The 48th meeting of State Expert Appraisal Committee for appraisal of the Project proposals received for Environmental Clearance was held on 18th October, 2016 in the Conference Hall of Department of Environment, Science & Technology, Shimla. The following were present in the meeting:

The minutes of the 47th meeting of SEAC held on 6th September, 2016 were ratified by the committee as per procedure.

ITEM N0.2: APPRAISAL OF CASE APPLICATIONS LISTED FOR ENVIRONMENTAL CLEARANCE:

2.1 Mr. Anil Kumar, S/o Bakshi llam, Village-Kangain, Post Office-Bardam, Tehsil-Jaisinghpur, District-Kangra, Himachal Pradesh. Brief outline of the project:

The project proponent applied to HP SEIAA on dated 10.06.2015. The application was scrutinized by SEIAA Secretariat and it was found that as per the certificate issued by Mining Officer, two other mining leases exists within the 500 meter periphery of the area applied out of these mining leases. The Environment Clearance has been already granted to one of mining lease of Sh. Kushal Rana (22-78-04 ha) by SEIAA, Himachal Pradesh on 30.04.2015, therefore, now total area exceeds more than 25 hectare when the other operational mining lease is also falling with in 500 meter radius.

The letter was sent to project proponent dated 06.08.2016 to apply as per the office memorandum of MoEF &CC dated 24.12.2013 issued under EIA Notification, 2006 and he was requested to apply along with EIA and EMP report prepared on the basis of standard TOR's as prescribed under EIA Notification in the first instance for taking further necessary action in the matter. .

Thereafter, the case was filed by Sh. Anil Sharma on dated 24th September, 2015. The reply was submitted by the Member Secretary, HP SEIAA (Respondent no. 3) on dated 03.12.2015. The Hon'ble High Court on dated 08th August, 2016 passed final orders that,

"In the given circumstances, the petition is disposed of by providing that the petitioner is at liberty to file representation before respondent No. 3 within four weeks from today and respondent No. 3 is directed to consider the same and make decision within four weeks thereafter, after examining the pleadings of the parties''.

The project proponent submitted his representation on dated 08.09.2016 to consider his representation for grant of Environment Clearance. The case was listed before the SEAC accordingly.

After deliberating on the representation submitted by the project proponent and considering the facts placed before the Committee, the SEAC observed that in view of the position stated by the project proponent that he had applied for the grant of EC after Sh. Kushal Rana and that the SEIAA, SEAC never debarred him from applying to the SEIAA for grant of EC prior to Sh. Kushal Rana since year 2011 as per the provisions of EIA Notification, 2006. Whereas now the case in view of the revised notifications issued from MoEF, CC, Gol falls under Bl Category and Cluster Mining, therefore, the project proponent is required to apply as per the provisions of Bl Category projects.

Hence, the SEAC recommended that the EIA report and EMP may be prepared as per standard TORs and case application be accordingly submitted to this office after the public hearing.

In addition the SEAC also recommended that the directions be issued to the project proponent Sh. Kushal Rana, Sh. Baldev Singh Rana, village & Post office Jaisingpur/ Kuthan, Tehsil Jaisinghpur, Distt. Kangra HP to join the and take' part in the public hearing jointly with the present proponent, and in case any issue is raised by the public and same is recommended by the concerned authority which may be required to be attended by the proponent Sh. Kushal Rana, Sh. Baldev Singh Rana the compliance to same shall be ensured by them as well.

2.2 Sh. Kamal Kumar, Mis Bharat Stone Crusher, Village & Post Office-Mawa Sindhiya, Tehsil-Amb, District-Una, Pin-177206, Himachal Pradesh.

The proposed lease area is situated in the Soan river, a primary tributary of Satluj river. The mining method shall be adopted to facilitate the replenishment of the excavated of the excavated pits during rainy season.

The project proponent has applied for grant of Environment clearance on dated 19.11.2015. The project proponent has submitted the form- I, prefeasibility report, buffer map, excavation route map, letter from State Geologist regarding grant of mining lease, letter from Mining Officer dated 21.08.2015 stating that one another mining lease of having 7-24-63 ha falls within the 500 meter from the existing mining lease, approved working cum-Environment management Plan dated 17.02.2014, surface plan, working plan, joint inspection report dated 15.01.2009, Land Revenue records, NOC from DFO-Una dated 27.06.2009, list of flora and fauna from DFO-Una dated 06.10.2015, undertaking regarding list of plant species to be planted in the area, NOC from Gram Panchayat dated 21.11 .2008, letter from Executive Engineer dated 03 .11.2009 regarding NOC for mineral concession in private land, Affidavit regarding CSR activities, detail of air, water and noise environment, site photographs etc.

