The Chairman welcomed the members and initiated the discussion. The subjects discussed and the decisions made under each of the agenda point are as follows:

105.1 Confirmation of the proceedings of 104th SEIAA Meeting held on 14th September 2015.

Proceedings of 104th SEIAA Meeting held on 14th September 2015 was read and as there were no comments the same was accepted.

105.2 Action Taken reports on the proceedings of 101st SEIAA Meeting held on

25th July 2015, 102nd SEIAA Meeting held on 14th August 2015, 103rd SEIAA Meeting held on 29th August 2015 and 104th SEIAA Meeting held on 14th September 2015.

The Authority perused the action taken reports on the proceedings of 101st SEIAA Meeting held on 25th July 2015, 102nd SEIAA Meeting held on 14th August 2015 and 103rd SEIAA Meeting held on 29th August 2015 are enclosed. The Authority noted the action taken.

105.3 Deferred Project (For Invite):

Residential Apartment at Survey No. 21/1 and 12, Chikkanagamangala Village, Sarjapura Hobli, Anekal Taluk, Bangalore Urban District of M/s. M.J.Infrastructure, (SEIAA 37 CON 2015)

It is a proposal seeking Environmental Clearance for construction of Residential Apartment of 225 Units with BF + GF + 4 UF on a plot area of 14,012.24 Sq.mts and with total built up area of 34,346.67 Sqm. Total water requirement of project is 151.85 KLD.

The subject was discussed in the SEAC meeting held on 5th & 6th June 2015 and 17th & 18th August 2015. The Committee has recommended to SEIAA for issue of

Environmental Clearance, with a condition that the proponent shall maintain more greenery on the mother earth and with the following observations:

1. The proposal is a low rise building having B+G+4UF only and the conceptual plan have been approved by the competent authority.

2. The proponent clarified that sufficient ventilation and lighting has already been provided by providing open to sky spaces wherever required in order to maintain the good ventilation and light.

3. NOC dated 17.03.2014 from the Village Panchayat for water supply has been submitted by the proponent and the water balance also calculated fresh water demand at the rate of 55 LPCD as per the norms prescribed for rural water supply and the scheme for meeting the additional requirement has been given.

4. Since the ground coverage is only 50%, there is a scope for providing more than 30% of the greenery on the mother earth.

The Authority during the meeting held on 29th August 2015 had perused the proposal and took note of the recommendation of SEAC. The Authority noted that the following observations were raised during the 99th SEIAA meeting held on 29th June 2015:

“The Authority perused the proposal and took note of the recommendation of SEAC. The Authority observed that the residential units are compactly arranged without adequate space for ventilation. The project does not have required recreational area and the greenbelt. The internal circulation roads are narrow and having varying width. The proposal do not have any proof assured source of water supply. The picturesque view of the drawing gives an indication of possible high level of indoor pollution in the proposed residential units.”

The Authority after discussion decided to get the following information for further considerations:

1. Modification in the conceptual plan keeping the observations of the Authority made on 29th June 2015.

2. Details of Recreation Ground Area. 3. Details of greenbelt with provision for at least 33% of the plot area. 4. Details of the internal circulation roads of at least 6m width and drive

way of 8 m width. 5. Possibility of high level indoor pollution and the proposed modified

plan for preventing indoor pollution.

The Authority also decided to invite the proponent.

The Authority perused the reply submitted by the proponent on 21.09.2015. The proponent appeared before the Authority and explained the proposal in brief.

The Authority opined that the reply submitted vide letter dated 21.09.2015 is incomplete and do not address the issues raised by SEIAA completely. The proponent sought for some time for submission of revised reply as directed by the Authority. The Authority after discussion decided to consider after the receipt of revised reply. The Authority also decided to invite the proponent.

105.4.1 Building Stone Quarry Project, Sy.No.617 (P) of Sattigeri Village, Soudatti Taluk, Belagavi District. (2 Acres) (QL No.1540) of Sri N B Hiremath, #7, Renuka Nivas, 3rd Cross, Hosur Hubli -21, Dharwad District (SEIAA 701 MIN 2015)

This is a Renewal proposal seeking Environmental clearance for quarrying of Building Stone in 2-00 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of an undertaking from the proponent that approach road to be asphalted.

The Authority perused the proposal and took note of the recommendation of SEAC.

