing on 2012 Municipal Budget and resolution adopting 2012 Municipal

Budget

Mayor Suraci stated that in preparing a budget that meets the Township Committee’s goals

of minimizing the impact on taxpayers, while providing the Township Departments with the funds

necessary to deliver needed and expected services for our residents, has been a rigorous challenge.

Mayor Suraci stated that once again the township committee has been able to deliver a

budget that has met the challenge.

Mayor Suraci explained that the 2012 budget represents nearly a 6% or $1.6M reduction in

spending over the 2011 appropriations.

Mayor Suraci said the Township Committee has worked extensively to reduce the costs that

are within its control and to compensate for those that are outside the control of local government.

As such, a total of 73 line items have been reduced or frozen from the 2011 budget.

Mayor Suraci reiterated that the 2012 budget is a reflection of the Township’s on-going

commitment of doing more with less and that township employees are asked to provide the same

level of service to the taxpayers, despite the reduction in line items and spending.

Mayor Suraci continued by saying that a major component of this Township Committee’s

fiscal philosophy is to minimize tax impacts by keeping any tax increase at or below the state cap.

Mayor Suraci said the Finance Committee worked hard to ensure that the 2% CAP,

implemented by the State in 2012 was adhered to.

Mayor Suraci also stated that it is important to note that for 2012 the tax levy is

approximately $900,000 less by not taking cap exceptions and if the exceptions to the 2% cap had

been taken, the tax levy would have exceeded $18M.

Mayor Suraci stated that this budget represents a business-like approach to government.

Mayor Suraci finished by thanking Finance Committee members Deputy Mayor Gloria

McCauley, Committeeman Frank DelCore, CFO, Nancy Haberle and Township Administrator

Mike Merdinger for their dedication and hard work on this year’s budget.

Mayor Suraci asked Nancy Haberle, the township CFO, to come forward and give her

presentation on the budget.

Ms. Haberle presented the 2012 Municipal Budget with a power point presentation.

Ms. Haberle stated that the 2% property tax cap established in 2011 and the decline in non-

tax revenue made the 2012 budget process very challenging.

Ms. Haberle stated that there were no exceptions taken in order to balance the budget and

stated that if there were exceptions taken over the last few years, the 2012 budget could be over $18

million.

Ms. Haberle stated that the budget is a decrease of $1,621,000 which is a 5.76% reduction

from the 2011 budget.

Ms. Haberle showed on a graph that the 2012 spending is significantly down from where it

was in 2007 and last year.

Ms. Haberle explained that with Hillsborough and Montgomery Township forming a

Shared Court Services merger which gave the township a net cost savings of $82,000.

Ms. Haberle said that departments continue to freeze and operate at or below spending

levels of previous years and 52 line items are still frozen this year as well as 21 additional line items

being reduced.

Ms. Haberle said that the mild winter allowed the township to lower that line item and

pension and insurance were reduced due to employee contributing to their health care.

Ms. Haberle also said that payments on bonds are also down.

Ms. Haberle stated that since 2008, the number of employees has been reduced by 8% from

162 to 149 employees and has reduced salary and pension line items but not the level of service in

the township.

Ms. Haberle said that all unions except one are contributing to their insurance with the last

union participating by in 2013.

Ms. Haberle showed a pie graph that showed the percentages for each major area of

expenditures.

Ms. Haberle said that State aid is down $1,400,000 since 2007 which is made up of 2 keys

pieces which are Receipt Tax and Consolidated Municipal Property Tax Relief Act.

Ms. Haberle stated that the tax rate will be .309 which is a 2% increase so for a house valued

at $370,000 there will be an increase of $26 annually.

Ms. Haberle announced that there will be a public hearing on April 24th where there will be

another budget presentation and is open to all public comments.

Ms. Haberle stated that this presentation and information will be on the Township website.

Committeeman Wagner thanked Ms. Haberle, Mr. Merdinger, and his fellow Committee

members, Frank DelCore, and Gloria McCauley for their many hours of work on the budget.

Deputy Mayor McCauley also thanked Ms. Haberle and Mr. Merdinger for their work at

meeting the challenge to stay under the 2% cap.