After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided to list the case in next Meeting after fulfilling of following observations:

The project proponent shall submit the cross sections of site. The project proponent shall submit bore well permission from concerned authority.

- The project proponent shall submit plantation plan for haulage road. The project proponent shall submit the revised Muck Management Plan with detailed quantification and locations etc. The project proponent shall submit the revised Working Plan Map with scale. The project proponent shall submit revised affidavit w.r.t. EMP & CSR which clearly specify the name of the School/Panchayat etc. where CSR activity is to be implemented with time frame.

2.3 Sh. Pawan Singh, Mis Mahadev Stone Crusher, S/o Sh. Kishan Singh, Village & Post Office-Kandwal, Tehsil-Nurpur, District-Kangra, Himachal Pradesh.

Mining of Minerals (Extraction/collection of Sand, Stone & Bajri). Khasra number 73113 falling in Mohal Maira Batrah, Mauza Maira Doomel, Tehsil-Nurpur, District-Kangra, H.P. 1, 14, 926 MT/annum. 5-40-07 ha, Private land, river bed. Capital Cost: Rs. 0.70 lakhs; Recurring cost: Rs. 2.25 lakhs Rs. 0.75 lakhs.

The proposed project is river bed mining for extraction of sand, stone and bajri from river bed. The mining area lies in the Chaki khad which is tributary of Beas river.

The project proponent has applied on 10.08.2016. The project has applied online on 29 July, 2016. The project proponent has submitted EMP & CSR cost, site photographs, grant of mining lease letter dated 08.01.2010, letter of Intent dated 30.05.2016, land revenue records, mining plan, joint inspection report dated 26.06.2015, NOC from gram panchayat dated 08.10.2013, NOC from PWD, list of flora and fauna from DFO dated 15 .07.2016, list of fast growing species, distance certificate dated 25.07.2016, proper referencing of important roads, link roads, important villages etc., cross section of the project site at appropriate intervals, certificate of assured source of water supply with lean period discharge and ground water table, detail of air, water and noise environment, list of proposed CSR activities, photographs at least from three angles.etc.

After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided to list the case in next Meeting after fulfilling of following observation:



- The project proponent shall submit the revised Form-I, Pre Feasibility Report after due correction pointed out during the appraisal. The project proponent shall submit Cross-sections of the site.

- The project proponent shall submit revised EMP & CSR with details of fast growing)-. . ant species as suggested Bamboo be included in the list for plantation and time frame.

The proposed project is located in Shimla Hills, near Kandaghat on Ambala-Shimla National Highway in the State of Himachal Pradesh. The project has proposed an addition of 125 KLD of STP. The Risk Management Plan is also attached with report.

The project proponent has applied for grant of Environment clearance on dated 01.09.2015. and on-line applied on August 24th, 2016. The project proponent has submitted form-1, form-lA, conceptual plan, land document, approval of State Government and SW AC approval, NOC from Public Works Department dated 24.06.2006, Environment Clearance letter from MoEF&CC dated 28th July, 2005, renewal of Consent from HP State Pollution Control Board dated 06.06.2011, renewal of Consent dated 26.07 .2008, NOC from Gram Panchayat dated 08.02.2015, detail of air, water and noise environment, Memorandum Of Associations, site plan maps etc.

After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided to list the case in next Meeting after fulfillment of following observations. The committee decided to carry out site inspection prior to listing of case for appraisal:

- The project proponent shall submit copies of six-monthly compliance report submitted to the Regional Office, MoEF&CC, Gal for earlier clearance.

- The project proponent shall submit cross-sections of the site with land documents. - The project proponent shall submit details of unit wise Muck management plans be revised and

resubmitted with details. - The project proponent shall submit rain water harvesting lay out designs/ plans with discharge

details, number of pits may be correlated again. - The project proponent shall submit details with lay out maps w.r.t. Parking lots, no. of vehicle,

with proposed green belt development. - The project proponent shall prepare Maps depicting clearly the Road network right of way, land

scape, parking.

- The project proponent shall prepare DMP based on risk and hazard analysis and may submit an abstract of hazard specific preparedness plan/ response plan.