105.4.3 Building Stone Quarry Project, Sy.No.139 of Arjunnagi Village, Afzalpur Taluk, Gulbarga District. (1 Acre) (QL No.956) of Sri Mohaseen Ahmed Patel, Arjunnagi Village, Afzalpur Taluk, Gulburga District (SEIAA 705 MIN 2015)

This is a Renewal proposal seeking Environmental clearance for quarrying of Building Stone in 1-00 Acre, Patta Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 70% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind with a condition that, since the railway track is passing nearby (300 m from the project site), blasting is to be synchronized with movement of trains.

The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of Building stone limiting the production to 70% of the proposed production, as recommended by SEAC and with a condition that, since the railway track is passing nearby (300 m from the project site), blasting is to be synchronized with movement of trains.

This is an existing proposal seeking Environmental clearance for quarrying of Building Stone in 4-00 Acres, Government Revenue Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. This is a proposal seeking Environmental clearance for quarrying of Building Stone in 2-00 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 80% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind.

The Authority perused the proposal and took note of the recommendation of SEAC.

This is an existing proposal seeking Environmental clearance for quarrying of Black Granite in 2-00 Acres, Government Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information:

1. An undertaking that approach road to be asphalted. 2. An undertaking that the waste shall be dumped in their own land being

converted for the non agricultural purpose.

This is an existing proposal seeking Environmental clearance for quarrying of Building Stone in 6-20 Acres Government Revenue Land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of an undertaking from the proponent that approach road to be asphalted and corrected mineable reserve calculations.

This is an existing proposal seeking Environmental clearance for quarrying of Building Stone in 1-00 Acres, Government land.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 60% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind.

The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of building stone limiting the production to 60 % of the proposed production, as recommended by SEAC.

105.4.17 Building Stone Quarry Project, Sy.No.123 (P) of Bilakundi Village, Gokak Taluk & Belagavi Dist. (8-0 Acres) of Sri Kallappa Ramappa Kudari S/o. Sri.Ramappa Kudari, Sajjihal (Tapasi) Village, Gokak Taluk, Belagavi District (SEIAA 737 MIN 2015)

This is a New proposal seeking Environmental clearance for quarrying of Building Stone in 8-00 Acres, Govt. Gyrana Land.

The subject was discussed in the SEAC meeting held on 5th September 2015. The committee observed that, in Bilakundi village of Gokak Tq. & Belagavi Dist. only already five (5) proposals to a total extent of 40.50 Acres in Sy. No’s 2,2(P) & 76(P) are considered in the 146th SEAC meeting. And if the total area of mining exceeds 25 Ha or 62 Acres, the mining activity as per EIA Notification 2006, should be treated as B1 category and General Conditions shall apply. Therefore it is decided to consider this proposal having mining area of 8.00 Acres, so that the total mining area will be within 25 Ha.

The Committee after discussion decided to recommend the proposal to SEIAA for issue of Environmental Clearance subject to submission of the following information.

1. A combined sketch covering all the quarry leases sanctioned by DMG in this village and total extent of mining duly approved by DMG.

2. An undertaking that existing cart track (karab land) running in the quarry area should be left open for public.

3. An undertaking that approach road to be asphalted.

The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of building stone as per approved quarry plan, subject to submission of information sought by SEAC.

105.4.18 Building Stone Quarry Project, Sy.No.79/4 of Nandur B Village, Gulbarga Taluk & Gulbarga Dist. (2.31 Acres) of Sri Imam Sab #56/1, Bolewaas H.No: 1/1 to 1067, Gulburga Taluk, Gulbarga – 585103 (SEIAA 739 MIN 2015)

This is a New proposal seeking Environmental clearance for quarrying of Building Stone in 2.31 Acres, Patta Land.

The subject was discussed in the SEAC meeting held on 5th September 2015.

The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information.

1. Revised Geological & Mineable reserve and five year production quantity duly approved by DMG.

2. An undertaking that approach road to be metalled. The Authority perused the proposal and took note of the recommendation of SEAC.

The Authority after discussion decided to issue Environmental Clearance for extraction of building stone as per approved quarry plan, subject to submission of information sought by SEAC.

105.4.19 Black Granite Quarry Project, Sy.No.57/2 of Yalachagere Village, Chamarajanagara Taluk & Dist. (2-35 Acres) of Sri Doddalingappa (SEIAA 740 MIN 2015)

This is a Renewal proposal seeking Environmental clearance for quarrying of Black Granite in 2-35 Acres, patta land.

The subject was discussed in the SEAC meeting held on 5th September 2015.

The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information.

1. Scheme foe disposal of quarry waste. An undertaking that the adjoining land shall be used for waste dumping after getting NA for the same and if NA is not obtained, quarry activity will be stopped.

