Novus Environmental Inc. 1.0 Proposed Development

Figure 1 (attached) provides excerpts from the concept plan for the proposed development. The proposed development will consist of up to 300 units and could potentially be comprised of:

Three 6-storey apartment buildings

One 3-storey apartment building

Five blocks of stacked townhouses.

2.0 Surrounding Land Uses

Figure 2 (attached) provides a context plan for the area surrounding the proposed development, and Figure 3 provides a composite zoning map. The site is located at the southwest corner of Roger Street and Moore Ave S. The southern edge of the site is located along the Kitchener Waterloo boundary.

Immediately to the south of the development is the Waterloo Mount Hope Cemetery. All other immediate surrounding land uses are predominantly low-rise residential Waterloo GR1 and GR2A, Kitchener R4, R5, R6, and R7). The closest Waterloo commercial uses are to the north along Union Street E (Waterloo Mixed Use Community Commercial C4A-6 and -12) approximately 170 m from the site. The closest Kitchener mixed use commercial uses are located to the south along King Street W (Kitchener Mixed Use Corridor MU-2 and MU-3) approximately 210 m away.

3.0 Stationary Noise Sources in the Surrounding Area

3.1 Industrial and Commercial Land Uses

The Ontario Ministry of the Environment and Climate Change (MOECC) developed the “D” series of guidelines as a means to assess recommended separation distances and other control measures for land use planning proposals in an effort to prevent or minimize ‘adverse effects’ from the encroachment of incompatible land uses.

Guideline D-6 “Compatibility Between Industrial Facilities and Sensitive Land Uses” is specific to industrial uses in proximity to more sensitive land uses such as the proposed residential re-development on the subject lands. Areas of influence and recommended minimum setback distances are included within the guideline. These setbacks are provided in the table below.

The area of influence criteria can be used as a screening tool to help determine if a particular industry or commercial use may affect the proposed development. Under Guide D-6 requirements, if Class I, II, or III industries are located within the area of influence of the proposed development, then a detailed noise assessment is recommended.

Ultimately, noise from industrial and commercial operations must meet MOECC Publication NPC-300 “stationary” noise guideline limits at the proposed development. The guideline sets out noise limits for two main types of noise sources:

Non-impulsive, “continuous” noise sources such as ventilation fans, mechanical equipment, and vehicles while moving within the property boundary of an industry. Continuous noise is measured using 1-hour average sound exposures (Leq (1-hr) values), in dBA; and

Impulsive noise, which is a “banging” type noise characterized by rapid rise time and decay. Impulsive noise is measured using a logarithmic mean (average) level (LLM) of the impulses in a one-hour period, in dBAI.

Furthermore, the guideline requires an assessment at, and provides separate guideline limits for:

Outdoor points of reception (e.g., back yards, communal outdoor amenity areas); and

Façade points of reception such as the plane of windows on the outdoor façade which connect onto noise sensitive spaces, such as living rooms, dens, eat-in kitchens, dining rooms and bedrooms.

The applicable noise limits at a point of reception are the higher of:

The existing ambient sound level due to road traffic, or

The exclusion limits set out in the guideline.

The following tables set out the exclusion limits from the guideline. As there are no significant sources of impulsive noise in the area, the impulsive noise guideline limits are not shown.

The Publication NCP-300 Class 1 Urban limits apply to the proposed development.

Figure 4 shows the Guide D-6 separation distances from the proposed development, as well as the name of local commercial and industrial land uses. The only nearby industrial areas are located in Waterloo along Union Street E (Waterloo Light Industrial LI-6) and along Roger Street north of the spur line trail (Waterloo Light Industrial LI-12). All are more than 170 m from the site. The closest industrial facilities are shown in Table 5 below. There are no heavy scale Class III industries within 1000 m of the development.

All Class I light scale industries (shown in Orange in Figure 4) are located well outside the 70 m Area of Influence, and the 20 m Recommended Minimum Separation distance.

There are only two Class II medium scale industries: Forbes Motors and Canadian Threadall Ltd. Both industries (shown in Yellow in Figure 4) are located well outside the 70 m Recommended Minimum Separation distance. Forbes Motors is well outside the 300 m Area of Influence. Canadian Threadall is located right at the 300 m area of influence, with the closest portions of their property being 245 m from the proposed development.

There are a number of commercial operations in the area not covered under Guide D-6, shown in blue in Figure 4, including the Len’s Mills Store, KW Auctions and Storage, Mini Mart, etc. There are no significant sources of noise associated with these facilities, and noise from these facilities are not audible at the proposed development.

A site visit was conducted on January 19, 2017. There is no outdoor storage or other outdoor operations, associated with Canadian Threadall operations. Noise from Canadian Threadall and from other industrial operations (e.g., from JG Group, Forbes, and other operations) was not audible at the proposed development, and therefore are likely to meet the applicable MOECC Publication NPC-300 noise guidelines.

3.2 Other Non-Industrial/ Commercial Sources of Noise

The majority of the non-industrial/ commercial land uses in the area are low-rose residential uses. However, there are three apartment/ condominium uses within 300 m of the proposed development, show in Green in Figure 4:

The Metropolitan Towers apartment buildings, at 57 Union St E o Central heating and wall/window mounted air conditioners

The Pine Grove apartments at 145 Lucan Ave o Central heating and wall/window mounted air conditioners

Condominiums located at 144 Lucan Ave. o Packaged Terminal Air Conditioning (PTAC) units

The closest of these building is more than 130 m from the development site. From our site visit, noise from these buildings was not audible at the proposed development site. Based on the above, noise levels from these sources are likely to meet the applicable MOECC Publication NPC-300 guideline limits at the proposed development.

4.0 Predicted Noise Levels

The projected stationary sound levels on the development were predicted using the Cadna/A computer model, a software implementation of the ISO-9613 noise propagation algorithms (ISO 1996). The “building evaluation” feature of the Cadna/A was also used to assess noise impacts.

Significant sources from surrounding residential, commercial and industrial lands were identified from the aerial photography and site visit, and include dust collectors, exhaust fans, HVAC and PTAC equipment. Modelled noise source locations are shown in Figure 5. Sound emission rates used in the noise modelling were based on typical values for equipment, obtained from Novus’ extensive database. The sound levels used in the modelling are summarized in Appendix C.

The worst-case scenario predicted sound levels from off-site stationary sources which are shown in Figure 6 and are summarized in Table 6 below.

The predicted worst-case stationary source sound levels from off-site sources are all well below the applicable guideline minimums. Therefore, noise from off-site stationary sources meet the requirements of MOECC Publication NPC-300. No additional mitigation for off-site stationary noise sources is required.

Given the setback distance from the stationary noise sources, the low predicted sound levels, and the fact that noise from the sources was inaudible at the proposed development, a stationary noise warning clause is not recommended.

5.0 Conclusions

Novus has conducted an assessment of the potential for off-site stationary noise sources associated with surrounding industrial, commercial, and residential land uses to affect the proposed Roger Street residential development.

Based on our review of the area, MOECC Guideline D-6 requirements are met. Noise levels from surrounding industrial, commercial and residential sources were inaudible at the proposed development. Noise modelling of off-site stationary noise sources shows that the MOECC Publication NPC-300 stationary noise guideline limits are met. No additional mitigation for off-site stationary noise sources is required. In our opinion, no stationary noise warning clause is required.