- The project proponent shall submit revised Green belt Development Plan as suggested by the committee depicting the removal of temporary sheds.

- The project proponent shall submit the Effluent and storm water discharge plan. The project proponent shall submit revised EMP & CSR with total costing of Rs. 40.00 lakhs. The project proponent shall submit the revised plan for STP with optimum capacity and in a manner to take up the load of peak and medium, lean occupancy in the hotel.

- The project proponent shall work out the water balance and provide copy of NOC of IPH department, Ground water authority. The project proponent shall submit plan for use drip irrigation system in lawns. The project proponent shall submit detailed survey report w.r.t. spring sources, water lifting supply schemes located in downstream areas of the site with analysis reports. The project proponent shall submit NOC of concerned Gram Panchayats. The project proponent shall submit details of analysis of soil percolation capacity. The project proponent shall submit details of plan for labors stay, sanitation facility etc.

- The project proponent shall submit details of Energy conservation plans DG sets, solar energy use, MSW disposal plans.

- The project proponent shall submit revised essentiality certificate from Tourism department. The project proponent shall submit compliance report to observations of Hon'ble National Green Tribunal.

2.5 Sh. Udesh Kumar, S/o Sh. Bhuri Singh, Village- Puer, Post Office-Bagehra, Tehsil-Sujanpur, District-Hamirpur, Himachal Pradesh.




Mining of Minerals (Extraction/collection of Sand, Stone & Bajri). Khasra number 510 (Govt. land) falling in Mahal Berry, Mauza Bir-Baghera ofTehsil-Sujanpur, District-Hamirpur, H.P. 1,22,400 TPA 5-44-00 ha. (Govt. Land, river bed) Capital Cost: Rs. 2.00 lakhs; Recurring cost: Rs. 0.55 lakhs Capital Cost: Rs. 1.55 lakhs; Recurring cost: Rs. 0.54 lakhs

The proposed project is open cast mining project, confirmed to collection of sediments from the river bed up to one meter depth from the surface of the river bed. As proposed the mining activities will be carried out manually.

The project proponent has applied on 10.08.2016. The project has applied online on 4th August, 2016.The project proponent has submitted letter of Intent dated 04.01.2016, land revenue records dated 27.06.2016, approved mining plan, geological plan showing position at the end of year, letter from DFO-Hamirpur, letter from State Geologist dated 16.05.2016, buffer map, land use and land cover map, site photographs, joint inspection report dated 31.12.2012, cross section of the project site at appropriate intervals, list of fast growing plant species in the area, list of flora and fauna, detail of air, water and noise environment, list of CSR activities, certificate of assured source of water supply with lean period discharge and ground water table etc.

The case was listed in 4 7th meeting of SEAC, where it was decided to list the case in next meeting since the project proponent was unable to present his case before the Committee.

After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided to list the case in next Meeting after fulfilling of following observations:

The project proponent shall submit NOC of Ground Water Authority, IPH for WSS, Public Works Department on significant structure. The project proponent shall submit revised EMP & CSR with details of plantation in association with College of Horticulture & Forestry, Neri, Hamirpur under Y.S. P"-._Jar University, Nauni, Solan. The project proponent shall submit cross-sections of the site.

2.6 Sh. Rajinder Kumar, Village-Talodi, Post Office-Sundla, Tehsil-Salooni, District-Chamba, Himachal Pradesh, Pin-176308, Mob: 94599 22623.



Mining of Minerals (Extraction/collection of Sand & Bajri). Khasra number 863/419 & 831 falling in Mohal/Mauza-Talodi of Tehsil-Salooni, District-Chamba. 1,84,140 TPA 163-15 Bighas (River bed acquired by NHPC), 13.2521 ha. Capital Cost: Rs. 3 .2 lakhs; Recurring cost: Rs. 2.5 lakhs Capital Cost: Rs. 1.5 lakhs; Recurring cost: Rs. 0.5 lakhs

The proposed project is mining of Sand and Bajri from Siul khad situated in Mauza and Mohal-Talodi. The lease area fall in the acquired reservoir zone of the Chamera Hydro Electric project. The material will be extracted mechanically. The mining will be carried out only up to a depth of Im (3 feet).

The case was listed in 46th meeting of SEAC, where it was observed that the case is falling under Cluster measuring area more than 25 hectare and therefore needs to be treated as Category BI project. It was decided that the Project Proponent may prepare the standard ToR and project proponent shall conduct public hearing jointly and sharing of monitoring data with Sh. Amar Chand prop. of Mis A.C. Stone crusher.