2. Toe wall to be constructed at waste dump area for protection of quarry waste dump.

105.4.20 Building Stone Quarry Project, Sy.No.380 (P) of Hirekoppa Village, Ramdurga Taluk, Belagavi Dist. (1-0 Acre) of Sri Channabasappa M. Dandin S/o.Sri. Murigeppa #164/8, Bagalkot, Bagalkot District (SEIAA 742 MIN 2015)

The subject was discussed in the SEAC meeting held on 5th September 2015. The proponent has given a letter stating that the DMG has declared a cluster combining four quarry leases adjoining each other of same village (883 MIN 2015, 884 MIN 2015, 885 MIN 2015 & 886 MIN 2015) and all the four will do a common EMP and submit the report.

The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 70% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind and subject to submission of the following.

1. An undertaking from the proponent that approach road will be asphalted. 2. Scheme of disposal of wastage.

The Authority perused the proposal and took note of the recommendation of SEAC. The Authority noted that this is a proposal having a lease area of 2-19 Acres. As per SCHEDULE II A of the Karnataka Minor Mineral Concession (Amendment) Rules, 2013, minimum area for grant of quarry lease in case of Ornamental and decorative building stones is 2-20 Acres. Therefore, this lease area does not meet the minimum requirement of the said Rules. The Authority further noted that the Director, Department of Mines & Geology vide cluster Notification dated 23.07.2015 have declared Melur Cluster. However, no details of other leases coming under the said cluster or whether all such leases result into cluster situation as defined in the O.M. No. J-13012/12/2013-IA.II (I) of the Ministry of Environment and Forests, Government of India dated 24th December 2013 is forthcoming in the said Notification. No information with regard to formation of cluster association as required under Rule 8-R of the Karnataka Minor Mineral Concession (Amendment) Rules, 2013 is formed for the collective implementation of approved Environment Management Plan is forthcoming from the proposal. In view of the above observations, the Authority decided to refer the proposal back to SEAC for further appraisal with all the relevant details.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, limiting the production to 70% of the total estimated production keeping the minable area quantity and the sustainability of the mine in the mind and subject to verification of not exceeds 5 Ha within 500 m distance from the boundary of the quarry site.

The Authority perused the proposal and took note of the recommendation of

SEAC.

The Authority observed that as per the presentation, the proposed quarry lease area is said to be located at a distance of 500 meters from inter-State boundary. In such situation if the sum total of the mining lease area of the said project or

activity and that of existing operating mines and mining projects which were accorded environment clearance and are located within 500 metres from the periphery of such project or activity equals or exceeds 5 ha., the project activity , then it attracts General Condition in which case it has to be appraised as category A activity. The Authority noted that this proposal has been appraised without ascertaining whether it attracts General Condition of not. Therefore the Authority decided to refer the proposal back to SEAC for re-appraisal if the activity do not attracts General Condition.

This is a proposal submitted by Member Secretary, District Sand Monitoring Committee, Kodagu District seeking Environmental Clearance for River Sand Mining at Kaveri River bed. It is located at Block No. 1, adjacent to Sy.No. 1/1, 2/1 of Hachchinadu village, Somavarpete Taluk, Kodagu District for an extent of 3.237 Ha ( 8 Acres).

The subject was discussed in the SEAC meeting held on 23rd September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, with the standard conditions that are being imposed for sand mining in the River bed and with a specific condition that the mining activity shall be undertaken only in the dry weather season.

It is a proposal seeking Environmental Clearance for construction of Residential Apartment of 351 units with Basement+Ground Floor+11 Upper Floor on a plot area of 17,502.50 Sq.mts (karab area = 607.02 Sq.m) and with total built up area of 54,578.58 Sqm. Total water requirement of project is 237 KLD.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information.

1. Scientific assessment of the availability of the water from the bore well in the project site

1. Revised layout plan exclusively for the land in Part-1 without considering the land in Part-2.

105.4.66 Residential Apartments at Plot No. 119, Kannamangala village, Devanahalli Taluk, Bangalore Rural District of M/s. Ozone Urbana Infra Developers Pvt. Ltd., (SEIAA 95 CON 2015)

It is a proposal seeking Environmental Clearance for construction of Residential Apartment of 84 units with Basemen + Ground Floor + 3 upper floor on a plot area of 9191.55 Sq.mts and with total built up area of 23715.77 Sqm. Total water requirement of project is 57 KLD.