Deputy Mayor McCauley stressed how hard it is to cut spending and reduce the budget by

$1.6 million when health cost, energy costs, etc are going up and that she is very proud that they

have met the challenge with this budget.

Committeeman DelCore said that the budget is a culmination of many people’s work. He

thanked Nancy Haberle and all of her employees in the Finance Department, the Administration

office, and all the employees since they have helped the budget by giving up increases in the last

few years and by contributing to their health insurance.

Committeeman DelCore stated how the employees have supported the town by continuing

to provide the same or better level of service with much less resources available to them which is

evident by the 8% decrease in employees over the past few years.

Committeeman Tomson reiterated the comments of his colleagues by thanking everyone

who worked on the budget and commented as someone who sees budgets from various towns that

Hillsborough has not taken advantage of any of the exceptions or loop holes that could have been

taken.

Mayor Suraci asked if there were any comments from the public and Mr. Shandra Nadra of

Hillsborough addressed the dais.

Mr. Nadra asked if the 2% tax cap is related to the Board of Education and the Township

separately or the overall tax levy.

Committeeman DelCore stated that the township part of the budget is staying under the 2%

cap but the 2% cap also applies to the total tax levy of the township.

Mr. Nadra stated that he would like the Township Committee to look at lowering the taxes

from previous years and read a portion of a book that stated that Indiana cut property taxes by 40-

60%.

Mayor Suraci explained that the township could have reduced taxes this year in the budget

except that the State has taken revenues from the township specifically with the Energy Tax

Receipts which is money that the township used to receive and now the State takes it.

Mayor Suraci stated that the League of Municipalities are currently trying to fight for that to

be given back to the towns and said the challenge to the State should be to decrease their budget by

6% as Hillsborough has.

Committeeman DelCore stated if someone tells you that they can cut your taxes 60% from

the year before then they were really overspending the previous years.

Committeeman DelCore added that the State has fixed some of their tax issues by taking

money from the municipalities and force the municipalities to deal with the problem.

Committeeman DelCore stated that there really is not anymore that could be taken away by

the State so it should not get worse the following year.

Mr. Nadra suggested that the municipal employees are getting paid too much and their

salaries should be reduced.

Committeeman DelCore explained that the staff has been reduced by 8% and that the

employees have taken several cuts in their salaries over the last few years.

Committeeman DelCore stated that the white collar union reduced their hours from 40 to

37.5 per week which is a direct savings to the township and is basically a 6% cut in pay for the

employees in addition to contributing to their health care costs.

RESOLUTION ADOPTING THE 2012 MUNICIPAL BUDGET

WHEREAS, the 2012 Municipal Budget was introduced and approved by the Hillsborough

Township Committee on March 27, 2012, at a regularly scheduled Township Committee meeting;

and

WHEREAS, the Public Hearing for the 2012 Municipal Budget was held on April 24, 2012, at

a regularly scheduled Township Committee meeting, at which said budget was read by title only.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey, that the 2012 Hillsborough Municipal

Budget totaling $26,521,439 is hereby adopted and that two certified copies of the same be

forwarded to the Director of the Division of Local Government Services and a certified copy of the

same be forwarded to the Somerset County Board of Taxation.

Committeeman Tomson moved to open the public hearing on the 2012 Municipal Budget.

Said motion was seconded by Committeeman DelCore and carried unanimously upon call of the

roll.

CONSIDERATIONS

1. Resolution to hire summer employees: Eugene Reid and Randy Sixt for the

Department of Parks and Recreation with a start date on or about April 25, 2012,

at a salary of $10.00 per hour funded through the Clean Communities Grant.

WHEREAS, there is a need for temporary summer employment in the Department of Parks

and Recreation in the Township of Hillsborough; and

WHEREAS, the Township of Hillsborough will receive monies from the Clean

Communities Grant Fund, said monies to be used to cover the cost of the summer help in the

Department of Parks and Recreation; and

WHEREAS, the Director of Parks and Recreation has determined that the following two (2)

applicants are the most qualified candidates and has recommended their appointment as summer

employees with a start date on or about April 25, 2012, at a salary of $10.00 per hour, 40 hours per

week ending August 31, 2012:

2. Resolution reducing the fees for various police reports that are distributed at the

Township of Hillsborough Police Department’s service window.