The case of Sh. Amar Chand prop. of Mis AC Stone Crusher was listed in 4 7th Meeting of SEAC, where the project proponent appeared before the SEAC and submitted that he intends to withdraw his application pending before the SEAC. The SEAC considereq his request and close the matter.

Now, Sh. Rajinder Kumar has requested to consider his case as Cat 'B-2' project, because Mis AC Stone Crusher has withdrawn his application, SEAC clarified the proponent about the with drawl of application I representation by the Mis. AC Stn Cr, and that the said proponent has not withdrew his case stating that he will not carry out the mining activity in future.

The project proponent presented his case and submitted the detailed Environment Management Plan report with compliance made w.r.t. the observations of public hearing conducted on dated 13-10-2016. After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided that the case be listed before SEAC after receiving the proceedings of the public hearing from ADM/ SPCB and revised EW EMP report, plans.

The project was under violation under Section-5 of Environment Protection Act, 1986 of Provision of EIA Notification 2006 and fine has been paid for violation of the provision ofEIA Notification 2006.

The project proponent has applied on 10.08.2016. The project has applied on line on 29th July 2016 and EIA has been prepared. the project proponent has submitted the grant of Mining lease dated 08.01.2010, letter oflntent dated 30.05.2016, land Revenue records, mining plan, NOC from Forest Department, distance certificate from Mining Officer, joint inspection report dated 19 .11.2008, NOC from Gram Panchayat, list of flora and fauna from DFO, affidavit regarding CSR activities etc.

After deliberating on the information submitted by the project proponent and considering the facts placed before the committee, the SEAC decided to list the case in next Meeting with following observation:

The project proponent shall resubmit approved revised Mining Plan and accordingly the revised application.

- The project proponent shall submit revised Form-I, Pre-feasibility Report. - The project proponent shall submit valid Letter of Intent. - The project proponent shall submit NOCs of Gram Panchyat, Public Works department on

significant structures, IPH for WSS. - The project proponent shall submit revised plan for plantations.

• As proposed the total water requirement of the project will be 99.62 KLD. The total Municipal Solid Waste to be generated is approximately 374 Kg/day.

The project proponent has applied for grant of Environment clearance on dated 28.09.2015. and on-line applied on 20.09 2016. The proposed project is river bed mining for extraction of Sand, Stone and Bajri from Swan river a tributary of Satluj river. The mining will be carried out only up to a depth of 1 m (3 feet) depth. No blasting is required. Only manually extraction of sand, stone & Bajri will be undertaken.

The project proposal is for extraction of Sand, Stone and Bajri from the bed of a stream called Chakki khad. The case was listed in 361h meeting of SEAC where "committee unanimously decided to recommend for consideration and approval of SEIAA that the lease application of environmental clearance in Chakki & its tributaries in the area in chakki khad and its tributaries 1 km upstream of the bridge on Mandi-Pathankot National Highway and 3 km downstream of railway bridge on Pathankot-Jullunder section should be dealt at one level i.e. at the level of Ministry of Environment & Forest, Govt. of India to take holistic view of the entire 'area and the environment, social, infrastructural and other issue. "

Then after the case was listed in 201h SEIAA meeting where it was decided that the matter be referred to Govt. of India for further necessary action as per the recommendations of SEAC in its 36th meeting held on 25th & 26th February, 2014.

Now, the project proponent has made representation on dated 05.04.2016 to consider his case in HP SEIAA for grant of Environment Clearance as per the latest notification of MoEF &CC.

The case was listed in 45th meeting of SEAC, where SEAC decided to relist the case in next meeting with following observations:

The project fall under the schedule 8(a) i.e. building and construction of EIA Notification, 2006. The project site is located on Chandigarh-Shimla National Highway at Sultanpur Road, Solan. As proposed total water requirement will be 242 KLD and there are 6 bore well within the campus. There will be STP having capacity of 240 KLD and ETP having 60 KLD capacity. The estimated population will be 2425 persons.

The case was listed in 43rd SEAC Meeting with certain observations. The case was again listed in 46th Meeting with one observation regarding site visit of SEAC members. The SEAC was also apprised about the visit of SEAC members to project site on 11-03-2016 by Member Sh. A.N. Gautam with certain observations.