The subject was discussed in the SEAC meeting held on 4th September 2015. The Committee has recommended to SEIAA for issue of Environmental Clearance, subject to submission of the following information.

1. An undertaking to treat the water using RO technology received from BWSSB and supplied to apartments.

It is a proposal seeking Environmental Clearance for expansion and modification of Residential Apartment of 224 units with Basement + Ground Floor + 14 Upper Floor on a plot area of 13607.44 Sq.mts and with total built up area of 42999.88 Sqm. (Enhancement from 30930.15 Sqm to 42999.88 Sqm). Total water requirement of project is 151 KLD.

105.5.5 River Sand Quarrying in Shirgur Inam Block I at Bhima River bed, opposite to Sy.No. 104 (part), 1, 2 and 4 (Part) of Shirgur Inam village, Indi Taluk, Bijapur District. (4.856 Ha / 12 Acres) of Deputy Director & Member Secretary, District Sand Monitoring Committee, Dept. of Mines & Geology (SEIAA 318 MIN 2014)

This is a proposal submitted by District Sand Monitoring Committee, Bijapura seeking Environmental Clearance for Sand Mining at Sy.No. 104 (part), 1, 2 and 4 (Part) of Shirgur Inam village, Indi Taluk, Bijapur District over an area of 4.856Ha of Revenue Land on the banks of Bhima River.

The subject was discussed in the SEAC meeting held on 23rd September 2015. The Committee has recommended to the proposal to SEIAA for closure and the extract of the proceedings of the Committee meeting is as below:

“Project Proponent along with Environment Consultant presented the proposal in the 119th Special meeting held on 1st October 2014.

The activity is an extraction of sand from Bhima river (excluding water course).

1. As proposed by proponent the extraction of the sand is done only during non-monsoon season when there is lean flow in the river.

2. The process proposed is a manual operation. 3. The PP proposes to extract only 1 m depth of sand, which is equal to

replenishment of sand which takes place in this water course in 5 years as admitted by PP during the presentation.

4. There are no sensitive locations in 5km distance around the sand mining area.

5. All preventive measures suggested by MoEF are considered in the proposal. 6. PP stated that there are no structures such as bridges and retaining walls

across/ along the above water course which are susceptible to erosion. 7. As stated by PP, the extracted sand will not be carried through any village

or habitation. However, PP was asked to furnish on the day of meeting, a key plan indicating approach road to the proposed site. PP submitted Toposheet/key map with marking of location of site & approach road.

8. PP stated that the EMP submitted is sufficient to mitigate the adverse effects, if any, due to sand mining.

Observations of the Committee:

1. PP was advised to plant Terminalia arjuna (Holemathi), Sygigium cumini (Nerale), Pongamia pinnata (Honge), Mangifera indica (Mango), Vitis nigandu (Lakki) and Agave to strengthen the river banks and on road sides Madhuca indica (Hippe), Holoptelia integrifolia (Thapasvi), Hardwickia binata (Anjana), Acacia ferruginea (Bannimara), Thespesia populnea (Bugari), Acacia arabica ( Kari jali)

2. The Committee suggests that the EC may be issued only for two years as approved in the plan period shown in the approved mining plan.

Based on the above submission made by the PP and also EMP proposed the Committee decided to recommend the proposal to SEIAA for consideration to issue of EC with the conditions that the PP Strictly adheres to,

1. The conditions laid in Karnataka Minor Mineral Concession (Amendment) Rules, 2013 vide G.O. No. CI 357 MMN 2012 dated 16.12.2013.

2. The stipulations/Guidelines issued by MoEF, GoI with regard to sand mining activities.

The Authority perused the proposal and took note of the recommendation of SEAC in its 82nd meeting held on 7th October 2014.

The Authority noted that Dr. Sarvabhoum Bagali, Ex-MLA, Indi, Bijapur District have filed an objection praying for rejection of Environmental Clearance to

this sand block. The reasons attributed by Dr. Sarvabhoum Bagali for the said objection are as follows;

1) The proposed sand block is having an area less than 5.0 Ha, therefore it may not be considered as per O.M. dated 24-12-2013 issued by the Ministry of Environment & Forest, Government of India.

2) A barrage constructed at Hilli-Gubbewad village on the Bhima river is located within 5 km from the proposed sand block.

3) Water of the above said barrage stagnates up to Inam Shiragur and Padanur Villages even during summer. No stream mining is permitted as per the above mentioned O.M. dated 24-12-2013.