WHEREAS, Section 237-2 of the Code of the Township of Hillsborough provide that the fees

for government records may be established by Resolution of the Township Committee; and

WHEREAS, Chief Paul Kaminsky recommended that the fees for various police reports that

are distributed at the Township of Hillsborough Police Department’s Service Window be reduced

from $.05 to $.00; and

WHEREAS, Chief Kaminsky’s basis for the recommendation is an effort to maximize the

productivity at the Police Department.

NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey, that the recommendation of Chief Paul

Kaminsky be and hereby is accepted and that the fees for various Police reports that are distributed

at the Township of Hillsborough Police Department’s Service Window be reduced from $.05 to $.00.

Upon motion by Committeeman Wagner seconded by Deputy Mayor McCauley, the

aforesaid resolution was unanimously approved upon call of the roll.

3. Resolution approving participation with the State of New Jersey in a Safe and

Secure Communities program administered by the Division of Criminal Justice,

Department of Law and Public Safety.

WHEREAS, the Hillsborough Township Police Department wishes to apply for a project

under the Safe and Secure Communities Program; and

WHEREAS, the Township Committee of Hillsborough has reviewed the application and

has approved said request; and

WHEREAS, the project is a joint effort between the Department of Law and Public Safety

and the Applicant Local Unit of Government, for the purpose described in the application; and

THEREFORE, BE IT RESOLVED, by the Township Committee of Hillsborough that

1. As a matter of public policy the Applicant’s Unit of Government wishes to

participate to the fullest extent possible with the Department of Law and Public

Safety.

2. The Attorney General of New Jersey will receive funds on behalf of the Applicant.

3. The Division of Criminal Justice shall be responsible for the receipt and review of the

applications for said funds.

4. The Division of Criminal Justice shall initiate allocations to the applicant as

authorized by law.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the Township Committee of the

Township of Hillsborough, County of Somerset, State of New Jersey approve participation in the

Safe and Secure Communities Program.

Hillsborough, County of Somerset, State of New Jersey that the terms and conditions for the

Agreement between the Township of Hillsborough and Country Classics, Inc. is hereby approved

and the Mayor and the Township Administrator/Acting Clerk are authorized to execute the

Agreement.

Upon motion by Deputy Mayor McCauley seconded by Committeeman DelCore, the

aforesaid resolution was unanimously approved upon call of the roll.

CONSENT

1. Resolution authorizing the transfer of earned amounts, in an amount of

$8,345.04, from the Engineering Inspection Escrow Accounts to the Treasurer’s

Account.

WHEREAS, in accordance with the following summary of accrued Engineering charges

related to various indicated projects, a total of $8,345.04 should be transferred from Engineering

account records through April 9, 2012, to ensure that sufficient funds are available for these

2. Resolution approving the application for a Carnival License by Jeannine Ianiro for an

event to be held on August 14 thru August 19, 2012 for the benefit of the

Hillsborough Rotary Club.

WHEREAS, an application for a carnival license had been filed by Jeannine Ianiro on

behalf of the Hillsborough Rotary Club for a Fundraising event to be held on August 14 thru

August 19, 2012; and

WHEREAS, the submitted application form was complete in all respects.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey that it hereby approves the carnival

application submitted by Jeannine Ianiro, for the Hillsborough Rotary Club Fundraising event

being held on August 14 thru August 19, 2012.

3. Resolution approving proposed fire hydrant installation, Gateway at Sunnymeade

Development.

WHEREAS, as part of the Gateway at Sunnymeade Development, New Jersey American

Water Company is proposing to install one (1) public hydrant and fifty (50) private hydrants at the

Gateway at Sunnymeade project site; and

WHEREAS, the Fire Official has determined that the installation of fifty-one (51) fire

hydrants are required to properly serve this project; and

WHEREAS, one (1) of the fifty-one (51) required fire hydrants, installed on Roycefield Road,

will be public with the annual fee being paid by the Township; and

WHEREAS, the other fifty (50) fire hydrant will be private and the annual fee will be paid

by Gateway at Sunnymeade; and

WHEREAS, the fire hydrants must be installed at the same time the water mains are being

installed because the pipe connections to the hydrants are installed in the water mains.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey that it hereby approves the installation of

one (1) public fire hydrant and fifty (50) private fire hydrants, as determined to be required by the

Fire Official, at the Gateway at Sunnymead Development.