The committee inspected the proposed parking space/ lots and advised the project proponents to make provisions of greening of the areas and mark the parking areas all along the roads inside the campus. The project proponents submitted the compliance report to the observations of SEAC and accordingly the case was listed before the SEAC. The project proponents were requested to make the presentation before the SEAC. During the presentation the proponents could not reply to the queries raised by the SEAC members w.r.t. the observations made during the inspection and could not link/ demonstrate/ explain the layout plans before the SEAC. The project proponent submitted that they may be given time to rearrange the fact and figures and may list their case afterward for appraisal.

The case was again listed in 451h Meeting where, the Committee decided that the case will be listed

in next Meeting after compliance to the certain observations.

The case was again listed in 4 7th meeting of SEAC, where SEAC decided to list the case in next meeting after resubmission of detailed Disaster Management Plan.

The project proponent has submitted the compliance to above observations. The project proponent shall submit the credible action taken under the Section 5 of the Environment (Protection) Act, 1986. The project proponent shall resubmit clarification from competent authority i.e. Mining Officer clearly indicating about the operation of the mining lease.

Annexure-'I' A. Specific Conditions:

1. Stone and Bajri (if extracted) is not allowed to be sold to crushers not having consent to establish and operate and also not complying with the condition stipulated by State Pollution Control Board.

2. The project proponent shall obtain Consent to Establish and Consent to Operate from the Himachal Pradesh Pollution Control Board and effectively implement all the conditions stipulated therein.

3. Environment clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004, as may be applicable to this project.

4. Annual replenishment report certified by an authorized agency shall be submitted. In case the replenishment is low, the mining activity/ production levels shall accordingly be decreased/ stopped.

5. Effective safeguard measures shall be taken to control particulate matter level so as to ensure that these are within permissible limit.

6. Regular monitoring of ambient air quality shall be carried out and records maintained. The results of monitoring shall be submitted to MoEF &CC and its Regional Office and CPCB, SPCB regularly.

7. Effective safeguard measures, such as regular water sprinkling shall be carried out in critical areas prone to air pollution and having high levels of particulate matter such as loading and unloading point and all transfer points. Extensive water sprinkling shall be carried out on haul roads. It should be ensured that the Ambient Air Quality parameters conform to the norms prescribed by the Central Pollution Control Board in this regard.

8. The project proponent shall undertake adequate safeguard measures during mining and ensure that due to this activity the hydro-geological regime of surrounding area shall not be affected. Regular monitoring of ground water level and quality shall be carried out around the mine lease area by establishing a network of existing wells and installing new piezometers during the mining operation. The periodic monitoring [(at least four times in a year pre-monsoon (April-May), monsoon (August), post-monsoon (November) and winter (January); once in each season)] shall be carried out in consultation with the State Ground Water Board/Central Ground Water Authority and the data thus collected may be sent regularly to · the Mo BF &CC and its Regional Office Dehradun, the Central Ground Water Authority and the Regional Director, Central Ground Water Board. If at any stage, it is observed that the groundwater table is getting depleted due to the mining activity, necessary corrective measures shall be carried out.

9. The project proponent shall obtain necessary prior permission from the competent authority for drawl of requisite quantity of water for the project.

10. Appropriate mitigative measures shall be taken to prevent pollution of the river in consultation with the State Pollution Control Board. It shall be ensured that there is no leakage of oil and grease in the river from the vehicles used for transportation.

11. Vehicular emission shall be kept under control and regularly monitored. The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded.

12. No drilling and blasting operation shall be carried out.

13. Mineral handling area shall be provided with the adequate number of high efficiency dust extraction system. Loading and unloading areas including all the transfer points should also have efficient dust control arrangements. These should be properly maintained and operated.

14. Periodical medical examination of the workers engaged in the project shall be carried out and records maintained. For the purpose, schedule of health examination of the workers should be drawn and followed accordingly.

15. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, safe drinking water, medical health care, creche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

16. The project authority shall implement suitable conservation measures to augment ground water resources in the area in consultation with the Regional Director, Central Ground Water Board.

17. The project proponent shall undertake all the commitments made during the public hearing and effectively address the concerns raised by the locals in the public hearing as well as during consideration of the project, while implementing the project.

B. General Conditions:

1. No change in mining technology and scope of working should be made without prior approval of the MoEF&CC.

2. No change in the calendar pfan including excavation, quantum of mineral Sand, Gravel, Boulders (minor mineral) and waste should be made.