4) Mining activities in this block will result in pollution of drinking water that is being supplied to the neighboring villages on either sides of the Bhima River.

5) This sand block is an on-going sand excavation project, big pits to the depth of 7 mtrs (21 feet) have been already dug. This big pits are not filled up by Public Works Department and Sand Mafia.

6) Sand mining is to be done manually, if Environment Clearance is given the Executive Engineer, Bijapur may continue to violate directions of MoEF.

7) The Executive Engineer, PWD, Bijapur and Sand Mafia has done sand mining by use of Pokliner, JCB / Hitachi in contravention of the rules. He is likely to continue mining in contravention of the rules.

8) The vehicles transporting sand pass through Shiragur Village and cause noise pollution and air pollution in the village. These vehicles being very heavy damage the roads. It is difficult for small children and school going children to pass through this heavy traffic.

The Authority also noted that Dr. Sarvabhouma Bagali have alleged that this proposal attracts General Condition of EIA Notification, 2006 by virtue of being close to the Inter-State boundary and therefore need to be appraised as category ‘A’ project.

The Authority observed that the O.M. dated 24-12-2013 issued by the Ministry of Environment & Forest, Government of India has been stayed by the Principle Bench of Hon’ble National Green Tribunal, New Delhi – Circuit Bench at Shimla in so far as it relates to the minor minerals like sand vide order dated 28th March 2014 in application No. 343 of 2013 and connected matters. Therefore the proposal need to be considered in accordance with the orders of Hon’ble Supreme Court dated 27-02-2012 in IA No. 12-13 of 2011 in SLP (C) No.19628-19629 of 2009, EIA Notification 2006 and the amendments made there on apart from the orders of the Hon’ble National Green Tribunal, Principle Bench, New Delhi dated 05-08-2013 made in original application No. 171 of 2013 and connected matters.

In view of the above said statutory position the Authority is bound to consider all application seeking Environment Clearance for mining of minor minerals in an area up to 50.0 Hectares.

However, the Authority after discussion had decided to refer the file back to SEAC for re-appraisal keeping the above objections made by Dr. Sarvabhouma Bagali in view and sending recommendations deemed fit based on merit.

Committee took note of the decision of the Authority in the 122nd SEAC meeting held on 24th, 25th and 26th November 2014.

Committee perused the proposal from file and had decided to deliberate further after receipt of the comments from project proponent (Deputy Commissioner, Bijapur District) and reply for the letter sent from SEIAA.

The representative of the proponent and the RQP/Environment Consultant attended in the 141st SEAC meeting held on 30th June and 1st July 2015 to give clarification/additional information.

The committee observed that the case is still pending in NGT. There is a barrage near Hilli – Gubbevadi which supplies drinking water to Padanur, Shirgur Inam villeges. The levels of these places should be checked and impact due to mining has to be verified and to be submitted. The GPS coordinates of certain blocks are identical which leads to confusion.

This is a proposal submitted by District Sand Monitoring Committee, Bijapur seeking Environmental Clearance for Sand Mining at Sy.No. 216 and 217 of Padanur village, Indi Taluk, Bijapur District over an area of 4.856Ha.

The subject was discussed in the SEAC meeting held on 23rd September 2015. The Committee has recommended to the proposal to SEIAA for closure and the extract of the proceedings of the Committee meeting is as below:

“Project Proponent along with Environment Consultant presented the proposal in the 119th Special meeting held on 1st October 2014.

The activity is an extraction of sand from Bhima river (excluding water course).

1. As proposed by proponent the extraction of the sand is done only during non-monsoon season when there is lean flow in the river.

2. The process proposed is a manual operation. 3. The PP proposes to extract only 1 m depth of sand, which is equal to

replenishment of sand which takes place in this water course in 5 years as admitted by PP during the presentation.

4. There are no sensitive locations in 5km distance around the sand mining area. 5. All preventive measures suggested by MoEF are considered in the proposal. 6. PP stated that there are no structures such as bridges and retaining walls

across/ along the above water course which are susceptible to erosion. 7. As stated by PP, the extracted sand will not be carried through any village or

habitation. However, PP was asked to furnish on the day of meeting, a key plan indicating approach road to the proposed site. PP submitted Toposheet/key map with marking of location of site & approach road.

8. PP stated that the EMP submitted is sufficient to mitigate the adverse effects, if any, due to sand mining.

Observations of the Committee:

Based on the above submission made by the PP and also EMP proposed the Committee decided to recommend the proposal to SEIAA for consideration to issue of EC with the conditions that the PP Strictly adheres to,

1. The conditions laid in Karnataka Minor Mineral Concession (Amendment) Rules, 2013 vide G.O. No. CI 357 MMN 2012 dated 16.12.2013.