4. Resolution approving request from Kris Winters for the release of Cash Escrow for

Road Open Permit No. 2012-12, in the amount of $150.00.

WHEREAS, a request has been received from Kris Winters for release of cash escrow for

Road Opening Permit No. 2010-12; and

WHEREAS, the Assistant Township Engineer certifies that all work has been satisfactorily

completed; and

WHEREAS, the Assistant Township Engineer recommends that the Township Committee

take action to release the $150.00 cash escrow that was posted for the completion of the project.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the

Assistant Township Engineer be and hereby is accepted and approved.

5. Resolution authorizing Officer Christopher McMinn to enroll in “Leadership

Communication” and “Counterterrorism” and to be eligible for tuition

reimbursement of said courses once they have been successfully completed, pursuant

to Article XVII of the current PBA Contract.

WHEREAS, it is the policy of the Township of Hillsborough to encourage continuing

education on the part of full-time employees for the purpose of enabling them to better perform in

their jobs and to better prepare them in the event of an opportunity for advancement and

promotion within the Township; and

WHEREAS, financial assistance for education is outlined in Article XVIII of the current PBA

contract; and

WHEREAS, Officer Christopher McMinn is requesting authorization to take “Leadership

Communication” and “Counterterrorism” towards his Bachelor’s Degree in Criminal Justice; and

WHEREAS, Officer McMinn has requested consideration under the Township’s

Educational Assistance provision upon successful completion of the aforementioned course; and

WHEREAS, the Chief of Police has requested favorable consideration of Officer McMinn’s

request for financial reimbursement of seventy-five percent (75%) of the cost incurred upon

successful completion of the classes.

NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey, that the recommendation of the Chief of

Police is hereby accepted and approved.

6. Resolution authorizing the submission of the 2012 Somerset County Historic

Preservation Trust Grant application for the Van de Veer-Harris House.

WHEREAS, The Friends of the Van derVeer-Harris House desires to apply for a grant from

the Somerset County Historic Preservation Trust for the restoration of the Van derVeer-Harris

House; and

NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey hereby authorizes The Friends of The Van

derVeer-Harris House to submit the 2012 Somerset County Historic Preservation Trust Grant

application for the restoration of the Van derVeer-Harris House.

7. Resolution authorizing the Township Qualified Purchasing Agent to request

proposals through the Competitive Contracting Procurement process for a Recreation

Baseball Summer Clinic.

WHEREAS, the Township Committee of the Township of Hillsborough authorized the

Township Qualified Purchasing Agent to accept proposals for a Recreation Baseball Summer Clinic

on May 16, 2012; and

WHEREAS, the date for acceptance of proposal needs to be amended to May 30, 2012; and

WHEREAS, the Township Attorney has reviewed the Request for Proposals drafted by the

Qualified Purchasing Agent and advised that the Request for Proposals meets the applicable

statutory requirements.

NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of

Hillsborough, County of Somerset, State of New Jersey as follows:

1. The Township Qualified Purchasing Agent to re-advertise the Request for Proposals.

2. The Competitive Contracting Process be administered by the Township Chief

Finance Officer.

3. Responses to the Request for Proposals be accepted on May 30, 2012 at 11:00 A.M.

4. This Resolution shall take effect immediately.

EXECUTIVE SESSION RESOLUTION

WHEREAS, Section 8 of the Open Public Meetings Act (N.J.S.A. 10:4-12 (b) (1-9), Chapter

231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Township Committee is of the opinion that such circumstances exist.

NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of

Hillsborough in the County of Somerset, State of New Jersey, as follows:

1. The public shall be excluded from discussion of and action upon the hereinafter specified

subject matters.

2. The general nature of the subject matter to be discussed is as follows:

3. The Township Committee may take official action on those items discussed in Executive