3. Four ambient air quality-monitoring stations should be established in the core zone as well as in the buffer zone for RSPM (Particulate matter with size less than 10 micron i.e., PM10) and NOx monitoring. Location of the stations should be decided based on the meteorological data, topographical features and environmentally and ecologically sensitive targets and frequency of monitoring should be undertaken in consultation with the State Pollution Control Board.

4. Data on ambient air quality should be regularly submitted to the MoEF&CC including its Regional office located at Dehradun and the State Pollution Control Board/ Central Pollution Control Board once in six months. Provisions contained in notification no. B-29016/20/90/PCI-I dated 18.11.2009 should be allowed for monitoring.

5. Fugitive dust emission from all the sources should be controlled regularly. Water spraying arrangement on haul roads, loading and unloading and at transfer points should be provided and properly maintained.

6. Personnel working in dusty areas should wear protective respiratory devices and they should also be provided with adequate training and information on safety and health aspects.

7. Occupational health surveillance program of the workers should be undertaken periodically to observe any contractions due to exposure to dust and take corrective measures, if needed.

8. A separate environmental management cell with qualified personnel should be set-up under the control of a Senior Executive, who will report directly to the Head of the Organization.

9. The funds earmarked for environmental protection measures should be kept in separate account and should not be diverted for other purpose. Year wise expenditure should be reported to the MoEF&CC and its Regional Office located at Dehradun.

I 0. The project authorities should inform to the Regional Office located at Chandigarh regarding date of financial closure and final approval of the project by the concerned authorities and the date of start of land development work.

11. The Regional Office of this Ministry located at Chandigarh shall monitor compliance of the stipulated conditions. The project authorities should extend full cooperation to the officer (s) of the Regional Office by furnishing the requisite data I information I monitoring reports.

12. The project proponent shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard copies as well as by e-mail) to the MoEF &CC, its Regional Office Dehradun, the respective Zonal Office of Central Pollution Control Board the State Pollution Control Board. The proponent shall upload the status of compliance of the environmental clearance conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of the Ministry of Environment and Forests, Chandigarh, the respective Zonal Office of Central Pollution Control Board and the State Pollution Control Board.

13. A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zila Parisad I Municipal Corporation, Urban Local Body and the Local NGO, if any, from whom suggestions/ representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

14. The State Pollution Control Board should display a copy of the clearance letter at the Regional office, District Industry Centre and the Collector's office/ Tehsildar's Office for 30 days.

15. The environmental statement for each financial year ending 3 !81 March in F orm-V as is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be put on the website of the company along with the status of compliance of environmental clearance conditions and shall also be sent to the Regional Office of the MoEF&CC, Dehradun by e-mail.

16. The project authorities should advertise at least in two local newspapers widely circulated, one of which shall be in the vernacular language of the locality concerned, within 7 days of the issue of the clearance letter informing that the project has been accorded environmental clearance and a copy of the clearance letter is available with the State Pollution Control Board and also at web site of the MoEF&CC at http://envfor.nic.in and a copy of the same should be forwarded to the Regional Office ofMoEF&CC at Dehradun.

Annexure-'11' A. SPECIFIC CONDITIONS:

1. The water requirement for the project shall be sourced from the rainwater harvesting system developed within the premises. Water consumption shall be only for domestic purpose.

2. There shall not be any wastewater generation nor any discharge from the project activities.

3. Domestic wastewater shall be discharged into septic tank/ soak pit system.

4. The storm water drains shall be kept dry and shall not be used for discharge of any kind of waste. The project proponent shall prepare an Action Plan for the monsoon period in which the water quality flowing outside the premises shall be monitored for hydrocarbon and oil & grease parameters and its records shall be maintained & submitted to MoEF&CC regional office, Dehradun and HP SEIAA.

5. Gaseous emission at workplaces shall be controlled and kept below the limits prescribed by the Factories Act and Rules. Their records shall be maintained.

6. The gaseous emissions and particulate matter from various processes shall confirm to the standards prescribed by HP State Pollution Control Board & CPCB. At no time, the emission levels shall go beyond the stipulated standards. In the event of failure of pollution control system adopted by the unit, the respective unit shall not be restarted until the control measures are rectified to achieve the prescribed standards.

7. The unit must strictly comply with the rules and regulations with regards to handling and disposal of Hazardous waste in accordance with the Hazardous Waste (Management and Handling) Rules 2003. Authorization from the HP SPCB must be obtained for collection I treatment /storage /disposal of hazardous wastes.