2. The stipulations/Guidelines issued by MoEF, GoI with regard to sand mining activities.

The Authority perused the proposal and took note of the recommendation of SEAC in its 82nd meeting held on 7th October 2014.

The Authority noted that Dr. Sarvabhoum Bagali, Ex-MLA, Indi, Bijapur District have filed an objection praying for rejection of Environmental Clearance to this sand block. The reasons attributed by Dr. Sarvabhoum Bagali for the said objection are same as enumerated in agenda item No.82.4.60 except for the following:

i) Existence of a Railway Bridge within 5 km from the proposed sand block.

ii) Gram Sabha conducted on 09-06-2014 at Padanur village passed a resolution opposing sand mining.

iii) The Chairman and Members of Gram Panchayath, Padanur and publics have requested Deputy Commissioner, Bijapur on 16-06-2014 not to allow sand mining in Padanur and Baragudi villages.

iv) This sand block is one of the subject matter in miscellaneous application No. 438 of 2014 and 507/2014 in original application 171 of 2014 before Hon’ble National Green Tribunal, Principal Bench, New Delhi where SEIAA is also a party.

The Authority therefore decided to refer the file back to SEAC for re-appraisal keeping the above objections made by Dr. Sarvabhouma Bagali in view and sending recommendations deemed fit based on merit.

Committee took note of the decision of the Authority in the 122nd SEAC meeting held on 24th, 25th and 26th November 2014.

Committee perused the proposal from file and had decided to deliberate further after receipt of the comments from PP (Deputy Commissioner, Bijapur District) and reply for the letter sent from SEIAA.

The representative of the proponent and the RQP/Environment Consultant attended in the 141st SEAC meeting held on 30th June and 1st July to give clarification/additional information.

The committee observed that the case is still pending in NGT. There is a barrage near Hilli – Gubbevadi which supplies drinking water to Padanur, Shirgur Inam villeges. The levels of these places should be checked and impact due to mining has to be verified and to be submitted. The GPS coordinates of certain blocks are identical which leads to confusion.

District Sand Monitoring Committee., have applied for EC from SEIAA for proposed Sand Mining with estimated extraction of 93960 TPA at Sy.No. 123, 126, 127, 130 and 132 (part) of Baragudi village, Indi Taluk, Bijapur District over an area of 4.856Ha of Revenue Land on the banks of Bhima River under Schedule 1 (a) of EIA Notification, 2006 read with O.M. dated 18.05.2012 of MoEF under Category- B.

105.6 Miscellaneous:

Building Stone Quarry Project, Sy.No.365/3 of Santhur Village, Udupi Taluk & Dist. (0.50 Acre) of Sri Suresh Shetty S/o. Sri Sitharam Shetty, Mundraguttu, Nandikur Post, Udupi Taluk & District (SEIAA 259 MIN 2015)

Sri Suresh Shetty S/o. Sri Sitharam Shetty had submitted two applications seeking Environmental Clearance for quarrying of Building stone in respect of QL No. 2947 and QL No. 2948, each with a lease area of 0.50 Acres. The said proposals were dealt in File No. SEIAA 255 MIN 2015 and SEIAA 259 MIN 2015 respectively.

Pursuant to the order dated 11.6.2015 of the Senior Geologist, Mines &

Geology Department, Udupi, both the above said leases have been merged. The proponent subsequently submitted revised application on 28.7.2015 along with quarry plan duly modified and approved by the DMG. The modified proposal was considered in the along with the old application in File No. SEIAA 255 MIN 2015. The Committee during the meeting held on 6th August 2015 have recommended the proposal for the amalgamated lease area of one Acre. Accordingly, the Authority also have cleared the proposal for issued of Environmental Clearance for amalgamated lease area.

While, considering the revised proposal of Sri Suresh Shetty, the Committee ought to have recommended the File No. SEIAA 259 MIN 2015. However, by oversight the 2nd file also have been recommended for Environmental Clearance and the same has been approved by the Authority during the meeting held on 29th August 2015.

Since, the area under lease in QL No. 2947 have been merged with QL No.

2948 due to amalgamation of leases, QL No. 2947 have lost its existence and hence the proposal being dealt in File No SEIAA 259 MIN 2015 is in fructuous. Therefore deserves to be closed.