8. The project management shall strictly comply with the provisions made in Manufacture Storage and Impact of Hazardous Chemicals Rules 1989 and subsequent amendments for handling of hazardous chemicals. Necessary approvals from the Govt. Authorities shall be obtained before commissioning of the project, if applicable.

9. All Transportation of Hazardous Chemicals shall be as per the Motor Vehicle Act & Rules.

10. Hazardous materials storage shall be at an isolated designated location, bund/ dyke walls shall be provided for storage tanks for Hazardous Chemicals.

11. All transportation routes within the premise shall have paved roads to minimize splashes and spillages.

12. Mock drills shall be conducted at regular intervals as per statutory requirements and their records shall be maintained.

13. Necessary dyke wall along with spill collection sump shall be provided around the storage tanks to arrest the spillage/ leakage.

14. All the storage tanks in the premises shall be provided with sprinkler as per OISD norms.

15. Fire protection system shall be upgraded for the additional storage tanks installation and shall confirm to OISD standards.

16. Necessary flame proof fittings shall be provided in the storage facility.

17. Proper ventilation shall be provided in the whole premises.

18. All venting equipment shall have vapour recovery system. All the pumps and other equipments where there is a likelihood of leakages shall be provided with Leak Detections and Repair (LDAR) system. Provisions for immediate isolation of such equipment in case of a leakage shall also be made. The detector sensitivity shall be in ppm levels.

19. All the storage tanks shall be fitted with appropriate controls to avoid any leakages. Close handling system for chemicals shall be provided. Double mechanical seals shall be provided for pumps /agitators for reactors for reduction of fugitive emissions and leakages. Traps shall be installed wherever necessary.

20. During material transfer, spillages shall be avoided and garland drain be constructed to avoid mixing of accidental spillages with domestic waste and storm water drain.

21. Personal Protective Equipment shall be provided to workers and its usage shall be ensured and supervised.

22. First Aid Box and required Antidotes for the chemicals used in the unit shall be made readily available in adequate quantity at all the times.

23. Training shall be given to all personnel on safety and health aspects of handling petroleum products including regular mock drills.

24. Occupational health surveillance of the workers shall be carried out on a regular basis and records shall be maintained as per the Factories Act and Rules. Pre-employment and periodical medical examination for all workers shall be undertaken as per statutory requirement.

25. The project management shall prepare a detailed Disaster Management Plan (DMP) for the project as per the guidelines from Himachal Pradesh State Disaster Management Authority and other concerned agencies.

26. On site Emergency Control Plan and Off Site Emergency Plan shall be updated and its recommendation shall be implemented.

27. Design of the storage tanks shall be done in accordance with the applicable OISD, IS, APl, ASME standards.

28. Necessary permissions from the Chief Controller of Explosive-Nagpur and other relevant Government Agencies shall be taken prior commencement of the project.

29. Ambient air quality status with respect to VOC in the area shall be monitored in consultation with Himachal Pradesh State Pollution Control Board and its records shall be submitted to MoEF&CC regional office, Dehradun and HP SEIAA.

30. First Aid Box, fire extinguishers, foams, sand etc. shall be made readily available in adequate quantity at all the times. Necessary tie up with the nearby fire stations and other emergency services shall be made to ensure that the required aids reach within the shortest possible time in case of any adverse conditions.

31. The unit shall undertake following waste minimization measures:

32. Use of automated and close filling to minimize spillages.

33. Venting equipment through vapour recovery system.

34. The company shall develop a plot area as green belt as per the CPCB guidelines to mitigate the effect of fugitive emissions and shall plant indigenous tree species such as Kikar, Khair, Peepal, Am/a, Mango, Gauvaetc.

35. The proponent shall adopt appropriate plan to contain escape ofVOC.

36. The proponent shall adopt appropriate plan to prevent ground water contamination.

3 7. Appropriate plan to prevent probable impact on human habitat in the event of fire hazards shall be put in place.

38. The project authorities shall undertake intensive awareness program among those living at the vicinity of the project site with regard to emergency safety plan.

B. GENERAL CONDITIONS:

1. The project authorities must strictly adhere to the stipulations made by the Himachal Pradesh State Level Environment Impact Assessment Authority (HP SEIAA) and the State Government.

2. The Proponent shall obtain the construction material such as stones and jelly etc. only from the approved quarries and other construction material shall also be procured from the authorized agencies/ traders.