The Authority perused the proposal and decided to close the File No. SEIAA

259 MIN 2015 and delist from the pendency.

105.7 With the permission of the Chair:

105.7.1 Review of Progress in disposal of applications by the Committee/Authority –reg.

The Member Secretary brought to the notice of the Authority that submission of online application in the MoEF portal has been made mandatory. The application so received are being forwarded to SEAC for online appraisal. The SEAC is also considering applications and sending their recommendation online in such proposals that have been received. The Member Secretary informed that 12 such proposals are being considered today by the Authority in addition to the offline applications submitted prior to the online portal by MoEF, Government of India. The Authority perused the applications received for ToR and for E.C., the applications returned to the proponent for shortfall information, the applications forwarded to SEAC for appraisal and the applications acknowledged by the SEAC. The Authority expressed satisfaction and pleasure for having initiated early action for transparent and time bound decision making in Environmental Clearance process. The Authority noted that only Karnataka and Gujarath States are actively involved in making use of the online portal of the MoEF. The Authority applauded for the efforts made by the Member Secretary in this regard.

105.7.2 Software Development Blocks at Plot No.57, 58, 59, 63 on Sy.Nos.12 of

Konnapanna Agrahara & Sy.Nos.157, 158, 161, 64, 65 of Doddathogur Village, Electronic City, Begur, Bangalore South Taluk, Bangalore Urban District by M/s. Infosys Limited (SEIAA 129 CON 2014)

It is a proposal for construction of two Blocks of Software Development buildings (SDB-01, and SDB-02) with 2B + GF + 8F + T on an area of 40,591.72 Sqm and with the total built up area of 1,25,693.76 Sqm. The total water requirement is 607.39 KLD.

The subject was discussed in the SEAC meeting held on 19th, 20th & 21st January 2015 and 30th June & 1st July 2015. The Committee has recommended for issue of environmental clearance, subject to submission of the following information:

1. Revised soil analysis report for the chemical parameters 2. Write up on bus shelter provided 3. Corrected water balance and mass balance 4. Estimation of the e-waste and earmarking dedicated area for

collection and disposal in accordance with the provisions of law 5. STP flow chart to be simplified.

The Authority during the meeting held on 25.07.2015 had perused the proposal and took note of the recommendation of SEAC. The Authority observed from the Google Imagery that large scale construction activity has been taken place without prior Environmental Clearance. The Authority therefore decided to consider this as case of violation and to seek clarification from the proponent. The Authority also decided to get the project site inspected.

The Authority perused the replies submitted by the proponent vide letters dated 31.07.2015 and 04.09.2015. The Authority also perused the inspection note submitted by Shri H.S. Sudheendra, Scientific Officer. The Authority noted that the proposed construction is a modification of the project for which Environmental Clearance has been issued vide letter No.SEIAA 78 CON 2007 dated 04.06.2009 in favour of M/s Tyche Developers for a total built up area of 1,76,220.31 Sqm. The project site along with the construction so undertaken has been taken over by M/s Infosys Limited who have submitted this application for the modification of the earlier E.C. The modified proposal has a reduced built up area of 1,25,693.76 Sqm which is to be used only for IT Park. The Authority opined that as the construction activity has been undertaken as per the earlier E.C. it cannot be construed as violation.

The Authority after discussion decided to issue Environmental Clearance.

105.7.3 Complaint regarding construction of Additional VIP and VVIP Guest house at Kumara Krupa Guest House without obtaining mandatory Environmental Clearance- reg.

The Authority perused the complaint submitted by Mrs. K. Sudha, No.1202, 12th Floor, F Block, Jalavayu Heights Apartments, HMT Main Road, Jalahalli, Bangalore vide letter dated 3.9.2015 regarding the subject above. The Authority also perused the legal notice dated 14.09.2015 of Shri Umapathi S., Advocate under the instructions of Smt. Sudha on the subject above.

The Authority after discussion, decided to communicate a copy of both the complaint and the legal notice to the Executive Engineer concerned and M/s BG Shirke Construction Technology Pvt. Ltd. directing them to show cause why action should not be taken against them for the alleged violation.