3. The proponent shall obtain approval from the competent authorities for structural safety of the building due to earthquake, adequacy of fire-fighting equipment etc. as per the National Building Code (NBC) including protection measures for lightening etc.

4. No further expansion or modification in the project shall be carried out without prior approval of the Himachal Pradesh State Level Environment Impact Assessment Authority (HP SEIAA). In case of deviations or alterations in the project proposal from those submitted to this Authority for clearance, a fresh reference shall be made to the Authority to assess the adequacy of conditions imposed and to add additional environmental protection measures required, if any.

5. The emissions of (RSPM, SPM, S02, NOx, HC & VOC) from DG Set and from flare stack shall conform to the standards prescribed by the HP State Pollution Control Board & CPCB. Regular monitoring of Ambient Air for HC and VOC shall be carried out as per CPCB guidelines. Stack height attached to DG sets shall be in-conformance with the environment protection acts and rules.

6. The project authorities must strictly comply with the rules and regulations under Manufacture, Storage and Import of Hazardous chemicals Rules, 1989 as amended subsequently. Prior approvals from Chief Inspectorate of Factories, Chief Controller of Explosives, Fire Safety Inspectorate etc. must be obtained, wherever applicable.

7. The project authorities must strictly comply with the rules and regulation with regard to handling and disposal of Hazardous Wastes (Management and Handling) Rules, 1989 and subsequent amendments as applicable. Authorization from the Himachal Pradesh State Pollution Control Board must be obtained for collections/ treatment/ storage/ disposal of hazardous wastes.

8. The overall noise levels in and around the plant area shall be kept well within the standards by providing noise control measures including acoustic hoods, silencers, enclosures etc. on all sources of noise generation. The ambient noise levels shall conform to the standards prescribed under EPA Rules, 1989.

9. A separate Environmental Management Cell equipped with full fledged laboratory facilities must be set up to carry out the environmental management and monitoring functions.

10. The project authorities will provide adequate funds both recurring and non-recurring to implement the conditions stipulated by the SEIAA, Himachal Pradesh as well as the State Government along with the implementation schedule for all the conditions stipulated herein. The funds so provided shall not be diverted for any other purposes.

11. The Regional Office of this MoEF &CC at Dehradun, Himachal Pradesh State Level Environment Impact Assessment Authority and other concerned agencies will monitor the stipulated conditions. A half yearly compliance report and the monitored data along with statistical interpretation shall be submitted to them regularly.

12. The project proponent shall inforni the public that the project has been accorded environmental clearance by the HP SEIAA and copies of the clearance letter are available with the HP SEIAA and may also be seen at State of Himachal Pradesh web portal at http://environmentclearance.nic.in/. This shall be advertised within seven days from the date of issue of the clearance letter, at least in two local newspapers that are widely circulated in the region of which one shall be in the vernacular language of the locality concerned and a copy of the same shall be forwarded to the Regional Office of MoEF at Dehradun & H.P. State Level Environment Impact Assessment Authority at Department of Environment, Science & Technology, Himachal Pradesh.

13. The project authorities shall inform the Regional Office of MoEF at Dehradun & H.P. State Level Environment Impact Assessment Authority at Department of Environment, Science & Technology, Himachal Pradesh about the date of financial closure and final approval of the project by the concerned authorities and the date of start of the project.

14. The Authority may revoke or suspend the clearance, if implementation of any of the above conditions is not satisfactory.

15. The Authority reserves the right to stipulate additional conditions if found necessary. The Company in a time bound manner will implement these conditions.

16. The above conditions will be enforced, inter-alia under the provisions of the Water (Prevention & Control of Pollution) Act, 1974, the Air (Prevention & Control of Pollution) Act, 1981 , the Environment (Protection) Act, 1986, Hazardous Wastes (Management & Handling) Rules, 1989, 2003 and the Public Liability Insurance Act, 1991 along with their amendments and rules.

17. The issue of Environment Clearance doesn't confer any right to the project proponent to operate/run the project without obtaining statutory clearances/ sanctions form all other concerned Authorities.

18. The project proponent should display the conditions prominently at the entrance of the project site on a suitable size board for the information of the public.

19. Concealing factual data or submission of false/ fabricated data and failure to comply with any of the conditions mentioned above may result in withdrawal of this clearance and attract action under the provisions of Environmental (Protection) Act, 1986.

20. Any Appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under Section 11 of the National Environment Appellate Authority Act, 1997.