105.7.4 Authorizing officers for filing complaint under section 19 of E (P) Act.

The Member Secretary brought to the notice of the Authority that the Authority have been delegated with the powers to file complaint against the violators in the jurisdiction court of law under section 19 of Environment

(Protection) Act, 1986 vide Notification No. S.O. 638 (E) dated 28.02.2015. Accordingly, complaints have been filed before different courts of law by the Member Secretary as per the decision taken in the Authority. The Member Secretary informed the Authority that it would be difficult possible for the Member Secretary himself to go before the jurisdictional courts throughout the State. In view of this opinion of Learned Advocate Shri Joshi with regard to authorizing other officers assisting the Authority to file complaints in accordance with the decision taken in the Authority. The Learned Advocate informed that SEIAA is a statutory Authority constituted by the Ministry of Environment, Forests and Climate Change under the Environment (Protection) Act, 1986. The Authority is expected to discharge the assigned functions through the officers and officials attached to them. Therefore expecting the entire Authority or the Member Secretary alone to shoulder the responsibility is impracticable. The Learned Advocate have therefore informed that the provisions under section 19 (1) of the General Clauses Act, 1897 can be made applicable for lawfull discharge of the functions of the Authority by the officers/officials attached to the Authority.

In view of the above opinion, the Member Secretary suggested that a list of officers attached to the Authority may be notified by the Authority for lawfull execution of the functions of the Authority including discharge of functions under section 19 of the Environment (Protection) Act, 1986.

The Authority after discussion, agreed with the opinion of the Learned Advocate and decided to issue notification authorizing the following officers of the Authority for lawfull implementation of the decision taken by the State Level Environment Impact Assessment Authority including filing of complaints before the Hon'ble jurisdictional courts of law as required under section 19 of the Environment (Protection) Act, 1986 wherever the Authority decides so. The Authority however clarified that the said officers may execute the decisions of the Authority subject to being authorized in each case through appropriate minutes/proceedings of the meetings of the Authority.

1. The Special Director (Technical Cell), Department of Ecology and Environment and the Secretary, State Expert Appraisal Committee, Karnataka.

2. The Scientific Officer (Grade-1), SEIAA, Department of Ecology and Environment, Government of Karnataka.

3. The Scientific Officer (Grade-1), SEAC, Department of Ecology and Environment, Government of Karnataka.

The Authority decided to issue a notification in this regard. The Authority further clarified that the Member Secretary being the executive head of the Authority will continue to have the powers inherited to that post in all such matters pertaining to the State Level Environment Impact Assessment Authority.

105.7.5 Inclusion of Shri H.K.Vasanth, Advocate in the panel of advocates of the Authority-reg.

The Member Secretary brought to the notice of the Authority that services of an advocate is required in addition to Shri D. Nagaraj for providing legal assistances

and for filing of complaints under section 19 of the Environment (Protection) Act, 1986 wherever violations are noticed. The Member Secretary also brought the interest expressed by Shri H.K. Vasanth, Advocate to assist the Authority. The Authority perused the interest and decided to approve Shri H.K. Vasanth, Advocate on the panel of advocates of the Authority. The Authority also decided to pay the following fee and remuneration.

1) Drafting complaint and miscellaneous - Rs. 5,000.00 2) Professional fee - Rs. 5,000.00 3) Hearing fee per day (up to 20 hearing) - Rs. 500.00

The Authority after discussion, decided to hire the services of Sri

H.K.Vasanth, Advocate for the purpose of filing complaint against the violators and to pay the charges as above. The Authority also decided to provide actual bus fare or III AC railway charges as Travelling Allowance and D.A. admissible for a Group-A officer of Government, while attending the courts in the places outside Bengaluru.

The Authority further decided to hand over the following files to

Sri H.K.Vasanth, Advocate for the purpose of filing complaint against the violators. The Authority also decided to authorize Shri H.K.Ananda, Scientific Officer, SEIAA to file complaint in the respective courts of law against the concerned persons responsible for violation of the provisions of EIA Notification, 2006 on behalf of the Authority:

The Member Secretary brought the letter dated 18th September 2015 submitted by M/s Mantri Tech Zone Pvt. Ltd. seeking clarification with regard to compliance of condition No. 39 in the Environmental Clearance letter No. SEIAA 30 CON 2011 dated 17th February 2012. The proponent have requested the Authority to confirm whether compliance of said condition No.39 is required on completion of the project and not during construction phase and that this is a general condition which is included in all the ECs for construction projects.

The Authority perused the request and observed that the proponent is seeking clarification on the conditions imposed in Environmental Clearance issued on 17th February 2012, after lapse of 3 and half years. The Authority further observed that the issue is pending before the Hon'ble National Green Tribunal, Principal Bench, New Delhi. Therefore taking any decision on the issue would be sub-judice. The Authority therefore decided to file the representation and await decision of the Hon'ble National Green Tribunal.
